Thisbillestablishesthe"PatientsFirstAct".
Thisbillprohibitsagrouphealthplanorhealthissuanceissuer
offeringgrouporindividualhealthinsurancecoveragefrom
discriminating withrespecttoparticipationundertheplanor
coverageagainstanyhealthcareproviderwhoisactingwithinthe
scopeoftheprovider'slicenseorcertificatewithanexclusion
forphysicianslicensedunderchapter334.
Thehealthbenefitplancannotdiscriminateagainstahealthcare
providerbasedontheprovider'slicensurewithrespectto
reimbursementorparticipationinanyplanorinsuranceprogram.
Thebillrequiresahealthcareprovidertobereimbursedatthe
samerateforthesameserviceaslongastheserviceiswithinthe
provider'sscopeofpractice,buttheseprovisionsshouldnotbe
construedtopreventagrouphealthplanorahealthinsurance
issuerfromestablishingvaryingreimbursementratesbasedon
qualityorperformancemeasures.

providersshouldbepaidthesameandnotlessforservicesthat
areequaltootherproviders.
