SectionA.Chapter393,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection393.401,toreadasfollows:
393.401.1.Forpurposesofthissection,thefollowingtermsshallmean:
2 (1)"Dispatchablepowerresource",asourceofelectricitythatis,undernormal
3operatingconditions,availableforuseondemandandthatcanhaveitspoweroutput
4adjustedaccordingtomarketneeds,exceptduringroutinemaintenanceandrepair;
5 (2)"Electricalcorporation",thesameasdefinedinsection386.020,butshallnot
6includeanelectricalcorporationasdescribedinsubsection2ofsection393.110;
7 (3)"Existingelectricgeneratingpowerplant",athermalpowerplantofover
8onehundredmegawattsinnameplatecapacity,ageneratingunitatathermalpower
9plantwithanameplatecapacityofoveronehundredmegawatts,ortwoormore
10generatingunitsatathermalpowerplantwithacombinednameplatecapacityofover
11onehundredmegawatts;
12 (4)"Regionaltransmissionoperator",aregionaltransmissionorganization,
13independentsystemoperator,orequivalententityapprovedbytheFederalEnergy
14RegulatoryCommission,orsuccessoragency,thatexercisesfunctionalcontrolover
15electrictransmissionfacilitieslocatedwithinthisstate;
16 (5)"Reliableelectricgeneration",electricgenerationmeetingtheaccreditation
17requirementsprovidedforinthissection;

20adversedecisionofacourtorachangeinastateorfederallaworregulationwhich
21causestheclosureofanexistingelectricgeneratingplant.
22 2.PriortotheclosureofanexistingelectricgeneratingpowerplantinMissouri,
23iftheclosureoccursonorafterJanuary1,2026,andsubjecttosubsection3ofthis
24section,anelectricalcorporationregisteredanddoingbusinessinthisstateshallfirst
25certifytothepublicservicecommissionthatsuchutilitycompanyhassecuredand
26placedontheelectricgridanequalorgreateramountofreliableelectricgenerationas
27accreditedpowerresourcesbasedontheregionaltransmissionoperator’sresource
28accreditationforthereliableelectricgenerationtechnologyatissue.Todetermineifan
29equalorgreateramountofreliableelectricgenerationisbeingplacedontheelectric
30gridtoreplacetheexistingelectricgeneratingpowerplanttobeclosed,theelectrical
31corporationshallcomparetherelevantregionaltransmissionoperator’saverageofthe
32summerandwinteraccreditedcapacityforthegenerationtechnologyoftheexisting
33electricgeneratingpowerplanttobeclosedtotherelevantregionaltransmission
34operator’saverageofthesummerandwinteraccreditedcapacityforthegeneration
35technologyofthereplacementreliableelectricgeneration.Suchaverageofthesummer
36andwinteraccreditedcapacityforthereplacementreliableelectricgenerationshall
37equalorexceedsuchaverageofthesummerandwinteraccreditedcapacityforthe
38existingelectricgeneratingplantthatistobeclosed.Dispatchablepowerresources
39shallcompriseatleasteightypercentoftheaverageofthesummerandwintercapacity
40ofthereplacementreliableelectricgeneration.
41 3.(1)Withrespecttothereplacementreliableelectricgenerationrequiredby
42subsection2ofthissection,adequateelectrictransmissionlinesshallbeinplaceandthe
43replacementreliableelectricgenerationshallbefullyoperationalconcurrentlywiththe
44closureoftheexistingelectricgeneratingplant,exceptwheresomeorallofthe
45replacementreliableelectricgenerationutilizessomeoralltheinterconnectionfacilities
46usedbytheexistingelectricgeneratingpowerplantorwheretheexistingelectric
47generatingpowerplantisclosedasaresultofanunexpectedorunplannedcauseor
48event.Intheeventthatsomeorallofthereplacementreliableelectricgeneration
49utilizessomeoralloftheinterconnectionfacilitiesutilizedbytheexistingelectric
50generatingpowerplant,thensuchreplacementfacilitiesshallbefullyoperationalwithin
51onehundredeightydaysoftheclosureoftheexistingelectricgeneratingpowerplant.
52Intheeventthattheexistingelectricgeneratingpowerplantisclosedasaresultofan
53unexpectedorunplannedcauseorevent,followingprocessshallapply:
HB476	2 54 (a)Withinonehundredtwentydaysaftertheeventcausingtheclosureoccurs,
55theelectricalcorporationshallfileanapplicationwiththecommissionoutliningitsplan
56toinstallreplacementreliableelectricgeneration.Theapplicationshallspecifythe
57generationtechnologytheelectricalcorporationproposestobeusedforthe
58replacement,itsestimatedcost,andshalldemonstratethatthereplacementreliable
59electricgeneration’saverageaccreditedcapacityisequaltoorgreaterthantheaverage
60accreditedcapacityoftheclosedplantaccordingtotheprocessoutlinedinsubsection2
61ofthissection.Withinonehundredeightydaysoftheapplication’sfiling,the
62commissionshalleitherapprovetheelectricalcorporation’sapplicationorapprove
63implementationofalternativereliableelectricgenerationmeetingtheaccreditation
64requirementsofthissection;and
65 (b)Promptlyafterissuanceofthecommission’sorderunderparagraph(a)of
66thissubdivision,theelectricalcorporationshallproceedanduseallreasonableeffortsto
67procure,build,andplaceintooperationtheapprovedalternativereliablegeneration.
68 (2)Duringanyperiodsallowedbythissubsectionwherethereplacementreliable
69electricgenerationisnotfullyoperationalbythetimeoftheclosureoftheexisting
70electricgeneratingpowerplant,theelectricalcorporationshalluseallreasonableefforts
71tocontractfororotherwiseacquireadditionalavailablefirmgeneratingcapacityina
72quantitynecessarytomeettheplanningreservemarginrequirementoftheregional
73transmissionoperatorinwhichtheelectricalcorporationoperateswithoutrelianceon
74suchreplacementreliableelectricgeneration.Atsuchtimeassuchreplacementreliable
75electricgenerationisfullyoperational,suchadditionalavailablefirmgenerating
76capacityshallnolongerberequired.
77 (3)Anelectricalcorporationshallnotenterintoavoluntaryornegotiated
78settlementwithathirdpartythatrequiresclosureofanexistingelectricgenerating
79plant,unlesstheelectricalcorporationdeterminesthatsuchasettlementisinthebest
80interestofitscustomersandwouldmaintainelectricreliability.Electricalcorporations
81shallnotenterintosuchasettlementinordertomeetpollutionreductionorother
82corporateorsocietalgoalsbeyondthoserequiredbylaw.
83 4.Theaverageofthesummerandwinteraccreditedcapacityofthereplacement
84reliableelectricgenerationdeterminedinaccordancewithsubsection2ofthissection
85shallbeequaltoorgreaterthantheaveragesummerandwinteraccreditedcapacityof
86thedispatchableexistingelectricgeneratingpowerplantdeterminedinaccordancewith
87subsection2ofthissection,usingtheregionaltransmissionoperator’sresource
88accreditationasofthetimeconstructionbeginsonthereplacementreliableelectric
89generation.Aspartofitsapprovalofthereplacementreliableelectricgenerationunder
90subsection1ofsection393.170,thepublicservicecommissionshallcertifythatthe
HB476	3 91requirementsofthissubsectionwillbemetbythereplacementreliableelectric
92generation.
93 5.Suchreliableelectricgenerationmaybeconstructedinastatethatneighbors
94Missouriifthegenerationisconnectedtotheelectricgridoftheregionaltransmission
95operatorofwhichtheelectricalcorporationisamember.
96 6.Onorbeforethedatethatthenewreliableelectricgenerationisplacedin
97servicetheelectricalcorporationshallprovidecertificationtothepublicservice
98commission,thegeneralassembly,andthegovernorthatithasmettherequirementsof
99thissection.
SectionB.Becauseimmediateactionisnecessarytoensureadequateelectricsupply
2isavailabletomeetcustomerdemand,sectionAofthisactisdeemednecessaryforthe
3immediatepreservationofthepublichealth,welfare,peace,andsafety,andisherebydeclared
4tobeanemergencyactwithinthemeaningoftheconstitution,andsectionAofthisactshall
5beinfullforceandeffectuponitspassageandapproval.
