HB393 4 4 (2)Knowinglypurchaseahemp-derivedconsumableproductonbehalfofa 5personwhoisundertwenty-oneyearsofage; 6 (3)Knowinglypersuade,entice,send,orassistapersonwhoisundertwenty-one 7yearsofagetopurchase,acquire,receive,orattempttopurchaseahemp-derived 8consumableproduct; 9 (4)Knowinglydistributefreesamplesofahemp-derivedconsumableproductin 10oronapublicstreet,sidewalk,orpark; 11 (5)Knowinglysellhemp-derivedconsumableproductsinoronapublicstreet, 12sidewalk,orparkwithoutobtainingatemporaryeventpermitfromthedivision;or 13 (6)Knowinglysellordistributeahemp-derivedconsumableproductwithout 14havingfirstobtainedproofofagefromtheprospectivepurchaserorrecipientunlessan 15ordinarypersonwouldconcludeonthebasisofappearancethattheprospective 16purchaserorrecipientisnotundertwenty-oneyearsofage. 17 2.(1)Apersonundertwenty-oneyearsofageshallnot: 18 (a)Knowinglypurchase,possess,oracceptreceiptofahemp-derived 19consumableproduct;or 20 (b)Knowinglypresentpurportedproofofagethatisfalseorfraudulentorthat 21doesnotactuallyidentifythepersonforthepurposeofpurchasingorreceivingahemp- 22derivedconsumableproduct. 23 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsectiontothe 24contrary,itshallbelawful,andshallnotconstituteaviolationofsections195.2550to 25195.2635,forapersonundertwenty-oneyearsofagetoconsumehemp-derived 26consumableproductsunderthesupervisionoftheperson'sparentorlegalguardianor 27inaccordancewiththeprovisionsofsection195.2635.Nothinginthissubdivisionshall 28beconstruedtoaltertheprohibitiononpersonsundertwenty-oneyearsofage 29possessinghemp-derivedconsumableproducts. 30 3.Aretailerorretailestablishmentshallmaintainanyhemp-derived 31consumableproductotherthanhemp-derivedconsumablebeverageproductsonor 32behindthecounter,inanareaorretailestablishmentrestrictedtoadultstwenty-one 33yearsofageorolder,orinalockedcabinet.Anyhemp-derivedconsumablebeverage 34product,includingthoseincasesorboxes,offeredforretailsaleshallbemerchandised 35insuchamanner,whichmayinclude,butshallnotbelimitedto,signage,shelf-talkers, 36andstickersoncoolerdoors,soastoclearlyindicatetoconsumerstheproductscontain 37hemp-derivedcannabinoidsandareforsaleonlytopersonstwenty-oneyearsofageor 38older. 39 4.Anypersonwhoviolatesanyprovisionofthissectionshallbesubjecttoafine 40nottoexceedtwohundredfiftydollarsforafirstviolationtobepaidintothestate HB393 5 41schoolmoneysfundestablishedundersection166.051asprovidedbylawforotherfines 42andpenalties.ThepenaltyforanysecondorsubsequentviolationshallbeaclassD 43misdemeanor. 44 5.Thedivisionshallenforcesections195.2550to195.2635inamannerthatmay 45reasonablybeexpectedtoreducetheextenttowhichhemp-derivedconsumable 46productsaresoldordistributedtopersonsundertwenty-oneyearsofageandshall 47conductinspectionsatlocationswheresuchproductsaresoldordistributedtoensure 48compliancewithsections195.2550to195.2635. 49 6.Nothinginthissectionshallprohibitlawenforcementfromusingthe 50followingpersonstoenforcetheprovisionsofthissection: 51 (1)Anyminorundereighteenyearsofageiftheminor'sparentorlegal 52guardianhasconsentedtotheminor'sinvolvementintheenforcementeffort;and 53 (2)Anypersoneighteenyearsofageorolderandundertwenty-oneyearsofage 54ifthepersonhasconsentedtohisorherinvolvementintheenforcementeffort. 55 7.Notwithstandingtheprovisionsofthischapterorchapter579oranyother 56provisionoflawtothecontraryotherthantheprovisionsofsubsection8ofthissection, 57anypurchase,possession,consumption,use,manufacture,transportation,or 58distributionofanyhemp-derivedconsumableproductthatcomplieswiththe 59provisionsofsections195.2550to195.2635shallbelawful. 60 8.Ifthesaleofhemp-derivedconsumableproductsbecomesillegalunder 61federallaw,thefollowingprovisionsshallapply: 62 (1)Thesaleofhemp-derivedconsumableproductsinthisstateshallbe 63prohibited; 64 (2)Anylicenseissuedbythedivisionundersections195.2550to195.2635shall 65berevoked;and 66 (3)Thedivisionshallnotbegin,orshallstop,issuinganylicensesundersections 67195.2550to195.2635. 195.2560.1.Apersonorentitythatisinthebusinessofhemp-derived 2consumableproductsinthisstate,includinganymanufacturer,distributor,orretailer, 3shallobtainalicensefromthedivisionauthorizingthepersonorentitytoengageinthat 4businesspriortothecommencementofthebusinessor,forabusinessoperatingbefore 5theeffectivedateoftherulespromulgatedundersections195.2550to195.2635,withina 6timeperiodspecifiedbythedivisionbyrule. 7 2.Anypersonorentityengaginginthebusinessofmanufacturingorselling 8hemp-derivedconsumableproductsinthisstatewithoutavalidlicenserequiredunder 9sections195.2550to195.2635shallbesubjecttoafinenottoexceedtwohundredfifty 10dollars. HB393 6 11 3.(1)Anylicensegrantedtoaretailershallbelocationspecific.Thedivision 12shallrequirearetailertoobtainaseparatelicenseforeachlocationatwhichtheretailer 13sellshemp-derivedconsumableproductsforconsumption. 14 (2)Anylicensegrantedtoamanufacturerordistributorshallnotbelocation 15specific.Thedivisionshallnotrequireamanufacturerordistributortoobtaina 16separatelicenseforeachlocationatwhichthemanufacturerordistributoroperates. 17 4.Toobtainandmaintainamanufacturer,distributor,orretailerlicenseunder 18thissection,apersonorentityshall: 19 (1)Submittothedivisioninformationthedivisionprescribesasnecessaryfor 20theefficientenforcementofsections195.2550to195.2635; 21 (2)Forinitiallicensing,paytothedivisionafeeof: 22 (a)Formanufacturersanddistributors,fivehundreddollars;and 23 (b)Forretailers,twohundredfiftydollarsperlocation,nottoexceedtwo 24thousandfivehundreddollarsforaretailerwithmultiplelocations;and 25 (3)Consenttoreasonableinspectionandsamplingbythedivisionoftheperson's 26orentity'sinventoryofhemp-derivedconsumableproducts. 27 5.Alicenseissuedunderthissectionshallbevalidforaperiodofoneyearand 28mayberenewedannually.Thedivisionshallchargeanannualrenewalfeeof: 29 (1)Formanufacturersanddistributors,twohundredfiftydollars;and 30 (2)Forretailers,onehundreddollarsperlocation,nottoexceedtwothousand 31fivehundreddollarsforaretailerwithmultiplelocations. 32 6.Thedivisionmaydenyorrevokealicenseforanyviolationofsections 33195.2550to195.2635ortherulespromulgatedundersections195.2550to195.2635. 34 7.Nomorethanninetydaysafterthepromulgationofrulesundersections 35195.2550to195.2635,thedivisionshallissuelicensesforthemanufacture,distribution, 36andsaleofhemp-derivedconsumableproductsinthisstate. 37 8.Notwithstandinganyotherprovisionofthissection,anyapplicantthatmeets 38therequirementssetforthinsections195.2550to195.2635shallbeissuedalicenseby 39thedivision.Alicenseapplicationshallbeautomaticallydeemedapproved,anda 40licenseshallbeissued,ifthedivisionfailstoapproveordenytheapplicationwithin 41thirtydaysofthedateofthesubmissionoftheapplication. 42 9.Allfeespayableunderthissectionshallbecollectedbythedivisionand 43transmittedtothedepartmentofrevenuefordepositinthestatetreasurytothecreditof 44thehempbusinessfundestablishedundersection195.2563. 45 10.(1)Beginningontheeffectivedateofthissectionandcontinuingthereafter, 46nonewretailestablishmentsofferinghemp-derivedconsumableproductsshallbe 47locatedwithinonehundredfeetofanyeducationalinstitution,publicorprivate, HB393 7 48providingelementaryorsecondaryeducationtochildrenatanylevelfromkindergarten 49throughgradetwelveoratanyequivalentleveliftheinstitutiondoesnotusegrade 50divisions. 51 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection,aretail 52establishmentthatwasoperatingwithinonehundredfeetofanyeducationalinstitution 53describedinsubdivision(1)ofthissubsectionbeforetheeffectivedateofthissection 54thatchangesownershiponoraftertheeffectivedateofthissectionshallbepermittedto 55operateinthesamelocation. 195.2563.1.Thereisherebycreatedinthestatetreasurythe"HempBusiness 2Fund".Allfeesauthorizedtobechargedbythedivisionundersection195.2560shallbe 3collectedbythedirectorofthedivisionandshallbetransmittedtothedepartmentof 4revenuefordepositinthestatetreasuryforcredittothisfund.Thestatetreasurershall 5becustodianofthefund.Inaccordancewithsections30.170and30.180,thestate 6treasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,upon 7appropriation,moneysinthisfundshallbeusedsolelyfortheadministrationofsections 8195.2550to195.2635. 9 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 10remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 11generalrevenuefund. 12 3.Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 13otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 14creditedtothefund. 195.2565.1.BeforeApril1,2026,thedivisionshallpromulgaterulesonthe 2licensureofhemp-derivedconsumableproductbusinessestoimplementtheprovisions 3ofsections195.2550to195.2635.Therulesshall,ataminimum: 4 (1)Setforthapplicationformsandguidelinesforobtainingalicenseasahemp- 5derivedconsumableproductbusiness; 6 (2)Specifythedatebywhichhemp-derivedconsumableproductbusinesses 7operatingbeforetheeffectivedateoftherulespromulgatedunderthissectionshall 8obtainalicensetocontinueoperating;and 9 (3)Setforthrequirementsforbusinessoperationsinaccordancewithsections 10195.2550to195.2635. 11 2.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 12createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit 13complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 14section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 15vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe HB393 8 16effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional, 17thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterthe 18effectivedateofthissectionshallbeinvalidandvoid. 195.2570.1.Hemp-derivedconsumableproductsshallbetestedinaccordance 2withtherequirementsofthissection.Thedepartmentofhealthandseniorservicesshall 3overseealltestingofhemp-derivedconsumableproducts. 4 2.(1)Thedepartmentshallmaintainandpostonitswebsitearegistryof 5independenttestinglaboratories,locatedbothinthisstateandoutsidethisstate,that 6arequalifiedtotestintermediatemanufacturedmaterialandfinishedproducts 7containingahemp-derivedcannabinoid. 8 (2)Thedepartmentshalldevelopanapplicationandprocessbywhichqualifying 9laboratories,locatedbothinthisstateandoutsidethisstate,arelistedonitswebsite.An 10applicationsubmittedbyapotentiallyqualifyinglaboratoryshallincludeasample 11certificateofanalysisissuedbytheapplyinglaboratory. 12 (3)Notwithstandingtheprovisionsofsubdivisions(1)and(2)ofthissubsection, 13independenttestinglaboratorieswishingtotesthemp-derivedconsumableproducts 14subjecttotherequirementsofsections195.2550to195.2635shallregisterimmediately 15withthedepartment. 16 3.(1)Amanufacturershallensureitshemp-derivedconsumableproductis 17testedpriortodistributiontoadistributororpriortodistributiontoaretailer. 18 (2)Adistributorshallnotberequiredtotestthehemp-derivedconsumable 19productifthehemp-derivedconsumableproductispackagedinamannerthatmaybe 20soldtotheultimateconsumeroftheproductwhendeliveredtothedistributorandthe 21distributordoesnotopensuchpackage.Adistributorshallberequiredtotestthe 22hemp-derivedconsumableproductpriortodistributionifthehemp-derived 23consumableproductisnotpackagedinamannerthatmaybesoldtotheultimate 24consumeroftheproductwhendeliveredtothedistributororifthedistributoropens 25anypackage. 26 (3)Thetestingrequiredunderthissubsectionshalldeterminethepresenceand 27amountsofanyofthesubstanceslistedinsubsection4ofthissection.Noproductthat 28containsmorethanthemaximumamountindicatedforanysubstanceinsubsection4of 29thissectionshallbedistributedorsoldinthisstate. 30 4.(1)Thedepartmentshallpromulgateregulationsspecifyingpassorfailaction 31levelsforsafetyandtoxicityforhemp-derivedconsumableproductswithrespecttothe 32testingrequiredbythissection.Allhemp-derivedconsumableproductsofferedforsale 33ordistributioninthisstateshallbetestedforthepresenceofandamountsofthe 34followingsubstances: HB393 9 35 (a)Heavymetals; 37 (2)Appeartoimitateafood,candy,orothercommonlyavailablesnackproduct 38thatistypicallymarketedtowardorappealingtochildren;or 39 (3)InfringeuponanytrademarksprotectedbytheUnitedStatesPatentand 40TrademarkOfficeortheMissouriofficeofthesecretaryofstate. 195.2580.1.Ahemp-derivedconsumableproductthatissoldinthisstateshall 2belabeledinaccordancewithsection195.2575andincludeaquickresponsecodethat HB393 11 3directsconsumerstoalllabelinformationrequiredbysection195.2575andall 4informationrequiredbysection195.2570. 5 2.Allhemp-derivedconsumableproductsofferedforsaleinthisstateotherthan 6hemp-derivedconsumablebeverageproductsshallsatisfythechild-resistant 7effectivenessstandardsunder16CFR1700.15(b)(1)whentestedinaccordancewith 8therequirementssetforthin16CFR1700.20. 9 3.(1)Ahemp-derivedconsumableproductthatissoldinthisstateshallbe 10manufacturedintheUnitedStatesunderallapplicablelawsgoverningthemanufacture 11ofhemp-derivedproductsinitsjurisdictionoforiginincluding,butnotlimitedto, 12abidingbyCurrentGoodManufacturingPractices(CGMP)andGenerallyRecognized 13asSafe(GRAS)standards. 14 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection, 15cannabinoidsareallowedinahemp-derivedconsumableproductdespitenothaving 16GRASstatus.Allingredientsotherthancannabinoidsinthefinalhemp-derived 17consumableproductshallhaveGRASstatus. 18 4.Anyhemp-derivedconsumableproductthatissoldinthisstateshallnotbe 19soldwithoutavalidlyissuedcertificateofanalysisissuedbyanindependenttesting 20laboratorywithintheprevioustwenty-fourmonths. 21 5.Anyhemp-derivedconsumableproductthatissoldinthisstateandthatis 22intendedforingestionandthatisnotintendedforinhalation,otherthanahemp- 23derivedconsumablebeverageproduct,shallnot: 24 (1)Besoldinaservingthatcontainsmorethanfivemilligrams,intheaggregate, 25ofdelta-8THCanddelta-9THC; HB393 13 11 3.Nothinginthissectionprohibitstheuseofdrawings,illustrations,orartwork 12depictingnonmythicalcreatures,inanimateobjects,scenery,humanoidcharacters, 13fruit-orflavor-focusedimages,oranyotheritemsnotknowntoappealprimarilyto 14personsundertwenty-oneyearsofage. 195.2590.1.Sections195.2550to195.2635shallnotbeconstruedtopermita 2persontoundertakeanytaskwhileimpairedbytheuseofahemp-derivedconsumable 3productifdoingsowouldconstitutenegligenceorprofessionalmalpractice. 4 2.(1)Apersonshallnotoperate,navigate,orbeinactualphysicalcontrolofa 5motorvehicle,aircraft,motorizedwatercraft,oranyothervehiclewhileimpairedbythe 6useofahemp-derivedconsumableproduct. 7 (2)Conductwhileintoxicatedfromtheuseofahemp-derivedconsumable 8productshallbesubjecttothepenaltiesfordrivingwhileintoxicatedundersection 9577.010inthesamemannerthatconductwhileintoxicatedfromtheuseofanyother 10drugissubjecttosuchpenalties. 11 3.(1)Apersonshallnotdriveamotorvehicleonapublicroadwhileconsuming 12ahemp-derivedconsumablebeverageproduct. 13 (2)Apersonshallnotpossessanopencontainerofahemp-derivedconsumable 14beverageproductwhiledrivingamotorvehicleonapublicroad. 15 (3)Aviolationofsubdivision(1)or(2)ofthissubsectionisaninfractionfor 16whichfourpointsshallbeassessedtotheperson'sdrivingrecord. 17 4.Sections195.2550to195.2635shallnotrequireanemployertoaccommodate 18theuseofahemp-derivedconsumableproductintheworkplaceoranemployee 19workingwhileimpairedbytheuseofahemp-derivedconsumableproduct. 20 5.Sections195.2550to195.2635shallnotexemptapersonfromprosecutionfor 21acriminaloffenserelatedtoimpairmentorintoxicationresultingfromtheuseofa 22hemp-derivedconsumableproductorrelieveapersonfromanyrequirementunderthe 23lawtosubmittoabreath,blood,urine,orothertesttodetectthepresenceofa 24controlledsubstance. 195.2595.1.Nothinginsections195.2550to195.2635shallprohibithemp- 2derivedconsumablebeverageproductmanufacturersfromassigningexclusive 3territoriesfordistributionofhemp-derivedconsumablebeverageproducts. 4 2.(1)Anyperson,cooperative,orbusinessholdinganyoneofthethreetypesof 5hemp-derivedconsumableproductlicenseswhoisengagedintheproduction, 6manufacturing,distribution,orsaleofhemp-derivedconsumablebeverageproducts 7shallnotholdeitheroftheothertwotypesofhemp-derivedconsumableproductlicenses 8andshallnothaveafinancialinterest,eitherdirectorindirect,inaperson,cooperative, HB393 14 9orbusinessholdinganyoftheothertwotypesofhemp-derivedconsumableproduct 10licenses. 11 (2)Ahemp-derivedconsumablebeverageproductmanufacturershallnot 12directlysolicit,sell,orotherwiseconveyhemp-derivedconsumablebeverageproductsto 13retailers.Hemp-derivedconsumablebeverageproductmanufacturersareauthorizedto 14solicitandsellhemp-derivedconsumablebeverageproductstohemp-derived 15consumablebeverageproductdistributors.Hemp-derivedconsumablebeverage 16productdistributorsareauthorizedtosolicitandsellhemp-derivedconsumable 17beverageproductstohemp-derivedconsumablebeverageproductretailers. 18 (3)Theprohibitionsofthissubsectionshallnotapplytoanyhemp-derived 19consumablebeverageproductmanufacturerwhosellslessthanonethousandgallonsof 20theproducteachyear. 21 3.Nopersonorentityshalldeliver,ship,orcausetobedeliveredorshippedany 22hemp-derivedconsumablebeverageproductdirectlytoanyresidentofthisstate. 195.2600.1.Eachhemp-derivedconsumableproductdistributedoravailable 2fordistributioninthisstateshallbeofficiallyregisteredwiththedivisionandshall 3complywiththerequirementsofthissection. 4 2.Applicationforregistrationshallbemadetothedivisiononaformprovided 5bythedivisionandshallincludethefollowinginformation: 6 (1)Thenameandaddressoftheapplicant; 7 (2)Thenameandaddressofthepersonwhosenamewillappearonthelabelif 8suchpersonisnottheapplicant; 9 (3)Thenameoftheproduct; 10 (4)Thetypeanduseoftheproduct; 11 (5)Acompletecopyofthelabelasitwillappearontheproductinalegible 12format; 13 (6)IftheproducthasbeenassignedaNationalDrugCodeinaccordancewith21 14CFR207.33,theNationalDrugCodenumber;and 15 (7)Theapplicant'sproofofusingCurrentGoodManufacturingPractices 16(CGMP)andGenerallyRecognizedasSafe(GRAS)standardsasrequiredunder 17sections195.2550to195.2635. 18 3.Theapplicationforregistrationshallincludeacertificateofanalysisforthe 19hemp-derivedconsumableproductthatisfromanindependenttestinglaboratoryand 20thatmeetstherequirementsofsection195.2570. 21 4.Thedivisionmaydenyregistrationforanincompleteapplication. 22 5.Anewregistrationisrequiredforanyofthefollowing: 23 (1)Anychangeinahemp-derivedconsumableproduct'singredients; HB393 15 24 (2)Anychangetothedirectionsforuse;and 25 (3)Anychangeofnamefortheproduct. 26 6.Anychangenotdescribedinsubsection5ofthissectionshallnotrequirea 27newregistration,buttheregistrantshallsubmitcopiesofeachlabelchangetothe 28divisionassoonasthechangeiseffective. 29 7.Theregistrantisresponsiblefortheaccuracyandcompletenessofthe 30informationsubmitted. 31 8.Ahemp-derivedconsumableproductthathasbeendiscontinuedshall 32continuetoberegisteredinthestateuntiltheproductisnolongeravailablefor 33distribution. 195.2605.1.Testingofanyhemp-derivedconsumableproductforpurposesof 2sections195.2550to195.2635shallbeconductedonthehemp-derivedconsumable 3productinitsfinalforminaccordancewiththerequirementssetforthinsection 4195.2570. 5 2.Thecertificateofanalysisforahemp-derivedconsumableproductshall 6reportthetestresultsrequiredinsection195.2570inspecifiedunitsofmeasureandin 7accordancewiththerequirementsforahemp-derivedconsumableproductinsection 8195.2580. 195.2607.1.Thedivisionshallconductrandomizedinspectionsofhemp-derived 2consumableproductsdistributedoravailablefordistributioninthisstatefor 3compliancewiththerequirementsofsections195.2550to195.2635. 4 2.Thedivisionshallperiodicallysample,analyze,andtesthemp-derived 5consumableproductsdistributedwithinthisstateforcompliancewithregistrationand 6labelingrequirementsandthecertificateofanalysis. 7 3.Thedivisionmayconductinspectionsofhemp-derivedconsumableproducts 8distributedoravailablefordistributionforanyreasonthedivisiondeemsnecessary. 195.2610.1.Allretailestablishmentsandfoodserviceestablishmentsoffering 2hemp-derivedconsumablebeverageproductsshallbelicensedbythedivisionin 3accordancewithsections195.2550to195.2635. 4 2.Ahemp-derivedconsumablebeverageproductmaybesoldbyon-premises 5retailersorinfoodserviceestablishmentsifthehemp-derivedconsumablebeverage 6producthasbeenregisteredinaccordancewithsection195.2600.Anyotherhemp- 7derivedconsumableproductorclassofproductsshallnotbesoldbyon-premises 8retailersorinfoodserviceestablishments. 9 3.Aretailestablishment,on-premisesretailer,orfoodserviceestablishment 10shallnotofferhemp-derivedconsumableproductsatatemporaryeventorfestival 11unlesstheretailestablishment,on-premisesretailer,orfoodserviceestablishmentis HB393 16 12licensedbythedivisioninaccordancewithsections195.2550to195.2635andobtainsa 13temporaryeventpermitfromthedivision. 14 4.Abusinessthatdistributes,sells,orserveshemp-derivedconsumable 15beverageproductsshallnotpermitanypersonwhoisundertwenty-oneyearsofageto 16servehemp-derivedconsumablebeverageproductsunlessthepersonisanemployeeof 17thebusinesswhoiseighteenyearsofageorolderandunderthedirectsupervisionofa 18persontwenty-oneyearsofageorolder. 19 5.Ahemp-derivedconsumablebeverageproductshallnotbesoldforon-site 20consumptionunlesstheprospectivepurchaserorrecipienthaspresentedproofofageor 21anordinarypersonwouldconcludeonthebasisofappearancethattheprospective 22purchaserorrecipientisnotundertwenty-oneyearsofage. 23 6.Exceptassetforthinthissection,onlyprepackagedregisteredhemp-derived 24consumablebeverageproductsshallbeofferedfordirectconsumptionaton-premises 25retailersorfoodserviceestablishments. 26 7.Hemp-derivedconsumablebeverageproductsshallnotbeaddedtoan 27ingestiblefoodproductatafoodserviceestablishment. 28 8.Hemp-derivedconsumablebeverageproductsmaybecombinedwith 29nonalcoholicingestiblebeverageproductsatanon-premisesretailerorfoodservice 30establishment. 31 9.On-premisesretailersandfoodserviceestablishmentsservinghemp-derived 32consumablebeverageproductsshallnotprovidehemp-derivedconsumablebeverage 33productstoindividualswhoarebelievedtobeintoxicated. 34 10.Anon-premisesretailerorfoodserviceestablishmentofferinganyhemp- 35derivedconsumablebeverageproductshallprovidetoconsumersuponrequest: 36 (1)Thecommonnameoftheproduct;and 37 (2)Thedistributorormanufactureroftheproduct. 38 11.On-sitesamplingofhemp-derivedconsumablebeverageproductsprovided 39byamanufactureratthemanufacturer'splaceofbusinessispermittedprovidedthat 40thepersonssamplingaretwenty-oneyearsofageorolderandthesamplingisconducted 41inamannerthatreflectsresponsibleservingpractices. 195.2615.Thedivisionmayregulatetheadvertisingandpromotionofhemp- 2derivedconsumableproductsales,butanysuchregulationshallbenomorestringent 3thancomparablestateregulationsontheadvertisingandpromotionofalcoholsales. 195.2617.ForalltaxyearsbeginningonorafterJanuary1,2026,anexcisetaxis 2leviedandimposedupontheretailsaleofhemp-derivedconsumableproductsto 3consumerswithinthisstateattherateandinthemannersetforthinsection144.028. 195.2620.1.Asusedinthissection,thefollowingtermsmean: HB393 17 2 (1)"Goodcause": 3 (a)Failurebythehemp-derivedconsumablebeverageproductdistributorto 4complysubstantiallywiththeprovisionsofanagreementorunderstandingwiththe 5hemp-derivedconsumablebeverageproductmanufactureriftheprovisionsareboth 6essentialandreasonable; 7 (b)Useofbadfaithorfailuretoobservereasonablecommercialstandardsof 8fairdealinginthetrade;or 9 (c)Revocationorsuspensionformorethanthirtydaysofthehemp-derived 10consumablebeverageproductdistributor'sstateorlocallicenserequiredforthenormal 11operationsofitsbusiness; 12 (2)"Goodfaith",thedutyofeachpartytoanyfranchiseandallofficers, 13employees,oragentsthereoftoactinafairandequitablemannertowardeachother. 14 2.Ifmorethanonefranchiseforthesamebrandorbrandsofhemp-derived 15consumablebeverageproductsisgrantedtodifferenthemp-derivedconsumable 16beverageproductdistributorsinthisstate,itshallbeunlawfulforanyhemp-derived 17consumablebeverageproductmanufacturertodiscriminatebetweenthedistributors 18withrespecttoanyoftheterms,provisions,andconditionsofthesefranchises. 19 3.Notwithstandingtheterms,provisions,andconditionsofanyfranchise,no 20hemp-derivedconsumablebeverageproductmanufacturershallunilaterallyterminate 21orrefusetocontinueorchangesubstantiallytheconditionofanyfranchisewiththe 22hemp-derivedconsumablebeverageproductdistributorunlessthemanufacturerhas 23firstestablishedgoodcauseforsuchtermination,noncontinuance,orchange. 24 4.Anyhemp-derivedconsumablebeverageproductdistributormaybringan 25actioninacourtofcompetentjurisdictionagainstahemp-derivedconsumablebeverage 26productmanufacturerforviolationofanyoftheprovisionsofthissectionandmay 27recoverdamagessustainedbysuchdistributortogetherwiththecostsoftheactionand 28reasonableattorney'sfees. 29 5.Inanyactionbroughtbyahemp-derivedconsumablebeverageproduct 30distributoragainstahemp-derivedconsumablebeverageproductmanufacturerfor 31termination,noncontinuance,orsubstantialchangeinviolationoftheprovisionsofthis 32section,itisacompletedefenseforthehemp-derivedconsumablebeverageproduct 33manufacturertoprovethatthetermination,noncontinuance,orsubstantialchangewas 34doneingoodfaithandforgoodcause. 195.2625.1.Anymanufacturerlicensedundersections195.2550to195.2635, 2includingitsaffiliates,officers,directors,employees,andagents,shallbeindemnified 3fromanyandallclaims,losses,liabilities,damages,costs,andexpenses,including 4reasonableattorney'sfeesandlitigationcosts,arisingoutofany: HB393 18 5 (1)Untruerepresentation,breachofwarranty,ornonfulfillmentbyanyretailer 6ordistributorofanyobligationundersections195.2550to195.2635; 8 (2)"Safeharbormanufacturerorstoragefacility",afacilitythatmanufactures 9fordistribution,producesfordistribution,packagesfordistribution,processesfor 10distribution,preparesfordistribution,treatsfordistribution,transportsfor 11distribution,orholdsfordistributionasafeharborhempproduct. 12 2.Sections195.2550to195.2635shallnotapplytoany: 13 (1)Safeharborhempproduct;or 14 (2)Safeharbormanufacturerorstoragefacility. 195.2635.1.BeforeJuly1,2026,eachschooldistrictinthisstateshalladoptand 2enforceawrittenpolicyprohibitingatalltimestheuseofanyhemp-derivedconsumable 3productbyanypersoninschoolbuildings,inschoolfacilities,onschoolcampuses,and 4inoronanyotherschoolpropertyownedoroperatedbytheschooldistrict.Thepolicy 5shallalsoprohibittheuseofanyhemp-derivedconsumableproductbypersons 6attendingaschool-sponsoredeventatalocationnotlistedinthissubsectionifinthe 7presenceofstudentsorschoolpersonnelorinanareawheresmokingorotheruseofa 8hemp-derivedconsumableproductisotherwiseprohibitedbylaw. 9 2.Notwithstandingtheprovisionsofsubsection1ofthissectionoranyother 10provisionofsections195.2550to195.2635tothecontrary,alicensedhealthcare 11professionalmayadministerahemp-derivedconsumableproducttoastudentata 12schoolunderthefollowingconditions: 13 (1)Thestudenthasarecommendationfromalicensedhealthcareprofessional 14specifyingthereasonfortheadministration,thesuggestedproduct,andthesuggested 15dosage; HB393 20 16 (2)Theparentorlegalguardianofthestudenthasprovidedalettergiving 17expresspermissiontoadministertheproducttothestudentinaccordancewiththe 18recommendationofthelicensedhealthcareprofessional; 19 (3)Foreachhemp-derivedconsumableproducttobeadministered,thestudent's 20parentorlegalguardianhassubmittedavalidlyissuedcertificateofanalysisfroman 21independenttestinglaboratorywithtestingresultsthatmeettherequirementsofsection 22195.2570;and 23 (4)Foreachhemp-derivedconsumableproducttobeadministered,nomore 24thanathreemonths'supplyoftheproductisprovidedtotheschoolatanygiventime. 25 3.Anyhemp-derivedconsumableproductprovidedtoaschoolunderthis 26sectionshallbekeptinanareathatisinaccessibletootherstudents,teachers,staff,and 27administrators. ✔ HB393 21
