termcarefacilities,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter198,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection198.700,toreadasfollows:
198.700.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Long-termcarefacility",anyfacilitylicensedunderthischapter;
3 (2)"Referralagency",anindividualorentitythatprovidesreferralstoalong-
4termcarefacilityforafeethatiscollectedfromthelong-termcarefacility.Theterm
5"referralagency"shallnotincludealong-termcarefacilityoritsemployees,afamily
6memberofaresidentofalong-termcarefacility,oraresidentofalong-termcare
7facilityregardlessofwhethertheresidentwhorefersaprospectiveresidenttoalong-
8termcarefacilityreceivesadiscountorotherremunerationfromthelong-termcare
9facility.
10 2.Areferralagencyshalldiscloseorprovide,asapplicable,toaprospective
11residentortherepresentativeoftheprospectiveresidentreferredtoalong-termcare
12facility:
13 (1)Writtenorelectronicdocumentationoftheexistenceofanyrelationships
14betweenthereferralagencyandthelong-termcarefacility,includingcommon
15ownershiporcontrolofthelong-termcarefacilityandfinancial,business,management,
16orfamilialrelationshipsbetweenthereferralagencyandthelong-termcarefacility;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Thatthereferralagencyreceivesafeefromthelong-termcarefacilityforthe
18referral;and
19 (3)Writtenorelectronicdocumentationoftheagreementbetweenthereferral
20agencyandtheprospectiveresidentorrepresentativeoftheprospectiveresident.The
21agreementshallinclude:
22 (a)Therightoftheprospectiveresidentorrepresentativeoftheprospective
23residenttoterminatethereferralagency'sservicesforanyreasonatanytime;
24 (b)Arequirementthatthereferralagencycommunicatethecancellationofthe
25agreementtoalllong-termcarefacilitiestowhichtheprospectiveresidenthasbeen
26referred;
27 (c)Therightoftheprospectiveresidentorrepresentativeoftheprospective
28residenttorequestnottobecontactedinthefuturebythereferralagency;and
29 (d)Therightoftheprospectiveresidentorrepresentativeoftheprospective
30residenttoreceivethereferralagency'sprivacypolicyuponrequesttothereferral
31agency.
32 3.(1)Thereferralagencyandtheprospectiveresidentorrepresentativeofthe
33prospectiveresidentshallsignanddate,inwritingorelectronically,theagreement
34requiredinsubsection2ofthissection.Thereferralagencyshallprovideawrittenor
35electroniccopyofthesignedagreementtothelong-termcarefacilityonorbeforethe
36datetheresidentisadmittedtothelong-termcarefacility.
37 (2)Thelong-termcarefacilityshall:
38 (a)Notpaythereferralagencyafeeuntilsuchfacilityreceivesthewrittenor
39electronicagreementrequiredinsubsection2ofthissection;
40 (b)Maintainawrittenorelectroniccopyoftheagreementrequiredin
41subsection2ofthissectionatthelong-termcarefacilityforatleastoneyearafterthe
42datethatthenewresidentisadmitted;and
43 (c)Notsellortransfertheprospectiveresident'sorprospectiveresident's
44representative'scontactinformationtoathirdpartywithoutthewrittenconsentofthe
45prospectiveresidentorrepresentativeoftheprospectiveresident.
46 4.Areferralagencythatviolatesthissectionissubjecttoacivilpenaltyofupto
47fivehundreddollarsperviolation.
48 5.Theattorneygeneraloracircuitattorneymaybringacivilactiononbehalfof
49thestatetoseektheimpositionofacivilpenaltyforaviolationofthissectionorto
50enjointhecontinuanceoftheviolationbythereferralagency.
