HB31 3 211.031.1.Exceptasotherwiseprovidedinthischapter,thejuvenilecourtorthe 2familycourtincircuitsthathaveafamilycourtasprovidedinchapter487shallhave 3exclusiveoriginaljurisdictioninproceedings: 4 (1)Involvinganychildwhomaybearesidentoforfoundwithinthecountyandwho 5isallegedtobeinneedofcareandtreatmentbecause: 6 (a)Theparents,orotherpersonslegallyresponsibleforthecareandsupportofthe 7child,neglectorrefusetoprovidepropersupport,educationwhichisrequiredbylaw, 8medical,surgicalorothercarenecessaryforhisorherwell-being;exceptthatreliancebya 9parent,guardianorcustodianuponremedialtreatmentotherthanmedicalorsurgical 10treatmentforachildshallnotbeconstruedasneglectwhenthetreatmentisrecognizedor 11permittedpursuanttothelawsofthisstate; 12 (b)Thechildisotherwisewithoutpropercare,custodyorsupport; 13 (c)Thechildwaslivinginaroom,buildingorotherstructureatthetimesuch 14dwellingwasfoundbyacourtofcompetentjurisdictiontobeapublicnuisancepursuantto 15section195.130;or 16 (d)Thechildisinneedofmentalhealthservicesandtheparent,guardianor 17custodianisunabletoaffordoraccessappropriatementalhealthtreatmentorcareforthe 18child; 19 (2)Involvinganychildwhomaybearesidentoforfoundwithinthecountyandwho 20isallegedtobeinneedofcareandtreatmentbecause: 21 (a)Thechildwhilesubjecttocompulsoryschoolattendanceisrepeatedlyandwithout 22justificationabsentfromschool; 47 (4)Fortheadoptionofaperson; 48 (5)Forthecommitmentofachildtotheguardianshipofthedepartmentofsocial 49servicesasprovidedbylaw; 50 (6)Involvinganorderofprotectionpursuanttochapter455whentherespondentis 51lessthaneighteenyearsofage;and 52 (7)Involvingachildwhohasbeenavictimofsextraffickingorsexualexploitation. 53 2.Transferofamatter,proceeding,jurisdictionorsupervisionforachildwhoresides 54inacountyofthisstateshallbemadeasfollows: 55 (1)Priortothefilingofapetitionanduponrequestofanypartyoratthediscretionof 56thejuvenileofficer,thematterintheinterestofachildmaybetransferredbythejuvenile 57officer,withthepriorconsentofthejuvenileofficerofthereceivingcourt,tothecountyof 58thechild'sresidenceortheresidenceofthepersoneighteenyearsofageforfutureaction; 59 (2)Uponthemotionofanypartyoronitsownmotionpriortofinaldispositiononthe 60pendingmatter,thecourtinwhichaproceedingiscommencedmaytransfertheproceedingof 61achildtothecourtlocatedinthecountyofthechild'sresidence,orthecountyinwhichthe 62offensepursuanttosubdivision(3)ofsubsection1ofthissectionisallegedtohaveoccurred 63forfurtheraction; 72 (5)Uponmotionofanychildorhisorherparent,thecourthavingjurisdictionshall 73grantonechangeofjudgepursuanttoMissourisupremecourtrules; HB31 5 74 (6)Uponthetransferofanymatter,proceeding,jurisdictionorsupervisionofachild, 75certifiedcopiesofalllegalandsocialdocumentsandrecordspertainingtothecaseonfile 76withtheclerkofthetransferringjuvenilecourtshallaccompanythetransfer. 77 3.Inanyproceedinginvolvinganychildtakenintocustodyinacountyotherthanthe 78countyofthechild'sresidence,thejuvenilecourtofthecountyofthechild'sresidenceshall 79benotifiedofsuchtakingintocustodywithinseventy-twohours. 80 4.Whenaninvestigationbyajuvenileofficerpursuanttothissectionrevealsthatthe 81onlybasisforactioninvolvesanallegedviolationofsection167.031involvingachildwho 82allegestobereceivinginstructionatahomeschooloranFPEschool,thejuvenileofficer 83shallcontactaparentorparentsofsuchchildtoverifythatthechildisreceivinginstructionat 84suchschoolandnotinviolationofsection167.031beforemakingareportofsuchaviolation. 85Anyreportofaviolationofsection167.031madebyajuvenileofficerregardingachildwho 86isreceivinginstructionatahomeschooloranFPEschoolshallbemadeonlytothe 87prosecutingattorneyofthecountywherethechildlegallyresidesandshallbebasedonly 88uponprobablecause. 89 5.Thedisabilityordiseaseofaparentshallnotconstituteabasisforadetermination 90thatachildisachildinneedofcareorfortheremovalofcustodyofachildfromtheparent 91withoutaspecificshowingthatthereisacausalrelationbetweenthedisabilityordiseaseand 92harmtothechild. [167.042.Forthepurposeofminimizingunnecessaryinvestigations 2 duetoreportsoftruancy,eachparent,guardian,orotherpersonresponsiblefor 3 thechildwhocauseshischildtoattendregularlyahomeschoolmayprovide 4 totherecorderofdeedsofthecountywherethechildlegallyresides,ortothe 5 chiefschoolofficerofthepublicschooldistrictwherethechildlegallyresides, 6 asigned,writtendeclarationofenrollmentstatingtheirintentforthechildto 7 attendahomeschoolwithinthirtydaysaftertheestablishmentofthehome 8 schoolandbySeptemberfirstannuallythereafter.Thenameandageofeach 9 childattendingthehomeschool,theaddressandtelephonenumberofthe 10 homeschool,thenameofeachpersonteachinginthehomeschool,andthe 11 name,addressandsignatureofeachpersonmakingthedeclarationof 12 enrollmentshallbeincludedinsaidnotice.Adeclarationofenrollmentto 13 provideahomeschoolshallnotbecausetoinvestigateviolationsofsection 14 167.031.Therecorderofdeedsmaychargeaservicecostofnotmorethan 15 onedollarforeachnoticefiled.] ✔ HB31 6
