HB397 2 51 (2)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the 52committeeshalldetermineifthecausefortheactionwascorrectedandthematter 53resolved.Ifthematterhasnotbeenresolvedbythatjurisdiction,thecommitteemay 54denyalicenseuntilthematterisresolved. 55 5.Nothinginthissectionshallprohibitthecommitteefromdenyingalicenseto 56anapplicantunderthissectionforanyreasondescribedinsection324.217. 57 6.Anypersonwhoislicensedundertheprovisionsofthissectionshallbesubject 58tothecommittee'sjurisdictionandallrulesandregulationspertainingtothepracticeas 59adietitianinthisstate. 60 7.Thissectionshallnotbeconstruedtowaiveanyrequirementforanapplicant 61topayanyfees. 324.218.1.Anapplicantwhohasnotpreviouslytakenorpassedanexamination 2recognizedbythecommitteeandwhomeetsthequalificationsofsubsection2ofsection 3324.210mayobtainwithoutexaminationanonrenewabletemporarylicensebypayinga 4temporary-licensefeeandsubmittingtothecommitteeanagreement-to-superviseform 5thatissignedbyalicenseddietitianwhohasagreedtosupervisetheapplicant.Such 6temporarylicenseemaypracticedietetics,butanysuchpracticeshallbeunderthe 7supervisionofadietitianlicensedinthisstate. 8 2.(1)Anydietitianwhohasagreedtosuperviseatemporarylicenseeshallhold 9anunencumberedlicensetopracticedieteticsinthisstateandshallprovidethe 10committeeproofofactivedieteticspracticeinthisstateforaminimumofoneyear 11beforesupervisingthetemporarylicensee. 12 (2)Thesupervisingdietitianshallnotbeanimmediatefamilymemberofthe 13temporarylicensee.Thecommitteeshalldefinetheterm"immediatefamilymember" 14forpurposesofthissubdivisionandthescopeofsuchsupervisionbyrule. 15 3.(1)Thedietitianwhohasagreedtosupervisetheapplicantforatemporary 16licenseshallsubmittothecommitteeasignedandnotarizedformprescribedbythe 17committeeattestingthattheapplicantforatemporarylicenseshallbeginemployment 18atalocationinthisstatewithinsevendaysofissuanceofthetemporarylicense. 19 (2)Ifthetemporarylicensee'semploymentdescribedinsubdivision(1)ofthis 20subsectionceases,thesupervisingdietitianshallnotifythecommitteewithinthreedays 21ofsuchcessation. 22 4.Alicenseddietitianshallnotsupervisemorethanonetemporarylicenseeata 23time. 24 5.Thetemporarylicenseobtainedbyanapplicantunderthissectionshallexpire 25thedatethecommitteeisnotifiedbythesupervisingdietitianthatthetemporary HB397 3 26licensee'semploymenthasceasedorwithinonehundredeightydaysofitsissuance, 27whicheveroccursfirst. 324.1800.1.Sections324.1800to324.1865shallbeknownandmaybecitedas 2the"DietitianLicensureCompact". 3 2.ThepurposeofthisCompactistofacilitateinterstatePracticeofDietetics 4withthegoalofimprovingpublicaccesstodieteticsservices.ThisCompactpreserves 5theregulatoryauthorityofStatestoprotectpublichealthandsafetythroughthe 6currentsystemofStatelicensure,whilealsoprovidingforlicensureportabilitythrough 7aCompactPrivilegegrantedtoqualifyingprofessionals. 8 3.ThisCompactisdesignedtoachievethefollowingobjectives: 9 (1)Increasepublicaccesstodieteticsservices; 10 (2)ProvideopportunitiesforinterstatepracticebyLicensedDietitianswhomeet 11uniformrequirements; 12 (3)EliminatethenecessityforLicensesinmultipleStates; 13 (4)ReduceadministrativeburdenonMemberStatesandLicensees; 14 (5)EnhancetheStates'abilitytoprotectthepublic'shealthandsafety; 15 (6)EncouragethecooperationofMemberStatesinregulatingmultistate 16practiceofLicensedDietitians; 17 (7)SupportrelocatingActiveMilitaryMembersandtheirspouses; HB397 7 39 5.NothinginthisCompactshallaffecttherequirementsestablishedbya 40MemberStatefortheissuanceofaSingleStateLicense. 41 6.AtnopointshalltheCompactCommissionhavethepowertodefinethe 42requirementsfortheissuanceofaSingleStateLicensetopracticedietetics.The 43MemberStatesshallretainsolejurisdictionovertheprovisionoftheserequirements. 324.1815.1.ToexercisetheCompactPrivilegeunderthetermsandprovisions 2oftheCompact,theLicenseeshall: 3 (1)Satisfyoneofthefollowing: 4 (a)Holdavalidcurrentregistrationthatgivestheapplicanttherighttousethe 5termRegisteredDietitian;or 6 (b)Completeallofthefollowing: 7 a.Aneducationprogramwhichiseither: 8 (i)Amaster'sdegreeordoctoraldegreethatisprogrammaticallyaccreditedby: 9 i.ACEND;or 10 ii.AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof 11Education,whichtheCompactCommissionmaybyRuledetermine,andfromacollege 12oruniversityaccreditedatthetimeofgraduationbytheappropriateregional 13accreditingagencyrecognizedbytheCouncilonHigherEducationAccreditationand 14theUnitedStatesDepartmentofEducation. 15 (ii)Anacademicdegreefromacollegeoruniversityinaforeigncountry 16equivalenttothedegreedescribedinitem(i)thatisprogrammaticallyaccreditedby: 17 i.ACEND;or 18 ii.AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof 19Education,whichtheCompactCommissionmaybyRuledetermine. 20 b.Aplanned,documented,supervisedpracticeexperienceindieteticsthatis 21programmaticallyaccreditedby: 22 (i)ACEND;or 23 (ii)AdieteticsaccreditingagencyrecognizedbytheUnitedStatesDepartmentof 24EducationwhichtheCompactCommissionmaybyRuledetermineandwhichinvolves 25atleast1000hoursofpracticeexperienceunderthesupervisionofaRegisteredDietitian 26oraLicensedDietitian. 27 c.Successfulcompletionofeither: 28 (i)TheRegistrationExaminationforDietitiansadministeredbyCDR;or 29 (ii)AnationalcredentialingexaminationfordietitiansapprovedbytheCompact 30CommissionbyRule;suchcompletionbeingnomorethanfiveyearspriortothedateof 31theLicensee'sapplicationforinitiallicensureandaccompaniedbyaperiodof HB397 8 32continuouslicensurethereafter,allofwhichmaybefurthergovernedbytheRulesofthe 33CompactCommission; 34 (2)HoldanUnencumberedLicenseintheHomeState; 35 (3)NotifytheCompactCommissionthattheLicenseeisseekingaCompact 36PrivilegewithinaRemoteStateorStates; 37 (4)Payanyapplicablefees,includinganyStatefee,fortheCompactPrivilege; 38 (5)MeetanyJurisprudenceRequirementsestablishedbytheRemoteStateor 39StatesinwhichtheLicenseeisseekingaCompactPrivilege;and 40 (6)ReporttotheCompactCommissionanyAdverseAction,Encumbrance,or 41restrictiononaLicensetakenbyanynon-MemberStatewithin30daysfromthedate 42theactionistaken. 43 2.TheCompactPrivilegeisvaliduntiltheexpirationdateoftheHomeState 44License.TomaintainaCompactPrivilege,renewaloftheCompactPrivilegeshallbe 45congruentwiththerenewaloftheHomeStateLicenseastheCompactCommissionmay 46definebyRule.TheLicenseemustcomplywiththerequirementsofsubsection1ofthis 47sectiontomaintaintheCompactPrivilegeintheRemoteStateorStates. 48 3.ALicenseeexercisingaCompactPrivilegeshalladheretothelawsand 49regulationsoftheRemoteState.Licenseesshallberesponsibleforeducatingthemselves 50on,andcomplyingwith,anyandallStatelawsrelatingtothePracticeofDieteticsin 51suchRemoteState. 52 4.NotwithstandinganythingtothecontraryprovidedinthisCompactorState 53law,aLicenseeexercisingaCompactPrivilegeshallnotberequiredtocomplete 54ContinuingEducationRequirementsrequiredbyaRemoteState.ALicenseeexercising 55aCompactPrivilegeisonlyrequiredtomeetanyContinuingEducationRequirements 56asrequiredbytheHomeState. 324.1820.1.ALicenseemayholdaHomeStateLicense,whichallowsfora 2CompactPrivilegeinotherMemberStates,inonlyoneMemberStateatatime. 3 2.IfaLicenseechangesHomeStatebymovingbetweentwoMemberStates: 4 (1)TheLicenseeshallfileanapplicationforobtaininganewHomeStateLicense 5basedonaCompactPrivilege,payallapplicablefees,andnotifythecurrentandnew 6HomeStateinaccordancewiththeRulesoftheCompactCommission. 7 (2)UponreceiptofanapplicationforobtaininganewHomeStateLicenseby 8virtueofaCompactPrivilege,thenewHomeStateshallverifythattheLicenseemeets 9thecriteriainsection324.1815viatheDataSystem,andrequirethattheLicensee 10completethefollowing: 11 (a)FederalBureauofInvestigationfingerprintbasedcriminalhistoryrecord 12informationcheck; HB397 11 49 10.IfaMemberStatetakesAdverseAction,itshallpromptlynotifythe 50administratoroftheDataSystem.TheadministratoroftheDataSystemshallpromptly 51notifytheotherMemberStatesofanyAdverseActions. 52 11.NothinginthisCompactshalloverrideaMemberState'sdecisionthat 53participationinanAlternativeProgrammaybeusedinlieuofAdverseAction. 324.1835.1.TheCompactMemberStatesherebycreateandestablishajoint 2governmentagencywhosemembershipconsistsofallMemberStatesthathaveenacted 3theCompactknownastheDietitianLicensureCompactCommission.TheCompact 4CommissionisaninstrumentalityoftheCompactStatesactingjointlyandnotan 5instrumentalityofanyoneState.TheCompactCommissionshallcomeintoexistence 6onoraftertheeffectivedateoftheCompactassetforthinsection324.1855. 7 2.(1)EachMemberStateshallhaveandbelimitedtoone(1)delegateselected 8bythatMemberState'sLicensingAuthority. 9 (2)ThedelegateshallbetheprimaryadministratoroftheLicensingAuthority 10ortheirdesignee. 11 (3)TheCompactCommissionshallbyRuleorbylawestablishatermofoffice 12fordelegatesandmaybyRuleorbylawestablishtermlimits. 13 (4)TheCompactCommissionmayrecommendremovalorsuspensionofany 14delegatefromoffice. 15 (5)AMemberState'sLicensingAuthorityshallfillanyvacancyofitsdelegate 16occurringontheCompactCommissionwithin60daysofthevacancy. 17 (6)EachdelegateshallbeentitledtoonevoteonallmattersbeforetheCompact 18Commissionrequiringavotebythedelegates. 19 (7)Delegatesshallmeetandvotebysuchmeansassetforthinthebylaws.The 20bylawsmayprovidefordelegatestomeetandvotein-personorbytelecommunication, 21videoconference,orothermeansofcommunication. 22 (8)TheCompactCommissionshallmeetatleastonceduringeachcalendaryear. 23Additionalmeetingsmaybeheldassetforthinthebylaws.TheCompactCommission 24maymeetinpersonorbytelecommunication,videoconference,orothermeansof 25communication. 26 3.TheCompactCommissionshallhavethefollowingpowers: 27 (1)EstablishthefiscalyearoftheCompactCommission; 77 (b)RecommendtotheCompactCommissionchangestotheRulesorbylaws, 78changestothisCompactlegislation,feeschargedtoCompactMemberStates,fees 79chargedtoLicensees,andotherfees; 80 (c)EnsureCompactadministrationservicesareappropriatelyprovided, 81includingbycontract; 82 (d)Prepareandrecommendthebudget; 83 (e)MaintainfinancialrecordsonbehalfoftheCompactCommission; 84 (f)MonitorCompactcomplianceofMemberStatesandprovidecompliance 85reportstotheCompactCommission; 86 (g)Establishadditionalcommitteesasnecessary; 95 (b)FivevotingmembersfromthecurrentmembershipoftheCompact 96Commission,electedbytheCompactCommission; 97 (c)Oneex-officio,nonvotingmemberfromarecognizedprofessionalassociation 98representingdietitians;and 99 (d)Oneex-officio,nonvotingmemberfromarecognizednationalcredentialing 100organizationfordietitians. 101 (3)TheCompactCommissionmayremoveanymemberoftheExecutive 102CommitteeasprovidedintheCompactCommission'sbylaws. 103 (4)(a)TheExecutiveCommitteeshallmeetatleastannually. 15 (5)Anydenialofapplicationforlicensure,andthereasonorreasonsforsuch 16denial; 17 (6)ThepresenceofCurrentSignificantInvestigativeInformation;and 18 (7)OtherinformationthatmayfacilitatetheadministrationofthisCompactor 19theprotectionofthepublic,asdeterminedbytheRulesoftheCompactCommission. 20 4.TherecordsandinformationprovidedtoaMemberStatepursuanttothis 21CompactorthroughtheDataSystem,whencertifiedbytheCompactCommissionoran 22agentthereof,shallconstitutetheauthenticatedbusinessrecordsoftheCompact 23Commission,andshallbeentitledtoanyassociatedhearsayexceptioninanyrelevant 24judicial,quasi-judicial,oradministrativeproceedingsinaMemberState. 25 5.CurrentSignificantInvestigativeInformationpertainingtoaLicenseeinany 26MemberStatewillonlybeavailabletootherMemberStates. 27 6.ItistheresponsibilityoftheMemberStatestoreportanyAdverseAction 28againstaLicenseeandtomonitortheDataSystemtodeterminewhetheranyAdverse HB397 18 29ActionhasbeentakenagainstaLicensee.AdverseActioninformationpertainingtoa 30LicenseeinanyMemberStatewillbeavailabletoanyotherMemberState. 31 7.MemberStatescontributinginformationtotheDataSystemmaydesignate 32informationthatmaynotbesharedwiththepublicwithouttheexpresspermissionof 33thecontributingState. 34 8.AnyinformationsubmittedtotheDataSystemthatissubsequentlyexpunged 35pursuanttofederallaworthelawsoftheMemberStatecontributingtheinformation 36shallberemovedfromtheDataSystem. 324.1845.1.TheCompactCommissionshallpromulgatereasonableRulesin 2ordertoeffectivelyandefficientlyimplementandadministerthepurposesand 3provisionsoftheCompact.ARuleshallbeinvalidandhavenoforceoreffectonlyifa 4courtofcompetentjurisdictionholdsthattheRuleisinvalidbecausetheCompact 5Commissionexerciseditsrulemakingauthorityinamannerthatisbeyondthescope 6andpurposesoftheCompact,orthepowersgrantedhereunder,orbaseduponanother 7applicablestandardofreview. 8 2.TheRulesoftheCompactCommissionshallhavetheforceoflawineach 9MemberState,providedhoweverthatwheretheRulesconflictwiththelawsor 10regulationsofaMemberStatethatrelatetotheprocedures,actions,andprocessesa 11LicensedDietitianispermittedtoundertakeinthatStateandthecircumstancesunder 12whichtheymaydoso,asheldbyacourtofcompetentjurisdiction,theRulesofthe 13CompactCommissionshallbeineffectiveinthatStatetotheextentoftheconflict. 14 3.TheCompactCommissionshallexerciseitsrulemakingpowerspursuantto 15thecriteriasetforthinthisSectionandtheRulesadoptedthereunder.Rulesshall 16becomebindingonthedayfollowingadoptionorasofthedatespecifiedintheRuleor 17amendment,whicheverislater. 18 4.IfamajorityofthelegislaturesoftheMemberStatesrejectsaRuleorportion 19ofaRule,byenactmentofastatuteorresolutioninthesamemannerusedtoadoptthe 20Compactwithinfour(4)yearsofthedateofadoptionoftheRule,thensuchRuleshall 21havenofurtherforceandeffectinanyMemberState. 22 5.RulesshallbeadoptedataregularorspecialmeetingoftheCompact 23Commission. 24 6.PriortoadoptionofaproposedRule,theCompactCommissionshallholda 25publichearingandallowpersonstoprovideoralandwrittencomments,data,facts, 26opinions,andarguments. 27 7.PriortoadoptionofaproposedRulebytheCompactCommission,andat 28leastthirty(30)daysinadvanceofthemeetingatwhichtheCompactCommissionwill HB397 19 29holdapublichearingontheproposedRule,theCompactCommissionshallprovidea 30NoticeofProposedrulemaking: 31 (1)OnthewebsiteoftheCompactCommissionorotherpubliclyaccessible 32platform; HB397 20 66 12.Upondeterminationthatanemergencyexists,theCompactCommission 67mayconsiderandadoptanemergencyRulewith24hours'notice,withopportunityto 68comment,providedthattheusualrulemakingproceduresprovidedintheCompactand 69inthisSectionshallberetroactivelyappliedtotheRuleassoonasreasonablypossible, 70innoeventlaterthanninety(90)daysaftertheeffectivedateoftheRule.Forthe 71purposesofthisprovision,anemergencyRuleisonethatmustbeadoptedimmediately 72inorderto: 73 (1)Meetanimminentthreattopublichealth,safety,orwelfare; 74 (2)PreventalossofCompactCommissionorMemberStatefunds; 75 (3)MeetadeadlineforthepromulgationofaRulethatisestablishedbyfederal 76laworrule;or 77 (4)Protectpublichealthandsafety. 78 13.TheCompactCommissionoranauthorizedcommitteeoftheCompact 79CommissionmaydirectrevisiontoapreviouslyadoptedRuleforpurposesofcorrecting 80typographicalerrors,errorsinformat,errorsinconsistency,orgrammaticalerrors. 81PublicnoticeofanyrevisionshallbepostedonthewebsiteoftheCompactCommission. 82Therevisionshallbesubjecttochallengebyanypersonforaperiodofthirty(30)days 83afterposting.Therevisionmaybechallengedonlyongroundsthattherevisionresults 84inamaterialchangetoaRule.Achallengeshallbemadeinwritinganddeliveredtothe 85CompactCommissionpriortotheendofthenoticeperiod.Ifnochallengeismade,the 86revisionwilltakeeffectwithoutfurtheraction.Iftherevisionischallenged,therevision 87maynottakeeffectwithouttheapprovaloftheCompactCommission. 88 14.NoMemberState'srulemakingrequirementsshallapplyunderthis 89Compact. 324.1850.1.(1)TheexecutiveandjudicialbranchesofStategovernmentin 2eachMemberStateshallenforcethisCompactandtakeallactionsnecessaryand 3appropriatetoimplementthisCompact. 4 (2)ExceptasotherwiseprovidedinthisCompact,venueisproperandjudicial 5proceedingsbyoragainsttheCompactCommissionshallbebroughtsolelyand 6exclusivelyinacourtofcompetentjurisdictionwheretheprincipalofficeofthe 7CompactCommissionislocated.TheCompactCommissionmaywaivevenueand 8jurisdictionaldefensestotheextentitadoptsorconsentstoparticipateinalternative 9disputeresolutionproceedings.Nothinghereinshallaffectorlimittheselectionor 10proprietyofvenueinanyactionagainstaLicenseeforprofessionalmalpractice, 11misconduct,oranysuchsimilarmatter. 12 (3)TheCompactCommissionshallbeentitledtoreceiveserviceofprocessin 13anyproceedingregardingtheenforcementorinterpretationoftheCompactandshall HB397 21 14havestandingtointerveneinsuchaproceedingforallpurposes.Failuretoprovidethe 15CompactCommissionserviceofprocessshallrenderajudgmentorordervoidastothe 16CompactCommission,thisCompact,orpromulgatedRules. 17 2.(1)IftheCompactCommissiondeterminesthataMemberStatehas 18defaultedintheperformanceofitsobligationsorresponsibilitiesunderthisCompactor 19thepromulgatedRules,theCompactCommissionshallprovidewrittennoticetothe 20defaultingState.Thenoticeofdefaultshalldescribethedefault,theproposedmeansof 21curingthedefault,andanyotheractionthattheCompactCommissionmaytakeand 22shalloffertrainingandspecifictechnicalassistanceregardingthedefault. 23 (2)TheCompactCommissionshallprovideacopyofthenoticeofdefaulttothe 24otherMemberStates. 25 3.IfaStateindefaultfailstocurethedefault,thedefaultingStatemaybe 26terminatedfromtheCompactuponanaffirmativevoteofamajorityofthedelegatesof 27theMemberStates,andallrights,privileges,andbenefitsconferredonthatStateby 28thisCompactmaybeterminatedontheeffectivedateoftermination.Acureofthe 29defaultdoesnotrelievetheoffendingStateofobligationsorliabilitiesincurredduring 30theperiodofdefault. 31 4.TerminationofmembershipintheCompactshallbeimposedonlyafterall 32othermeansofsecuringcompliancehavebeenexhausted.Noticeofintenttosuspendor 33terminateshallbegivenbytheCompactCommissiontothegovernor,themajorityand 34minorityleadersofthedefaultingState'slegislature,thedefaultingState'sLicensing 35Authority,andeachoftheMemberStates'LicensingAuthority. 36 5.AStatethathasbeenterminatedisresponsibleforallassessments, 37obligations,andliabilitiesincurredthroughtheeffectivedateoftermination,including 38obligationsthatextendbeyondtheeffectivedateoftermination. 39 6.UpontheterminationofaState'smembershipfromthisCompact,thatState 40shallimmediatelyprovidenoticetoallLicenseeswithinthatStateofsuchtermination. 41TheterminatedStateshallcontinuetorecognizeallCompactPrivilegesgranted 42pursuanttothisCompactforaminimumofsixmonthsafterthedateofsaidnoticeof 43termination. 44 7.TheCompactCommissionshallnotbearanycostsrelatedtoaStatethatis 45foundtobeindefaultorthathasbeenterminatedfromtheCompact,unlessagreed 46uponinwritingbetweentheCompactCommissionandthedefaultingState. 47 8.ThedefaultingStatemayappealtheactionoftheCompactCommissionby 48petitioningtheU.S.DistrictCourtfortheDistrictofColumbiaorthefederaldistrict 49wheretheCompactCommissionhasitsprincipaloffices.Theprevailingpartyshallbe 50awardedallcostsofsuchlitigation,includingreasonableattorney'sfees. HB397 22 51 9.(1)UponrequestbyaMemberState,theCompactCommissionshallattempt 52toresolvedisputesrelatedtotheCompactthatariseamongMemberStatesandbetween 53Memberandnon-MemberStates. 54 (2)TheCompactCommissionshallpromulgateaRuleprovidingforboth 55mediationandbindingdisputeresolutionfordisputesasappropriate. 56 10.(1)Bysupermajorityvote,theCompactCommissionmayinitiatelegal 57actionagainstaMemberStateindefaultintheUnitedStatesDistrictCourtforthe 58DistrictofColumbiaorthefederaldistrictwheretheCompactCommissionhasits 59principalofficestoenforcecompliancewiththeprovisionsoftheCompactandits 60promulgatedRules.Thereliefsoughtmayincludebothinjunctivereliefanddamages. 61Intheeventjudicialenforcementisnecessary,theprevailingpartyshallbeawardedall 62costsofsuchlitigation,includingreasonableattorney'sfees.Theremedieshereinshall 63notbetheexclusiveremediesoftheCompactCommission.TheCompactCommission 64maypursueanyotherremediesavailableunderfederalorthedefaultingMember 65State'slaw. 66 (2)AMemberStatemayinitiatelegalactionagainsttheCompactCommission 67intheU.S.DistrictCourtfortheDistrictofColumbiaorthefederaldistrictwherethe 68CompactCommissionhasitsprincipalofficestoenforcecompliancewiththeprovisions 69oftheCompactanditspromulgatedRules.Thereliefsoughtmayincludeboth 70injunctivereliefanddamages.Intheeventjudicialenforcementisnecessary,the 71prevailingpartyshallbeawardedallcostsofsuchlitigation,includingreasonable 72attorney'sfees. 73 (3)NopartyotherthanaMemberStateshallenforcethisCompactagainstthe 74CompactCommission. 324.1855.1.(1)TheCompactshallcomeintoeffectonthedateonwhichthe 2CompactstatuteisenactedintolawintheseventhMemberState. 3 (2)(a)OnoraftertheeffectivedateoftheCompact,theCompactCommission 4shallconveneandreviewtheenactmentofeachofthefirstsevenMemberStates 5("CharterMemberStates")todetermineifthestatuteenactedbyeachsuchCharter 6MemberStateismateriallydifferentthanthemodelCompactstatute. 7 (b)ACharterMemberStatewhoseenactmentisfoundtobemateriallydifferent 8fromthemodelCompactstatuteshallbeentitledtothedefaultprocesssetforthin 9section324.1850. 10 (c)IfanyMemberStateislaterfoundtobeindefault,oristerminated,or 11withdrawsfromtheCompact,theCompactCommissionshallremaininexistenceand 12theCompactshallremainineffectevenifthenumberofMemberStatesshouldbeless 13thanseven. HB397 23 14 (3)MemberStatesenactingtheCompactsubsequenttotheseveninitialCharter 15MemberStatesshallbesubjecttotheprocesssetforthinsubdivision(21)ofsubsection 163ofsection324.1835todetermineiftheirenactmentsaremateriallydifferentfromthe 17modelCompactstatuteandwhethertheyqualifyforparticipationintheCompact. 18 (4)AllactionstakenforthebenefitoftheCompactCommissionorin 19furtheranceofthepurposesoftheadministrationoftheCompactpriortotheeffective 20dateoftheCompactortheCompactCommissioncomingintoexistenceshallbe 21consideredtobeactionsoftheCompactCommissionunlessspecificallyrepudiatedby 22theCompactCommission. 23 (5)AnyStatethatjoinstheCompactsubsequenttotheCompactCommission's 24initialadoptionoftheRulesandbylawsshallbesubjecttotheRulesandbylawsasthey 25existonthedateonwhichtheCompactbecomeslawinthatState.AnyRulethathas 26beenpreviouslyadoptedbytheCompactCommissionshallhavethefullforceandeffect 27oflawonthedaytheCompactbecomeslawinthatState. 28 2.(1)AnyMemberStatemaywithdrawfromthisCompactbyenactinga 29statuterepealingthesame. 30 (2)AMemberState'swithdrawalshallnottakeeffectuntil180daysafter 31enactmentoftherepealingstatute. 32 (3)Withdrawalshallnotaffectthecontinuingrequirementofthewithdrawing 33State'sLicensingAuthoritytocomplywiththeinvestigativeandAdverseAction 34reportingrequirementsofthisCompactpriortotheeffectivedateofwithdrawal. 35 (4)UpontheenactmentofastatutewithdrawingfromthisCompact,aState 36shallimmediatelyprovidenoticeofsuchwithdrawaltoallLicenseeswithinthatState. 37Notwithstandinganysubsequentstatutoryenactmenttothecontrary,suchwithdrawing 38StateshallcontinuetorecognizeallCompactPrivilegesgrantedpursuanttothis 39Compactforaminimumof180daysafterthedateofsuchnoticeofwithdrawal. 40 3.NothingcontainedinthisCompactshallbeconstruedtoinvalidateorprevent 41anylicensureagreementorothercooperativearrangementbetweenaMemberState 42andanon-MemberStatethatdoesnotconflictwiththeprovisionsofthisCompact. 43 4.ThisCompactmaybeamendedbytheMemberStates.Noamendmenttothis 44CompactshallbecomeeffectiveandbindinguponanyMemberStateuntilitisenacted 45intothelawsofallMemberStates. 324.1860.1.ThisCompactandtheCompactCommission'srulemaking 2authorityshallbeliberallyconstruedsoastoeffectuatethepurposesandthe 3implementationandadministrationoftheCompact.ProvisionsoftheCompact 4expresslyauthorizingorrequiringthepromulgationofRulesshallnotbeconstruedto 5limittheCompactCommission'srulemakingauthoritysolelyforthosepurposes. HB397 24 6 2.TheprovisionsofthisCompactshallbeseverableandifanyphrase,clause, 7sentence,orprovisionofthisCompactisheldbyacourtofcompetentjurisdictiontobe 8contrarytotheconstitutionofanyMemberState,aStateseekingparticipationinthe 9Compact,oroftheUnitedStates,ortheapplicabilitythereoftoanygovernment, 10agency,person,orcircumstanceisheldtobeunconstitutionalbyacourtofcompetent 11jurisdiction,thevalidityoftheremainderofthisCompactandtheapplicabilitythereof 12toanyothergovernment,agency,person,orcircumstanceshallnotbeaffectedthereby. 13 3.Notwithstandingsubsection2ofthissection,theCompactCommissionmay 14denyaState'sparticipationintheCompactor,inaccordancewiththerequirementsof 15subsection2ofsection324.1850,terminateaMemberState'sparticipationinthe 16Compact,ifitdeterminesthataconstitutionalrequirementofaMemberStateisa 17materialdeparturefromtheCompact.Otherwise,ifthisCompactshallbeheldtobe 18contrarytotheconstitutionofanyMemberState,theCompactshallremaininfullforce 19andeffectastotheremainingMemberStatesandinfullforceandeffectastothe 20MemberStateaffectedastoallseverablematters. 324.1865.1.Nothinghereinshallpreventorinhibittheenforcementofany 2otherlawofaMemberStatethatisnotinconsistentwiththeCompact. 3 2.Anylaws,statutes,regulations,orotherlegalrequirementsinaMemberState 4inconflictwiththeCompactaresupersededtotheextentoftheconflict. 5 3.AllpermissibleagreementsbetweentheCompactCommissionandthe 6MemberStatesarebindinginaccordancewiththeirterms. ✔ HB397 25
