27jurisdiction.
28 3.Thecommitteeshall:
29 (1)Withinsixmonthsofreceivinganapplicationdescribedinsubsection2of
30thissection,waiveanyexamination,educational,orexperiencerequirementsfor
31licensureinthisstatefortheapplicantifitdeterminesthattherewereminimum
32educationrequirementsand,ifapplicable,workexperienceandclinicalsupervision
33requirementsineffectandtheotherjurisdictionverifiesthatthepersonmetthose
34requirementsinordertobelicensedorcertifiedinthatjurisdiction.Thecommittee
35mayrequireanapplicanttotakeandpassanexaminationspecifictothelawsofthis
36state;or
37 (2)Withinthirtydaysofreceivinganapplicationdescribedinsubsection2of
38thissectionfromanonresidentmilitaryspouseoraresidentmilitaryspouse,waiveany
39examination,educational,orexperiencerequirementsforlicensureinthisstateforthe

45complaintpending,orwhoiscurrentlyunderdisciplinaryaction,exceptasprovidedin
46subdivision(2)ofthissubsection,withanoversightbodyoutsidethestate;whodoesnot
47holdalicenseingoodstandingwithanoversightbodyoutsidethestate;whohasa
48criminalrecordthatwoulddisqualifyhimorherforlicensureinMissouri;orwhodoes
49notholdavalidcurrentlicenseintheotherjurisdictiononthedatethecommittee
50receiveshisorherapplicationunderthissection.

324.218.1.Anapplicantwhohasnotpreviouslytakenorpassedanexamination
2recognizedbythecommitteeandwhomeetsthequalificationsofsubsection2ofsection
3324.210mayobtainwithoutexaminationanonrenewabletemporarylicensebypayinga
4temporary-licensefeeandsubmittingtothecommitteeanagreement-to-superviseform
5thatissignedbyalicenseddietitianwhohasagreedtosupervisetheapplicant.Such
6temporarylicenseemaypracticedietetics,butanysuchpracticeshallbeunderthe
7supervisionofadietitianlicensedinthisstate.
8 2.(1)Anydietitianwhohasagreedtosuperviseatemporarylicenseeshallhold
9anunencumberedlicensetopracticedieteticsinthisstateandshallprovidethe
10committeeproofofactivedieteticspracticeinthisstateforaminimumofoneyear
11beforesupervisingthetemporarylicensee.
12 (2)Thesupervisingdietitianshallnotbeanimmediatefamilymemberofthe
13temporarylicensee.Thecommitteeshalldefinetheterm"immediatefamilymember"
14forpurposesofthissubdivisionandthescopeofsuchsupervisionbyrule.
15 3.(1)Thedietitianwhohasagreedtosupervisetheapplicantforatemporary
16licenseshallsubmittothecommitteeasignedandnotarizedformprescribedbythe
17committeeattestingthattheapplicantforatemporarylicenseshallbeginemployment
18atalocationinthisstatewithinsevendaysofissuanceofthetemporarylicense.
19 (2)Ifthetemporarylicensee'semploymentdescribedinsubdivision(1)ofthis
20subsectionceases,thesupervisingdietitianshallnotifythecommitteewithinthreedays
21ofsuchcessation.
22 4.Alicenseddietitianshallnotsupervisemorethanonetemporarylicenseeata
23time.
24 5.Thetemporarylicenseobtainedbyanapplicantunderthissectionshallexpire
25thedatethecommitteeisnotifiedbythesupervisingdietitianthatthetemporary

324.1800.1.Sections324.1800to324.1865shallbeknownandmaybecitedas

3 2.ThepurposeofthisCompactistofacilitateinterstatePracticeofDietetics
4withthegoalofimprovingpublicaccesstodieteticsservices.ThisCompactpreserves
5theregulatoryauthorityofStatestoprotectpublichealthandsafetythroughthe
6currentsystemofStatelicensure,whilealsoprovidingforlicensureportabilitythrough
7aCompactPrivilegegrantedtoqualifyingprofessionals.
8 3.ThisCompactisdesignedtoachievethefollowingobjectives:
9 (1)Increasepublicaccesstodieteticsservices;
10 (2)ProvideopportunitiesforinterstatepracticebyLicensedDietitianswhomeet
11uniformrequirements;
12 (3)EliminatethenecessityforLicensesinmultipleStates;
13 (4)ReduceadministrativeburdenonMemberStatesandLicensees;
14 (5)EnhancetheStates'abilitytoprotectthepublic'shealthandsafety;
15 (6)EncouragethecooperationofMemberStatesinregulatingmultistate
16practiceofLicensedDietitians;
17 (7)SupportrelocatingActiveMilitaryMembersandtheirspouses;
18 (8)Enhancetheexchangeoflicensure,investigative,anddisciplinary
19informationamongMemberStates;and
20 (9)VestallMemberStateswiththeauthoritytoholdaLicensedDietitian
21accountableformeetingallStatepracticelawsintheStateinwhichthepatientis
22locatedatthetimecareisrendered.
324.1805.AsusedinthisCompact,andexceptasotherwiseprovided,the
2followingdefinitionsshallapply:
3 (1)"ACEND"meanstheAccreditationCouncilforEducationinNutritionand
4Dieteticsoritssuccessororganization.
5 (2)"ActiveMilitaryMember"meansanyindividualwithfull-timedutystatusin
6theactivearmedforcesoftheUnitedStates,includingmembersoftheNationalGuard
7andReserve.
8 (3)"AdverseAction"meansanyadministrative,civil,equitableorcriminal
9actionpermittedbyaState'slawswhichisimposedbyaLicensingAuthorityorother
10authorityagainstaLicensee,includingactionsagainstanindividual'sLicenseor
11CompactPrivilegesuchasrevocation,suspension,probation,monitoringofthe
12Licensee,limitationontheLicensee'spractice,oranyotherEncumbranceonlicensure

28 (9)"CompactPrivilege"meansalegalauthorization,whichisequivalenttoa
29License,permittingthePracticeofDieteticsinaRemoteState.
30 (10)"CurrentSignificantInvestigativeInformation"means:
31 (a)InvestigativeInformationthataLicensingAuthority,afterapreliminary
32inquirythatincludesnotificationandanopportunityforthesubjectLicenseeto
33respond,ifrequiredbyStatelaw,hasreasontobelieveisnotgroundlessand,ifproved
34true,wouldindicatemorethanaminorinfraction;or
35 (b)InvestigativeInformationthatindicatesthatthesubjectLicenseerepresents

5 2.AMemberStateshall:
6 (1)ParticipatefullyintheCompactCommission'sDataSystem,includingusing
7theuniqueidentifierasdefinedinRules;
8 (2)NotifytheCompactCommission,incompliancewiththetermsofthe
9CompactandRules,ofanyAdverseActionortheavailabilityofCurrentSignificant
10InvestigativeInformationregardingaLicensee;
11 (3)Implementorutilizeproceduresforconsideringthecriminalhistoryrecord
12informationofapplicantsforaninitialCompactPrivilege.Theseproceduresshall
13includethesubmissionoffingerprintsorotherbiometric-basedinformationby
14applicantsforthepurposeofobtaininganapplicant'scriminalhistoryrecord
15informationfromtheFederalBureauofInvestigationandtheagencyresponsiblefor
16retainingthatState'scriminalrecords;
17 (a)AMemberStatemustfullyimplementacriminalhistoryrecordinformation
18requirement,withinatimeframeestablishedbyRule,whichincludesreceivingthe
19resultsoftheFederalBureauofInvestigationrecordsearchandshallusethoseresults
20indeterminingCompactPrivilegeeligibility.

29renewaloflicensure,aswellasallotherapplicableStatelaws;and
30 (6)RecognizeaCompactPrivilegegrantedtoaLicenseewhomeetsallofthe

33 3.MemberStatesmaysetandcollectafeeforgrantingaCompactPrivilege.
34 4.IndividualsnotresidinginaMemberStateshallcontinuetobeabletoapply
35foraMemberState'sSingleStateLicenseasprovidedunderthelawsofeachMember
36State.However,theSingleStateLicensegrantedtotheseindividualsshallnotbe
37recognizedasgrantingaCompactPrivilegetoengageinthePracticeofDieteticsinany
38otherMemberState.
HB397	7 39 5.NothinginthisCompactshallaffecttherequirementsestablishedbya
40MemberStatefortheissuanceofaSingleStateLicense.
41 6.AtnopointshalltheCompactCommissionhavethepowertodefinethe
42requirementsfortheissuanceofaSingleStateLicensetopracticedietetics.The
43MemberStatesshallretainsolejurisdictionovertheprovisionoftheserequirements.
324.1815.1.ToexercisetheCompactPrivilegeunderthetermsandprovisions
2oftheCompact,theLicenseeshall:
3 (1)Satisfyoneofthefollowing:
4 (a)Holdavalidcurrentregistrationthatgivestheapplicanttherighttousethe
5termRegisteredDietitian;or
6 (b)Completeallofthefollowing:
7 a.Aneducationprogramwhichiseither:
8 (i)Amaster'sdegreeordoctoraldegreethatisprogrammaticallyaccreditedby:
9 i.ACEND;or
10 ii.AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof
11Education,whichtheCompactCommissionmaybyRuledetermine,andfromacollege
12oruniversityaccreditedatthetimeofgraduationbytheappropriateregional
13accreditingagencyrecognizedbytheCouncilonHigherEducationAccreditationand
14theUnitedStatesDepartmentofEducation.
15 (ii)Anacademicdegreefromacollegeoruniversityinaforeigncountry
16equivalenttothedegreedescribedinitem(i)thatisprogrammaticallyaccreditedby:
17 i.ACEND;or
18 ii.AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof
19Education,whichtheCompactCommissionmaybyRuledetermine.
20 b.Aplanned,documented,supervisedpracticeexperienceindieteticsthatis
21programmaticallyaccreditedby:
22 (i)ACEND;or
23 (ii)AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof
24EducationwhichtheCompactCommissionmaybyRuledetermineandwhichinvolves
25atleast1000hoursofpracticeexperienceunderthesupervisionofaRegisteredDietitian
26oraLicensedDietitian.
27 c.Successfulcompletionofeither:
28 (i)TheRegistrationExaminationforDietitiansadministeredbyCDR;or
29 (ii)AnationalcredentialingexaminationfordietitiansapprovedbytheCompact
30CommissionbyRule;suchcompletionbeingnomorethanfiveyearspriortothedateof
31theLicensee'sapplicationforinitiallicensureandaccompaniedbyaperiodof

33CompactCommission;
34 (2)HoldanUnencumberedLicenseintheHomeState;
35 (3)NotifytheCompactCommissionthattheLicenseeisseekingaCompact
36PrivilegewithinaRemoteStateorStates;
37 (4)Payanyapplicablefees,includinganyStatefee,fortheCompactPrivilege;
38 (5)MeetanyJurisprudenceRequirementsestablishedbytheRemoteStateor
39StatesinwhichtheLicenseeisseekingaCompactPrivilege;and
40 (6)ReporttotheCompactCommissionanyAdverseAction,Encumbrance,or

43 2.TheCompactPrivilegeisvaliduntiltheexpirationdateoftheHomeState
44License.TomaintainaCompactPrivilege,renewaloftheCompactPrivilegeshallbe
45congruentwiththerenewaloftheHomeStateLicenseastheCompactCommissionmay
46definebyRule.TheLicenseemustcomplywiththerequirementsofsubsection1ofthis
47sectiontomaintaintheCompactPrivilegeintheRemoteStateorStates.
48 3.ALicenseeexercisingaCompactPrivilegeshalladheretothelawsand
49regulationsoftheRemoteState.Licenseesshallberesponsibleforeducatingthemselves
50on,andcomplyingwith,anyandallStatelawsrelatingtothePracticeofDieteticsin
51suchRemoteState.
52 4.NotwithstandinganythingtothecontraryprovidedinthisCompactorState
53law,aLicenseeexercisingaCompactPrivilegeshallnotberequiredtocomplete
54ContinuingEducationRequirementsrequiredbyaRemoteState.ALicenseeexercising
55aCompactPrivilegeisonlyrequiredtomeetanyContinuingEducationRequirements
56asrequiredbytheHomeState.
324.1820.1.ALicenseemayholdaHomeStateLicense,whichallowsfora
2CompactPrivilegeinotherMemberStates,inonlyoneMemberStateatatime.
3 2.IfaLicenseechangesHomeStatebymovingbetweentwoMemberStates:
4 (1)TheLicenseeshallfileanapplicationforobtaininganewHomeStateLicense
5basedonaCompactPrivilege,payallapplicablefees,andnotifythecurrentandnew
6HomeStateinaccordancewiththeRulesoftheCompactCommission.
7 (2)UponreceiptofanapplicationforobtaininganewHomeStateLicenseby
8virtueofaCompactPrivilege,thenewHomeStateshallverifythattheLicenseemeets
9thecriteriainsection324.1815viatheDataSystem,andrequirethattheLicensee
10completethefollowing:
11 (a)FederalBureauofInvestigationfingerprintbasedcriminalhistoryrecord
12informationcheck;

16 (3)TheformerHomeStateshallconverttheformerHomeStateLicenseintoa

18inaccordancewithapplicableRulesadoptedbytheCompactCommission.
19 (4)NotwithstandinganyotherprovisionofthisCompact,iftheLicenseecannot
20meetthecriteriainsection324.1815,thenewHomeStatemayapplyitsrequirements
21forissuinganewSingleStateLicense.
22 (5)TheLicenseeshallpayallapplicablefeestothenewHomeStateinorderto
23beissuedanewHomeStateLicense.
24 3.IfaLicenseechangestheirStateofresidencebymovingfromaMemberState
25toanon-MemberState,orfromanon-MemberStatetoaMemberState,theState
26criteriashallapplyforissuanceofaSingleStateLicenseinthenewState.
27 4.NothinginthisCompactshallinterferewithaLicensee'sabilitytoholda
28SingleStateLicenseinmultipleStates;however,forthepurposesofthisCompact,a
29LicenseeshallhaveonlyoneHomeStateLicense.

7CompactCommissionislocated.TheCompactCommissionmaywaivevenueand
8jurisdictionaldefensestotheextentitadoptsorconsentstoparticipateinalternative
9disputeresolutionproceedings.Nothinghereinshallaffectorlimittheselectionor
10proprietyofvenueinanyactionagainstaLicenseeforprofessionalmalpractice,

20defaultingState.Thenoticeofdefaultshalldescribethedefault,theproposedmeansof
21curingthedefault,andanyotheractionthattheCompactCommissionmaytakeand

15subsection2ofsection324.1850,terminateaMemberState'sparticipationinthe
16Compact,ifitdeterminesthataconstitutionalrequirementofaMemberStateisa
17materialdeparturefromtheCompact.Otherwise,ifthisCompactshallbeheldtobe
18contrarytotheconstitutionofanyMemberState,theCompactshallremaininfullforce
19andeffectastotheremainingMemberStatesandinfullforceandeffectastothe
20MemberStateaffectedastoallseverablematters.
324.1865.1.Nothinghereinshallpreventorinhibittheenforcementofany
2otherlawofaMemberStatethatisnotinconsistentwiththeCompact.
3 2.Anylaws,statutes,regulations,orotherlegalrequirementsinaMemberState
