Thisbillrequireslawenforcementagenciesinthestateto,by
January1,2028,andthereafter,submitreferralsfortraffic
violations,ordinanceviolations,misdemeanors,andfeloniestoa
prosecutingorcircuitattorneysotheMissouriOfficeof
ProsecutionServices(MOPS)cankeepcompleteandaccuratereports.
Anylawenforcementagencythatfailstocomplywillbeineligible
toreceivestateorfederalfundsthatwouldotherwisebepaidto
theagencyforlawenforcement,safety,orcriminaljustice
purposes.
Currently,$2,000oftheauthorizedsalaryfortheprosecuting
attorneyispayabletotheattorneyonlyiftheattorneyhas
completedatleast20hoursofclassroominstructiononcertain
topicseachyear.Thisbillchangesittoapplytoanyprosecuting
attorney,includinginthecityofSt.Louis.Additionally,$5,000
oftheauthorizedsalarywillbepayabletoaprosecutingattorney
onlyiftheattorneyhascollectedthespecifieddataeach
prosecutingattorney'sofficeisrequiredtocollectinamanner
approvedbytheProsecutorsCoordinatorsTrainingCouncilandto
makereadilyaccessibletoMOPS.Oftheauthorizedsalary,$3,000
willbepayabletoaprosecutingattorneyonlyiftheattorneyhas
provideddiscoverytocriminaldefenseattorneyswhohaveentered
anappearanceonbehalfofadefendantinamannerapprovedbythe
trainingcouncil. MOPSwillprovideacertificateofcompliance
fortherelevantrequirementstoeachprosecutingattorneywho
complieswiththisprovisionandwillsendalistofthecertified
prosecutingattorneystotherespectivetreasurerofeachcounty
andofthecityofSt.Louis.
StartingMarch31,2028,andbyMarch31ofeachyearthereafter,
MOPSwillcompileastatewidereportsummarizingcertaindata,
specifiedinthebill,fromtheautomatedcasemanagementsystem.
Thesummaryreportswillbeconsideredpublicrecords,butthe
individualinformationcompiledbyandreceivedfromeach
prosecutingorcircuitattorney'sofficeisconfidentialandwill
beaclosedrecordandnotsubjecttorelease.
IMMIGRATIONSTATUS(Section43.505)
Thisbillrequireseverylawenforcementagencyinthestateto
submittotheDepartmentofPublicSafetyanyinformation
pertainingtothecitizenorimmigrationstatusofanyperson
arrestedforareportableoffense. ThisprovisionissimilartoHB1147,SCSSB52&44,andSB583
(2025).
ASSISTANCEFROMOTHERLAWENFORCEMENTAGENCIES(Section44.087)
Thisbillallowsthechieflawenforcementexecutiveforanylaw
enforcementagencytorequestassistancefromalawenforcement
agencyinanotherjurisdiction,includingfromoutsidetheState
butwithintheUnitedStates.Thebillcreatesprovisionsforhow
arrestsarehandledifexecutedbyanofficeroutsideofhisorher
jurisdiction. Thisbillspecifiesthat,forbenefitsandother
employment-relatedmatters,lawenforcementofficersremain
employeesoftheirrespectivelawenforcementagenciesthroughout
anyrequestforassistance.

SHERIFFOFTHECITYOFST.LOUIS(Section57.010)
ThisbillrequiresthesheriffofthecityofSt.Louistoholda
validpeaceofficerlicensewithintwoyearsofbeingelected
sheriff.

STUNTDRIVINGANDSTREETTAKEOVERS(Sections82.1000,304.012,
304.145)
Thisbillallowsthegoverningbodyofcertaincitiestoenact
ordinancesthatwouldsubjecttoforfeiturethevehicleofaperson
whoselicensetooperateamotorvehiclesuspendedorrevokeddue
toafindingofpleaofguiltyfortwoormoreviolationsofstunt
drivingorstreettakeovercommittedonseparateoccasionswherein
eachviolationthepersonwasdrivingandanotherpersonwas
injuredorkilledorfortheoffenseofaggravatedfleeingastop
ordetentionofamotorvehicle.
Thebillcreatesanoffenseprohibitingtheperformanceofstunt
drivinginconnectionwithastreettakeoverortheperformanceor
participationinastreettakeover. TheoffenseisaclassB
misdemeanorforafirstoffense,aclassAmisdemeanorforasecond
offense,andaclassEfelonyforathirdorsubsequentoffense. A
personproventobeaprior,persistent,aggravated,chronic,or
habitualoffenderofstuntdrivingorstreettakeoverswillnotbe
eligibleforasuspendedimpositionofsentenceortopayafinein
lieuofimprisonment. Thebillprovidesminimumtermsof
imprisonmentorcommunityservicebeforeadefendantfoundtobe
oneofthespecifiedtypesofoffenderswillbeeligiblefor
probationorparole. ThisprovisionisthesameasSCSSBs52&44.
BOARDOFPOLICECOMMISSIONERS(Sections84.012,84.020,84.030,
84.100,84.160,84.170,84.225,84.325,105.726,andSectionB)
Thisbillestablishesaboardofpolicecommissionersmadeupof
themayorofthecityofSt.Louis,fourcitizencommissionerswho
mustberesidentsofthecityofSt.Louisforatleasttwoyears
priortoappointmenttotheboard,andonenon-votingcommissioner
whoisaresidentofthecityofSt.Louisorisaresidentofa
countythatadjoinsthecityofSt.Louisbutwhoownspropertyin
thecityofSt.Louis.TheboardwillassumecontroloftheSt.
LouisPoliceDepartmentaswellastheobligationsand
responsibilities ofthedepartment.
ThisbillprovidesthatthecityofSt.Louismaypassordinances,
includingordinancesforpreservingorderandprotectingthe
public,butnoordinance,charterprovision,orinitiativepetition
canconflictorinterferewiththepowersortheexerciseofthe
powersoftheBoardofPoliceCommissioners. Additionally,the
mayororanycityofficermustnotimpedeorhindertheBoardof
PoliceCommissioners. Themayororanycityofficerwillbeliable
forapenaltyof$1,000foreachoffensetohindertheBoardand
willforeverbedisqualifiedfromholdingorexercisinganyoffice
ofthecity.
Thebillcreatesafundingschedulefortheminimumthecitymust
budgettofundthepolicedepartment,increasingapercentage
annuallyuntilitreachesamaximumof25%ofthebudgetin2028.
Currently,theboardcancreateprogramstoprovideadditional
compensationtoemployeesforsuccessfulcompletionofacademic
workatanaccreditedcollegeoruniversity. Thisbillrequires
theboardtocreateprogramstoprovideadditionalcompensationfor
completingacademiccoursework.
Theseprovisionsaresubjecttoanemergencyclause.

FACILITIESALLOWINGINDIVIDUALSTOSELF-ADMINISTERCONTROLLED
SUBSTANCES(Section191.1005)
Thebillprohibitsapersonorentity,withexceptions,from
knowinglyopening,leasing,renting,owning,using,maintaining,
managing,operating,orcontrollingafacility,site,orbuilding
forthepurposeofallowingindividualstoself-administer
preobtainedillegallypossessedcontrolledsubstances. Thebill
doesnotaffectthegoodsamaritanexceptionforapersonwhoin goodfaithseeksorobtainsmedicalassistanceforhimselfor
herselforanotherpersonwhoisexperiencinganoverdoseofa
controlledsubstance.
ThisprovisionisthesameasSCSSBs52&44(2025).
JAILSANDCORRECTIONALCENTERS(Sections217.451,221.108,221.520,
and221.523)
Thisbillprohibitsajailorcorrectionalcenterfromchargingan
inmateoroffender,respectively,morethan$.12perminutefora
domesticphonecall.Thebillalsorequiresjailstoprovide
inmateswithreasonableaccesstophoneservicesbutitallows
jailstorestrictaccessasadisciplinarymeasure.
Thebillprohibitsjailsfromusingrestraintsonapregnant
offenderinherthirdtrimesterotherthaninextraordinary
circumstances. Sheriffsorjailerswhodeterminethat
extraordinarycircumstancesexist,requiringrestraintstobeused,
mustdocumentinwritingwithin48hoursthereasonsheorshe
determinedtheextraordinarycircumstancesexistedandthereasons
therestraintsweredeemedreasonableunderthecircumstances.
Thisbillrequiresallcityandcountyjailstodevelopprocedures
fortheintakeandcareofpregnantinmatesbyJanuary1,2026,and
thebilllistscertainitemsthatmustbeincluded.

ELECTRONICMONITORINGWITHVICTIMNOTIFICATION(Section455.095)
Thebillrepealstheexpirationdateoftheelectronicmonitoring
withvictimnotificationsystem.
ThisprovisionisthesameasaprovisioninSS#2SCSSB10(2025)
CRIMINALINFORMANTS(Sections491.065and595.209)
Thebillcreatesprovisionsrelatedtocriminalinformants. The
billprovidescertainmaterialsandinformationaprosecutingor
circuitattorneywhoendorsesawitnesstotestifyasaninformant
mustdisclosetoallattorneysofrecordwithin14daysofthe
endorsement.
Thebilladdstotherightsofvictimsofcrimestherighttobe
informedofthenameofaninformantwhohasbeenendorsedasa
witnessbyaprosecutingorcircuitattorneyandanybenefitthat hasbeenrequestedbyorofferedtotheinformantandanybenefit
thatmaybeprovidedatafuturedate.

ThebilladdsoffensesunderChapters301,304,311,409,491,567,
571,572,and578tothedefinitionof"criminalactivity"under
theCriminalActivityForfeitureAct.Theoffenseofbushijacking
whenpunishedasaclassAfelonyandtheoffenseofplantinga
bomborexplosiveinorhearabusorterminaltothedefinitionof
"dangerousfelony"inthecriminalcode.
Currently,theagethresholdforthevictimoftheoffenseof
sexualtraffickingofachildinthefirstdegreeisundertheage
of12.Thisbillincreasestheagetounder14.Additionally,a
personsentencedunderthisoffenseisnoteligibleforprobation
orparoleuntiltheoffenderhasservedatleast25yearsofthe
sentence. Thebillincreasestheminimumtermofimprisonmentto
atleast30years.Thisbillalsoincreasestheminimumprison
termforsexualtraffickingofachildintheseconddegreefromat
least10yearstoatleast20years.
Thebillamendstheoffenseofendangeringthewelfareofachild
inthefirstdegreetoincludewhenapersonunlawfully
manufacturesorattemptstomanufacture,compounds,possesses,
produces,prepares,sells,transports,tests,oranalyzesfentanyl
orcarfentaniloranyanaloguethereofinthepresenceofchild
undertheageof17orinaresidencewhereachildunder17
resides. Iftheoffenseofendangeringthewelfareofachildin
thefirstdegreeinvolvesfentanylorcarfentaniloranyanalogue
thereof,itisaclassBfelonyanditcarriesaminimumprison
termoffiveyears.
Thebilladdsorganizedretailtheft,definedinthebill,tothe
offenseofstealing. ItisaclassBfelonyapersonappropriates
propertyaspartofanorganizedretailtheftandthevalueofthe
propertytakencombinedwithanypropertydamageinflictedduring
thetheftis$10,000ormore.ItisaclassCfelonyifthe
combinedvalueis$750tolessthan$10,000. Ifaprosecutingor
circuitattorneymakesawrittenrequesttotheAttorneyGeneral,
theAttorneyGeneralwillhavetheauthoritytocommencea
prosecutionfortheoffenseofstealingifitinvolvesorganized
retailtheft.Thecostsandfeesoftheprosecutionwillbepaid
bythestate,notbyanycountyorlocalgovernment.
Thisbillamendstheoffenseoffilinganonconsensualcommonlaw
lienbymakingitaclassAmisdemeanorforasecondoffense. For
athirdorsubsequentoffense,itisaclassEfelony.Aperson convictedofathirdorsubsequentoffensewillbeconsidereda
persistentoffender.
Thisbillallowsavehicleusedintheoffenseofresistingarrest,
detention,orstopsubjecttoapunishmentasaclassEfelonyto
beimpoundedandforfeited.
Thebillmakestheoffenseofobstructinggovernmentoperationsa
classAmisdemeanorifthepersonusesviolenceorforcetocommit
theoffense.
Thebillamendsthepenaltiesfortheoffenseoftamperingwitha
watersupply,makingitaclassEfelonywhenapersonpurposely
poisons,defiles,orcorruptsthewaterofawell,spring,brook,
orreservoirusedfordomesticormunicipalpurposes,andaclassA
misdemeanorwhenapersondiverts,damsup,andholdsbackfromits
naturalcourseandflowanyspring,brook,orotherwatersupply
fordomesticormunicipalpurposes.

PEACEOFFICERTRAININGFORLICENSURE(Section590.040)
Thisbillrequiresthebasictrainingofeverypeaceofficerfirst
licensedonorafterAugust28,2027,toincludeatleastsixhours
oftrainingconcerningtheprohibitionagainstracialprofiling.
Thetrainingmustincludetwohoursofracialprofilingtraining,
twohoursofimplicitbiastraining,andtwohoursofde-escalation
training.
COMMITTEEONSCHOOLSAFETY(Section590.208)
Thebillcreatesthe"CommitteeonSchoolSafety"withinthe
DepartmentofPublicSafety.Thebillprovidesthemakeupofthe
committeeandrequirestherepresentative fromtheDepartmentto
serveasthechairofthecommittee. Thecommitteeisrequiredto
meetatleastfourtimesayearandatleastoncepercalendar
quartertoevaluateandestablishguidelinesforschoolsafety
concerns. Allmeetingsotherthanthoseallowedtobeclosedunder
statutewillbeopentothepublic.Thecommitteemustsubmita
writtenreportannuallytotheGovernor,PresidentProTemofthe
Senate,andtheSpeakeroftheHouse.
ThisprovisionissimilartoHB1076(2025).
MISSINGANDMURDEREDAFRICANAMERICANWOMENANDGIRLSTASKFORCE
(Section595.325) Thisbillestablishesthe"MissingandMurderedAfricanAmerican
WomenandGirlsTaskForce".Themembershipisspecifiedinthe
billandincludestwomembersoftheHouseofRepresentatives, with
oneappointedbytheSpeakerandoneappointedbytheMinority
FloorLeaderoftheHouseofRepresentatives. Thetaskforcemust
electachairpersonandholdaninitialmeetingbeforeOctober1,
2025.
TheTaskForcewillsubmitareportregardingpoliciesandmeasures
toaddressviolenceagainstAfricanAmericanwomenandgirlstothe
GovernorandtheGeneralAssemblyonorbeforeDecember31stof
eachyear.ThetaskforceexpiresonDecember31,2027,unlessthe
DepartmentofPublicSafetydeterminestheTaskForceshouldbe
extendeduntilDecember31,2029.

WRONGFULCONVICTION(Section650.058)
Currently,onlyindividualswhoareexoneratedbasedonDNA
evidencemayreceiverestitutionforawrongfulconviction. This
billprovidesthatanyindividualwhowaslaterdeterminedtobe
innocentasaresultofanevidentiaryhearingandfindinginana
habeascorpusproceedingoraproceedingheldpursuanttothe
prosecution'smotiontovacateorsetasideajudgmentmaybepaid
restitution.
Thebillincreasestheamountapersoncanreceivefrom$100to
$179perdayforeachdayofpostconviction incarcerationforthe
offensetheindividualisfoundtobeinnocent,upto$65,000per
fiscalyear.
Anyindividualfoundinnocentmayalsobeawardedothernonmonetary
reliefthatincludescounselingandhousingassistance.
