Thisbillestablishesthe"Anti-RedFlagGunSeizureAct".
Forpurposesofthebill,"redflaglaw"isdefinedasanygun
controllaw,order,ormeasurethatdirectstheseizureofany
firearmofanindividualwithoutboththeadjudicationofa
contestedcourtcaseandafindingofprobablecausethatthe
individualisengagedorhasengagedincriminalactivity,orany
FederalorStaterule,statute,orjudicialorderthatprohibitsa
Missouricitizenfromowningorreceivinganyfirearm,oranyorder
ofremovalforthesurrenderofanyfirearm,unlesssuchcitizenis
convictedofaviolentfelonyorisotherwisedisqualifiedpursuant
toanorderofprotectionorunderSection571.070,RSMo.
Anyredflaglawthatdirectstheconfiscationofanyfirearmfrom
anylaw-abidingcitizenwithinMissouriwillbeconsideredan
infringementonthepeople'srighttokeepandbeararmsas
guaranteedbytheStateandFederalconstitutionsandcannotbe
enforcedwithinMissouri.
NoStateagency,politicalsubdivision,orStateorlocallaw
enforcementagencymayreceiveanyFederalfundsforthepurposeof
enforcinganyFederallaw,order,orjudicialfindingforthe
purposeofenforcinganyStatestatute,rule,order,orjudicial
findingthatwouldhavetheeffectofenforcingaredflaglaw
againstaMissouricitizen.
Noentityorperson,includingaStateentityoremployeethereof,
orpoliticalsubdivisionoremployeethereof,willhavethe
authoritytoenforceorattempttoenforcearedflaglaw
regardlessoftheredflaglaw'soriginortheauthorityofthe
issuingentity,exceptthatthisprohibitionwillnotapplytoany
agentoftheFederalgovernmentenforcingaFederallaworFederal
order.
ApoliticalsubdivisionorStateorlocallawenforcementagency
thatemploysalawenforcementofficerthatknowinglyviolatesthe
provisionsofthisbillwillbeliabletothepartyagainstwhoma
redflaglawwasenforcedandadditionallywillbesubjecttoa
civilpenaltyof$50,000peroccurrence. TheAttorneyGeneralwill
alsohavestandingtobringanactiontoenforcetheprovisionsof
thissection.
Inanyactionbroughtundertheprovisionsofthisbill,acourt
mayorderinjunctiveorotherequitablerelief,recoveryof
damages,otherlegalremedies,andpaymentofreasonableattorney's fees,costs,andexpensesoftheparty.Suchreliefwillnotbe
exclusiveandadditionalrelieforremediesmaybeawardedas
otherwisepermittedbylaw.
Thisbillcontainsanemergencyclause.
