SectionA.Chapter393,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection393.401,toreadasfollows:
393.401.1.Forpurposesofthissection,thefollowingtermsshallmean:
2 (1)"Dispatchablepowerresource",asourceofelectricitythatis,undernormal
3operatingconditions,availableforuseondemandandthatcanhaveitspoweroutput
4adjustedaccordingtomarketneeds,exceptduringroutinemaintenanceandrepair;
5 (2)"Electricalcorporation",thesameasdefinedinsection386.020,butshallnot
6includeanelectricalcorporationasdescribedinsubsection2ofsection393.110;
7 (3)"Existingelectricgeneratingpowerplant",athermalpowerplantofover
8onehundredmegawattsinnameplatecapacity,ageneratingunitatathermalpower
9plantwithanameplatecapacityofoveronehundredmegawatts,ortwoormore
10generatingunitsatathermalpowerplantwithacombinednameplatecapacityofover
11onehundredmegawatts;
12 (4)"Regionaltransmissionoperator",aregionaltransmissionorganization,
13independentsystemoperator,orequivalententityapprovedbytheFederalEnergy
14RegulatoryCommission,orsuccessoragency,thatexercisesfunctionalcontrolover
15electrictransmissionfacilitieslocatedwithinthisstate;
16 (5)"Reliableelectricgeneration",electricgenerationmeetingtheaccreditation
17requirementsprovidedforinthissection;

20adversedecisionofacourtorachangeinastateorfederallaworregulationwhich
21causestheclosureofanexistingelectricgeneratingplant.
22 2.PriortotheclosureofanexistingelectricgeneratingpowerplantinMissouri
23iftheclosureoccursonorafterJanuary1,2026,andsubjecttosubsection3ofthis
24section,anelectricalcorporationregisteredanddoingbusinessinthisstateshallfirst
25certifytothepublicservicecommissionthatsuchutilitycompanyhassecuredand
26placedontheelectricgridanequalorgreateramountofreliableelectricgenerationas
27accreditedpowerresourcesbasedontheregionaltransmissionoperator'sresource
28accreditationforthereliableelectricgenerationtechnologyatissuewithconsideration
29oftheelectricalcorporation'santicipatedlossofload,ifany.Todetermineifanequalor
30greateramountofreliableelectricgenerationisbeingplacedontheelectricgridto
31replacetheexistingelectricgeneratingpowerplantthatistobeclosed,theelectrical
32corporationshallcomparetherelevantregionaltransmissionoperator'saverageofthe
33summerandwinteraccreditedcapacityforthegenerationtechnologyoftheto-be-closed
34existingelectricgeneratingpowerplanttotherelevantregionaltransmissionoperator's
35averageofthesummerandwinteraccreditedcapacityforthegenerationtechnologyof
36thereplacementreliableelectricgenerationwithconsiderationoftheelectrical
37corporation'santicipatedlossofload,ifany.Suchaverageofthesummerand
38winteraccreditedcapacityforthereplacementreliableelectricgenerationshallequalor
39exceedsuchaverageofthesummerandwinteraccreditedcapacityfortheexisting
40electricgeneratingplantthatistobeclosedwithconsiderationoftheelectrical
41corporation'santicipatedlossofload,ifany.Dispatchablepowerresourcesshall
42compriseatleasteightypercentoftheaverageofthesummerandwinteraccredited
43capacityofthereplacementreliableelectricgeneration.
44 3.Withrespecttothereplacementreliableelectricgenerationrequiredby
45subsection2ofthissection,adequateelectrictransmissionlinesshallbeinplaceandthe
46replacementreliableelectricgenerationshallbefullyoperationalconcurrentlywiththe
47closureoftheexistingelectricgeneratingplant,exceptwheresomeorallofthe
48replacementreliableelectricgenerationutilizessomeoralloftheinterconnection
49facilitiesusedbytheexistingelectricgeneratingpowerplant,orwheretheexisting
50electricgeneratingpowerplantisclosedasaresultofanunexpectedorunplannedcause
51orevent.Intheeventthatsomeorallofthereplacementreliableelectricgeneration
52utilizessomeoralloftheinterconnectionfacilitiesutilizedbytheexistingelectric
53generatingpowerplant,thensuchreplacementfacilitiesshallbefullyoperationalwithin
54onehundredeightydaysoftheclosureoftheexistingelectricgeneratingpowerplant.
HCSHB476	2 55Intheeventthattheexistingelectricgeneratingpowerplantisclosedasaresultofan
56unexpectedorunplannedcauseorevent,thenthefollowingprocessshallapply:
57 (1)Withinonehundredtwentydaysaftertheeventcausingtheclosureoccurs,
58theelectricalcorporationshallfileanapplicationwiththecommissionoutliningitsplan
59toinstallreplacementreliableelectricgeneration.Theapplicationshallspecifythe
60generationtechnologytheelectricalcorporationproposestobeusedforthe
61replacement,itsestimatedcost,andshalldemonstratethatthereplacementreliable
62electricgeneration'saverageaccreditedcapacityisequaltoorgreaterthantheaverage
63accreditedcapacityoftheclosedplantaccordingtotheprocessoutlinedinsubsection2
64ofthissection.Theapplicationunderthissectionshallbesubmittedtothecommission
65priortotheelectricalcorporation'sfilingofanapplicationtothecommissionunder
66subsection1ofsection393.170.Withintwohundredseventydaysoftheapplication's
67filing,thecommissionshalleitherapproveordenytheelectricalcorporation's
68application.
69 (2)Promptlyafterissuanceofthecommission'sorderundersubdivision(1)of
70thissubsection,theelectricalcorporationshallproceedanduseallreasonableeffortsto
71procure,build,andplaceintooperationtheapprovedalternativereliablegeneration.
72Duringanyperiodsallowedbythissubsectionwherethereplacementreliableelectric
73generationisnotfullyoperationalbythetimeoftheclosureoftheexistingelectric
74generatingpowerplant,theelectricalcorporationshalluseallreasonableeffortsto
75contractfororotherwiseacquireadditionalavailablefirmgeneratingcapacityina
76quantitynecessarytomeettheplanningreservemarginrequirementoftheregional
77transmissionoperatorinwhichtheelectricalcorporationoperateswithoutrelianceon
78suchreplacementreliableelectricgeneration.Atsuchtimeassuchreplacementreliable
79electricgenerationisfullyoperational,suchadditionalavailablefirmgenerating
80capacityshallnolongerberequiredunderthissection.Anelectricalcorporationshall
81notenterintoavoluntaryornegotiatedsettlementwithathirdpartythatrequires
82closureofanexistingelectricgeneratingplantunlesstheelectricalcorporation
83determinesthatsuchasettlementisinthebestinterestofitscustomersandwould
84maintainelectricreliability.Electricalcorporationsshallnotenterintosucha
85settlementinordertomeetpollutionreductionorothercorporateorsocietalgoals
86beyondthoserequiredbylaw.
87 4.(1)Theaverageofthesummerandwinteraccreditedcapacityofthe
88replacementreliableelectricgenerationdeterminedinaccordancewithsubsection2of
89thissectionshallbeequaltoorgreaterthantheaveragesummerandwinteraccredited
90capacityoftheto-be-closeddispatchableexistingelectricgeneratingpowerplant
91determinedinaccordancewithsubsection2ofthissection,usingtheregional

93corporation'sapplicationtothecommissionundersubsection1ofsection393.170
94withconsiderationoftheelectricalcorporation'santicipatedlossofload,ifany.
95 (2)Thecommissionmayconsiderinformationregardinganticipatedlossofload
96submittedbytheelectricalcorporationtothepertinentregionaltransmissionoperator
97forpurposesofitslongtermresourceplans.Aspartofitsapprovalofthereplacement
98reliableelectricgenerationundersubsection1ofsection393.170,thepublicservice
99commissionshallcertifythattherequirementsofthissubsectionshallbemetbythe
100replacementreliableelectricgeneration.
101 (3)Ifinformationissubmittedtothecommissionthattheelectricalcorporation
102hasexperiencedasignificantandlong-termlossofload,pursuanttothissection,the
103commission,priortoareviewofpotentialreplacementreliableelectricgenerationunder
104subsection1ofsection393.170,shalldetermineiftheacquisitionorconstructionoffull
105replacementgenerationisinthepublicinterest.Ifthecommissiondeterminesthatfull
106replacementgenerationisnotinthepublicinterest,therequirementsofsubsection2of
107thissectionshallnotapply.
108 5.SuchreliableelectricgenerationmaybeconstructedinMissouriorinastate
109thatneighborsMissouri,ifthegenerationisconnectedtotheelectricgridoftheregional
110transmissionoperatorofwhichtheelectricalcorporationisamemberorislocatedina
111neighboringregionaltransmissionoperatorwhichalsooperatesinMissouriandshares
112aseamwiththatmember'sregionaltransmissionoperator.
113 6.Onorbeforethedatethatthenewreliableelectricgenerationisplacedin
114service,theelectricalcorporationshallprovidecertificationtothepublicservice
115commission,thegeneralassembly,andthegovernorthatithasmettherequirementsof
116thissection.
117 7.Totheextentexistingelectricgeneratingpowerplantcapacityisreplaced
118pursuanttothissection,suchcapacityshallnotbereplacedby"replacementresources"
119undersection393.1705.
