Torepealsection644.021,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
cleanwatercommissionofthestateofMissouri.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section644.021,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection644.021,toreadasfollows:
644.021.1.Thereisherebycreatedawatercontaminantcontrolagencytobeknown
2asthe"CleanWaterCommissionoftheStateofMissouri",whosedomicileforthepurposes
3ofsections644.006to644.141shallbedeemedtobethatofthedepartmentofnatural
4resources.Thecommissionshallconsistofsevenmembersappointedbythegovernorwith
5theadviceandconsentofthesenate.Nomorethanfourofthemembersshallbelongtothe
6samepoliticalparty.Allmembersshallberepresentativeofthegeneralinterestofthepublic
7andshallhaveaninterestinandknowledgeofconservationandtheeffectsandcontrolof
8watercontaminants.Atleasttwomembersshallbeknowledgeableconcerningtheneedsof
9agriculture,industryorminingandinterestedinprotectingtheseneedsinamannerconsistent
10withthepurposesofsections644.006to644.141.Atleastonemembershallbe
11knowledgeableconcerningtheneedsofpubliclyownedwastewatertreatmentworks.No
12morethanfourmembersshallrepresentthepublic.[Nomembershallreceive,orhave
13receivedduringtheprevioustwoyears,asignificantportionofhisorherincomedirectlyor
14indirectlyfrompermitholdersorapplicantsforapermitpursuanttoanyfederalwater
15pollutioncontrolactasamendedandasapplicabletothisstate.] Allmembersappointedon
16orafterAugust28,2002,shallhavedemonstratedaninterestandknowledgeaboutwater
17quality.AllmembersappointedonorafterAugust28,2002,shallbequalifiedbyinterest,

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18education,trainingorexperiencetoprovide,assessandevaluatescientificandtechnical
19informationconcerningwaterquality,financialrequirementsandtheeffectsofthe
20promulgationofstandards,rulesandregulations.Atthefirstmeetingofthecommission
21andatyearlyintervalsthereafter,themembersshallselectfromamongthemselvesa
22chairmanandavicechairman.
23 2.Themembers'termsofofficeshallbefouryearsanduntiltheirsuccessorsare
24selectedandqualified.Provided,however,thatthefirstthreemembersappointedshallserve
25atermoftwoyears,thenextthreemembersappointedshallserveatermoffouryears,
26thereafterallmembersappointedshallserveatermoffouryears.Thereisnolimitationon
27thenumberoftermsanyappointedmembermayserve.Ifavacancyoccursthegovernormay
28appointamemberfortheremainingportionoftheunexpiredtermcreatedbythevacancy.
29Thegovernormayremoveanyappointedmemberforcause.Themembersofthe
30commissionshallbereimbursedfortravelandotherexpensesactuallyandnecessarily
31incurredintheperformanceoftheirduties.
32 3.Thecommissionshallholdatleastfourregularmeetingseachyearandsuch
33additionalmeetingsasthechairmandeemsdesirableataplaceandtimetobefixedbythe
34chairman.Specialmeetingsmaybecalledbythreemembersofthecommissionupon
35deliveryofwrittennoticetoeachmemberofthecommission.Reasonablewrittennoticeof
36allmeetingsshallbegivenbythedirectortoallmembersofthecommission.Fourmembers
37ofthecommissionshallconstituteaquorum.Allpowersanddutiesconferredspecifically
38uponmembersofthecommissionshallbeexercisedpersonallybythemembersandnotby
39alternatesorrepresentatives.Allactionsofthecommissionshallbetakenatmeetingsopento
40thepublic.Anymemberabsentfromsixconsecutiveregularcommissionmeetingsforany
41causewhatsoevershallbedeemedtohaveresignedandthevacancyshallbefilled
42immediatelyinaccordancewithsubsection1ofthissection.
