44 3.(1)Beginninginthe2026-27academicyearandforallsubsequentacademic
45years,thedepartmentshall,byrule,establishaprocedureforthereimbursementofthe
46costsoftuition,books,andfeesfromthecareer-techcertificate(CTC)programfundto
47theapprovedinstitutionatwhichaneligiblestudentisenrolledinaneligibleprogramof
48studyoratrainingprogram.
49 (2)Notuitionreimbursementsinexcessofthetuitionratechargedbyapublic
50communitycollegeforcourseworkofferedbyatwo-yearprivatevocationalortechnical
51school,approvedvirtualinstitutionasdefinedundersection173.1102,oreligible
52trainingproviderwithintheserviceareaofsuchcollegeshallbereimbursedunderthis
53section.
HCSHB331	2 54 (3)(a)Ifapubliccommunitycollegeorvocationalortechnicalschooloffersthe
55sameorasubstantiallysimilareligibleprogramofstudyortrainingprogramasa
56privatevocationalortechnicalschool,virtualinstitution,oreligibletrainingproviderat
57whichaneligiblestudentintendstoenrollandtheschoolorproviderislocatedinthe
58serviceregionofthepubliccommunitycollegeorvocationalortechnicalschoolthat
59offersthesameorsimilarprogramofstudyortrainingprogram,notuition
60reimbursementshallbeprovidedunderthissectionforsucheligiblestudentunless,
61beforetheeligiblestudentenrolls:
62 a.Theprivatevocationalortechnicalschool,virtualinstitution,oreligible
63trainingproviderrequestsauthorizationfromthedepartmentforsuchtuition
64reimbursement;and
65 b.Thedepartmentauthorizessuchrequest.
66 (b)Thedepartmentshall:
67 a.Developandadoptatuitionreimbursementauthorizationrequestformanda
68procedureforsubmittingsuchrequest;
69 b.Reviewandeitherauthorizeordenysuchrequestwithintwentybusinessdays
70ofreceivinganaccurate,complete,andproperlysubmittedrequest;and
71 c.Ifthedepartmentdeniessuchrequest,providetheeducationalentityandthe
72eligiblestudentwiththereasonsforsuchdenial.
73 (c)Thedepartmentshallnotdenyatuitionreimbursementauthorization
74requestwithoutgoodcause,asdeterminedbythedepartmentonacase-by-casebasis.
75 (4)Thereimbursementsprovidedunderthissectiontoatwo-yearprivate
76vocationalortechnicalschool,approvedvirtualinstitutionasdefinedundersection
77173.1102,oreligibletrainingprovidershallnotviolatetheprovisionsofArticleIX,
78Section8,orArticleI,Section7,oftheConstitutionofMissouriortheFirstAmendment
79totheConstitutionoftheUnitedStates.
80 4.(1)Thereisherebycreatedinthestatetreasurythe"Career-TechCertificate
81(CTC)ProgramFund",whichshallconsistofanymoneysappropriatedannuallybythe
82generalassembly,gifts,bequests,grants,publicorprivatedonations,ortransfers.The
83statetreasurershallbecustodianofthefund.Inaccordancewithsections30.170and
8430.180,thestatetreasurermayapprovedisbursements.Thefundshallbeadedicated
85fundand,uponappropriation,moneysinthisfundshallbeusedsolelyfor
86reimbursementsasprovidedinthissection.
87 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
88remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
89generalrevenuefund.

91otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
92creditedtothefund.
93 5.Norulepromulgatedbythedepartmentunderthissectionshallprohibit
94studentsenrolledinaneligibleprogramofstudyoratrainingprogramfromqualifying
95fortuitionreimbursementunderthissectionsolelybecausetheeligibleprogramof
96studyortrainingprogramdoesnotmeetthelength-of-programrequirementsforan
97eligibleprogramunder34CFR668.8,asamended,orbecausetheeligibletraining
98provideratwhichastudentenrollsdoesnotparticipateinfederalstudentaidprograms.
99 6.Eligibilityfortuition,books,andfeesreimbursementtoanapproved
100institutionasprovidedunderthissectionshallexpireupontheearliestof:
101 (1)Receiptofthereimbursementfortherequiredlengthforcompletionofsuch
102programasdeterminedbythedepartment;
103 (2)Astudent'ssuccessfulcompletionofaneligibleprogramofstudyortraining
104program;or
105 (3)Astudent'scompletionofonehundredfiftypercentofthetimeusually
106requiredtocompleteaneligibleprogramofstudyortrainingprogram.
107 7.Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe
108implementationandadministrationofthissection.Anyruleorportionofarule,asthat
109termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
110sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
111provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
112536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
113pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
114arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
115andanyruleproposedoradoptedaftertheeffectivedateofthisactshallbeinvalidand
116void.
