3 (1)"Actofschoolviolence"or"violentbehavior",thesamemeaningasin
4section160.261;
5 (2)"Bullying"[means], intimidation,unwantedaggressivebehavior,orharassment
6thatisrepetitiveorissubstantiallylikelytoberepeatedandcausesareasonablestudentto
7fearforhisorherphysicalsafetyorproperty;substantiallyinterfereswiththeeducational
8performance,opportunities,orbenefitsofanystudentwithoutexception;orsubstantially
9disruptstheorderlyoperationoftheschool.Bullyingmayconsistofphysicalactions,

11threatofretaliationforreportingofsuchacts.Bullyingofstudentsisprohibitedonschool

14 (4)"Cyberbullying"[means], bullyingasdefinedinthissubsectionthroughthe
15transmissionofacommunicationincluding,butnotlimitedto,amessage,text,sound,or
16imagebymeansofanelectronicdeviceincluding,butnotlimitedto,atelephone,wireless
17telephone,orotherwirelesscommunicationdevice,computer,orpager.
18 3.Eachschooldistrict'sandcharterschool'santibullyingpolicyshallbefoundedon
19theassumptionthatallstudentsneedasafelearningenvironment.Policiesshalltreatall
20studentsequallyandshallnotcontainspecificlistsofprotectedclassesofstudentswhoareto
21receivespecialtreatment.Policiesmayincludeage-appropriatedifferencesforschoolsbased
22onthegradelevelsattheschool.Eachsuchpolicyshallcontainastatementofthe
23consequencesofbullying.
24 4.Eachschooldistrict'sandcharterschool'santibullyingpolicyshallbeincludedin
25thestudenthandbookandshallrequire,ataminimum,thefollowingcomponents:
26 (1)Astatementprohibitingbullying,definednolessinclusivelythaninsubsection2
27ofthissection;
28 (2)Astatementrequiringschooldistrictorcharterschoolemployeestoreportany
29instanceofbullyingofwhichtheemployeehasfirsthandknowledge.Thepolicyshallrequire
30aschooldistrictorcharterschoolemployeewhowitnessesanincidentofbullyingtoreport
31theincidenttotheschooldistrict'sorcharterschool'sdesignatedindividualattheschool
32within[two]oneschool[days] dayoftheemployeewitnessingtheincident;
33 (3)Astatementrelatingtopupilswhoengageinself-defensethattheschool
34districtorcharterschooladministration,whendeterminingdisciplinaryactionfora
35pupilwhohascommittedanactofschoolviolenceorexhibitedviolentbehavior,will
36takeintoaccountifsuchactofschoolviolenceorviolentbehaviorwascommittedinself-
37defenseasanimmediateresponsetoanactofschoolviolenceorviolentbehavior
38committedagainstsuchpupil;
39 (4)Aprocedureforreportinganactofbullying.Thepolicyshallalsoincludea
40statementrequiringthattheschooldistrictorcharterschooldesignateanindividualateach
41schoolbuildinginthedistrictandcharterschooltoreceivereportsofincidentsofbullying.
42Suchindividualshallbeaschooldistrictorcharterschoolemployeewhoisteacherlevel
43stafforabove;
44 [(4)](5)Aprocedureforpromptinvestigationofreportsofviolationsandcomplaints,
45identifyingoneormoreemployeesresponsiblefortheinvestigationincluding,ataminimum,
46thefollowingrequirements:

51investigation;[and]
52 (c)Theinvestigationshallbecompletedwithintenschooldaysfromthedate[ofthe
53writtenreport] theinvestigationisinitiatedunderparagraph(a)ofthissubdivisionunless
54goodcauseexiststoextendtheinvestigation;and
55 (d)Awrittenreportshallbepreparedthatcontainstheresultsofthe
56investigationandanyresponseincluding,butnotlimitedto,adescriptionofany
57interventions,initiatives,techniques,ordisciplineprovidedtoallinvolvedindividualsof
58theincident.Theschooldistrictorcharterschoolmaydevelopastandardizedformto
59useforsuchwrittenreport;

85orretaliationagainstanypersonwhoreportsanactofbullying;
86 (d)Theadministrationoftheschooldistrictorcharterschoolshallinstructitsschool
87counselors,schoolsocialworkers,licensedsocialworkers,mentalhealthprofessionals,and
88schoolpsychologiststoeducatestudentswhoarevictimsofbullyingandstudents
89committingactsofbullyingontechniquesforstudentstoovercomebullying'snegative
90effects.Suchtechniquesshallinclude,butnotbelimitedto,cultivatingthestudent'sself-
91worthandself-esteem;teachingthestudenttodefendhimselforherselfassertivelyand
92effectively;helpingthestudentdevelopsocialskills;orencouragingthestudenttodevelopan
93internallocusofcontrol.Theprovisionsofthisparagraphshallnotbeconstruedtocontradict
94orlimitanyotherprovisionofthissection;and
95 (e)Theadministrationoftheschooldistrictorcharterschoolshallimplement
96programsandotherinitiativestoaddressbullying,torespondtosuchconductinamanner
97thatdoesnotstigmatizethevictim,andtomakeresourcesorreferralsavailabletovictimsof
98bullyingandstudentscommittingactsofbullying.
99 5.Notwithstandinganyotherprovisionoflawtothecontrary,anyschooldistrictor
100charterschoolshallhavejurisdictiontoprohibitcyberbullyingthatoriginatesonaschool's
101campusoratadistrictactivityiftheelectroniccommunicationwasmadeusingtheschool's
102technologicalresources,ifthereisasufficientnexustotheeducationalenvironment,orifthe
103electroniccommunicationwasmadeontheschool'scampusorataschooldistrictorcharter
104schoolactivityusingthestudent'sownpersonaltechnologicalresources.Theschooldistrict
105orcharterschoolmaydisciplineanystudentforsuchcyberbullyingtothegreatestextent
106allowedbylaw.
107 6.Eachschooldistrictandcharterschoolshallreviewitsantibullyingpolicyand
108reviseitasneeded.Theschooldistrict'sschoolboardorcharterschool'sgoverningboard
109shallreceiveinputfromschoolpersonnel,students,andadministratorswhenreviewingand
110revisingthepolicy.
111 7.(1)Theadministrationofeachschooldistrictandcharterschoolshallreport
112totheschoolboardorgoverningboardallactsofbullying,actsofschoolviolenceor
113violentbehavior,andcrimesthatoccurredinbetweenboardmeetingsandthediscipline
114ofanypupilwhocommittedsuchacts.Suchreportshallbesubmittedmonthlyand
