2product"shallhavethesamemeaninggiventotheterminsection195.2550.
3 2.ForalltaxyearsbeginningonorafterJanuary1,2026,anexcisetaxishereby
4leviedandimposedupontheretailsaleofhemp-derivedconsumableproductsto
5consumerswithinthisstate.Therateoftaxshallbetwopercentoftheretailpurchase
6pricepaidorchargedandshallbeinadditiontoanytaximposedunderanyother
7provisionoffederal,state,orlocallaw.
8 3.Therevenuederivedfromthetwopercentrateleviedunderthissectionshall
9beusedexclusivelyforthefundingofveterans'programs,drugabusepreventionand
10educationprograms,andfirstresponderprograms.
11 4.Thetaximposedunderthissectionisintendedtobepassedontoandborneby
12thepurchaserofthehemp-derivedconsumableproduct.Thetaxisadebtfromthe
13purchasertotheretaileruntilpaidandisrecoverableatlawbytheretailerinthesame
14mannerasotherdebts.Aretailerisconsideredtoactasatrusteeonbehalfofthestate

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 15whenitcollectstaxfromthepurchaseronataxabletransaction.Thetaxshallbestated

38concentrationofnotmorethanthree-tenthsofonepercentonadry-weightbasis;
39 (11)"Hemp-derivedcannabinoid",anycannabinoidnaturallyoccurringin,and
40originatingfrom,thehempplantincluding,butnotlimitedto,delta-9
41tetrahydrocannabinol(delta-9THC),tetrahydrocannabinolicacid(THCA),
42cannabidiol(CBD),cannabidiolicacid(CBDA),cannabinol(CBN),cannabigerol
43(CBG),cannabichromene(CBC),cannabicyclol(CBL),cannabivarin(CBV),
44tetrahydrocannabivarin(THCV),cannabidivarin(CBDV),cannabicitran(CBT),and
45delta-8tetrahydrocannabinol(delta-8THC).Theterm"hemp-derivedcannabinoid"
46alsoincludesanysyntheticcannabinoidorsemi-syntheticcannabinoidwiththesame
47molecularstructureasacannabinoidnaturallyoccurringinthehempplantaslongas
48suchcannabinoidwasderivedfromthehempplant;
49 (12)"Hemp-derivedconsumablebeverageproduct",ahemp-derived
50consumableproductthatisaliquidintendedforingestionandthatisnotatincture;
51 (13)"Hemp-derivedconsumableproduct",ahempproductthatisafinished
52goodintendedforhumaningestionorinhalationandthatdoesnotcontainatotalTHC
53concentrationmeasuredpost-decarboxylationofmorethanthree-tenthsofonepercent
54onadry-weightbasis.TotalTHCconcentrationshallbecalculatedasthesumof:
55 (a)Themeasureddelta-9THC;and
56 (b)TheproductofthemeasuredTHCAmultipliedbyeighthundredseventy-
57seventhousandths;
58 (14)"Hempproduct",anyproductthatcontainsahemp-derivedcannabinoid.
59Theterm"hempproduct"shallnotinclude:
60 (a)Anyhemp-derivedproductintendedfortopicalapplication;
61 (b)Anyhemp-derivedanimalfeedproduct;or
62 (c)Anyhempseedsorhemp-seed-derivedingredientsthataregenerally
63recognizedassafebytheUnitedStatesFoodandDrugAdministration;
64 (15)"Independenttestinglaboratory",alaboratorythatmeetsallofthe
65followingconditions:
66 (a)HoldsanInternationalOrganizationforStandardization(ISO)17025
67accreditationorisregisteredwiththeDrugEnforcementAdministrationinaccordance
68with21CFR1301.13;
69 (b)Doesnothaveadirectorindirectinterestintheentitywhoseproductisbeing
70tested;

72processes,distributes,dispenses,orsellshemp-derivedconsumableproductsinthis

75high-performanceliquidchromatography(HPLC)method;

8consumableproduct;
9 (4)Knowinglydistributefreesamplesofahemp-derivedconsumableproductin
10oronapublicstreet,sidewalk,orpark;
11 (5)Knowinglysellhemp-derivedconsumableproductsinoronapublicstreet,
12sidewalk,orparkwithoutobtainingatemporaryeventpermitfromthedivision;or
13 (6)Knowinglysellordistributeahemp-derivedconsumableproductwithout
14havingfirstobtainedproofofagefromtheprospectivepurchaserorrecipientunlessan
15ordinarypersonwouldconcludeonthebasisofappearancethattheprospective
16purchaserorrecipientisnotundertwenty-oneyearsofage.
17 2.(1)Apersonundertwenty-oneyearsofageshallnot:
18 (a)Knowinglypurchase,possess,oracceptreceiptofahemp-derived
19consumableproduct;or
20 (b)Knowinglypresentpurportedproofofagethatisfalseorfraudulentorthat
21doesnotactuallyidentifythepersonforthepurposeofpurchasingorreceivingahemp-
22derivedconsumableproduct.
23 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsectiontothe
24contrary,itshallbelawful,andshallnotconstituteaviolationofsections195.2550to
25195.2635,forapersonundertwenty-oneyearsofagetoconsumehemp-derived
26consumableproductsunderthesupervisionoftheperson'sparentorlegalguardianor
27inaccordancewiththeprovisionsofsection195.2635.Nothinginthissubdivisionshall
28beconstruedtoaltertheprohibitiononpersonsundertwenty-oneyearsofage
29possessinghemp-derivedconsumableproducts.
30 3.Aretailerorretailestablishmentshallmaintainanyhemp-derived
31consumableproductotherthanhemp-derivedconsumablebeverageproductsonor
32behindthecounter,inanareaorretailestablishmentrestrictedtoadultstwenty-one
33yearsofageorolder,orinalockedcabinet.Anyhemp-derivedconsumablebeverage
34product,includingthoseincasesorboxes,offeredforretailsaleshallbemerchandised
35insuchamanner,whichmayinclude,butshallnotbelimitedto,signage,shelf-talkers,
36andstickersoncoolerdoors,soastoclearlyindicatetoconsumerstheproductscontain
37hemp-derivedcannabinoidsandareforsaleonlytopersonstwenty-oneyearsofageor
38older.
39 4.Anypersonwhoviolatesanyprovisionofthissectionshallbesubjecttoafine
40nottoexceedtwohundredfiftydollarsforafirstviolationtobepaidintothestate

42andpenalties.ThepenaltyforanysecondorsubsequentviolationshallbeaclassD
43misdemeanor.
44 5.Thedivisionshallenforcesections195.2550to195.2635inamannerthatmay
45reasonablybeexpectedtoreducetheextenttowhichhemp-derivedconsumable
46productsaresoldordistributedtopersonsundertwenty-oneyearsofageandshall
47conductinspectionsatlocationswheresuchproductsaresoldordistributedtoensure
48compliancewithsections195.2550to195.2635.
49 6.Nothinginthissectionshallprohibitlawenforcementfromusingthe
50followingpersonstoenforcetheprovisionsofthissection:
51 (1)Anyminorundereighteenyearsofageiftheminor'sparentorlegal
52guardianhasconsentedtotheminor'sinvolvementintheenforcementeffort;and
53 (2)Anypersoneighteenyearsofageorolderandundertwenty-oneyearsofage
54ifthepersonhasconsentedtohisorherinvolvementintheenforcementeffort.
55 7.Notwithstandingtheprovisionsofthischapterorchapter579oranyother
56provisionoflawtothecontraryotherthantheprovisionsofsubsection8ofthissection,
57anypurchase,possession,consumption,use,manufacture,transportation,or
58distributionofanyhemp-derivedconsumableproductthatcomplieswiththe
59provisionsofsections195.2550to195.2635shallbelawful.
60 8.Ifthesaleofhemp-derivedconsumableproductsbecomesillegalunder
61federallaw,thefollowingprovisionsshallapply:
62 (1)Thesaleofhemp-derivedconsumableproductsinthisstateshallbe
63prohibited;
64 (2)Anylicenseissuedbythedivisionundersections195.2550to195.2635shall
65berevoked;and
66 (3)Thedivisionshallnotbegin,orshallstop,issuinganylicensesundersections
67195.2550to195.2635.
195.2560.1.Apersonorentitythatisinthebusinessofhemp-derived
2consumableproductsinthisstate,includinganymanufacturer,distributor,orretailer,
3shallobtainalicensefromthedivisionauthorizingthepersonorentitytoengageinthat
4businesspriortothecommencementofthebusinessor,forabusinessoperatingbefore
5theeffectivedateoftherulespromulgatedundersections195.2550to195.2635,withina
6timeperiodspecifiedbythedivisionbyrule.
7 2.Anypersonorentityengaginginthebusinessofmanufacturingorselling
8hemp-derivedconsumableproductsinthisstatewithoutavalidlicenserequiredunder
9sections195.2550to195.2635shallbesubjecttoafinenottoexceedtwohundredfifty
10dollars.
HB393	6 11 3.(1)Anylicensegrantedtoaretailershallbelocationspecific.Thedivision
12shallrequirearetailertoobtainaseparatelicenseforeachlocationatwhichtheretailer
13sellshemp-derivedconsumableproductsforconsumption.
14 (2)Anylicensegrantedtoamanufacturerordistributorshallnotbelocation
15specific.Thedivisionshallnotrequireamanufacturerordistributortoobtaina
16separatelicenseforeachlocationatwhichthemanufacturerordistributoroperates.
17 4.Toobtainandmaintainamanufacturer,distributor,orretailerlicenseunder
18thissection,apersonorentityshall:
19 (1)Submittothedivisioninformationthedivisionprescribesasnecessaryfor
20theefficientenforcementofsections195.2550to195.2635;
21 (2)Forinitiallicensing,paytothedivisionafeeof:
22 (a)Formanufacturersanddistributors,fivehundreddollars;and
23 (b)Forretailers,twohundredfiftydollarsperlocation,nottoexceedtwo
24thousandfivehundreddollarsforaretailerwithmultiplelocations;and
25 (3)Consenttoreasonableinspectionandsamplingbythedivisionoftheperson's
26orentity'sinventoryofhemp-derivedconsumableproducts.
27 5.Alicenseissuedunderthissectionshallbevalidforaperiodofoneyearand
28mayberenewedannually.Thedivisionshallchargeanannualrenewalfeeof:
29 (1)Formanufacturersanddistributors,twohundredfiftydollars;and
30 (2)Forretailers,onehundreddollarsperlocation,nottoexceedtwothousand
31fivehundreddollarsforaretailerwithmultiplelocations.
32 6.Thedivisionmaydenyorrevokealicenseforanyviolationofsections
33195.2550to195.2635ortherulespromulgatedundersections195.2550to195.2635.
34 7.Nomorethanninetydaysafterthepromulgationofrulesundersections
35195.2550to195.2635,thedivisionshallissuelicensesforthemanufacture,distribution,
36andsaleofhemp-derivedconsumableproductsinthisstate.
37 8.Notwithstandinganyotherprovisionofthissection,anyapplicantthatmeets
38therequirementssetforthinsections195.2550to195.2635shallbeissuedalicenseby
39thedivision.Alicenseapplicationshallbeautomaticallydeemedapproved,anda
40licenseshallbeissued,ifthedivisionfailstoapproveordenytheapplicationwithin
41thirtydaysofthedateofthesubmissionoftheapplication.
42 9.Allfeespayableunderthissectionshallbecollectedbythedivisionand
43transmittedtothedepartmentofrevenuefordepositinthestatetreasurytothecreditof
44thehempbusinessfundestablishedundersection195.2563.
45 10.(1)Beginningontheeffectivedateofthissectionandcontinuingthereafter,
46nonewretailestablishmentsofferinghemp-derivedconsumableproductsshallbe
47locatedwithinonehundredfeetofanyeducationalinstitution,publicorprivate,
HB393	7 48providingelementaryorsecondaryeducationtochildrenatanylevelfromkindergarten
49throughgradetwelveoratanyequivalentleveliftheinstitutiondoesnotusegrade
50divisions.
51 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection,aretail
52establishmentthatwasoperatingwithinonehundredfeetofanyeducationalinstitution
53describedinsubdivision(1)ofthissubsectionbeforetheeffectivedateofthissection
54thatchangesownershiponoraftertheeffectivedateofthissectionshallbepermittedto
55operateinthesamelocation.
195.2563.1.Thereisherebycreatedinthestatetreasurythe"HempBusiness
2Fund".Allfeesauthorizedtobechargedbythedivisionundersection195.2560shallbe
3collectedbythedirectorofthedivisionandshallbetransmittedtothedepartmentof
4revenuefordepositinthestatetreasuryforcredittothisfund.Thestatetreasurershall
5becustodianofthefund.Inaccordancewithsections30.170and30.180,thestate
6treasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,upon
7appropriation,moneysinthisfundshallbeusedsolelyfortheadministrationofsections
8195.2550to195.2635.
9 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
10remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
11generalrevenuefund.
12 3.Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
13otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
14creditedtothefund.
195.2565.1.BeforeApril1,2026,thedivisionshallpromulgaterulesonthe
2licensureofhemp-derivedconsumableproductbusinessestoimplementtheprovisions
3ofsections195.2550to195.2635.Therulesshall,ataminimum:
4 (1)Setforthapplicationformsandguidelinesforobtainingalicenseasahemp-
5derivedconsumableproductbusiness;
6 (2)Specifythedatebywhichhemp-derivedconsumableproductbusinesses
7operatingbeforetheeffectivedateoftherulespromulgatedunderthissectionshall
8obtainalicensetocontinueoperating;and
9 (3)Setforthrequirementsforbusinessoperationsinaccordancewithsections
10195.2550to195.2635.
11 2.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
12createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
13complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
14section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
15vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
HB393	8 16effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
17thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterthe
18effectivedateofthissectionshallbeinvalidandvoid.
195.2570.1.Hemp-derivedconsumableproductsshallbetestedinaccordance
2withtherequirementsofthissection.Thedepartmentofhealthandseniorservicesshall
3overseealltestingofhemp-derivedconsumableproducts.
4 2.(1)Thedepartmentshallmaintainandpostonitswebsitearegistryof
5independenttestinglaboratories,locatedbothinthisstateandoutsidethisstate,that
6arequalifiedtotestintermediatemanufacturedmaterialandfinishedproducts
7containingahemp-derivedcannabinoid.
8 (2)Thedepartmentshalldevelopanapplicationandprocessbywhichqualifying
9laboratories,locatedbothinthisstateandoutsidethisstate,arelistedonitswebsite.An
10applicationsubmittedbyapotentiallyqualifyinglaboratoryshallincludeasample
11certificateofanalysisissuedbytheapplyinglaboratory.
12 (3)Notwithstandingtheprovisionsofsubdivisions(1)and(2)ofthissubsection,
13independenttestinglaboratorieswishingtotesthemp-derivedconsumableproducts
14subjecttotherequirementsofsections195.2550to195.2635shallregisterimmediately
15withthedepartment.
16 3.(1)Amanufacturershallensureitshemp-derivedconsumableproductis
17testedpriortodistributiontoadistributororpriortodistributiontoaretailer.
18 (2)Adistributorshallnotberequiredtotestthehemp-derivedconsumable
19productifthehemp-derivedconsumableproductispackagedinamannerthatmaybe
20soldtotheultimateconsumeroftheproductwhendeliveredtothedistributorandthe
21distributordoesnotopensuchpackage.Adistributorshallberequiredtotestthe
22hemp-derivedconsumableproductpriortodistributionifthehemp-derived
23consumableproductisnotpackagedinamannerthatmaybesoldtotheultimate
24consumeroftheproductwhendeliveredtothedistributororifthedistributoropens
25anypackage.
26 (3)Thetestingrequiredunderthissubsectionshalldeterminethepresenceand
27amountsofanyofthesubstanceslistedinsubsection4ofthissection.Noproductthat
28containsmorethanthemaximumamountindicatedforanysubstanceinsubsection4of
29thissectionshallbedistributedorsoldinthisstate.
30 4.(1)Thedepartmentshallpromulgateregulationsspecifyingpassorfailaction
31levelsforsafetyandtoxicityforhemp-derivedconsumableproductswithrespecttothe
32testingrequiredbythissection.Allhemp-derivedconsumableproductsofferedforsale
33ordistributioninthisstateshallbetestedforthepresenceofandamountsofthe
34followingsubstances:
HB393	9 35 (a)Heavymetals;
36 (b)Pesticides;
37 (c)Mycotoxins;
38 (d)Solvents;and
39 (e)Microbials.
40 (2)Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
41createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
42complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
43section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
44vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
45effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
46thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterthe
47effectivedateofthissectionshallbeinvalidandvoid.
48 5.Amanufacturerordistributorshallcontractwithanindependenttesting

41orrepresentatives,inconnectionwithhemp-derivedconsumableproducts;or

46undersections195.2550to195.2635,includingthestorage,transportation,anddelivery
47oftheproducts;or
48 (c)Anyactualorallegeddefectinahemp-derivedconsumableproductorinthe
49labelingorpackagingoftheproduct.
195.2630.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Safeharborhempproduct",ahemp-derivedcompoundorhemp-derived
3cannabinoid,whetherafinishedproductorintheprocessofbeingproduced,thatis
4manufacturedfordistribution,producedfordistribution,packagedfordistribution,
5processedfordistribution,preparedfordistribution,treatedfordistribution,
6transportedfordistribution,orheldfordistributioninthisstateforexportfromthis
7statebutthatisnotsoldordistributedinthisstate;
8 (2)"Safeharbormanufacturerorstoragefacility",afacilitythatmanufactures
9fordistribution,producesfordistribution,packagesfordistribution,processesfor
10distribution,preparesfordistribution,treatsfordistribution,transportsfor
11distribution,orholdsfordistributionasafeharborhempproduct.
12 2.Sections195.2550to195.2635shallnotapplytoany:
13 (1)Safeharborhempproduct;or
14 (2)Safeharbormanufacturerorstoragefacility.
195.2635.1.BeforeJuly1,2026,eachschooldistrictinthisstateshalladoptand
2enforceawrittenpolicyprohibitingatalltimestheuseofanyhemp-derivedconsumable
3productbyanypersoninschoolbuildings,inschoolfacilities,onschoolcampuses,and
4inoronanyotherschoolpropertyownedoroperatedbytheschooldistrict.Thepolicy
5shallalsoprohibittheuseofanyhemp-derivedconsumableproductbypersons
6attendingaschool-sponsoredeventatalocationnotlistedinthissubsectionifinthe
7presenceofstudentsorschoolpersonnelorinanareawheresmokingorotheruseofa
8hemp-derivedconsumableproductisotherwiseprohibitedbylaw.
9 2.Notwithstandingtheprovisionsofsubsection1ofthissectionoranyother
10provisionofsections195.2550to195.2635tothecontrary,alicensedhealthcare
11professionalmayadministerahemp-derivedconsumableproducttoastudentata
12schoolunderthefollowingconditions:
13 (1)Thestudenthasarecommendationfromalicensedhealthcareprofessional
14specifyingthereasonfortheadministration,thesuggestedproduct,andthesuggested
15dosage;
HB393	20 16 (2)Theparentorlegalguardianofthestudenthasprovidedalettergiving
17expresspermissiontoadministertheproducttothestudentinaccordancewiththe
18recommendationofthelicensedhealthcareprofessional;
19 (3)Foreachhemp-derivedconsumableproducttobeadministered,thestudent's
20parentorlegalguardianhassubmittedavalidlyissuedcertificateofanalysisfroman
21independenttestinglaboratorywithtestingresultsthatmeettherequirementsofsection
22195.2570;and
23 (4)Foreachhemp-derivedconsumableproducttobeadministered,nomore
24thanathreemonths'supplyoftheproductisprovidedtotheschoolatanygiventime.
25 3.Anyhemp-derivedconsumableproductprovidedtoaschoolunderthis
26sectionshallbekeptinanareathatisinaccessibletootherstudents,teachers,staff,and
27administrators.
