5 (2)"Calleridentificationservice",atypeoftelephoneservicewhichpermits
6telephonesubscriberstoseethetelephonenumberofincomingtelephonecalls;
7 [(2)](3)"Residentialsubscriber",apersonwho,forprimarilypersonalandfamilial
8use,hassubscribedtoresidentialtelephoneservice,wirelessserviceorsimilarservice,orthe
9otherpersonslivingorresidingwithsuchperson;
10 [(3)](4)"Telephonesolicitation",anyvoice,facsimile,shortmessagingservice
11(SMS),ormultimediamessagingservice(MMS),forthepurposeofencouragingthe
12purchaseorrentalof,orinvestmentin,property,goodsorservices,butdoesnotinclude
13communications:
14 (a)Toanyresidentialsubscriberwiththatsubscriber'spriorexpressinvitationor
15permission;

17abusinesscontactwithinthepastonehundredeightydaysoracurrentbusinessorpersonal
18relationship;
19 (c)ByoronbehalfofanentityorganizedpursuanttoChapter501(c)(3)oftheUnited
20StatesInternalRevenueCode,whilesuchentityisengagedinfund-raisingtosupportthe
21charitablepurposeforwhichtheentitywasestablishedprovidedthatabonafidememberof
22suchexemptorganizationmakesthevoicecommunication;
23 (d)Byoronbehalfofanyentityoverwhichafederalagencyhasregulatoryauthority
24totheextentthat:
25 a.Subjecttosuchauthority,theentityisrequiredtomaintainalicense,permitor
26certificatetosellorprovidethemerchandisebeingofferedthroughtelemarketing;and
27 b.Theentityisrequiredbylaworruletodevelopandmaintainano-calllist;
28 (e)Byanaturalpersonrespondingtoareferral,orworkingfromhisorherprimary
29residence,orapersonlicensedbythestateofMissouritocarryoutatrade,occupationor
30professionwhoissettingorattemptingtosetanappointmentforactionsrelatingtothat
31licensedtrade,occupationorprofessionwithinthestateorcountiescontiguoustothestate.
407.1098.Nopersonorentityshallmakeorcausetobemadeanytelephone
2solicitationtoanyresidentialorbusinesssubscriberinthisstatewhohasgivennoticetothe
3attorneygeneral,inaccordancewithrulespromulgatedpursuanttosection407.1101ofsuch
4subscriber'sobjectiontoreceivingtelephonesolicitations.
407.1101.1.Theattorneygeneralshallestablishandprovidefortheoperationofa
2databasetocompilealistoftelephonenumbersofresidentialorbusinesssubscriberswho
3objecttoreceivingtelephonesolicitations.[Suchlistisnotintendedtoincludeanytelephone
4numberprimarilyusedforbusinessorcommercialpurposes.]
5 2.Theattorneygeneralshallpromulgaterulesandregulationsgoverningthe
6establishmentofastateno-calldatabaseasheorshedeemsnecessaryandappropriatetofully
7implementtheprovisionsofsections407.1095to407.1110.Therulesandregulationsshall
8includethosewhich:
9 (1)Specifythemethodsbywhicheachresidentialorbusinesssubscribermaygive
10noticetotheattorneygeneraloritscontractorofhisorherobjectiontoreceivingsuch
11solicitationsorrevocationofsuchnotice.Thereshallbenocosttothesubscriberforjoining
12thedatabase;
13 (2)Specifythelengthoftimeforwhichanoticeofobjectionshallbeeffectiveand
14theeffectofachangeoftelephonenumberonsuchnotice;
15 (3)Specifythemethodsbywhichsuchobjectionsandrevocationsshallbecollected
16andaddedtothedatabase;

18solicitationswillobtainaccesstothedatabaseasrequiredtoavoidcallingthetelephone

25to47U.S.C.Section227(c)(3),theattorneygeneralshallincludethatpartofsuchsingle
26nationaldatabasethatrelatestoMissouriinthedatabaseestablishedpursuanttothissection.
27 4.Informationcontainedinthedatabaseestablishedpursuanttothissectionshallbe
28usedonlyforthepurposeofcompliancewithsection407.1098andthissectionorina
29proceedingoractionpursuanttosection407.1107.Suchinformationshallnotbeconsidered

31 5.InApril,July,OctoberandJanuaryofeachyear,theattorneygeneralshallbe
32encouragedtoobtainsubscriptionlistingsofresidentialorbusinesssubscribersinthisstate
33whohavearrangedtobeincludedonanynationaldo-not-calllistandaddthosetelephone
34numberstothestatedo-not-calllist.
35 6.Theattorneygeneralmayutilizemoneysappropriatedfromgeneralrevenueand
36moneysappropriatedfromthemerchandisingpracticesrevolvingfundestablishedinsection
37407.140forthepurposesofestablishingandoperatingthestateno-calldatabase.
38 7.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
39createdundertheauthoritydelegatedinsections407.1095to407.1110shallbecomeeffective
40onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
41section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
42vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate
43ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
44rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid
45andvoid.
407.1104.1.Anypersonorentitywhomakesatelephonesolicitationtoany
2residentialorbusinesssubscriberinthisstateshall,atthebeginningofsuchsolicitation,state
3clearlytheidentityofthepersonorentityinitiatingthesolicitation.
4 2.Nopersonorentitywhomakesatelephonesolicitationtoaresidentialorbusiness
5subscriberinthisstateshallknowinglyuseanymethodtoblockorotherwisecircumventany
6subscriber'suseofacalleridentificationservice.
407.1110.Theattorneygeneralshallestablishanadvisorygroupcomposedof
2governmententities,localtelecommunicationscompanies,businesses,andseniorcitizenand
HB292	3 3othercommunityadvocatestocompileandpromotealistofeducationalliteraturetohelp
4consumersunderstandtheiroptionswithregardtotelephonesolicitations.Theattorney
5generalshallworkwithlocalexchangetelecommunicationscompaniestodisseminatetotheir
6residentialorbusinesssubscribersinformationabouttheavailabilityofandinstructions
7abouthowtorequesteducationalliteraturefromtheattorneygeneral.Theattorneygeneral
8mayenterintoagreementswiththosecompaniesforthepurposeofdisseminationofthe
9educationalliterature.Theattorneygeneralshallincludeonhisorherinternetwebsite
10informationthatinformsresidentialorbusinesssubscribersoftheirrightstobeplacedona
11no-calllistandthevariousmethods,includingnoticetotheattorneygeneral,ofplacingtheir
12namesonthisno-calllist.Theattorneygeneralshallhavethisliteraturedevelopedfor
13disseminationtothepublicnolaterthanJanuary1,2001.
