Thisbillestablishesthe"KratomConsumerProtectionAct",which
requiresdealerswhoprepare,distribute,sell,orexposeforsale
kratom,asdefinedinthebill,todisclosethefactualbasison
whichthisrepresentation ismade.Adealerisprohibitedfrom
preparing,distributing,selling,orexposingforsalekratomthat
doesnotconformtotheselabelingrequirements.
TheGeneralAssemblypreemptstheentirefieldofregulatingkratom
totheexclusionofanyorder,ordinance,orregulationofany
politicalsubdivisionofthestate.Anyexistingorders,
ordinances,orregulationsofanypoliticalsubdivisionofthe
staterelatingtokratomarevoidunderthisbill.
Adealerisprohibitedfrompreparing,distributing,selling,or
exposingforsalekratomthatisadulteratedorcontaminatedwitha
dangerousnonkratomsubstance,containsalevelof7-
hydroxymitragynine inthealkaloidfractionthatisgreaterthan2%
compositionoftheproduct,containsanysyntheticalkaloids,or
doesnotincludeonitspackageorlabeltheamountofmitragynine,
7-hydroxymitragynine, orothersyntheticallyderivedcompoundsof
theplantMitragynaspeciosa. Adealerisprohibitedfrom
distributing,selling,orexposingforsalekratomtoanyoneunder
18yearsofage.
Thebillspecifiespenaltiesforaviolationoftheserequirements
andallowsforapersonwhoisaggrievedbyaviolationofthe
labelingrequirementstobringacauseofactionfordamages
resultingfromtheviolation.
