BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter196,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection196.1170,toreadasfollows:
196.1170.1.Thissectionshallbeknownandmaybecitedasthe"Kratom
2ConsumerProtectionAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Dealer",apersonwhosells,prepares,ormaintainskratomoradvertises,
5represents,orholdsoneselfoutasselling,preparing,ormaintainingkratom.Such
6personmayinclude,butnotbelimitedto,amanufacturer,wholesaler,store,restaurant,
7hotel,cateringfacility,camp,bakery,delicatessen,supermarket,grocerystore,
8conveniencestore,nursinghome,orfoodordrinkcompany;
9 (2)"Kratom",anygoodplacedinthemarketplacecontaininganypartofthe
10leafoftheplantMitragynaspeciosa.
11 3.Thegeneralassemblyherebyoccupiesandpreemptstheentirefieldof
12regulatingkratomtothecompleteexclusionofanyorder,ordinance,orregulationof
13anypoliticalsubdivisionofthisstate.Anypoliticalsubdivision'sexistingorfuture
14orders,ordinances,orregulationsrelatingtokratomareherebyvoid.
15 4.Adealerwhoprepares,distributes,sells,orexposesforsalekratomincluding,
16butnotlimitedto,kratomintendedforhumanconsumption,shalldisclosethefactual
17basisuponwhichthatrepresentationismade.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 5.Adealershallnotprepare,distribute,sell,orexposeforsaleanyofthe
19following:
20 (1)Kratomthatisadulteratedwithadangerousnonkratomsubstance.Kratom
21shallbeconsideredtobeadulteratedwithadangerousnonkratomsubstanceifthe
22kratomismixedorpackedwithanonkratomsubstanceandthatsubstanceaffectsthe
23qualityorstrengthofthekratomtosuchadegreeastorenderthekratominjurioustoa
24consumer;
25 (2)Kratomthatiscontaminatedwithadangerousnonkratomsubstance.
26Kratomshallbeconsideredtobecontaminatedwithadangerousnonkratomsubstance
27ifthekratomcontainsapoisonousorotherwisedeleteriousnonkratomingredient
28including,butnotlimitedto,anysubstancelistedinsection195.017;
29 (3)Kratomcontainingalevelof7-hydroxymitragynineinthealkaloidfraction
30thatisgreaterthantwopercentofthealkaloidcompositioncontainedtherein;
31 (4)Kratomcontaininganysyntheticalkaloids,includingsyntheticmitragynine,
32synthetic7-hydroxymitragynine,oranyothersyntheticallyderivedcompoundsofthe
33plantMitragynaspeciosa;or
34 (5)Kratomthatdoesnotincludeonitspackageorlabeltheamountof
35mitragynineand7-hydroxymitragyninecontainedtherein.
36 6.Adealershallnotdistribute,sell,orexposeforsalekratomtoanindividual
37undereighteenyearsofage.
38 7.(1)Adealerwhoviolatessubsection4ofthissectionshallbeguiltyofan
39infraction.
40 (2)Adealerwhoviolatessubsection5or6ofthissectionshallbeguiltyofaclass
41Dmisdemeanor.
42 (3)Apersonaggrievedbyaviolationofsubsection4or5ofthissectionmay,in
43additiontoanddistinctfromanyotherremedyatlaworinequity,bringaprivatecause
44ofactioninacourtofcompetentjurisdictionfordamagesresultingfromthatviolation
45including,butnotlimitedto,economic,noneconomic,andconsequentialdamages.
46 (4)Adealerdoesnotviolatesubsection4or5ofthissectionifapreponderance
47oftheevidenceshowsthatthedealerreliedingoodfaithupontherepresentationsofa
48manufacturer,processor,packer,ordistributorrepresentedtobekratom.
