20 (5)Maintaintheprivacyandsecurityofinformationinaccordancewithapplicable 21stateandfederallaws,regulationsandorders;and 22 (6)Establishsuchrulesandregulationsasarenecessaryforimplementingthe 23provisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection 24536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffective 25onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 26section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 27vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate 28ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 29rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid 30andvoid. 31 3.Everylawenforcementagencyinthestateshall: 32 (1)Submitcrimeincidentreportstothedepartmentofpublicsafetyonformsorinthe 33formatprescribedbythedepartment;[and] 34 (2)Submitanyothercrimeincidentinformationwhichmayberequiredbythe 35departmentofpublicsafety, includinginformationpertainingtotheimmigrationstatusof 36anycriminaloffender,indicatingwhethertheoffenderisacitizenoftheUnitedStates,is HCS#2HB495 2 37alawfullypresentimmigrant,ordoesnotpossesstheinformationtoshowthatheorshe 38isacitizenoftheUnitedStatesoralawfullypresentimmigrant. 39 4.AnylawenforcementagencythatviolatesthissectionafterDecember31,2021, 40maybeineligibletoreceivestateorfederalfundswhichwouldotherwisebepaidtosuch 41agencyforlawenforcement,safetyorcriminaljusticepurposes. 44.087.1.Thechieflawenforcementexecutiveforanylawenforcementagency, 2orsuchexecutive'sdesignee,mayrequestassistancefromalawenforcementagencyof 3anotherjurisdiction,includingajurisdictionoutsidethestateofMissouributwithinthe 4UnitedStates. 5 2.Ifalawenforcementofficermakesanarrestorapprehensionoutsidesuch 6officer'sjurisdiction,theoffendershallbedeliveredtothefirstavailablelaw 7enforcementofficerwhoiscommissionedinthejurisdictioninwhichthearrestwas 8made.Theofficermakingtheinitialarrestorapprehensionshallassistinthe 9preparationofanyaffidavitsfiledwiththecomplaintorbasedonotherevidencethat 10thereisprobablecausetobelievethatbothacrimehasbeencommittedandthe 11defendanthascommittedsuchcrime. 12 3.Forthepurposeofliability,workers'compensation,andanyother 13employment-relatedmatter,lawenforcementofficersremainemployeesoftheir 14respectivelawenforcementagencythroughoutanyrequestforassistance.Qualified 15immunity,sovereignimmunity,officialimmunity,andthepublicdutyruleshallapplyto 16theprovisionsofthissectionasinterpretedbythefederalandstatecourtsofthe 17respondingagency. 18 4.Nothinginthissectionshallbeconstruedtolimittheactionsoflaw 19enforcementofficersoragenciesconductedinaccordancewithsection44.095or44.098, 20oranyothermutualaidagreementmadeunderthischapter. 21 5.Theprovisionsofchapter544areapplicabletoanylawenforcementofficers 22fromjurisdictionslocatedoutsidethestateofMissouri,butwithintheUnitedStates, 23whoareactingpursuanttoarequestmadeunderthissection. 84.012.Inallcitiesofthisstatenotwithinacounty,thecommoncouncilor 2municipalassemblyofsuchcitiesmaypassordinancesforpreservingorder;securing 3propertyandpersonsfromviolence,danger,ordestruction;protectingpublicand 4privateproperty;andpromotingtheinterestsandensuringthegoodgovernanceofthe 5cities,butnoordinancesheretoforepassed,orthatmayhereafterbepassed,bythe 6commoncouncilormunicipalassemblyofthecitiesshall,inanymanner,conflictor 7interferewiththepowersortheexerciseofthepowersoftheboardsofpolice 8commissionersofthecitiesascreatedbysection84.020,norshallthecitiesorany 9officeroragentofthecorporationofthecities,orthemayorthereof,inanymanner HCS#2HB495 3 10impede,obstruct,hinder,orinterferewiththeboardsofpolice,anyofficer,agent,or 11servantthereoforthereunder. 84.020.1.Inallcities[ofthisstatethatnowhave,ormayhereafterattain,a 2populationoffivehundredthousandinhabitantsorover]notwithinacounty, thereshallbe, 3andisherebyestablished,withinandforsaidcities,aboardofpolicecommissioners, to 4consistoffourcitizencommissioners,asprovidedinsections84.040to84.080,tobethe 5governingbodyofthepermanentpoliceforcepursuanttosection84.100,togetherwith 6themayorofsaidcitiesforthetimebeing,orwhosoevermaybeofficiallyactinginthat 7capacity,andsaidboardshallannuallyappointoneofitsmembersaspresident,[and]one 8memberwhoshallactasvicepresident[duringtheabsenceofthepresident], andone 9memberwhoshallactasboardsecretary; andsuchpresidentorvicepresidentshallbethe 10executiveofficeroftheboardandshallactforitwhentheboardisnotinsession. 11 2.Theboardshallconsistoffivecommissioners,oneofwhomisthemayorofa 12citynotwithinacounty,onecitizencommissionerappointedatthesolediscretionofthe 13governor,andthreecitizencommissionersappointedasprovidedundersubdivision(2) 14ofthissubsection.Citizencommissionersshallberesidentsofthecityfornotlessthan 15threeyearsprecedingtheirappointment.Exceptforthemayor,nocommissionershall 16benominatedfororholdanyotherelectiveorappointedpoliticaloffice.Ifanycitizen 17commissionerisnominatedfororelectedtoanyelectiveorappointedpoliticaloffice, 18suchcommissionershallforfeittheappointmentandshallimmediatelyvacatehisorher 19office.Themayorofacitynotwithinacountyshallautomaticallybeamemberofthe 20board,whiletheremaininginauguralcommissionersshallbeappointedasfollows: 21 (1)Onecitizencommissionertobeappointedatthesolediscretionofthe 22governor;and 23 (2)Theremainingthreecitizencommissionersmaybeappointedbythe 24governorfromthreeseparatepanelsofcandidatessubmittedtothegovernor,including 25onecandidatesubmittedbythemayorofacitynotwithinacountyanduptofour 26candidatessubmittedbythelocalfraternalorganizationsrepresentingtherankofpolice 27officerwithinthecitynotwithinacounty.Forthepurposesofthissubdivision,theterm 28"fraternalorganizations"shallmeantheSt.LouisPoliceOfficers'Associationandthe 29EthicalSocietyofPolice.Thenumberofcandidatessubmittedbythelocalfraternal 30organizationsshallbebasedononeselectionpertwohundredfiftytotalactivemembers 31thattheyrepresentfromtheSt.LouisMetropolitanPoliceDepartment,nottoexceeda 32totalofthreeselectionsperorganization.Intheeventthegovernorelectsnottoselecta 33candidatefromapanel,thegovernorhasdiscretiontoappointanyresidentofacitynot 34withinacounty. HCS#2HB495 4 35 3.Anymemberoftheboardmayberemovedforcausewiththeapprovalofa 36majorityoftheotherboardmembers,butsuchmembershallfirstbepresentedwitha 37writtenstatementofthereasonsforremovalandshallhavetheopportunityfora 38hearingbytheboardtoestablishcauseforremoval.Thedecisionforremovalofa 39boardmemberisfinal.However,theremovedmembermayappealtheirremovaltothe 40twenty-secondjudicialcircuitcourt. 41 4.Amajorityoftheboardshallconstituteaquorumforthetransactionof 42business,butnoactionshallbetakenbytheboardordeemedvalidunlessthree 43concurringvotesarecast. 44 5.Theboardshallhavethepowertosummonandcompeltheattendanceof 45witnessesbeforetheboardandtocompeltheproductionofdocumentsandother 46evidence,whenevernecessaryinthedischargeofitsduties,andshallhavethepowerto 47administeroathsoraffirmationstoanypersonappearingorcalledbeforeit. 48 6.Theboardshallhavethefollowingpowersandduties: 49 (1)Toreceiveinputfromthechiefofpolice,inordertoformulateandapprove 50policiesgoverningtheoperationandconductofthepermanentpoliceforcepursuantto 51section84.100; 52 (2)Toappointasachiefofpoliceanypersonwhoshallberesponsibletothe 53boardforproperexecutionofthepolicies,duties,andresponsibilitiesestablishedbythe 54boardfortheadministrationofthepolicedepartment,andtoremovethechiefpursuant 55tosection106.273; 56 (3)Tohearanddetermineappealsfromthedecisionsofthechiefofpoliceon 57disciplinarymattersarisingwiththedepartment,pursuanttosection590.502;however, 58atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboardadoptsother 59investigativeanddisciplinarypoliciesandproceduresnotinconsistentwithsection 60590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian 61employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe 62policedepartmentineffectasofNovember4,2013;exceptthat,whererule7isin 63conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection 64590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt 65investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing 66boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin 67effectasofNovember4,2013; 68 (4)Topromulgateamanualofrulesandregulationsforthequalificationsand 69conductofpersonnelofthepolicedepartmentanditsoperation; 70 (5)Tohavesuchotherpowersanddutieswithrespecttopoliceadministration 71andlawenforcementasprovidedbystatute; HCS#2HB495 5 72 (6)Toregulateandlicenseallprivatewatchmen,privatedetectives,andprivate 73policeservingoractinginthecityandnopersonshallactassuchwithoutfirsthaving 74obtainedsuchlicense.Penaltiesfortheviolationofregulationspromulgatedbythe 75boardunderthissubsectionshallbeprescribedbyordinance. 84.030.1.Beginningon[January9,1989,thegovernorofthestateofMissouri,by 2andwiththeadviceandconsentofthesenate,shallappointthefourcommissionersprovided 3forinsection84.020,andonecommissionershallbeappointedforatermofoneyear;one 4commissionershallbeappointedforatermoftwoyears;onecommissionershallbe 5appointedforatermofthreeyears;onecommissionershallbeappointedforatermoffour 6years] August28,2025,andnolaterthanSeptember28,2025,thefourcitizen 7commissionersshallbeappointedasprovidedundersection84.020andshallserveas 8follows: 9 (1)Onecitizencommissionerappointedbythegovernorshallserveforatermof 10oneyear;and 11 (2)Ofthethreeremainingcitizencommissionersselectedbythegovernor,one 12shallserveforatermoftwoyears,oneshallserveforatermofthreeyears,andone 13shallserveforatermoffouryears. 14 15Theirsuccessorsshalleachbeappointedforatermoffouryears,andsaidcommissioners 16shallholdofficefortheirtermofappointmentanduntiltheirsuccessorsshallhavebeen 17appointedandqualified.[Incaseofavacancyinsaidboardforanycausewhatsoever,itshall 18befilledbyappointmentfortheunexpiredterm,inthesamemannerasinthecaseoforiginal 19appointments.Thegovernorshallissuecommissionstothepersonssoappointed,designating 20thetimeforwhichtheyareappointedincasetheappointmentistofillanunexpiredterm 21occasionedbydeath,resignationoranyothercause,andwheneverthetermofofficeofany 22commissionerexpires,theappointmentofhissuccessorshallbeforfouryears.The 23commissionersnowholdingofficesunderexistinglawsinanycityofthisstatetowhich 24sections84.010to84.340applyaretoholdtheirofficesuntiltheexpirationoftheirterms,and 25theirsuccessorsaredulyappointedandqualified.] 26 2.Withtheexceptionofthecitizencommissionerappointedatthesolediscretion 27ofthegovernor,wheneveravacancyoccursonthecommissionthegovernormayfillthe 28vacancyfortheunexpiredtermfromapanelofnamesdeterminedbytheformula 29establishedundersubsection2ofsection84.020. 84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare 2herebyauthorizedandrequiredtoappoint,enrollandemploy[a]onlyonepermanentpolice 3forceforthecitieswhichtheyshallequipandarmastheymayjudgenecessary.Exceptas 4providedbelow,thenumberofpatrolmentobeappointedshallnotbe[more] lessthanone HCS#2HB495 6 5thousand[six]threehundred[eighty-three] thirteen,ofwhichnumbernotmorethantwo 6hundredfiftyaretobeprobationarypatrolmen.Anyincreaseinthenumberofpatrolmen 7authorized,inadditiontothatprovidedforabove,shallbepermitteduponrecommendation 8bytheboardofpolicecommissioners,withtheapprovalofthemunicipalboardofestimate 9andapportionment.[Thenumberofturnkeystobeappointedshallbesixty-five,exceptthat 10foreachpatrolmanhereafterpromoted,demoted,removed,resignedorotherwiseseparated 11fromtheforce,anadditionalturnkeymaybeappointed,butundernocircumstancesshall 12morethanonehundredfiftyturnkeysbeappointed.Aseachadditionalturnkeyisappointed, 13themaximumnumberofpatrolmentobeappointedshallbereducedaccordinglysothatwhen 14onehundredfiftyturnkeyshavebeenappointed,thenumberofpatrolmentobeappointed 15shallnotbemorethanonethousandfivehundredninety-eight.] Theboardmaycontinueto 16employasmanynoncommissionedpolicecivilians,whichshallincludecitymarshals 17andparkrangers,asitdeemsnecessaryinordertoperformthedutiesimposeduponit. 84.150.Themaximumnumberofofficersofthepoliceforceineachsuchcityshall 2beasfollows:[onechiefofpolicewiththerankofcolonel;lieutenantcolonels,nottoexceed 3fiveinnumberandothersuchranksandnumberofmemberswithinsuchranksastheboard 4fromtimetotimedeemsnecessary] seventy-sixcommissionedofficersattherankof 5lieutenantandabove;twohundredcommissionedofficersattherankofsergeant;and 6onethousandthirty-sevencommissionedofficersattherankofpatrolman. Theofficers 7ofthepoliceforceshallhavecommissionsissuedtothembytheboardsofpolice 8commissioners,andthoseheretoforeandthosehereaftercommissionedshallservesolongas 9theyshallfaithfullyperformtheirdutiesandpossessthenecessarymentalandphysical 10ability,andbesubjecttoremovalonlyforcauseafterahearingbytheboard,whoarehereby 11investedwithexclusivejurisdictioninthepremises. 84.160.1.AsofAugust28,[2006] 2025, theboardofpolicecommissionersshall 2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice 3force, withoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe 4lessthantheannualsalarypaidtoanymemberatthetimeoftheenactmentofthisact. 5 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires 6nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed 7threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof 8subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime 9offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof 10therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe 11contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation 12pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat 13fundingforsuchcompensationshallnot: HCS#2HB495 7 14 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice 15commissionersofthecity;or 16 (2)Beviolativeofanyfederallaworotherstatelaw. 17 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake 18thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforcegoverned 19bytheboardofpolicecommissionersinthemannerhereinandhereafterprovided[; 20provided,thatinnoeventshallsuchmunicipalassemblyorcommoncouncilberequiredto 21appropriateforsuchpurposes(including,butnotlimitedto,costsoffundingpensionsor 22retirementplans)foranyfiscalyearasuminexcessofanylimitationimposedby]forin 23section84.210,exceptthat,pursuanttosubsection2ofarticleX[,]ofsection21[,]ofthe 24MissouriConstitution[; andprovidedfurther,that],suchmunicipalassemblyorcommon 25council[may] shallappropriateaminimumsum[inexcessofsuchlimitationforanyfiscal 26yearbyanappropriationsordinanceenactedinconformitywiththeprovisionsofthecharter 27ofsuchcities] equaltotwenty-fivepercentofthecity'sgeneralrevenuetofundthepolice 28forcegovernedbytheboardofpolicecommissioners.Pensionandretirementcostsare 29excludedfromthecalculationofexpensesformaintenanceofthepoliceforcefor 30purposesoftheminimumfundingrequirement. 31 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 32boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice 33renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe 34establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half 35timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except 36that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto 37whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade 38frompaymentsforovertimeforthepurposeofretirementbenefits. 39 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary, 40probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional 41compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe 42totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas 43compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor. 44 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime 45shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby 46time. 47 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide 48additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan 49accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries 50orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree HCS#2HB495 8 51percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree 52percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup 53toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead 54officers. 55 8.Theboardofpolicecommissioners: 56 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits 57providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe 58department; 59 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation 60coverageforofficersandemployeesofthepolicedepartment; 61 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand 62employeesofthepolicedepartment.Health,medicalandlifeinsurancecoverageshallbe 63madeavailableforpurchasetothespousesordependentsofdeceasedretiredofficersand 64employeesofthepolicedepartmentwhoreceivepensionbenefitspursuanttosections86.200 65to86.364attheratethatsuchdependent'sorspouse'scoveragewouldcostunderthe 66appropriateplanifthedeceasedwereliving; 67 (4)Maypayanadditionalshiftdifferentialcompensationtomembersofthepolice 68forceforeveningandnighttourofdutyinanamountnottoexceedtenpercentoftheofficer's 69basehourlyrate. 70 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 73hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase 74hourlypay. 75 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may 76payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying 77commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any 78suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates 79equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment; 80exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused 81vacationtime. 84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe 2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve 3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall 4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants 5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant; 6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain; HCS#2HB495 9 7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce 8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore 9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot 10belowthegradeoflieutenant. 11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations, 12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge 13necessary,fortheappointment,employment,uniforming,discipline,trialandgovernmentof 14thepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboard 15adoptsotherinvestigativeanddisciplinarypoliciesandproceduresnotinconsistentwith 16section590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian 17employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe 18policedepartmentineffectasofNovember4,2013;exceptthat,whererule7isin 19conflictwithsection590.502,theboardshallcomplywiththerequirementsofsection 20590.502.Undernocircumstancesshalltheboardinitiallyorhereafteradopt 21investigativeanddisciplinaryproceduresthatdonotincludethesummaryhearing 22boardproceduresprovidedforinrule7ofthepolicemanualofthepolicedepartmentin 23effectasofNovember4,2013.Thesaidboardsshallalsohavepowertorequireofany 24officerorpolicemanbondwithsuretieswhentheymayconsideritdemandedbythepublic 25interests.Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceon 26painofdismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionor 27forfeitureofpay,orotherwiseastheboardsmayadjudge. 28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the 9dutiesbysuchsectionsimposeduponhimorher,shallbesubjecttoapenaltyofone 10thousanddollarsforeachoffense,recoverablebytheboardsbyactionatlawinthe 11nameofthestate,andshallforeverthereafterbedisqualifiedfromholdingorexercising 12anyofficeoremploymentwhatsoeverunderthemayororcommoncouncilormunicipal 13assemblyofsuchcities,orundersections84.012to84.340,providedthatnothinginthis HCS#2HB495 10 14sectionshallbeconstruedtointerferewiththepunishment,underanyexistingorany 15futurelawsofthisstate,ofanycriminaloffensethatiscommittedbythepartiesinor 16abouttheresistance,obstruction,hindrance,conspiracy,combination,ordisbursement 17aforesaid. 84.325.1.Atransitiondirectorshallbeappointedbythegovernortoensure 2oversightofanorderlytransitionofthecontrolofanymunicipalpoliceforcefromany 3citynotwithinacountytotheboardofpolicecommissioners.Theimplementation 4periodshallbeginonAugust28,2025,andendnolaterthanJuly1,2026.Theboardof 5policecommissionersshallassumecontrolofanymunicipalpoliceforceestablished 6withinanycitynotwithinacountyduringtheimplementationperiod,accordingtothe 7requirementsofthissectionandanyrulespromulgatedundersubsection6ofthis 8sectionandasdeterminedincoordinationwiththetransitiondirector,localofficials, 9andtheboardofpolicecommissioners.Thepurposeoftheseproceduresand 10requirementsistoensurethecontinuityofoperationsofthemunicipalpoliceforcewith 11minimizeddisruptionstotheresidentsofanycitynotwithinacounty,toprovideforan 12orderlyandappropriatetransitioninthegovernanceofthepoliceforce,andtoprovide 13foranequitableemploymenttransitionforcommissionedandcivilianpersonnel. 14 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 15subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 16acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof 17allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 18propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such 19cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce. 20 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 21subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability 22assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe 23municipalpolicedepartment. 24 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 25inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 26policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately 27priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 28yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 29policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand 30civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 31personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime, 32andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice 33department. 4284.340.Otherthananyprovisionthatmakeschapter86applicabletoamunicipal 43policeforceestablishedundersections84.343to84.346,nothinginsections84.012to 4484.340shallbeconstruedaslimitingorchangingtherightsorbenefitsprovidedunder 45chapter86. 46 6.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand 47regulationsfortheimplementationandadministrationofthissection.Anyruleor 48portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 49authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 50subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 51sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 52generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 20substance,orimmediateprecursorinSchedulesIthroughVlistedinchapter195. 211.141.1.Whenachildistakenintocustodyasprovidedinsection211.131,the 2persontakingthechildintocustodyshall,unlessithasbeenotherwiseorderedbythecourt, 3returnthechildtohisorherparent,guardianorlegalcustodianonthepromiseofsuchperson 4tobringthechildtocourt,ifnecessary,atastatedtimeoratsuchtimesasthecourtmay 5direct.Thecourtmayalsoimposeotherconditionsrelatingtoactivitiesofthechild.Ifthese 6additionalconditionsarenotmet,thecourtmayorderthechilddetainedasprovidedin 7section211.151.Ifadditionalconditionsareimposed,thechildshallbenotifiedthatfailure 8toadheretotheconditionsmayresultinthecourtimposingmorerestrictiveconditionsor 9orderingthedetentionofthechild.Ifthepersontakingthechildintocustodybelievesit 18exceedtwenty-fourhoursifitisimpracticaltoobtainawrittenorderfromthecourtbecause 19oftheunreasonablenessofthehourorthefactthatitisaSundayorholiday.Theconditional 20releaseshallbeasprovidedinsubsection1ofthissection,andthedetentionshallbeas 21providedinsection211.151.Awrittenrecordofsuchconditionalreleaseordetentionshallbe 22keptandareportinwritingfiledwiththecourt.Intheeventthatthejudgeisabsentfromhis 23circuit,orisunabletoact,theapprovalofanothercircuitjudgeofthesameoradjoining 24circuitmustbeobtainedasaconditionorcontinuingtheconditionalreleaseordetentionofa 25childformorethantwenty-fourhours. 26 4.Inanymatterreferredtothejuvenilecourtpursuanttosection211.031,thejuvenile 27officershallmakeariskandneedsassessmentofthechildand,beforethedispositionofthe 28matter,shallreporttheresultsoftheassessmenttothejuvenilecourt.Theassessmentshallbe 29writtenonastandardizedformapprovedbytheofficeofstatecourtsadministrator.The 30juvenileofficershalluseacumulativetotalofpointsassessedforallallegedoffenses HCS#2HB495 14 31committedtodeterminewhetherthecourtshallorderthechildtobedetainedas 32providedinsection211.151. 33 5.Thedivision,incooperationwithjuvenileofficersandjuvenilecourts,shallatleast 34bienniallyreviewarandomsampleofassessmentsofchildrenandthedispositionofeach 35child'scasetorecommendassessmentanddispositionequitythroughoutthestate.Such 36reviewshallidentifyanyevidenceofracialdisparityincertification.Suchreviewshallbe 37conductedinamannerwhichprotectstheconfidentialityofthecasesexamined. 300.100.1.Thedriverofanauthorizedemergencyvehicle,whenrespondingtoan 2emergencycallorwheninthepursuitofanactualorsuspectedviolatorofthelaworwhen 3respondingtobutnotuponreturningfromafirealarm,mayexercisetheprivilegessetforthin 4thissection,butsubjecttotheconditionshereinstated. 5 2.Thedriverofanauthorizedemergencyvehiclemay: 6 (1)Parkorstand,irrespectiveoftheprovisionsofthisordinance; 7 (2)Proceedpastaredorstopsignalorstopsign,butonlyafterslowingdownasmay 8benecessaryforsafeoperation; 9 (3)Exceedthemaximumspeedlimitssolongashedoesnotendangerlifeor 10property; 11 (4)Disregardregulationsgoverningdirectionofmovementorturninginspecified 12directions. 13 3.Theexemptionshereingrantedtoanauthorizedemergencyvehicleshallapply 14onlywhenthedriverofanysaidvehiclewhileinmotionsoundsaudiblesignalbysirenor 15whilehavingatleastonelightedlampexhibitingaredlightvisibleundernormalatmospheric 16conditionsfromadistanceoffivehundredfeettothefrontofsuchvehicleoraflashingblue 17lightauthorizedbysection307.175, exceptthatanauthorizedemergencyvehicleoperated 18asapolicevehicleisnotrequiredtouseanaudiblesignalordisplayavisualsignalwhen 19thevehicleisbeingusedto: 20 (1)Obtainevidenceofaspeedingviolationonamaintainedfederalorstate 21highwayandwherethespeedlimitissetbystatestatute; 22 (2)Respondtoasuspectedcrimeinprogresswhenuseofanaudibleorvisual 23signal,orboth,couldreasonablyresultinthedestructionofevidenceorescapeofa 24suspect;or 25 (3)Conductsurveillanceofavehicleorthepassengersofavehiclewhoare 26suspectedofinvolvementinacrime. 27 4.Theforegoingprovisionsshallnotrelievethedriverofanauthorizedemergency 28vehiclefromthedutytodrivewithdueregardforthesafetyofallpersons,norshallsuch 29provisionsprotectthedriverfromtheconsequencesofhisrecklessdisregardforthesafetyof 30others. 5.Theperiodofsuspensionofthedriver'slicenseanddrivingprivilegeofanyperson 28undertheprovisionsofsubdivision(8)ofsubsection1ofsection302.302orwhohas 29accumulatedsufficientpointstogetherwithaconvictionundersubdivision(10)ofsubsection 301ofsection302.302shallbethirtydays,followedbyasixty-dayperiodofrestricteddriving 31privilegeasdefinedinsection302.010.Uponcompletionofsuchperiodofrestricteddriving 32privilege,uponcompliancewithotherrequirementsoflawanduponfilingofproofof 33financialresponsibilitywiththedepartmentofrevenue,inaccordancewithchapter303,the 34licenseanddrivingprivilegeshallbereinstated.Ifaperson,otherwisesubjecttothe 35provisionsofthissubsection,filesproofofinstallationwiththedepartmentofrevenuethat 36anyvehicleoperatedbysuchpersonisequippedwithafunctioning,certifiedignition 37interlockdevice,thereshallbenoperiodofsuspension.However,inlieuofasuspensionthe HCS#2HB495 16 38personshallinsteadcompleteaninety-dayperiodofrestricteddrivingprivilege.Iftheperson 39failstomaintainsuchproofofthedevicewiththedirectorofrevenueasrequired,the 40restricteddrivingprivilegeshallbeterminated.Uponcompletionofsuchninety-dayperiod 41ofrestricteddrivingprivilege,uponcompliancewithotherrequirementsoflaw,andupon 42filingofproofoffinancialresponsibilitywiththedepartmentofrevenue,inaccordancewith 43chapter303,thelicenseanddrivingprivilegeshallbereinstated.However,ifthemonthly 44monitoringreportsduringsuchninety-dayperiodindicatethattheignitioninterlockdevice 45hasregisteredaconfirmedbloodalcoholconcentrationlevelabovethealcoholsetpoint 46establishedbythedepartmentoftransportationorsuchreportsindicatethattheignition 47interlockdevicehasbeentamperedwithorcircumvented,thenthelicenseanddriving 48privilegeofsuchpersonshallnotbereinstateduntilthepersoncompletesanadditionalthirty- 49dayperiodofrestricteddrivingprivilege. 50 6.Ifthepersonfailstomaintainproofoffinancialresponsibilityinaccordancewith 51chapter303,or,ifapplicable,ifthepersonfailstomaintainproofthatanyvehicleoperatedis 52equippedwithafunctioning,certifiedignitioninterlockdeviceinstalledpursuantto 53subsection5ofthissection,theperson'sdrivingprivilegeandlicenseshallberesuspended. 54 7.Thedirectorshallrevokethelicenseanddrivingprivilegeofanypersonwhenthe 55person'sdrivingrecordshowssuchpersonhasaccumulatedtwelvepointsintwelvemonthsor 56eighteenpointsintwenty-fourmonthsortwenty-fourpointsinthirty-sixmonths.The 57revocationperiodofanypersonwhoselicenseanddrivingprivilegehavebeenrevokedunder 58theprovisionsofsections302.010to302.540andwhohasfiledproofoffinancial 65anddrivingprivilegeshallbererevoked.Anypersonwhoselicenseanddrivingprivilege 66havebeenrevokedundertheprovisionsofsections302.010to302.540shall,uponreceiptof 67thenoticeofterminationoftherevocationfromthedirector,passthecompletedriver 68examinationandapplyforanewlicensebeforeagainoperatingamotorvehicleuponthe 69highwaysofthisstate. 70 8.If,priortoconvictionforanoffensethatwouldrequiresuspensionorrevocationof 71aperson'slicenseundertheprovisionsofthissection,theperson'stotalpointsaccumulated 72arereduced,pursuanttotheprovisionsofsection302.306,belowthenumberofpoints 73requiredforsuspensionorrevocationpursuanttotheprovisionsofthissection,thenthe HCS#2HB495 17 74person'slicenseshallnotbesuspendedorrevokeduntilthenecessarypointsareagain 75obtainedandaccumulated. 76 9.Ifanypersonshallneglectorrefusetosurrendertheperson'slicense,asprovided 77herein,thedirectorshalldirectthestatehighwaypatroloranypeaceorpoliceofficerto 78securepossessionthereofandreturnittothedirector. 79 10.Upontheissuanceofareinstatementorterminationnoticeafterasuspensionor 80revocationofanyperson'slicenseanddrivingprivilegeundertheprovisionsofsections 81302.010to302.540,theaccumulatedpointvalueshallbereducedtofourpoints,exceptthat 82thepointsofanypersonservingasamemberoftheArmedForcesoftheUnitedStates 83outsidethelimitsoftheUnitedStatesduringaperiodofsuspensionorrevocationshallbe 84reducedtozerouponthedateofthereinstatementorterminationofnotice.Itshallbethe 85responsibilityofsuchmemberoftheArmedForcestosubmitcopiesofofficialorderstothe 86directorofrevenuetosubstantiatesuchoverseasservice.Anyotherprovisionofsections 87302.010to302.540tothecontrarynotwithstanding,theeffectivedateofthefourpoints 88remainingontherecorduponreinstatementorterminationshallbethedateofthe 89reinstatementorterminationnotice. 90 11.Nocredittowardreductionofpointsshallbegivenduringperiodsofsuspension 91orrevocationoranyperiodofdrivingunderalimiteddrivingprivilegegrantedbyacourtor 92thedirectorofrevenue. 93 12.Anypersonornonresidentwhoselicenseorprivilegetooperateamotorvehicle 94inthisstatehasbeensuspendedorrevokedunderthisoranyotherlawshall,beforehaving 95thelicenseorprivilegetooperateamotorvehiclereinstated,paytothedirectora 96reinstatementfeeoftwentydollarswhichshallbeinadditiontoallotherfeesprovidedby 97law. 98 13.Notwithstandinganyotherprovisionoflawtothecontrary,ifaftertwoyearsfrom 99theeffectivedateofanysuspensionorrevocationissuedunderthischapter,exceptany 100suspensionorrevocationissuedundersection302.410,302.462,or302.574,thepersonor 101nonresidenthasnotpaidthereinstatementfeeoftwentydollars,thedirectorshallreinstate 102suchlicenseorprivilegetooperateamotorvehicleinthisstate.Anypersonwhohashadhis 103orherlicensesuspendedorrevokedundersection302.410,302.462,or302.574,shallbe 104requiredtopaythereinstatementfee. 105 14.Nopersonwhohashadalicensetooperateamotorvehiclesuspendedorrevoked 106asaresultofanassessmentofpointsforaviolationundersubdivision(8),(9)or(10)of 107subsection1ofsection302.302shallhavethatlicensereinstateduntilsuchpersonhas 108participatedinandsuccessfullycompletedasubstanceabusetrafficoffenderprogramdefined 109insection302.010,oraprogramdeterminedtobecomparablebythedepartmentofmental 110health.Assignmentrecommendations,basedupontheneedsassessmentasdescribedin HCS#2HB495 18 111subdivision(24)ofsection302.010,shallbedeliveredinwritingtothepersonwithwritten 112noticethatthepersonisentitledtohavesuchassignmentrecommendationsreviewedbythe 113courtifthepersonobjectstotherecommendations.Thepersonmayfileamotioninthe 114associatedivisionofthecircuitcourtofthecountyinwhichsuchassignmentwasgiven,ona 115printedformprovidedbythestatecourtsadministrator,tohavethecourthearanddetermine 116suchmotionpursuanttotheprovisionsofchapter517.Themotionshallnamethepersonor 117entitymakingtheneedsassessmentastherespondentandacopyofthemotionshallbe 118servedupontherespondentinanymannerallowedbylaw.Uponhearingthemotion,the 119courtmaymodifyorwaiveanyassignmentrecommendationthatthecourtdeterminestobe 120unwarrantedbaseduponareviewoftheneedsassessment,theperson'sdrivingrecord,the 121circumstancessurroundingtheoffense,andthelikelihoodofthepersoncommittingalike 122offenseinthefuture,exceptthatthecourtmaymodifybutmaynotwaivetheassignmentto 123aneducationorrehabilitationprogramofapersondeterminedtobeapriororpersistent 124offenderasdefinedinsection577.001orofapersondeterminedtohaveoperatedamotor 125vehiclewithfifteen-hundredthsofonepercentormorebyweightinsuchperson'sblood. 126Compliancewiththecourtdeterminationofthemotionshallsatisfytheprovisionsofthis 127sectionforthepurposeofreinstatingsuchperson'slicensetooperateamotorvehicle.The 128respondent'spersonalappearanceatanyhearingconductedpursuanttothissubsectionshall 129notbenecessaryunlessdirectedbythecourt. 130 15.Thefeesfortheprogramauthorizedinsubsection14ofthissection,oraportion 131thereoftobedeterminedbythedepartmentofmentalhealth,shallbepaidbytheperson 132enrolledintheprogram.Anypersonwhoisenrolledintheprogramshallpay,inadditionto 133anyfeechargedfortheprogram,asupplementalfeeinanamounttobedeterminedbythe 134departmentofmentalhealthforthepurposesoffundingthesubstanceabusetrafficoffender 135programdefinedinsection302.010oraprogramdeterminedtobecomparablebythe 136departmentofmentalhealth.Theadministratoroftheprogramshallremittothedivisionof 137alcoholanddrugabuseofthedepartmentofmentalhealthonorbeforethefifteenthdayof 138eachmonththesupplementalfeeforallpersonsenrolledintheprogram,lesstwopercentfor 139administrativecosts.Interestshallbechargedonanyunpaidbalanceofthesupplementalfees 140duethedivisionofalcoholanddrugabusepursuanttothissectionandshallaccrueatarate 141nottoexceedtheannualrateestablishedpursuanttotheprovisionsofsection32.065,plus 142threepercentagepoints.Thesupplementalfeesandanyinterestreceivedbythedepartment 143ofmentalhealthpursuanttothissectionshallbedepositedinthementalhealthearningsfund 144whichiscreatedinsection630.053. 145 16.Anyadministratorwhofailstoremittothedivisionofalcoholanddrugabuseof 146thedepartmentofmentalhealththesupplementalfeesandinterestforallpersonsenrolledin 147theprogrampursuanttothissectionshallbesubjecttoapenaltyequaltotheamountof HCS#2HB495 19 148interestaccruedonthesupplementalfeesduethedivisionpursuanttothissection.Ifthe 149supplementalfees,interest,andpenaltiesarenotremittedtothedivisionofalcoholanddrug 150abuseofthedepartmentofmentalhealthwithinsixmonthsoftheduedate,theattorney 151generalofthestateofMissourishallinitiateappropriateactionofthecollectionofsaidfees 152andinterestaccrued.Thecourtshallassessattorneyfeesandcourtcostsagainstany 153delinquentprogram. 154 17.Anypersonwhohashadalicensetooperateamotorvehiclesuspendedor 155revokedasaresultof: 156 (1)Anassessmentofpointsforaconvictionforanintoxication-relatedtraffic 157offense, asdefinedundersection577.001,inwhichtheperson'sbloodalcoholcontentwas 158foundtobeatleasteight-hundredthsofonepercentbutlessthanfifteen-hundredthsof 159onepercentbyweightofalcoholinsuchperson'sbloodandwhohasaprioralcohol- 160relatedenforcementcontactasdefinedundersection302.525[,]; or 161 (2)Anassessmentofpointsforaconvictionforanintoxication-relatedtraffic 162offense,asdefinedundersection577.001,inwhichtheperson'sbloodalcoholcontent 163wasfoundtobefifteen-hundredthsofonepercentormorebyweightofalcoholinsuch 164person'sblood 165 166shallberequiredtofileproofwiththedirectorofrevenuethatanymotorvehicleoperatedby 167thepersonisequippedwithafunctioning,certifiedignitioninterlockdeviceasarequired 168conditionofreinstatementofthelicense.Theignitioninterlockdeviceshallfurtherbe 171reportsshowthattheignitioninterlockdevicehasregisteredanyconfirmedbloodalcohol 172concentrationreadingsabovethealcoholsetpointestablishedbythedepartmentof 173transportationorthatthepersonhastamperedwithorcircumventedtheignitioninterlock 174devicewithinthelastthreemonthsofthesix-monthperiodofrequiredinstallationofthe 175ignitioninterlockdevice,thentheperiodforwhichthepersonmustmaintaintheignition 176interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas 177completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe 178personfailstomaintainsuchproofwiththedirector,thelicenseshallberesuspendedor 179revokedandthepersonshallbeguiltyofaclassAmisdemeanor. 302.440.Inadditiontoanyotherprovisionsoflaw,acourtmayrequirethatany 2personwhoisfoundguiltyofafirstintoxication-relatedtrafficoffense,asdefinedinsection 3577.001,andacourtshallrequirethatanypersonwhoisfoundguiltyofasecondor 4subsequentintoxication-relatedtrafficoffense,asdefinedinsection577.001,oranyperson 5whoisfoundguiltyofanintoxication-relatedtrafficoffense,asdefinedundersection HCS#2HB495 20 6577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobefifteen-hundredths 7ofonepercentormorebyweightofalcoholinsuchperson'sbloodshallnotoperateany 8motorvehicleunlessthatvehicleisequippedwithafunctioning,certifiedignitioninterlock 9devicethatthepersonmustuseforaperiodofnotlessthansixmonthsfromthedateof 10reinstatementoftheperson'sdriver'slicense.Inaddition,anycourtauthorizedtogranta 11limiteddrivingprivilegeundersection302.309toanypersonwhoisfoundguiltyofasecond 12orsubsequentintoxication-relatedtrafficoffenseortoanypersonwhoisfoundguiltyofan 13intoxication-relatedtrafficoffense,asdefinedundersection577.001,inwhichthe 14person'sbloodalcoholcontentwasfoundtobefifteen-hundredthsofonepercentor 15morebyweightofalcoholinsuchperson'sbloodshallrequiretheuseofanignition 16interlockdeviceonallvehiclesoperatedbythepersonasarequiredconditionofthelimited 17drivingprivilege,exceptasprovidedinsection302.441.Theserequirementsshallbein 18additiontoanyotherprovisionsofthischapterorchapter577requiringinstallationand 19maintenanceofanignitioninterlockdevice.Anypersonrequiredtouseanignitioninterlock 20deviceshallcomplywithsuchrequirementsubjecttothepenaltiesprovidedbysection 21577.599. 302.525.1.Thelicensesuspensionorrevocationshallbecomeeffectivefifteendays 2afterthesubjectpersonhasreceivedthenoticeofsuspensionorrevocationasprovidedin 3section302.520,orisdeemedtohavereceivedthenoticeofsuspensionorrevocationbymail 4asprovidedinsection302.515.Ifarequestforahearingisreceivedbyorpostmarkedtothe 5departmentwithinthatfifteen-dayperiod,theeffectivedateofthesuspensionorrevocation 6shallbestayeduntilafinalorderisissuedfollowingthehearing;provided,thatanydelayin 7thehearingwhichiscausedorrequestedbythesubjectpersonorcounselrepresentingthat 8personwithoutgoodcauseshownshallnotresultinastayofthesuspensionorrevocation 9duringtheperiodofdelay. 10 2.Theperiodoflicensesuspensionorrevocationunderthissectionshallbeas 11follows: 12 (1)Iftheperson'sdrivingrecordshowsnoprioralcohol-relatedenforcementcontacts 13duringtheimmediatelyprecedingfiveyears,theperiodofsuspensionshallbethirtydays 14aftertheeffectivedateofsuspension,followedbyasixty-dayperiodofrestricteddriving 15privilegeasdefinedinsection302.010andissuedbythedirectorofrevenue.Therestricted 16drivingprivilegeshallnotbeissueduntilheorshehasfiledproofoffinancialresponsibility 17withthedepartmentofrevenue,inaccordancewithchapter303,andisotherwiseeligible. 18Therestricteddrivingprivilegeshallindicate[whether] thatafunctioning,certifiedignition 19interlockdeviceisrequiredasaconditionofoperatingamotorvehicle.Acopyofthe 20restricteddrivingprivilegeshallbegiventothepersonandsuchpersonshallcarryacopyof 21therestricteddrivingprivilegewhileoperatingamotorvehicle.Innocaseshallrestricted HCS#2HB495 21 22drivingprivilegesbeissuedpursuanttothissectionorsection302.535untilthepersonhas 23completedthefirstthirtydaysofasuspensionunderthissection.Ifapersonotherwise 24subjecttotheprovisionsofthissubdivisionfilesproofofinstallationwiththedepartmentof 25revenuethatanyvehiclethatheorsheoperatesisequippedwithafunctioning,certified 26ignitioninterlockdevice,thereshallbenoperiodofsuspension.However,inlieuofa 27suspensionthepersonshallinsteadcompleteaninety-dayperiodofrestricteddriving 28privilege.Uponcompletionofsuchninety-dayperiodofrestricteddrivingprivilege, 29compliancewithotherrequirementsoflaw,andfilingofproofoffinancialresponsibilitywith 30thedepartmentofrevenue,inaccordancewithchapter303,thelicenseanddrivingprivilege 31shallbereinstated.However,ifthemonthlymonitoringreportsduringsuchninety-day 32periodindicatethattheignitioninterlockdevicehasregisteredaconfirmedbloodalcohol 33concentrationlevelabovethealcoholsetpointestablishedbythedepartmentoftransportation 34orsuchreportsindicatethattheignitioninterlockdevicehasbeentamperedwithor 35circumvented,thenthelicenseanddrivingprivilegeofsuchpersonshallnotbereinstated 36untilthepersoncompletesanadditionalthirty-dayperiodofrestricteddrivingprivilege.If 37thepersonfailstomaintainsuchproofofthedevicewiththedirectorofrevenueasrequired, 38therestricteddrivingprivilegeshallbeterminated; 39 (2)Theperiodofrevocationshallbeoneyeariftheperson'sdrivingrecordshows 40oneormoreprioralcohol-relatedenforcementcontactsduringtheimmediatelyprecedingfive 41years; 42 (3)Innocaseshallrestricteddrivingprivilegesbeissuedunderthissectiontoany 43personwhosedrivingrecordshowsoneormoreprioralcohol-relatedenforcementcontactsor 44toanypersonwhosedrivingrecordshowsaconvictionofanintoxication-relatedtraffic 45offense,asdefinedundersection577.001,inwhichtheperson'sbloodalcoholcontent 46wasfoundtobefifteen-hundredthsofonepercentormorebyweightofalcoholinsuch 47person'sblooduntilthepersonhasfiledproofwiththedepartmentofrevenuethatanymotor 48vehicleoperatedbythepersonisequippedwithafunctioning,certifiedignitioninterlock 49deviceasarequiredconditionoftherestricteddrivingprivilege.Ifthepersonfailsto 50maintainsuchprooftherestricteddrivingprivilegeshallbeterminated. 51 3.Forpurposesofthissection,"alcohol-relatedenforcementcontacts"shallinclude 52anysuspensionorrevocationundersections302.500to302.540,anysuspensionor 53revocationenteredinthisoranyotherstateforarefusaltosubmittochemicaltestingunder 54animpliedconsentlaw,andanyconvictioninthisoranyotherstateforaviolationwhich 55involvesdrivingwhileintoxicated,drivingwhileundertheinfluenceofdrugsoralcohol,or 56drivingavehiclewhilehavinganunlawfulalcoholconcentration. 57 4.Wherealicenseissuspendedorrevokedunderthissectionandthepersonisalso 58convictedonchargesarisingoutofthesameoccurrenceforaviolationofsection577.010or HCS#2HB495 22 59577.012orforaviolationofanycountyormunicipalordinanceprohibitingdrivingwhile 60intoxicatedoralcohol-relatedtrafficoffense,boththesuspensionorrevocationunderthis 61sectionandanyothersuspensionorrevocationarisingfromsuchconvictionsshallbe 62imposed,buttheperiodofsuspensionorrevocationundersections302.500to302.540shall 63becreditedagainstanyothersuspensionorrevocationarisingfromsuchconvictions,andthe 64totalperiodofsuspensionorrevocationshallnotexceedthelongerofthetwosuspensionor 65revocationperiods. 66 5.Anypersonwhohashadalicensetooperateamotorvehiclerevokedunderthis 67sectionorsuspendedunderthissectionwithoneormoreprioralcohol-relatedenforcement 68contactsoraconvictionforanintoxication-relatedtrafficoffense,asdefinedunder 69section577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobefifteen- 70hundredthsofonepercentormorebyweightofalcoholinsuchperson'sbloodshowing 71ontheirdriverrecordshallberequiredtofileproofwiththedirectorofrevenuethatany 72motorvehicleoperatedbythatpersonisequippedwithafunctioning,certifiedignition 73interlockdeviceasarequiredconditionofreinstatement.Theignitioninterlockdeviceshall 74furtherberequiredtobemaintainedonallmotorvehiclesoperatedbythepersonforaperiod 75ofnotlessthansixmonthsimmediatelyfollowingthedateofreinstatement.Ifthemonthly 76monitoringreportsshowthattheignitioninterlockdevicehasregisteredanyconfirmedblood 77alcoholconcentrationreadingsabovethealcoholsetpointestablishedbythedepartmentof 78transportationorthatthepersonhastamperedwithorcircumventedtheignitioninterlock 79devicewithinthelastthreemonthsofthesix-monthperiodofrequiredinstallationofthe 80ignitioninterlockdevice,thentheperiodforwhichthepersonmustmaintaintheignition 81interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas 82completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe 83personfailstomaintainsuchproofwiththedirector,thelicenseshallbesuspendedor 84revoked,untilproofasrequiredbythissectionisfiledwiththedirector,andthepersonshall 85beguiltyofaclassAmisdemeanor. 302.574.1.Ifapersonwhowasoperatingavehiclerefusesupontherequestofthe 2officertosubmittoanychemicaltestundersection577.041,theofficershall,onbehalfofthe 3directorofrevenue,servethenoticeoflicenserevocationpersonallyuponthepersonand 4shalltakepossessionofanylicensetooperateavehicleissuedbythisstatewhichisheldby 5thatperson.Theofficershallissueatemporarypermit,onbehalfofthedirectorofrevenue, 6whichisvalidforfifteendaysandshallalsogivethepersonnoticeofhisorherrighttofilea 7petitionforreviewtocontestthelicenserevocation. 8 2.Suchofficershallmakeacertifiedreportunderpenaltiesofperjuryformakinga 9falsestatementtoapublicofficial.Thereportshallbeforwardedtothedirectorofrevenue 10andshallincludethefollowing: HCS#2HB495 23 11 (1)Thattheofficerhas: 12 (a)Reasonablegroundstobelievethatthearrestedpersonwasdrivingamotor 13vehiclewhileinanintoxicatedcondition;or 14 (b)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 15twenty-oneyears,wasdrivingamotorvehiclewithabloodalcoholcontentoftwo- 16hundredthsofonepercentormorebyweight;or 17 (c)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 18twenty-oneyears,wascommittingaviolationofthetrafficlawsofthestate,orpolitical 19subdivisionofthestate,andsuchofficerhasreasonablegroundstobelieve,aftermakingsuch 20stop,thatthepersonhadabloodalcoholcontentoftwo-hundredthsofonepercentorgreater; 21 (2)Thatthepersonrefusedtosubmittoachemicaltest; 22 (3)Whethertheofficersecuredthelicensetooperateamotorvehicleoftheperson; 23 (4)Whethertheofficerissuedafifteen-daytemporarypermit; 24 (5)Copiesofthenoticeofrevocation,thefifteen-daytemporarypermit,andthe 25noticeoftherighttofileapetitionforreview.Thenoticesandpermitmaybecombinedin 26onedocument;and 27 (6)Anylicense,whichtheofficerhastakenintopossession,tooperateamotor 28vehicle. 29 3.Uponreceiptoftheofficer'sreport,thedirectorshallrevokethelicenseofthe 30personrefusingtotakethetestforaperiodofoneyear;orifthepersonisanonresident,such 31person'soperatingpermitorprivilegeshallberevokedforoneyear;orifthepersonisa 32residentwithoutalicenseorpermittooperateamotorvehicleinthisstate,anordershallbe 33issueddenyingthepersontheissuanceofalicenseorpermitforaperiodofoneyear. 34 4.Ifaperson'slicensehasbeenrevokedbecauseoftheperson'srefusaltosubmittoa 35chemicaltest,suchpersonmaypetitionforahearingbeforeacircuitdivisionorassociate 36divisionofthecourtinthecountyinwhichthearrestorstopoccurred.Pursuanttolocalcourt 37rulepromulgatedpursuanttoSection15ofArticleVoftheMissouriConstitution,thecase 38mayalsobeassignedtoatrafficjudgepursuanttosection479.500.Thepersonmayrequest 39suchcourttoissueanorderstayingtherevocationuntilsuchtimeasthepetitionforreview 40canbeheard.Ifthecourt,initsdiscretion,grantssuchstay,itshallentertheorderupona 41formprescribedbythedirectorofrevenueandshallsendacopyofsuchordertothedirector. 42Suchordershallserveasproofoftheprivilegetooperateamotorvehicleinthisstateandthe 43directorshallmaintainpossessionoftheperson'slicensetooperateamotorvehicleuntil 44terminationofanyrevocationunderthissection.Upontheperson'srequest,theclerkofthe 45courtshallnotifytheprosecutingattorneyofthecountyandtheprosecutorshallappearatthe 46hearingonbehalfofthedirectorofrevenue.Atthehearing,thecourtshalldetermineonly: 47 (1)Whetherthepersonwasarrestedorstopped; HCS#2HB495 24 48 (2)Whethertheofficerhad: 49 (a)Reasonablegroundstobelievethatthepersonwasdrivingamotorvehiclewhile 50inanintoxicatedordruggedcondition;or 51 (b)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 52twenty-oneyears,wasdrivingamotorvehiclewithabloodalcoholcontentoftwo- 53hundredthsofonepercentormorebyweight;or 54 (c)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 55twenty-oneyears,wascommittingaviolationofthetrafficlawsofthestate,orpolitical 56subdivisionofthestate,andsuchofficerhadreasonablegroundstobelieve,aftermakingsuch 57stop,thatthepersonhadabloodalcoholcontentoftwo-hundredthsofonepercentorgreater; 58and 59 (3)Whetherthepersonrefusedtosubmittothetest. 60 114fifteen-hundredthsofonepercentormorebyweightofalcoholinsuchperson'sblood 115shallberequiredtofileproofwiththedirectorofrevenuethatanymotorvehicleoperatedby 116thepersonisequippedwithafunctioning,certifiedignitioninterlockdeviceasarequired 117conditionoflicensereinstatement.Suchignitioninterlockdeviceshallfurtherberequiredto 118bemaintainedonallmotorvehiclesoperatedbythepersonforaperiodofnotlessthansix 119monthsimmediatelyfollowingthedateofreinstatement.Ifthemonthlymonitoringreports 120showthattheignitioninterlockdevicehasregisteredanyconfirmedbloodalcohol 121concentrationreadingsabovethealcoholsetpointestablishedbythedepartmentof HCS#2HB495 26 122transportationorthatthepersonhastamperedwithorcircumventedtheignitioninterlock 123devicewithinthelastthreemonthsofthesix-monthperiodofrequiredinstallationofthe 124ignitioninterlockdevice,thentheperiodforwhichthepersonshallmaintaintheignition 125interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas 126completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe 127personfailstomaintainsuchproofwiththedirectorasrequiredbythissection,thelicense 3endangerthepropertyofanotherorthelifeorlimbofanypersonandshallexercisethe 4highestdegreeofcare. 5 2.Nopersonoperatingamotorvehicleontheroadsandhighwaysofthisstate 6shallperformstuntdriving,assuchtermisdefinedinsection304.145. 7 3.AnypersonwhoviolatestheprovisionsofthissectionisguiltyofaclassB 8misdemeanor,unlessanaccidentisinvolvedthenitshallbeaclassAmisdemeanor. 46 (2)Theperson'sprevioushistoryofdomesticviolence; 47 (3)Theperson'shistoryofothercriminalacts,ifany; 48 (4)Whetherthepersonhasaccesstoaweapon; 49 (5)Whetherthepersonhasthreatenedsuicideorhomicide; 50 (6)Whetherthepersonhasahistoryofmentalillnessorhasbeencivillycommitted; HCS#2HB495 52 5 (2)Doesnotdependupontheconsentoftheownerofthepropertyaffectedorthe 6existenceofacontractforitsexistence;and 7 (3)Isnotanequitableorconstructivelienimposedbyastateorfederalcourtof 8competentjurisdiction. 9 2.Thissectionshallnotapplytoafilingofficerasdefinedinsection428.105thatis 10actinginthescopeofhisorheremployment. 11 3.TheoffenseoffilinganonconsensualcommonlawlienisaclassBmisdemeanor, 12unlessitisasecondoffense,inwhichcaseitisaclassAmisdemeanor.Anythirdor 13subsequentoffenseoffilinganonconsensualcommonlawlienisaclassEfelony.Any 14personconvictedofathirdorsubsequentoffenseoffilinganonconsensualcommonlaw 15lienshallbeconsideredapersistentoffender,assuchtermisdefinedinsection558.016. 575.150.1.Apersoncommitstheoffenseofresistingorinterferingwitharrest, 2detention,orstopifheorsheknowsorreasonablyshouldknowthatalawenforcement 3officerismakinganarrestorattemptingtolawfullydetainorstopanindividualorvehicle, 4andforthepurposeofpreventingtheofficerfromeffectingthearrest,stopordetention,heor 5she: 6 (1)Resiststhearrest,stopordetentionofsuchpersonbyusingorthreateningtheuse 7ofviolenceorphysicalforceorbyfleeingfromsuchofficer;or 8 (2)Interfereswiththearrest,stopordetentionofanotherpersonbyusingor 9threateningtheuseofviolence,physicalforceorphysicalinterference. 10 2.Thissectionappliesto: 11 (1)Arrests,stops,ordetentions,withorwithoutwarrants; 12 (2)Arrests,stops,ordetentions,foranyoffense,infraction,orordinanceviolation; 13and 14 (3)Arrestsforwarrantsissuedbyacourtoraprobationandparoleofficer. 15 3.Apersonispresumedtobefleeingavehiclestopifheorshecontinuestooperatea 16motorvehicleafterheorshehasseenorshouldhaveseenclearlyvisibleemergencylightsor 17hasheardorshouldhaveheardanaudiblesignalemanatingfromthelawenforcementvehicle 18pursuinghimorher. 19 4.Itisnodefensetoaprosecutionpursuanttosubsection1ofthissectionthatthelaw 20enforcementofficerwasactingunlawfullyinmakingthearrest.However,nothinginthis 21sectionshallbeconstruedtobarcivilsuitsforunlawfularrest. 22 5.TheoffenseofresistingorinterferingwithanarrestisaclassEfelonyforanarrest 23fora: 24 (1)Felony; 25 (2)Warrantissuedforfailuretoappearonafelonycase;or 26 (3)Warrantissuedforaprobationviolationonafelonycase. HCS#2HB495 53 27 28Theoffenseofresistinganarrest,detentionorstopinviolationofsubdivision(1)or(2)of 29subsection1ofthissectionisaclassAmisdemeanor,unlessthepersonfleeingcreatesa 30substantialriskofseriousphysicalinjuryordeathtoanyperson,inwhichcaseitisaclassE 31felony. 32 6.Inthecaseofanoffenseunderthissectionthatissubjecttopunishmentasa 33classEfelony,anyvehicleusedinviolationofthissectionshallbeimpoundedand 34forfeitedpursuanttosection82.1000andsections513.600to513.645. 576.030.1.Apersoncommitstheoffenseofobstructinggovernmentoperationsifhe 2orshepurposelyobstructs,impairs,hindersorpervertstheperformanceofagovernmental 3functionbytheuseorthreatofviolence,force,orotherphysicalinterferenceorobstacle. 4 2.Theoffenseofobstructinggovernmentoperationsisaclass[B]Amisdemeanorif 5thepersonthreatensviolence,force,orotherphysicalinterferenceorobstacle.The 6offenseofobstructinggovernmentoperationsisaclassEfelonyifthepersonuses 7violence,force,orotherphysicalinterferenceorobstacle. 577.150.1.Apersoncommitstheoffenseoftamperingwithawatersupplyifheor 2shepurposely: 3 (1)Poisons,defiles, orinanywaycorruptsthewaterofawell,spring,brook, or 4reservoirusedfordomesticormunicipalpurposes;or 5 (2)Diverts,damsup,andholdsbackfromitsnaturalcourseandflowanyspring, 6brook, orotherwatersupplyfordomesticormunicipalpurposes,aftersaidwatersupplyshall 7haveoncebeentakenforusebyanypersonorpersons,corporation,town, orcityfortheir 8use. 9 2.TheoffenseoftamperingwithawatersupplyisaclassEfelonywhentheoffense 10isaviolationofsubdivision(1)ofsubsection1ofthissectionandisaclassA 11misdemeanorwhentheoffenseisaviolationofsubdivision(2)ofsubsection1ofthis 12section. 590.208.1.Thereisherebyestablishedthe"CommitteeonSchoolSafety" 2withinthedepartmentofpublicsafety. 3 2.Thecommitteeshallconsistofthefollowingmembers: 4 (1)Uptothreerepresentativesofthedepartmentofpublicsafety,oneofwhom 5shallbearepresentativeoftheMissouriStateEmergencyManagementAgency; 6 (2)ArepresentativeoftheMissouriSheriff'sAssociation; 7 (3)ArepresentativeoftheMissouriMunicipalLeague; 8 (4)Arepresentativeofthedepartmentofelementaryandsecondaryeducation; 9and HCS#2HB495 54 10 (5)ArepresentativeoftheMissouriSchoolBoards'Association'sCenterfor 11EducationSafety. 12 3.Onememberwhorepresentsthedepartmentofpublicsafetyshallserveas 13chairofthecommittee. 14 4.Membersofthecommitteeshallservewithoutcompensationbutmaybe 15reimbursedforactualexpensesnecessarytotheperformanceoftheirofficialdutiesfor 16thecommittee. 17 5.Thecommitteeshallmeetatleastfourtimesperyearandatleastonceper 18calendarquartertoevaluateandestablishguidelinesforschoolsafetyconcerns, 19includingplanstopreventandimproveresponsestoschoolfirearmviolence. 20 6.Exceptasprovidedinsection610.021,allmeetingsofthecommitteeshallbe 21opentothepublic. 22 7.Thecommitteeshallsubmitareportinwritingtothegovernor,presidentpro 23temporeofthesenate,andspeakerofthehouseofrepresentativesonanannualbasis. [84.175.1.Uponrecommendationofthechiefofpolice,theboard 2 mayauthorizeandprovidefortheorganizationofapolicereserveforce 3 composedofmemberswhoreceiveaserviceretirementundertheprovisions 4 ofsections86.200to86.366andwhoqualifyundertheprovisionsofsection 5 84.120.Suchreserveforceshallbeunderthecommandofthechiefofpolice 6 andshallbeprovidedtraining,equipment,uniforms,andarmsasthechief 7 shalldirectwiththeapprovaloftheboard.Membersofthereserveforceshall 8 possessallofthepowersofregularpoliceofficersandshallbesubjecttoall 9 lawsandregulationsapplicabletopoliceofficers;provided,however,thatthe 10 citycouncilorothergoverningbodyofanysuchcitymayinitsdiscretionfixa 11 totalinnumberwhichthereserveforcemaynotexceed. 12 2.Ineventofriotorotheremergenciesasdeclaredanddefinedbythe 13 mayor,inconcurrencewiththeboard,theboard,uponrecommendationofthe 14 chief,mayappointspecialofficersorpatrolmenfortemporaryservicein 15 additiontothepolicereserveforcehereinprovidedfor,butthelengthoftime 16 forwhichsuchofficersorpatrolmenshallbeemployedshallbelimitedtothe 17 timeduringwhichsuchemergencyshallexist.] [84.240.Theboardofpolicecommissionersshallestablishthe 2 Bertillonsystemofidentificationofcriminalsandothersbymeansof 3 anthropometricindications,andtheyarefurtherrequiredtoemploysuch 4 additionalassistanceasmaybenecessarytoproperlyconductandmanagethis 5 department.] [84.341.Noelectedorappointedofficialofthestateoranypolitical 2 subdivisionthereofshallactorrefrainfromactinginanymannertoimpede, 3 obstruct,hinder,orotherwiseinterferewithanymemberofamunicipalpolice 4 forceestablishedundersections84.343to84.346intheperformanceofhisor 5 herjobduties,orwithanyaspectofanyinvestigationarisingfromthe HCS#2HB495 55 6 performanceofsuchjobduties.Thissectionshallnotbeconstruedtoprevent 7 suchofficialsfromactingwithinthenormalcourseandscopeoftheir 8 employmentorfromactingtoimplementsections84.343to84.346.Any 9 personwhoviolatesthissectionshallbeliableforapenaltyoftwothousand 10 fivehundreddollarsforeachoffenseandshallforeverbedisqualifiedfrom 11 holdinganyofficeoremploymentwhatsoeverwiththegovernmentalentity 12 thepersonservedatthetimeoftheviolation.Thepenaltyshallnotbepaidby 13 thefundsofanycommitteeasthetermcommitteeisdefinedinsection 14 130.011.Thissectionshallnotbeconstruedtointerferewiththepunishment, 15 underanylawsofthisstate,ofacriminaloffensecommittedbysuchofficials, 16 norshallthissectionapplytodulyappointedmembersofthemunicipalpolice 17 force,ortheirappointingauthorities,whoseconductisotherwiseprovidedfor 18 bylaw.] [84.342.1.Itshallbeanunlawfulemploymentpracticeforanofficial, 2 employee,oragentofamunicipalpoliceforceestablishedundersections 3 84.343to84.346todischarge,demote,reducethepayof,orotherwiseretaliate 4 againstanemployeeofthemunicipalpoliceforceforreportingtoany 5 superior,governmentagency,orthepresstheconductofanotheremployee 6 thatthereportingemployeebelieves,ingoodfaith,isillegal. 7 2.Anyemployeeofthemunicipalpoliceforcemaybringacauseof 8 actionforgeneralorspecialdamagesbasedonaviolationofthissection.] [84.343.1.Subjecttotheprovisionsofsections84.344to84.346,any 2 citynotwithinacountymayestablishamunicipalpoliceforceforthe 3 purposesof: 4 (1)Preservingthepublicpeace,welfare,andorder; 5 (2)Preventingcrimeandarrestingsuspectedoffenders; 6 (3)Enforcingthelawsofthestateandordinancesofthecity; 7 (4)Exercisingallpowersavailabletoapoliceforceundergenerally 8 applicablestatelaw;and 9 (5)Regulatingandlicensingallprivatewatchmen,privatedetectives, 10 andprivatepolicemenservingoractingassuchinsaidcity. 11 2.Anypersonwhoactsasaprivatewatchman,privatedetective,or 12 privatepolicemaninsaidcitieswithouthavingobtainedawrittenlicensefrom 13 saidcitiesisguiltyofaclassAmisdemeanor.] [84.344.1.Notwithstandinganyprovisionsofthischaptertothe 2 contrary,anycitynotwithinacountymayestablishamunicipalpoliceforce 3 onorafterJuly1,2013,accordingtotheproceduresandrequirementsofthis 4 section.Thepurposeoftheseproceduresandrequirementsistoprovideforan 5 orderlyandappropriatetransitioninthegovernanceofthepoliceforceand 6 provideforanequitableemploymenttransitionforcommissionedandcivilian 7 personnel. 8 2.Upontheestablishmentofamunicipalpoliceforcebyacityunder 9 sections84.343to84.346,theboardofpolicecommissionersshallconvey, 10 assign,andotherwisetransfertothecitytitleandownershipofall 11 indebtednessandassets,including,butnotlimitedto,allfundsandrealand HCS#2HB495 56 12 personalpropertyheldinthenameoforcontrolledbytheboardofpolice 13 commissionerscreatedundersections84.010to84.340.Theboardofpolice 14 commissionersshallexecutealldocumentsreasonablyrequiredtoaccomplish 15 suchtransferofownershipandobligations. 16 3.Ifthecityestablishesamunicipalpoliceforceandcompletesthe 17 transferdescribedinsubsection2ofthissection,thecityshallprovidethe 18 necessaryfundsforthemaintenanceofthemunicipalpoliceforce. 19 4.Beforeacitynotwithinacountymayestablishamunicipalpolice 20 forceunderthissection,thecityshalladoptanordinanceaccepting 21 responsibility,ownership,andliabilityassuccessor-in-interestfor 22 contractualobligations,indebtedness,andotherlawfulobligationsofthe 23 boardofpolicecommissionerssubjecttotheprovisionsofsubsection2of 24 section84.345. 25 5.Acitynotwithinacountythatestablishesamunicipalpoliceforce 26 shallinitiallyemploy,withoutareductioninrank,salary,orbenefits,all 27 commissionedandcivilianpersonneloftheboardofpolicecommissioners 28 createdundersections84.010to84.340thatwereemployedbytheboard 29 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such 30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay 31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The 32 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned 33 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such 34 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey 35 wereentitledtoasemployeesoftheboardofpolicecommissioners. 36 6.Commissionedandcivilianpersonnelofamunicipalpoliceforce 37 establishedunderthissectionshallnotbesubjecttoaresidencyrequirementof 38 retainingaprimaryresidenceinacitynotwithinacountybutmayberequired 39 tomaintainaprimaryresidencelocatedwithinaone-hourresponsetime. 40 7.Thecommissionedandcivilianpersonnelwhoretirefromservice 41 withtheboardofpolicecommissionersbeforetheestablishmentofa 42 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe 43 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame 44 benefitssetforthinsubsection5ofthissection. 45 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice 46 forceunderthissection,thecityshallestablishaseparatedivisionforthe 47 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe 48 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa 49 policedepartment.Suchrulesandregulationsshallreserveexclusive 50 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned 51 officerstothecivilservicecommission;however,untilsuchtimeasthecity 52 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue 53 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin 54 purposesofapplyingtherulesandregulations.Unlessotherwiseprovidedfor, 57 existingcivilservicecommissionrulesandregulationsgoverningtheappealof 58 disciplinarydecisionstothecivilservicecommissionshallapplytoall 59 commissionedandcivilianpersonnel.Thecivilservicecommission'srules HCS#2HB495 57 60 andregulationsshallprovidethatrecordspreparedfordisciplinarypurposes 61 shallbeconfidential,closedrecordsavailablesolelytothecivilservice 62 commissionandthosewhopossessauthoritytoconductinvestigations 63 regardingdisciplinarymatterspursuanttothecivilservicecommission'srules 64 andregulations.Ahearingofficershallbeappointedbythecivilservice 65 commissiontohearanysuchappealsthatinvolvedisciplineresultingina 66 suspensionofgreaterthanfifteendays,demotion,ortermination,butthecivil 67 servicecommissionshallmakethefinalfindingsoffact,conclusionsoflaw, 68 anddecisionwhichshallbesubjecttoanyrightofappealunderchapter536. 69 9.Acitynotwithinacountythatestablishesandmaintainsa 70 municipalpoliceforceunderthissection: 71 (1)Shallprovideorcontractforlifeinsurancecoverageandfor 72 insurancebenefitsprovidinghealth,medical,anddisabilitycoveragefor 73 commissionedandcivilianpersonnelofthemunicipalpoliceforcetothesame 74 extentaswasprovidedbytheboardofpolicecommissionersundersection 75 84.160; 76 (2)Shallprovideorcontractformedicalandlifeinsurancecoverage 77 10.Acitynotwithinacountythatestablishesamunicipalpoliceforce 93 undersections84.343to84.346shallestablishatransitioncommitteeoffive 94 membersforthepurposeof:coordinatingandimplementingthetransitionof 95 authority,operations,assets,andobligationsfromtheboardofpolice 96 commissionerstothecity;windingdowntheaffairsoftheboard;making 97 nonbindingrecommendationsforthetransitionofthepoliceforcefromthe 98 boardtothecity;andotherrelatedduties,ifany,establishedbyexecutive 99 orderofthecity'smayor.Oncetheordinancereferencedinthissectionis 100 enacted,thecityshallprovidewrittennoticetotheboardofpolice 101 commissionersandthegovernorofthestateofMissouri.Withinthirty 102 daysofsuchnotice,themayorshallappointthreememberstothecommittee, 103 twoofwhomshallbemembersofastatewidelawenforcementassociation 104 thatrepresentsatleastfivethousandlawenforcementofficers.Theremaining 105 membersofthecommitteeshallincludethepolicechiefofthemunicipal 106 policeforceandapersonwhocurrentlyorpreviouslyservedasa HCS#2HB495 58 107 commissionerontheboardofpolicecommissioners,whoshallbeappointedto 108 thecommitteebythemayorofsuchcity.] [84.345.1.Exceptasrequiredfortheboardofpolicecommissioners 2 toconcludeitsaffairsandpursuelegalclaimsanddefenses,uponthe 3 establishmentofamunicipalpoliceforce,thetermsofofficeofthe 4 commissionersoftheboardofpolicecreatedundersections84.020and 5 84.030shallexpire,andtheprovisionsofsections84.010to84.340shallnot 6 applytoanycitynotwithinacountyoritsmunicipalpoliceforceasofsuch 7 date.Theboardshallcontinuetooperate,ifnecessary,towinddownthe 8 board'saffairsuntilthetransferofownershipandobligationsundersubsection 9 2ofsection84.344hasbeencompleted.Duringsuchtime,theboardofpolice 10 commissionersshalldesignateandauthorizeitssecretarytoactonbehalfof 11 theboardforpurposesofperformingtheboard'sdutiesandanyotheractions 12 incidenttothetransferandwindingdownoftheboard'saffairs. 13 2.Foranyclaim,lawsuit,orotheractionarisingoutofactions 14 occurringbeforethedateofcompletionofthetransferprovidedunder 15 subsection2ofsection84.344,thestateshallcontinuetoprovidelegal 16 representationassetforthinsection105.726,andthestatelegalexpensefund 17 shallcontinuetoprovidereimbursementforsuchclaimsundersection 18 105.726.Thissubsectionappliestoallclaims,lawsuits,andotheractions 19 broughtagainstanycommissioner,policeofficer,employee,agent, 20 representative,oranyindividualorentityactingorpurportingtoactonits 21 ortheirbehalf. 22 3.Notwithstandinganyotherprovisionoflaw,rule,orregulationto 23 thecontrary,anycitynotwithinacountythatestablishesamunicipalpolice 24 forceundersections84.343to84.346shallnotberestrictedorlimitedinany 25 wayintheselectionofapolicechieforchiefofthedivisioncreatedunder 26 subsection8ofsection84.344. 27 4.Itshallbethedutyofthesheriffforanycitynotwithinacounty, 28 whenevercalleduponbythepolicechiefofthemunicipalpoliceforce,toact 29 underthepolicechief'scontrolforthepreservationofthepublicpeaceand 30 quiet;and,whenevertheexigencyorcircumstancesmay,inthepolicechief's 31 judgment,warrantit,saidpolicechiefshallhavethepowertoassumethe 32 controlandcommandofalllocalandmunicipalconservatorsofthepeaceof 33 thecity,whethersheriff,constable,policemenorothers,andtheyshallact 34 undertheordersofthesaidpolicechiefandnototherwise.] [84.346.Anypolicepensionsystemcreatedunderchapter86forthe 2 benefitofapoliceforceestablishedundersections84.010to84.340shall 3 continuetobegovernedbychapter86,andshallapplytoanypoliceforce 4 establishedundersection84.343to84.346.Otherthananyprovisionthat 5
