HB285--BREAKFASTAFTERTHEBELL SPONSOR: Proudie Thisbillrequiresapublicorcharterschooltooffer"breakfast afterthebell"asdefinedinthebillbeginninginthe2025-26 schoolyearif70%ormoreoftheschool'sstudentswereeligible forfreeorreducedpricemealsinthepreviousyear,theschool usestheUnitedStatesDepartmentofAgricultureCommunity EligibilityOption,ortheschoolhasanindividualsitepercentage forfreeorreducedpricemealsof70%ormoreandisaProvision2 schoolasdescribedin7CFR245.9. Anyschoolinwhich70%ormoreofitsstudentswhoareeligible forfreeorreducedpricemealsarealreadyparticipatinginthe SchoolBreakfastProgramwillnotberequiredtoofferbreakfast afterthebell. Ifaschoolinitiallyrequiredtoofferbreakfastafterthebell fallsbelowthe70%thresholdtheschoolmustcontinuetooffer breakfastafterthebellfortwoconsecutiveyearsandifduring thesecondyeartheschooldoesnotmeettherequirementsthe schoolmaystopservingbreakfastafterthebillattheendofthe two-yearperiod.Iftheschoolbecomeseligibletheymustbegin servingbreakfastafterthebill. Schoolsmustofferbreakfastafterthebelltoallstudentsinthe school,includingstudentswhoarrivelateorbyadifferentmode oftransportation thanmoststudents.Schoolsmaychooseaservice modelthatbestsuitstheirstudents,includingbreakfastinthe classroomorbreakfastafterfirstperiod. Schoolscannotberequiredtoofferbreakfastafterthebellif theFederalper-mealreimbursements forfreeorreducedprice breakfastsaredecreasedbelow2025levelsoriftheprogramis eliminatedbyCongress. ThebillalsorequirestheDepartmentofElementaryandSecondary Educationtonotifyschoolsrequiredtoofferbreakfastafterthe bell;recognizeupto15minutesspentbystudentsconsuming breakfastasinstructionaltimeifthestudentsreceiveinstruction whileconsumingbreakfastintheclassroom;assistschoolsas specifiedinthebill;collectinformationasspecifiedinthe bill;andsubmitareporteachyearonorbeforeDecember31st,to theGeneralAssemblyontheimplementation andeffectivenessofthe provisionsofthebill.
