BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter191,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection191.820,toreadasfollows: 191.820.1.Asusedinthissection,"breakfastafterthebell"meansanyfood 2servedaftertheinstructionaldayhasofficiallybegunbutbeforeanylunchperiodinthe 3schoolbegins. 4 2.Exceptasprovidedinsubsections5and9ofthissection,inschoolyear2025- 526andeachschoolyearthereafter,thefollowingschoolsshallofferbreakfastafterthe 6belltoeachstudentinsuchschool,includinganystudentwhoarriveslateorwhoarrives 7byadifferentmodeoftransportationthanmoststudents: 8 (1)Anypublicschool,includinganycharterschool,inwhichseventypercentor 9moreofstudentsenrolledintheschoolintheimmediatelyprecedingschoolyearwere 10eligibleforfreeorreducedpricemealsthroughtheNationalSchoolLunchProgramor 11SchoolBreakfastProgram;and 12 (2)Anypublicschool,includinganycharterschool,thathasanindividualsite 13percentageforfreeorreducedpricemealsofseventypercentormoreandthatisa 14Provision2schoolasdescribedin7CFRSection245.9orthatusestheUnitedStates 15DepartmentofAgricultureCommunityEligibilityOption. 16 3.Nothinginthissectionshallbeconstruedtoprohibitschoolsfromproviding 17breakfastbeforetheinstructionaldayhasofficiallybegun. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 4.Eachschoolrequiredtoofferbreakfastafterthebellunderthissectionmay 19useanyservicemodelthatbestsuitssuchschool'sstudents.Servicemodelsinclude,but 20arenotlimitedto,breakfastintheclassroom,breakfastafterfirstperiod,andbreakfast 21tobepickedupbystudentssothatsuchstudentscaneatwhereandwhensuchstudents 22want. 23 5.Apublicschool,includinganycharterschool,inwhichseventypercentor 24moreofsuchschool'sstudentswhoareeligibleforfreeorreducedpricemeals 25participateintheSchoolBreakfastProgramshallnotberequiredtoofferbreakfast 26afterthebellunderthissection. 27 6.Aschoolinitiallyrequiredtoofferbreakfastafterthebellbutthatlaterfalls 28belowtheseventypercentthresholddescribedinsubsection2ofthissectionshall 29continuetoofferbreakfastafterthebellfortwoconsecutiveyearsbeginningwiththe 30yearinwhichtheschooldoesnotmeettherequirementstoservebreakfastafterthebell 31undersubsection2ofthissection.Ifduringthesecondyearofthetwo-yearperiodthe 32schoolstilldoesnotmeettherequirementstoservebreakfastafterthebellunder 33subsection2ofthissection,theschoolshallnotberequiredtoofferbreakfastafterthe 34bellattheconclusionofthetwo-yearperiod.Aschoolnolongerrequiredtooffer 35breakfastafterthebellunderthissubsectionshallberequiredtoagainofferbreakfast 36afterthebellifsuchschoolbecomessubjecttosubsection2ofthissection.Nothingin 37thissectionshallbeconstruedtopreventaschoolfromcontinuingtoofferbreakfast 38afterthebellevenifnotrequiredtodoso. 39 7.Thedepartmentofelementaryandsecondaryeducationshall: 40 (1)Notify,onorbeforeJulyfirstofeachyear,thoseschoolsrequiredtooffer 41breakfastafterthebellunderthissectionofsuchschools'dutiesunderthissection; 42 (2)Developanddistributeproceduresandguidelinesfortheimplementationof 43thissection,whichshallcomplywithfederalregulationsgoverningtheSchoolBreakfast 44Program; 45 (3)Offertechnicalassistancetopublicschoolsandschooldistrictsregardingthe 46implementationofthissection; 47 (4)Ifrequestedbyaschoolsubjecttothissection,recognizetimespentby 48studentsconsumingbreakfastasinstructionaltimeifstudentsconsumethebreakfastin 49theclassroomandarereceivinginstructionwhileconsumingbreakfast.Nomorethan 50fifteenminutesshallberecognizedasinstructionaltimewhilestudentsareconsuming 51breakfast; 52 (5)Annuallycollectinformationaboutthebreakfastafterthebelldelivery 53modelsimplementedateachschoolandmaketheinformationpubliclyavailable; HB285 2 54 (6)Assistschoolssubjecttothissectionthatdemonstratebreakfastenrollment 55increasesoflessthantenpercentannuallyindevelopingaplanforincreased 56participation;and 57 (7)Prepareandsubmittothegeneralassembly,onorbeforeDecemberthirty- 58firstofeachyear,areportontheimplementationandeffectivenessofthissection. 59 8.Infulfillingthedepartment'sresponsibilitiesunderthissection,the 60departmentofelementaryandsecondaryeducationshallcollaboratewithnonprofit 61organizationsknowledgeableaboutequity,theopportunitygap,hungerandfood 62securityissues,andbestpracticesforimprovingstudentaccesstoschoolbreakfast.The 63departmentshallmaintainalistofopportunitiesforphilanthropicsupportofschool 64breakfastprogramsandmakethelistavailabletoschoolsinterestedinbreakfastafter 65thebellprograms. 66 9.Ifthefederalper-mealreimbursementsforfreeorreducedpricebreakfasts 67aredecreasedbelow2025levelsoreliminatedbyCongress,schoolsshallnotberequired 68toofferbreakfastafterthebellunderthissection. ✔ HB285 3
