11threatofretaliationforreportingofsuchacts.Bullyingofstudentsisprohibitedonschool 12property,atanyschoolfunction,oronaschoolbus[.]; 13 (3)"Crime",anyofthecrimeslistedinsection160.261; 14 (4)"Cyberbullying"[means], bullyingasdefinedinthissubsectionthroughthe 15transmissionofacommunicationincluding,butnotlimitedto,amessage,text,sound,or 16imagebymeansofanelectronicdeviceincluding,butnotlimitedto,atelephone,wireless 17telephone,orotherwirelesscommunicationdevice,computer,orpager. 18 3.Eachschooldistrict'sandcharterschool'santibullyingpolicyshallbefoundedon 19theassumptionthatallstudentsneedasafelearningenvironment.Policiesshalltreatall 20studentsequallyandshallnotcontainspecificlistsofprotectedclassesofstudentswhoareto 21receivespecialtreatment.Policiesmayincludeage-appropriatedifferencesforschoolsbased 22onthegradelevelsattheschool.Eachsuchpolicyshallcontainastatementofthe 23consequencesofbullying. 24 4.Eachschooldistrict'sandcharterschool'santibullyingpolicyshallbeincludedin 25thestudenthandbookandshallrequire,ataminimum,thefollowingcomponents: 26 (1)Astatementprohibitingbullying,definednolessinclusivelythaninsubsection2 27ofthissection; 28 (2)Astatementrequiringschooldistrictorcharterschoolemployeestoreportany 29instanceofbullyingofwhichtheemployeehasfirsthandknowledge.Thepolicyshallrequire 30aschooldistrictorcharterschoolemployeewhowitnessesanincidentofbullyingtoreport 31theincidenttotheschooldistrict'sorcharterschool'sdesignatedindividualattheschool 32within[two]oneschool[days] dayoftheemployeewitnessingtheincident; 33 (3)Astatementrelatingtopupilswhoengageinself-defensethattheschool 34districtorcharterschooladministration,whendeterminingdisciplinaryactionfora 5.Notwithstandinganyotherprovisionoflawtothecontrary,anyschooldistrictor 100charterschoolshallhavejurisdictiontoprohibitcyberbullyingthatoriginatesonaschool's 101campusoratadistrictactivityiftheelectroniccommunicationwasmadeusingtheschool's 102technologicalresources,ifthereisasufficientnexustotheeducationalenvironment,orifthe 103electroniccommunicationwasmadeontheschool'scampusorataschooldistrictorcharter 104schoolactivityusingthestudent'sownpersonaltechnologicalresources.Theschooldistrict 105orcharterschoolmaydisciplineanystudentforsuchcyberbullyingtothegreatestextent 106allowedbylaw. 107 6.Eachschooldistrictandcharterschoolshallreviewitsantibullyingpolicyand 108reviseitasneeded.Theschooldistrict'sschoolboardorcharterschool'sgoverningboard 109shallreceiveinputfromschoolpersonnel,students,andadministratorswhenreviewingand 110revisingthepolicy. 111 7.(1)Theadministrationofeachschooldistrictandcharterschoolshallreport 112totheschoolboardorgoverningboardallactsofbullying,actsofschoolviolenceor 113violentbehavior,andcrimesthatoccurredinbetweenboardmeetingsandthediscipline 114ofanypupilwhocommittedsuchacts.Suchreportshallbesubmittedmonthlyand HCSHBs408,306&854 9 18 4.Eachlocaleducationalagencyshallprovidepromptnotificationtoparentsof 19anyseriousdisciplinaryincidentsinvolvingtheirchildandshallofferameetingor 20conferencetodiscussthebehaviorandoutlinestepsforcorrectionandimprovement. 21 5.(1)Eachlocaleducationalagencyshalladoptreasonableproceduresfor 22parentstofollowwhenvisitingtheirminorchildduringschoolhours. 23 (2)Eachlocaleducationalagencyshalladoptreasonableproceduresforparents 24tofollow: 25 (a)Duringanemergencyinwhichthesafetyofthestudentsrequires: 26 a.Alockdowntolimitexposureofbuildingoccupantstoanimminenthazardor 27threat;or 28 b.Alockouttopreventanoutsidehazardorthreatfromenteringthebuilding; 29or 30 (b)Whensuchlocaleducationalagencyisrequiredtoprohibitanindividual 31fromhavinganyinteractionwithaminorchildduetoanorderenteredunderany 32provisionofstateorfederallawrestrictingorprohibitingsuchindividualfrom 33interactingwithsuchminorchildortheLEAhasotherwiseprohibitedtheindividual 34fromaccessingschoolpropertyorevents. 35 6.(1)Teachers,schooladministrators,parents,andstudentsshallbefully 36informedoftherightsconferreduponparentsandteachersundersections160.1052to 37160.1055.EachLEAshallprovideaphysicalorelectroniccopyofsections160.1052to 38160.1055toeachparent,teacher,andstudentatthebeginningofeachschoolyear. 39 (2)Eachlocaleducationalagencyshallposttherightslistedinsections160.1052 40to160.1055onsuchLEA'swebsiteorprovideaprintedcopyifnowebsiteexists. 41 7.(1)Eachlocaleducationalagencyshalladopt,enforce,publiclypost,and 42annuallyreviewacodeofstudentconductasdescribedinsections160.1052to160.1055. 43 (2)Suchcodeofconductshallpromotesafe,respectful,andorderlylearning 44environmentsbyreinforcingteacherauthorityinmaintainingclassroomdisciplineand 45enhancingparentalinvolvementinstudentbehavioralissuesandshallsetforth 46expectationsforbehaviorconsistentwithethicalresponsibility,communitystandards, 47andregardforschoolauthority. 48 (3)Eachlocaleducationalagencyshalladoptsuchcodeofstudentconductfor 49the2026-27schoolyearandallsubsequentschoolyears. 50 (4)Thestatedepartmentofelementaryandsecondaryeducationmayoffer 51guidanceandtechnicalassistancetolocaleducationalagenciestoensurecompliance. 52ThedepartmentshallnotimposeundueburdensormandatesonsuchLEAs. 53 8.Thecodeofstudentconductrequiredundersubsection7ofthissectionshall: HCSHBs408,306&854 10 54 (1)Reinforcerespectforteachers,administrators,andstaff,emphasizingthat 55willfuldisobedienceordisregardtowardschoolpersonnelisnottolerated; 56 (2)Promotehighexpectationsofpersonalresponsibility,encouragingstudentsto 57upholdvaluessuchashonesty,diligence,andcivility; 58 (3)Includemeasurestoaddressandcorrectdisruptivebehaviorpromptly, 59ensuringthatteachershavethenecessaryauthorityandsupporttoremovestudents 60fromclassroomswhenwarranted,inaccordancewithtrainingprovidedbytheLEA; 61 (4)Outlineasystemofgraduatedconsequencesformisconduct,balancedby 62opportunitiesforstudentstodeveloppersonalresilienceandreflectontheiractions 63throughLEA-approvedinterventions; 64 (5)Requireparentalnotificationandinvolvementinsignificantdisciplinary 65actions,ensuringthatparentshavetimelyinformationandopportunitiestoengagewith 66teachersandadministrators;and 67 (6)Clearlyprohibitanypolicyorprogramthatdifferentiatestreatmentof 68studentsprimarilyonthebasisofracealone,ensuringthatalldisciplinarymeasuresare 69appliedequallyandfairlytoeverystudent. 70 9.(1)Alocaleducationalagencymay,atsuchLEA'sdiscretionandwiththe 71LEA'sgoverningboard'sapproval,incorporateevidence-basedtrainingforteachers 72andcounselorsonstrategiestoguidestudentstowardpersonalresilience. 73 (2)Suchstrategiesmayinclude: 74 (a)Encouragingpersonalresponsibilityandself-management; 75 (b)Providingstudentswithopportunitiestodevelopcopingskills,conflict 76resolutiontechniques,andappropriateresponsestoauthority;and 77 (c)Usingschoolcounselorsorotherqualifiedpersonneltooffersupportive 78interventionsthatemphasizerespectforselfandothers,problemsolving,and 79perseverance. 80 (3)Thecontentandmethodofdeliveringsuchstrategiesshallnotreferenceor 81requireanytrainingorcurriculumprimarilyfocusedonrace,gender,orothersimilar 82classifications.Suchstrategiesshallemphasizeuniversalcommunitystandardsthat 83benefitallstudentsequally. 84 10.Eachlocaleducationalagencyshallensurethatteachersandstaffaretrained 85inmethodstomaintainorder,encouragecompliance,fostercivility,andencourage 86personalresponsibility. 87 11.Eachlocaleducationalagencyshallmakeeffortstofacilitateparental 88engagementthroughregularcommunication,opportunitiesforparentstoreviewand 89understandthepolicyhandbook,andtheprovisionofresourcesthatsupportethical 90responsibilityandcommunitystandardsathome.
