SectionA.Chapter162,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection162.207,toreadasfollows:
162.207.1.Forthe2026-27schoolyearandallsubsequentschoolyears,each
2schooldistrictandcharterschoolgoverningboardshalladoptawrittenpolicy
3governingastudent'spossessionoruseofanelectronicpersonalcommunications
4device.Suchschooldistrictorgoverningboardshalldevelopanddesignsuchpolicyto
5promotetheeducationalinterestsofstudentsandtoprovideasafeandeffectiveworking
6environmentforschoolemployeesandvolunteers.
7 2.Suchpolicyshall,ataminimum:
8 (1)Prohibitastudentfromdisplayingorusinganelectronicpersonal
9communicationsdeviceduringregularlyscheduledinstructionalactivities;
10 (2)Describethedisciplinaryproceduresandmeasuresthatwillbetakenifa
11studentviolatesthepolicy;and
12 (3)Provideexceptionstotheprohibitionthatallowthedisplayanduseofan
13electronicpersonalcommunicationsdevicebyastudent:
14 (a)Inthecaseofanemergency;
15 (b)Whendirectedtousesuchdevicebyaschoolemployeeorvolunteerforan
16instructionalpurpose;and
17 (c)Whenauthorizedbythefollowingfederalactsortheirsuccessoracts:

26harmlessandimmunefromanyliabilityforactionstakenunderthissectionifsuch
27employeeorvolunteeractsingoodfaithandfollowstheproperdisciplinaryprocedures
28andmeasuresadoptedunderthissectionbytheschoolboardorcharterschool
29governingboard.
