Toamendchapter1,RSMo,byaddingtheretoonenewsectionrelatingtotheanti-redflag
gunseizureact,withpenaltyprovisionsandanemergencyclause.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter1,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection1.486,toreadasfollows:
1.486.1.Thissectionshallbeknownandmaybecitedasthe"Anti-RedFlag
2GunSeizureAct".
3 2.Asusedinthissection,"redflaglaw"means:
4 (1)Anyguncontrollaw,order,ormeasurethatdirectsthetemporaryor
5permanentseizureofanyfirearm,firearmaccessory,orammunitionofanindividual
6withoutboth:
7 (a)Theadjudicationofacontestedcourtcasewheretheindividualwaspresent
8andhadtheopportunitytobeheard;and
9 (b)Afindingofprobablecausethattheindividualisengagedorhasengagedin
10criminalactivity;or
11 (2)Anyfederalstatute,federalrule,federalexecutiveorder,orfederaljudicial
12orderorfinding,oranystatestatute,staterule,stateexecutiveorder,orstatejudicial
13orderorfinding,that:
14 (a)ProhibitsaMissouricitizenfromowning,possessing,transporting,
15transferring,orreceivinganyfirearm,firearmaccessory,orammunitionunlessthe
16individualhasbeenconvictedofaviolentfelonycrimeorisotherwisedisqualifiedunder
17section455.050or571.070;or
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (b)Orderstheremovalorrequiresthesurrenderofanyfirearm,firearm
19accessory,orammunitionfromaMissouricitizenunlesstheindividualhasbeen
20convictedofaviolentfelonycrimeorisotherwisedisqualifiedundersection455.050or
21571.070.
22 3.Anyfederalorderofprotection,otherjudicialorderissuedbyafederalcourt,
23orfederalexecutiveorderthatisaredflaglaworotherwisedirectstheconfiscationof
24anyfirearm,firearmaccessory,orammunitionfromanylaw-abidingcitizenwithinthe
25bordersofthisstateshallnotbeenforcedinthisstatebyanystateagency,political
26subdivision,orstateorlocallawenforcementagency.
27 4.Nostateagency,politicalsubdivision,orstateorlocallawenforcementagency
28shallreceiveanyfederalmoneysforthepurposeofenforcinganyfederalstatute,federal
29rule,federalexecutiveorder,orfederaljudicialorderorfindings,orforthepurposeof
30enforcinganystatestatute,staterule,stateexecutiveorder,orstatejudicialorderor
31findings,thatwouldhavetheeffectofenforcingaredflaglawagainstaMissouricitizen.
32 5.Nostateentityoremployeethereof,politicalsubdivisionoremployeethereof,
33orotherentityorpersonshallhavetheauthoritytoenforceorattempttoenforceared
34flaglawregardlessoftheredflaglaw'soriginortheauthorityoftheissuingentity.This
35subsectionshallnotapplytoanyagentofthefederalgovernmentenforcingafederal
36laworfederalorder.
37 6.Nothinginthissectionshallbeconstruedtopreventafirearm,firearm
38accessory,orammunitionfrombeingseizedasevidencebylawenforcementinthe
39courseofacriminalinvestigation.
40 7.(1)Apoliticalsubdivisionorstateorlocallawenforcementagencythat
41employsalawenforcementofficerwhoknowinglyactstoviolatethissectionandenforce
42aredflaglawunderthecolorofanystateorfederalstatute,rule,executiveorder,or
43judicialorderorfindingshallbeliabletothepartyagainstwhomtheredflaglawwas
44enforcedinanactionatlaw,suitinequity,orotherproperproceedingforredressand
45shallbesubjecttoacivilpenaltyoffiftythousanddollarsperoccurrence.
46 (2)Anypersoninjuredunderthissectionshallhavestandingtopursueanaction
47forinjunctivereliefinthecircuitcourtofthecountyinwhichtheactionallegedly
48occurredorinthecircuitcourtofColeCounty.
49 (3)Thecourtshallholdahearingonanymotionforatemporaryrestraining
50orderorpreliminaryinjunctionwithinthirtydaysofserviceofapetitionforthesame.
51 (4)Inanactionbroughtunderthissectionbyapartyagainstwhomtheredflag
52lawwasenforced,acourtmayorderinjunctiveorotherequitablerelief,recoveryof
53damages,otherlegalremedies,andpaymentofreasonableattorney'sfees,costs,and
54expensesoftheparty.Thereliefandremediessetforthinthissectionshallnotbe
HB434	2 55deemedexclusiveandshallbeinadditiontoanyotherrelieforremediespermittedby
56law.Thecourtmayawardtheprevailingparty,ifnotthestateofMissouriorapolitical
57subdivisionthereof,reasonableattorney'sfeesandcosts.
58 (5)Sovereignimmunityshallnotbeanaffirmativedefensetoanyactionbrought
59underthissection.
SectionB.Becauseimmediateactionisnecessarytolimitanyoverreachofthe
2federalgovernment'spowerandtoprotectcitizens'rightstobeararms,theenactmentof
3section1.486ofsectionAofthisactisdeemednecessaryfortheimmediatepreservationof
4thepublichealth,welfare,peace,andsafety,andisherebydeclaredtobeanemergencyact
5withinthemeaningoftheconstitution,andtheenactmentofsection1.486ofsectionAofthis
6actshallbeinfullforceandeffectuponitspassageandapproval.
