4 distanceoffivehundredfeettothefrontofsuchvehicleoraflashingbluelight
5 authorizedbysection307.175,thedriverofeveryothervehicleshallyieldthe
6 right-of-wayandshallimmediatelydrivetoapositionparallelto,andasfaras
7 possibletotherightof,thetraveledportionofthehighwayandthereuponstop
8 andremaininsuchpositionuntilsuchemergencyvehiclehaspassed,except
9 whenotherwisedirectedbyapoliceortrafficofficer.
10 2.Uponapproachingastationaryvehicledisplayinglightedredorred
11 andbluelights,orastationaryvehicledisplayinglightedamberoramberand
12 whitelights,thedriverofeverymotorvehicleshall:
13 (1)Proceedwithcautionandyieldtheright-of-way,ifpossiblewith
14 dueregardtosafetyandtrafficconditions,bymakingalanechangeintoalane
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 15 notadjacenttothatofthestationaryvehicle,ifonaroadwayhavingatleast

19 maintainingasafespeedforroadconditions,ifchanginglaneswouldbe
20 unsafeorimpossible.
21 3.Themotormanofeverystreetcarshallimmediatelystopsuchcar
22 clearofanyintersectionandkeepitinsuchpositionuntiltheemergency
23 vehiclehaspassed,exceptasotherwisedirectedbyapoliceortrafficofficer.
24 4.An"emergencyvehicle"isavehicleofanyofthefollowingtypes:
25 (1)Avehicleoperatedbythestatehighwaypatrol,thestatewater
26 patrol,theMissouricapitolpolice,aconservationagent,orastateoracounty
27 ormunicipalparkranger,thosevehiclesoperatedbyenforcementpersonnelof
28 thestatehighwaysandtransportationcommission,policeorfiredepartment,
29 sheriff,constableordeputysheriff,federallawenforcementofficerauthorized
30 tocarryfirearmsandtomakearrestsforviolationsofthelawsoftheUnited
31 States,trafficofficer,coroner,medicalexaminer,orforensicinvestigatorofthe
32 countymedicalexaminer'soffice,orbyaprivatelyownedemergencyvehicle
33 company;
34 (2)Avehicleoperatedasanambulanceoroperatedcommerciallyfor
35 thepurposeoftransportingemergencymedicalsuppliesororgans;
36 (3)Anyvehiclequalifyingasanemergencyvehiclepursuantto
37 section307.175;
38 (4)Anywrecker,ortowtruckoravehicleownedandoperatedbya
39 publicutilityorpublicservicecorporationwhileperformingemergency
40 service;

82 asmaybereasonablynecessary,andwhenthevehicleisequippedwithatleast
83 onelightedlampdisplayingaredlightorbluelightvisibleundernormal
84 atmosphericconditionsfromadistanceoffivehundredfeettothefrontof
85 suchvehicle.
86 6.Nopersonshallpurchaseanemergencylightasdescribedinthis
87 sectionwithoutfurnishingthesellerofsuchlightanaffidavitstatingthatthe
88 lightwillbeusedexclusivelyforemergencyvehiclepurposes.
89 7.ViolationofthissectionshallbedeemedaclassAmisdemeanor.]
304.022.1.Upontheimmediateapproachofanemergencyvehiclegivingaudible
2signalbysirenorwhilehavingatleastonelightedlampexhibitingredlightvisibleunder
3normalatmosphericconditionsfromadistanceoffivehundredfeettothefrontofsuch
4vehicleoraflashingbluelightauthorizedbysection307.175,thedriverofeveryother
5vehicleshallyieldtheright-of-wayandshallimmediatelydrivetoapositionparallelto,and
6asfaraspossibletotherightof,thetraveledportionofthehighwayandthereuponstopand
7remaininsuchpositionuntilsuchemergencyvehiclehaspassed,exceptwhenotherwise
8directedbyapoliceortrafficofficer.
9 2.Uponapproachingastationaryvehicledisplayinglightedredorredandbluelights,
10orastationaryvehicledisplayinglightedamberoramberandwhitelights,thedriverofevery
11motorvehicleshall:
12 (1)Proceedwithcautionandyieldtheright-of-way,ifpossiblewithdueregardto
13safetyandtrafficconditions,bymakingalanechangeintoalanenotadjacenttothatofthe
14stationaryvehicle,ifonaroadwayhavingatleastfourlaneswithnotlessthantwolanes
15proceedinginthesamedirectionastheapproachingvehicle;or

17speedforroadconditions,ifchanginglaneswouldbeunsafeorimpossible.
18 3.Themotormanofeverystreetcarshallimmediatelystopsuchcarclearofany
19intersectionandkeepitinsuchpositionuntiltheemergencyvehiclehaspassed,exceptas
20otherwisedirectedbyapoliceortrafficofficer.
21 4.An"emergencyvehicle"isavehicleofanyofthefollowingtypes:
22 (1)Avehicleoperatedbythestatehighwaypatrol,thestatewaterpatrol,theMissouri
23capitolpolice,aconservationagent,orastateoracountyormunicipalparkranger,those
24vehiclesoperatedbyenforcementpersonnelofthestatehighwaysandtransportation
25commission,policeorfiredepartment,sheriff,constableordeputysheriff,federallaw
26enforcementofficerauthorizedtocarryfirearmsandtomakearrestsforviolationsofthelaws
27oftheUnitedStates,trafficofficer,coroner,medicalexaminer,orforensicinvestigatorofthe
28countymedicalexaminer'soffice,orbyaprivatelyownedemergencyvehiclecompany;
29 (2)Avehicleoperatedasanambulanceoroperatedcommerciallyforthepurposeof
30transportingemergencymedicalsuppliesororgans;
31 (3)Anyvehiclequalifyingasanemergencyvehiclepursuanttosection307.175;
32 (4)Anywrecker,ortowtruckoravehicleownedandoperatedbyapublicutilityor
33publicservicecorporationwhileperformingemergencyservice;
34 (5)Anyvehicletransportingequipmentdesignedtoextricatehumanbeingsfromthe
35wreckageofamotorvehicle;
36 (6)Anyvehicledesignatedtoperformemergencyfunctionsforacivildefenseor
37emergencymanagementagencyestablishedpursuanttotheprovisionsofchapter44;
38 (7)Anyvehicleoperatedbyanauthorizedemployeeofthedepartmentofcorrections
39who,aspartoftheemployee'sofficialduties,isrespondingtoariot,disturbance,hostage
40incident,escapeorothercriticalsituationwherethereisthethreatofseriousphysicalinjury
41ordeath,respondingtomutualaidcallfromanothercriminaljusticeagency,orin
42accompanyinganambulancewhichistransportinganoffendertoamedicalfacility;
43 (8)Anyvehicledesignatedtoperformhazardoussubstanceemergencyfunctions
44establishedpursuanttotheprovisionsofsections260.500to260.550;
45 (9)Anyvehicleownedbythestatehighwaysandtransportationcommissionand
46operatedbyanauthorizedemployeeofthedepartmentoftransportationthatismarkedasa
47departmentoftransportationemergencyresponseormotoristassistancevehicle;or
48 (10)AnyvehicleownedandoperatedbythecivilsupportteamoftheMissouri
49NationalGuardwhileinresponsetoorduringoperationsinvolvingchemical,biological,or
50radioactivematerialsorinsupportofofficialrequestsfromthestateofMissouriinvolving
51unknownsubstances,hazardousmaterials,orasmayberequestedbytheappropriatestate
52agencyactingonbehalfofthegovernor.
