29Missourieligibletrainingprovidersystemmaintainedbytheofficeofworkforce

31notafour-yearinstitutionofhighereducation;
32 (6)"Trainingprogram",aprogramofstudythatleadstoacertificateordegree
33andisofferedbyanapprovedinstitutionbutthatdoesnotmeetthelength-of-program
34requirementsforaneligibleprogramunder34CFR668.8,asamended.Theterm
35includes,butisnotlimitedto,certifiednurseassistant(CNA)programs,certified
36medicationtechnician(CMT)programs,level1medicationaide(L1MA)programs,
37insulinadministrationprograms,orcommercialdriver'slicense(CDL)programs.
38 3.(1)Beginninginthe2026-27academicyearandforallsubsequentacademic
39years,thedepartmentshall,byrule,establishaprocedureforthereimbursementofthe
40costsoftuition,books,andfeesfromthecareer-techcertificate(CTC)programfundto
41theapprovedinstitutionatwhichaneligiblestudentisenrolledinaneligibleprogramof
42studyoratrainingprogram.
43 (2)Notuitionreimbursementsinexcessofthetuitionratechargedbyapublic
44communitycollegeforcourseworkofferedbyatwo-yearprivatevocationalortechnical
45school,approvedvirtualinstitutionasdefinedundersection173.1102,oreligible
46trainingproviderwithintheserviceareaofsuchcollegeshallbereimbursedunderthis
47section.
48 (3)(a)Ifapubliccommunitycollegeorvocationalortechnicalschooloffersthe
49sameorasubstantiallysimilareligibleprogramofstudyortrainingprogramasa
50privatevocationalortechnicalschool,virtualinstitution,oreligibletrainingproviderat
51whichaneligiblestudentintendstoenrollandtheschoolorproviderislocatedinthe
52serviceregionofthepubliccommunitycollegeorvocationalortechnicalschoolthat
53offersthesameorsimilarprogramofstudyortrainingprogram,notuition
HB331	2 54reimbursementshallbeprovidedunderthissectionforsucheligiblestudentunless,
55beforetheeligiblestudentenrolls:
56 a.Theprivatevocationalortechnicalschool,virtualinstitution,oreligible
57trainingproviderrequestsauthorizationfromthedepartmentforsuchtuition
58reimbursement;and
59 b.Thedepartmentauthorizessuchrequest.
60 (b)Thedepartmentshall:
61 a.Developandadoptatuitionreimbursementauthorizationrequestformanda
62procedureforsubmittingsuchrequest;
63 b.Reviewandeitherauthorizeordenysuchrequestwithintwentybusinessdays
64ofreceivinganaccurate,complete,andproperlysubmittedrequest;and
65 c.Ifthedepartmentdeniessuchrequest,providetheeducationalentityandthe
66eligiblestudentwiththereasonsforsuchdenial.
67 (c)Thedepartmentshallnotdenyatuitionreimbursementauthorization
68requestwithoutgoodcause,asdeterminedbythedepartmentonacase-by-casebasis.
69 (4)Thereimbursementsprovidedunderthissectiontoatwo-yearprivate
70vocationalortechnicalschool,approvedvirtualinstitutionasdefinedundersection
71173.1102,oreligibletrainingprovidershallnotviolatetheprovisionsofArticleIX,
72Section8,orArticleI,Section7,oftheConstitutionofMissouriortheFirstAmendment
73totheConstitutionoftheUnitedStates.
74 4.(1)Thereisherebycreatedinthestatetreasurythe"Career-TechCertificate
75(CTC)ProgramFund",whichshallconsistofanymoneysappropriatedannuallybythe
76generalassembly,gifts,bequests,grants,publicorprivatedonations,ortransfers.The
77statetreasurershallbecustodianofthefund.Inaccordancewithsections30.170and
7830.180,thestatetreasurermayapprovedisbursements.Thefundshallbeadedicated
79fundand,uponappropriation,moneysinthisfundshallbeusedsolelyfor
80reimbursementsasprovidedinthissection.
81 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
82remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
83generalrevenuefund.
84 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
85otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
86creditedtothefund.
87 5.Norulepromulgatedbythedepartmentunderthissectionshallprohibit
88studentsenrolledinaneligibleprogramofstudyoratrainingprogramfromqualifying
89fortuitionreimbursementunderthissectionsolelybecausetheeligibleprogramof
90studyortrainingprogramdoesnotmeetthelength-of-programrequirementsforan
HB331	3 91eligibleprogramunder34CFR668.8,asamended,orbecausetheeligibletraining
92provideratwhichastudentenrollsdoesnotparticipateinfederalstudentaidprograms.
93 6.Eligibilityfortuition,books,andfeesreimbursementtoanapproved
94institutionasprovidedunderthissectionshallexpireupontheearliestof:
95 (1)Receiptofthereimbursementfortherequiredlengthforcompletionofsuch
96programasdeterminedbythedepartment;
97 (2)Astudent'ssuccessfulcompletionofaneligibleprogramofstudyortraining
98program;or
99 (3)Astudent'scompletionofonehundredfiftypercentofthetimeusually
100requiredtocompleteaneligibleprogramofstudyortrainingprogram.
101 7.Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe
102implementationandadministrationofthissection.Anyruleorportionofarule,asthat
103termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
104sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
105provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
106536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
107pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
108arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
109andanyruleproposedoradoptedaftertheeffectivedateofthisactshallbeinvalidand
