HB403--EMPLOYEESTERMINATEDINCERTAINLAYOFFS SPONSOR: Clemens Thisbillrequiresanemployer,asdefinedinthebill,who operatesanestablishment,asdefinedinthebill,thatissubject toatransferofoperationsorterminationofoperations,during anycontinuousperiodofnomorethan30days,thatresultsina terminationof50ormoreemployees,oramasslayoff,toprovide: (1)Inthecaseofanemployerwhoemploys100ormoreemployees, atleast90daysortheperiodoftimerequiredunderfederallaw, whicheverislonger,noticeoftheterminationorlayoffas specifiedinthebill; (2)Toeachemployee,whowasterminated,severancepayequalto oneweekpayforeachfullyearofemployment. Iftheemployerdoesnotprovideanemployeesufficientnoticeof terminationorlayoff,thentheemployerisrequiredtopaythe employeeanadditionalfourweeksofpay.Thebillsetsoutthe calculationoftherateofseverance. Nowaiveroftherighttoseveranceprovidedforunderthisbill willbeeffectivewithouttheapprovaloftheDirectorofthe DepartmentofLaborandIndustrialRelationsoracourt.
