Torepealsection302.302,RSMo,andtoenactinlieuthereoftwonewsectionsrelatingto
loadscarriedbytrucks,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section302.302,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections260.333and302.302,toreadasfollows:
260.333.1.Eachoperatorofasolidwastesanitarylandfillshallcollectacharge
2equaltotwenty-fivecentspertonoritsvolumetricequivalentofsolidwasteaccepted
3andeachoperatorofthesolidwastedemolitionlandfillshallcollectachargeequalto
4twenty-fivecentspertonoritsvolumetricequivalentofsolidwasteaccepted.Each
5operatorshallsubmitthecharge,lesscollectioncosts,tothedepartmentofrevenuefor
6depositinthestateroadfundtobeusedbythedepartmentoftransportationsolelyfor
7highwaybeautificationpurposes.BeginningJanuary1,2027,andeachyearthereafter
8untilJanuary1,2030,thechargeimposedshallbeincreasedbytwenty-fivecents.
9Thereafter,thechargeimposedshallbeadjustedannuallybythesamepercentageasthe
10increaseinthegeneralpricelevelasmeasuredbytheConsumerPriceIndexforAll
11UrbanConsumersfortheUnitedStates,oritssuccessorindex,asdefinedandofficially
12recordedbytheUnitedStatesDepartmentofLabororitssuccessoragency.Collection
13costsshallnotexceedtwopercentoftheamountcollectedunderthissection.Charges
14collectedunderthissectionshallbeseparatefromandinadditiontoanycharges
15collectedundersection260.330.
16 2.Thechargesestablishedinthissectionshallbeenumeratedseparatelyfrom
17thedisposalfeechargedbythelandfillandmaybepassedthroughtopersonswho
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18generatedthesolidwaste.Moneystransmittedtothedepartmentshallbenolessthan
19theamountcollectedlesscollectioncostsandinaform,manner,andfrequencyasthe
20departmentshallprescribe.Failuretocollectthechargedoesnotrelievetheoperator
21fromresponsibilityfortransmittinganamountequaltothechargetothedepartment.
22 3.Thedepartmentofrevenuemayexamineorauditfinancialrecordsand
23landfillactivityrecordsandmeasurelandfillusagetoverifythecollectionand
24transmittalofthechargesestablishedinthissection.Thedepartmentmaypromulgate
25byruleandregulationprocedurestoensureandtoverifythatthechargesimposed
26hereinareproperlycollectedandtransmittedtothedepartment.
27 4.AnypersonwhooperatesatransferstationinMissourishalltransmitafeeto
28thedepartmentofrevenuefordepositinthestateroadfundthatisequaltotwenty-five
29centspertonoritsvolumetricequivalentofsolidwasteacceptedtobeusedbythe
30departmentoftransportationsolelyforhighwaybeautificationpurposes.Beginning
31January1,2027,andeachyearthereafteruntilJanuary1,2030,thechargeimposed
32shallbeincreasedbytwenty-fivecents.Thereafter,thechargeimposedshallbe
33adjustedannuallybythesamepercentageastheincreaseinthegeneralpricelevelas
34measuredbytheConsumerPriceIndexforAllUrbanConsumersfortheUnitedStates,
35oritssuccessorindex,asdefinedandofficiallyrecordedbytheUnitedStates
36DepartmentofLabororitssuccessoragency.Collectioncostsshallnotexceedtwo
37percentoftheamountcollectedunderthissubsection.Atransferstationwiththesole
38functionofseparatingmaterialsforrecyclingorresourcerecoveryactivitiesshallnotbe
39subjecttothefeeimposedinthissubsection.
40 5.Eachpoliticalsubdivisionthatownsanoperationalsolidwastedisposalarea
41maydesignate,underthissection,uptotwofreedisposaldaysduringeachcalendar
42year.Onanysuchfreedisposalday,thepoliticalsubdivisionshallallowresidentsofthe
43politicalsubdivisiontodisposeofanysolidwastethatmaybelawfullydisposedofat
44suchsolidwastedisposalareafreeofanycharge,andsuchwasteshallnotbesubjectto
45anystatefeeunderthissection.Noticeofanyfreedisposaldayshallbepostedatthe
46solidwastedisposalareasiteandinatleastonenewspaperofgeneralcirculationinthe
47politicalsubdivisionnolaterthanfourteendayspriortothefreedisposalday.
48 6.Thedepartmentofrevenueshallbyruleandregulationprovidefor:
49 (1)Themethodandmannerofcollectionoffeesunderthissection,whichshall
50besubstantiallysimilartothemethodandmannerofcollectionoffeesundersection
51260.330;
52 (2)Thetransmittaloffeesandverificationofwastevolumestransportedoutof
53statefromtransferstations;and

56 7.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
57createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
58complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
59section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
60vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
61effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
62thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
6328,2025,shallbeinvalidandvoid.
302.302.1.Thedirectorofrevenueshallputintoeffectapointsystemforthe

75ordinance,pointsmaybeassessedforeitherviolationbutnotforboth.Notwithstandingthat
76anoffensearisingoutofthesameoccurrencecouldbeconstruedtobeaviolationof
77subdivisions(8),(9)and(10)ofsubsection1ofthissection,nopersonshallbetriedor
78convictedformorethanoneoffensepursuanttosubdivisions(8),(9)and(10)ofsubsection1
79ofthissectionforoffensesarisingoutofthesameoccurrence.
80 5.Thedirectorofrevenueshallputintoeffectasystemforstayingtheassessmentof
81pointsagainstanoperator.Thesystemshallprovidethatthesatisfactorycompletionofa
82driver-improvementprogramor,inthecaseofviolationscommittedwhileoperatinga
83motorcycle,amotorcycle-ridertrainingcourseapprovedbythestatehighwaysand
84transportationcommission,byanoperator,whensoorderedandverifiedbyanycourt
85havingjurisdictionoveranylawofthisstateorcountyormunicipalordinance,regulating
86motorvehicles,otherthanaviolationcommittedinacommercialmotorvehicleasdefinedin
87section302.700oraviolationcommittedbyanindividualwhohasbeenissuedacommercial
88driver'slicenseorisrequiredtoobtainacommercialdriver'slicenseinthisstateoranyother
89state,shallbeacceptedbythedirectorinlieuoftheassessmentofpointsforaviolation
90pursuanttosubdivision(1),(2)or(4)ofsubsection1ofthissectionorpursuanttosubsection
913ofthissection.Theoperatorshallbegiventheoptiontocompletethedriver-improvement
92programthroughanonlineorin-personcourse.Acourtusingacentralizedviolationbureau
93establishedundersection476.385mayelecttohavethebureauorderandverifycompletion

95ofthecourt.Forthepurposesofthissubsection,thedriver-improvementprogramshallmeet

97Course"or,inthecaseofaviolationwhichoccurredduringtheoperationofamotorcycle,the

99commissionpursuanttosections302.133to302.137.Thecompletionofadriver-
100improvementprogramoramotorcycle-ridertrainingcourseshallnotbeacceptedinlieuof
101pointsmorethanonetimeinanythirty-six-monthperiodandshallbecompletedwithinsixty
102daysofthedateofconvictioninordertobeacceptedinlieuoftheassessmentofpoints.
103Everycourthavingjurisdictionpursuanttotheprovisionsofthissubsectionshall,within
104fifteendaysaftercompletionofthedriver-improvementprogramormotorcycle-ridertraining
105coursebyanoperator,forwardarecordofthecompletiontothedirector,allotherprovisions
106ofthelawtothecontrarynotwithstanding.Thedirectorshallestablishproceduresforrecord
107keepingandtheadministrationofthissubsection.
