relatingtoajudgmentofdissolutionofmarriageorlegalseparation.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections452.305and452.310,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections452.305and452.310,toreadasfollows:
452.305.1.Thecourtshallenterajudgmentofdissolutionofmarriageif:
2 (1)Thecourtfindsthatoneofthepartieshasbeenaresidentofthisstate,orisa
3memberofthearmedserviceswhohasbeenstationedinthisstate,forninetydays
4immediatelyprecedingthecommencementoftheproceedingandthatthirtydayshave
5elapsedsincethefilingofthepetition;and
6 (2)Thecourtfindsthatthereremainsnoreasonablelikelihoodthatthemarriagecan
7bepreservedandthatthereforethemarriageisirretrievablybroken;and
8 (3)Totheextentithasjurisdiction,thecourthasconsideredandmadeprovisionfor
9childcustody,thesupportofeachchild,themaintenanceofeitherspouseandthedisposition
10ofproperty.
11 2.Thecourtshallenterajudgmentoflegalseparationif:
12 (1)Thecourtfindsthatoneofthepartieshasbeenaresidentofthisstate,orisa
13memberofthearmedserviceswhohasbeenstationedinthisstate,forninetydays
14immediatelyprecedingthecommencementoftheproceedingandthatthirtydayshave
15elapsedsincethefilingofthepetition;and
16 (2)Thecourtfindsthatthereremainsareasonablelikelihoodthatthemarriagecanbe
17preservedandthatthereforethemarriageisnotirretrievablybroken;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (3)Totheextentithasjurisdiction,thecourthasconsideredandmadeprovisionfor
19thecustodyandthesupportofeachchild,themaintenanceofeitherspouseandthe
20dispositionofproperty.
21 3.Pregnancystatusshallnotpreventthecourtfromenteringajudgmentof
22dissolutionofmarriageorlegalseparation.
23 4.Anyjudgmentofdissolutionofmarriageorlegalseparationshallincludethelast
24fourdigitsoftheSocialSecuritynumbersoftheparties.ThefullSocialSecuritynumberof
25eachpartyandeachchildshallberetainedinthemannerrequiredundersection509.520.
452.310.1.Inanyproceedingcommencedpursuanttothischapter,thepetition,a
2motiontomodify,amotionforafamilyaccessorderandamotionforcontemptshallbe
3verified.Thepetitioninaproceedingfordissolutionofmarriageshallallegethatthe
4marriageisirretrievablybrokenandthatthereforethereremainsnoreasonablelikelihoodthat
5themarriagecanbepreserved.Thepetitioninaproceedingforlegalseparationshallallege
6thatthemarriageisnotirretrievablybrokenandthatthereforethereremainsareasonable
7likelihoodthatthemarriagecanbepreserved.
8 2.Thepetitioninaproceedingfordissolutionofmarriageorlegalseparationshallset
9forth:
10 (1)Theresidenceofeachparty,includingthecounty,andthelengthofresidenceof
11eachpartyinthisstateandinthecountyofresidence;
12 (2)Thedateofthemarriageandtheplaceatwhichitisregistered;
13 (3)Thedateonwhichthepartiesseparated;
14 (4)Thename,age,andaddressofeachchild,andtheparentwithwhomeachchild
15hasprimarilyresidedforthesixtydaysimmediatelyprecedingthefilingofthepetitionfor
16dissolutionofmarriageorlegalseparation;
17 (5)Whetherthewifeispregnant; however,pregnancystatusshallnotpreventthe
18courtfromenteringajudgmentofdissolutionofmarriageorlegalseparation;
19 (6)ThelastfourdigitsoftheSocialSecuritynumberofthepetitioner,respondentand
20eachchild;
21 (7)Anyarrangementsastothecustodyandsupportofthechildrenandthe
22maintenanceofeachparty;and
23 (8)Thereliefsought.
24 3.Uponthefilingofthepetitioninaproceedingfordissolutionofmarriageorlegal
25separation,eachchildshallimmediatelybesubjecttothejurisdictionofthecourtinwhichthe
26proceedingiscommenced,unlessaproceedinginvolvingallegationsofabuseorneglectof
27thechildispendinginjuvenilecourt.Untilpermittedbyorderofthecourt,neitherparent
28shallremoveanychildfromthejurisdictionofthecourtorfromanyparentwithwhomthe
HB280	2 29childhasprimarilyresidedforthesixtydaysimmediatelyprecedingthefilingofapetitionfor
30dissolutionofmarriageorlegalseparation.
31 4.Themerefactthatoneparenthasactualpossessionofthechildatthetimeoffiling
32shallnotcreateapreferenceinfavorofsuchparentinanyjudicialdeterminationregarding
33custodyofthechild.
34 5.Therespondentshallbeservedinthemannerprovidedbytherulesofthesupreme
35courtandapplicablecourtrulesand,toavoidaninterlocutoryjudgmentofdefault,shallfilea
36verifiedanswerwithinthirtydaysofthedateofservicewhichshallnotonlyadmitordeny
37theallegationsofthepetition,butshallalsosetforth:
38 (1)ThelastfourdigitsoftheSocialSecuritynumberofthepetitioner,respondentand
39eachchild;
40 (2)Anyarrangementsastothecustodyandsupportofthechildandthemaintenance
41ofeachparty;and
42 (3)Thereliefsought.
43 6.Previouslyexistingdefensestodivorceandlegalseparation,includingbutnot
44limitedtocondonation,connivance,collusion,recrimination,insanity,andlapseoftime,are
45abolished.
46 7.ThefullSocialSecuritynumberofeachpartyandeachchildandthedateofbirth
47ofeachchildshallbeprovidedinthemannerrequiredundersection509.520.
48 8.Thepetitionerandrespondentshallsubmitaproposedparentingplan,either
49individuallyorjointly,withinthirtydaysafterserviceofprocessorthefilingoftheentryof
50appearance,whichevereventfirstoccursofamotiontomodifyorapetitioninvolving
51custodyorvisitationissues.Theproposedparentingplanshallsetforththearrangementsthat
52thepartybelievestobeinthebestinterestoftheminorchildrenandshallincludebutnotbe
53limitedto:
54 (1)Aspecificwrittenscheduledetailingthecustody,visitationandresidentialtime
55foreachchildwitheachpartyincluding:
56 (a)Majorholidaysstatingwhichholidaysapartyhaseachyear;
57 (b)Schoolholidaysforschool-agechildren;
58 (c)Thechild'sbirthday,Mother'sDayandFather'sDay;
59 (d)Weekdayandweekendschedulesandforschool-agechildrenhowthewinter,
60spring,summerandothervacationsfromschoolwillbespent;
61 (e)Thetimesandplacesfortransferofthechildbetweenthepartiesinconnection
62withtheresidentialschedule;
63 (f)Aplanforsharingtransportationdutiesassociatedwiththeresidentialschedule;
64 (g)Appropriatetimesfortelephoneaccess;

66temporaryvariationfromtheresidentialschedule;
67 (i)Anysuggestedrestrictionsorlimitationsonaccesstoapartyandthereasonssuch
68restrictionsarerequested;
69 (2)Aspecificwrittenplanregardinglegalcustodywhichdetailshowthedecision-
70makingrightsandresponsibilitieswillbesharedbetweenthepartiesincludingthefollowing:
71 (a)Educationaldecisionsandmethodsofcommunicatinginformationfromthe
72schooltobothparties;
73 (b)Medical,dentalandhealthcaredecisionsincludinghowhealthcareproviderswill

76 (c)Extracurricularactivities,includingamethodfordeterminingwhichactivitiesthe
77childwillparticipateinwhenthoseactivitiesinvolvetimeduringwhicheachpartyisthe
78custodian;
79 (d)Childcareproviders,includinghowsuchproviderswillbeselected;
80 (e)Communicationproceduresincludingaccesstotelephonenumbersasappropriate;
81 (f)Adisputeresolutionprocedureforthosemattersonwhichthepartiesdisagreeor
82ininterpretingtheparentingplan;
83 (g)Ifapartysuggestsnoshareddecision-making,astatementofthereasonsforsuch
84arequest;
85 (3)Howtheexpensesofthechild,includingchildcare,educationalandextraordinary
86expensesasdefinedinthechildsupportguidelinesestablishedbythesupremecourt,willbe
87paidincluding:
88 (a)Thesuggestedamountofchildsupporttobepaidbyeachparty;
89 (b)Thepartywhowillmaintainorprovidehealthinsuranceforthechildandhowthe
90medical,dental,vision,psychologicalandotherhealthcareexpensesofthechildnotpaidby
91insurancewillbepaidbytheparties;
92 (c)Thepaymentofeducationalexpenses,ifany;
93 (d)Thepaymentofextraordinaryexpensesofthechild,ifany;
94 (e)Childcareexpenses,ifany;
95 (f)Transportationexpenses,ifany.
96 9.Iftheproposedparentingplansofthepartiesdifferandthepartiescannotresolve
97thedifferencesorifanypartyfailstofileaproposedparentingplan,uponmotionofeither
98partyandanopportunityforthepartiestobeheard,thecourtshallenteratemporaryorder
99containingaparentingplansettingforththearrangementsspecifiedinsubsection8ofthis
100sectionwhichwillremainineffectuntilfurtherorderofthecourt.Thetemporaryorder

102custody,childsupportorvisitation.
103 10.TheMissourisupremecourtshallhaveguidelinesforaparentingplanwhichmay
104beusedbythepartiespursuanttothissectioninanydissolutionofmarriage,legalseparation
105ormodificationproceedinginvolvingissuesofcustodyandvisitationrelatingtothechild.
106Parentingplanguidelinesshallbemadeavailableontheofficeofstatecourtsadministrator's
107website.
108 11.Thefilingofaparentingplanforanychildovertheageofeighteenforwhom
109custody,visitation,orsupportisbeingestablishedormodifiedbyacourtofcompetent
110jurisdictionisnotrequired.Nothinginthissectionshallbeconstruedasprecludingthefiling
111ofaparentingplanuponagreementofthepartiesoriforderedtodosobythecourtforany
112childovertheageofeighteenforwhomcustody,visitation,orsupportisbeingestablishedor
113modifiedbyacourtofcompetentjurisdiction.
