[58.200.Whentheofficeofsheriffshallbevacant,bydeathor 2 otherwise,thecoronerofthecountyisauthorizedtoperformalltheduties 3 whicharebylawrequiredtobeperformedbythesheriff,untilanothersheriff 4 forsuchcountyshallbeappointedandqualifiedandsuchcoronershallhave 5 noticethereof.Insuchcase,saidcoronermayappointoneormoredeputies, 6 withtheapprobationofthejudgeofthecircuitcourt,andeverysuch 7 appointment,withtheoathofofficeendorsedthereon,shallbefiledinthe 8 officeoftheclerkofthecircuitcourtofthecounty.Ifthecoronerbecomesthe 9 actingsheriffandthesheriffisnolongerreceivingthesheriff'ssalary,the HB532 15 10 coronermaybepaid,inadditiontothecoroner'ssalary,thedifferencebetween 11 thesalariesofsheriffandcoronersothatthecoronerreceivestheequivalentof 12 thesheriff'ssalarywhileservingasactingsheriff.] 58.200.Whentheofficeofsheriffshallbevacant,bydeathorotherwise,thecoroner 2ofthecountyisauthorizedtoperformallthedutieswhicharebylawrequiredtobe 3performedbythesheriff,untilanothersheriffforsuchcountyshallbeappointedandqualified 4[,]andsuchcoronershallhavenoticethereof[, and].Insuchcase,saidcoronermayappoint 5oneormoredeputies,withtheapprobationofthejudgeofthecircuitcourt;andeverysuch 6appointment,withtheoathofofficeendorsedthereon,shallbefiledintheofficeoftheclerk 7ofthecircuitcourtofthecounty.Ifthecoronerbecomestheactingsheriffandthesheriff 8isnolongerreceivingthesheriff'ssalary,thecoronermaybepaid,inadditiontothe 9coroner'ssalary,thedifferencebetweenthesalariesofsheriffandcoronersothatthe 10coronerreceivestheequivalentofthesheriff'ssalarywhileservingasactingsheriff. 64.231.1.Thecountyplanningboardshallhavepowertomake,adoptandmay 2publishanofficialmasterplanforthecountyforthepurposeofbringingaboutcoordinated 3physicaldevelopmentinaccordancewithpresentandfutureneeds.Themasterplanshallbe 4developedsoastoconservethenaturalresourcesofthecounty,toensureefficient 5expenditureofpublicfunds,andtopromotethehealth,safety,convenience,prosperityand 6generalwelfareoftheinhabitants.Themasterplanmayinclude,amongotherthings,aland 7useplan,studiesandrecommendationsrelativetothelocations,characterandextentof 8highways,railroads,bus,streetcarandothertransportationroutes,bridges,publicbuildings, 9schools,sewers,parksandrecreationfacilities,parkways,forests,wildliferefuges,damsand 10projectsaffectingconservationofnaturalresources.Thecountyplanningboardmayadopt 11themasterplaninwholeorinpart,andsubsequentlyamendorextendtheadoptedplanorany 12portionthereof.Beforetheadoption,amendmentorextensionoftheplanorportionthereof, 13theboardshallholdatleastonepublichearingthereon,fifteendays'noticeofthetimeand 14placeofwhichshallbepublishedinatleastonenewspaperhavinggeneralcirculationwithin 15thecounty,andnoticeofthehearingshallalsobeposted[atleastfifteendaysinadvance 16thereofinatleasttwoconspicuousplacesineachtownship] onthecounty'swebsite. The 17hearingmaybeadjournedfromtimetotime.Theadoptionoftheplanshallbebyresolution 18carriedbynotlessthanamajorityvoteofthefullmembershipofthecountyplanningboard. 19Aftertheadoptionofthemasterplananattestedcopyshallbecertifiedtothecountyclerk 20andacopyshallberecordedintheofficeoftherecorderofdeeds. 21 2.Themasterplan,withtheaccompanyingmaps,diagrams,charts,descriptive 22matter,andreports,shallincludetheplansspecifiedbythissectionwhichareappropriateto 23thecountyandwhichmaybemadethebasisforitsphysicaldevelopment.Themasterplan HB532 16 24maycompriseany,all,oranycombinationoftheplansspecifiedinthissection,forallorany 25partofthecounty. 67.597.1.Thegoverningbodyofacountywithmorethanfifteenthousand 2sevenhundredbutfewerthanseventeenthousandsixhundredinhabitantsandwitha 3countyseatwithmorethanfourthousandtwohundredtenbutfewerthansixthousand 4inhabitantsmayadoptanorderorordinanceimposingasalestaxonallretailsales 5madewithinthecountythataresubjecttosalestaxunderchapter144.Therateofsuch 6taxshallnotexceedonepercent. 7 2.Suchtaxshallnotbecomeeffectiveunlessthegoverningbodyofthecounty 8submitstothevotersofthecounty,onanydateavailableforelectionsforthecounty,a 9proposaltoauthorizethegoverningbodyofthecountytoimposesuchtax.Suchtax 10shallbeinadditiontoallothertaxesimposedbylaw.Suchtaxshallbestatedseparately 11fromallotherchargesandtaxes.Theproceedsofsuchtaxshallbeusedbythecounty 12solelyforthesupportoftheoperationsofhospitalservicesinsuchcounty. 13 3.Theballotofsubmissionforsuchtaxshallbeinsubstantiallythefollowing 32shallnotbecommingledwithanymoneysofthestate.Thedirectormaymakerefunds 33fromtheamountsinthefundandcreditedtothecountyforerroneouspaymentsand 34overpaymentsmadeandmayredeemdishonoredchecksanddraftsdepositedtothe 35creditofsuchcounty.Anymoneysinthespecialfundthatarenotneededforcurrent HB532 17 36expendituresshallbeinvestedinthesamemannerasothermoneysareinvested.Any 37interestandmoneysearnedonsuchinvestmentsshallbecreditedtothefund. 38 7.Thegoverningbodyofacountythathasadoptedsuchtaxmaysubmitthe 39questionofrepealofthetaxtothevotersonanydateavailableforelectionsforthe 40county.Ifamajorityofthevotescastonthequestionbythequalifiedvotersvoting 41thereonareinfavoroftherepeal,therepealshallbecomeeffectiveonDecemberthirty- 42firstofthecalendaryearinwhichsuchrepealwasapproved.Ifamajorityofthevotes 43castonthequestionbythequalifiedvotersvotingthereonareopposedtotherepeal, 44suchtaxshallremaineffectiveuntilthequestionisresubmittedunderthissectiontothe 45qualifiedvotersandtherepealisapprovedbyamajorityofthequalifiedvotersvoting 46onthequestion. 47 8.Wheneverthegoverningbodyofacountythathasadoptedsuchtaxreceivesa 48petition,signedbyanumberofregisteredvotersofthecountyequaltoatleastten 49percentofthenumberofregisteredvotersofthecountyvotinginthelastgubernatorial 50election,callingforanelectiontorepealsuchtax,thegoverningbodyshallsubmittothe 51votersaproposaltorepealthetax.Ifamajorityofthevotescastonthequestionbythe 52qualifiedvotersvotingthereonareinfavoroftherepeal,therepealshallbecome 53effectiveonDecemberthirty-firstofthecalendaryearinwhichsuchrepealwas 54approved.Ifamajorityofthevotescastonthequestionbythequalifiedvotersvoting 55thereonareopposedtotherepeal,suchtaxshallremaineffectiveuntilthequestionis 56resubmittedunderthissectiontothequalifiedvotersandtherepealisapprovedbya 57majorityofthequalifiedvotersvotingonthequestion. 58 9.Ifsuchtaxisrepealedorterminatedbyanymeans,allmoneysremainingin 59thespecialtrustfundshallcontinuetobeusedsolelyforthedesignatedpurposes.The 60countyshallnotifythedirectorofthedepartmentofrevenueoftherepealor 61terminationatleastninetydaysbeforetheeffectivedateoftherepealortermination. 62Thedirectormayorderretentioninthetrustfund,foraperiodofoneyear,oftwo 63percentoftheamountcollectedafterreceiptofsuchnoticetocoverpossiblerefundsor 64overpaymentofthetaxandtoredeemdishonoredchecksanddraftsdepositedtothe 65creditofsuchaccount.Afteroneyearhaselapsedaftertheeffectivedateoftherepeal 66ortermination,thedirectorshallremitthebalanceintheaccounttothecountyand 67closetheaccountofthatcounty.Thedirectorshallnotifysuchcountyofeachinstance 68ofanyamountrefundedoranycheckredeemedfromreceiptsduethecounty. 67.782.1.Thegoverningbodyofthefollowingcountiesmayimposeataxas 2providedinthissection: 3 (1)Anycounty[ofthethirdclasshavingapopulationof]withmorethan[ten 4thousandandlessthanfifteenthousandand]ninethousandninehundredbutfewerthan HB532 18 5eleventhousandinhabitantsandwithacountyseatwithmorethanonethousandbut 6fewerthanonethousandfivehundredinhabitants;or 7 (2)Anycounty[ofthesecondclasshavingapopulationof]withmorethan[fifty- 8eightthousandandlessthanseventythousandadjacenttosuchthirdclasscounty,both 9countiesmakingupthesamejudicialcircuit,] eightythousandbutfewerthanonehundred imposeasalestax[throughouteachoftheirrespectivecounties] forpublic 14recreationalpurposesincludingthefinancing,acquisition,construction,operation, and 15maintenanceofrecreationalprojectsandprograms,butthesalestaxesauthorizedbythis 16sectionshallnotbecomeeffectiveunlessthegoverningbodyof[each] suchcountysubmitsto 17thevoters[oftheirrespectivecounties] aproposaltoauthorize[thecountiestoimpose] the 18salestax. 19 [2.]3.Theballotofsubmissionshallbeinsubstantiallythefollowingform: 20 ShalltheCountyof______imposeasalestaxof______percent[in 21 conjunctionwiththecountyof______] forthepurposeoffundingthe 22 financing,acquisition,construction,operation, andmaintenanceof 23 recreationalprojectsandprograms,includingtheacquisitionofland 24 forsuchpurposes? 25☐Yes☐No 26 27Ifa[separate] majorityofthevotescastontheproposalbythequalifiedvotersvotingthereon 28[ineachcounty] [4.]5.Allsalestaxescollectedbythedirectorofrevenueunderthissectiononbehalf 40ofanycounty,lessonepercentforthecostofcollection,whichshallbedepositedinthe 41state'sgeneralrevenuefundafterpaymentofpremiumsforsuretybondsasprovidedin HB532 19 42section32.087,shallbedepositedwiththestatetreasurerinaspecialtrustfund,whichis 43herebycreated,tobeknownasthe"CountyRecreationSalesTaxTrustFund".Themoneys 44inthecountyrecreationsalestaxtrustfundshallnotbedeemedtobestatefundsandshallnot 45becommingledwithanyfundsofthestate.Thedirectorofrevenueshallkeepaccurate 46recordsoftheamountofmoneyinthetrustfundwhichwascollectedineachcounty 47imposingasalestaxunderthissection,andtherecordsshallbeopentotheinspectionof 48officersofeachcountyandthegeneralpublic.Notlaterthanthetenthdayofeachmonth,the 49directorofrevenueshalldistributeallmoneysdepositedinthetrustfundduringthepreceding 50monthbydistributingtothecountytreasurer,orsuchotherofficerasmaybedesignatedby 51thecountyordinanceororder,ofeachcountyimposingthetaxauthorizedbythissection,the 52sum,ascertifiedbythedirectorofrevenue,duethecounty. 53 [5.]6.Thedirectorofrevenuemayauthorizethestatetreasurertomakerefundsfrom 54theamountsinthetrustfundandcreditedtoanycountyforerroneouspaymentsand 55overpaymentsmade,andmayredeemdishonoredchecksanddraftsdepositedtothecreditof 56suchcounties.Eachcountyshallnotifythedirectorofrevenueatleastninetydayspriorto 57theeffectivedateoftheexpirationofthesalestaxauthorizedbythissectionandthedirector 58ofrevenuemayorderretentioninthetrustfund,foraperiodofoneyear,oftwopercentofthe 59amountcollectedafterreceiptofsuchnoticetocoverpossiblerefundsoroverpaymentof 60suchtaxandtoredeemdishonoredchecksanddraftsdepositedtothecreditofsuchaccounts. 61Afteroneyearhaselapsedafterthedateofexpirationofthetaxauthorizedbythissectionin 62suchcounty,thedirectorofrevenueshallremitthebalanceintheaccounttothecountyand 63closetheaccountofthatcounty.Thedirectorofrevenueshallnotifyeachcountyofeach 64instanceofanyamountrefundedoranycheckredeemedfromreceiptsduethecounty. 65 [6.]7.Thetaxauthorizedbythissectionmaybeimposed,inaccordancewiththis 66section,byacountyinadditiontoorinlieuofthetaxauthorizedbysections67.750to 6767.780. 68 [7.]8.Anycountyimposingasalestaxpursuanttotheprovisionsofthissectionmay 69contractwiththeauthorityofanyothercountyorwithanycityorpoliticalsubdivisionforthe 70financing,acquisition,operation,construction,maintenance,orutilizationofanyrecreation 71facilityorprojectorprogramfundedinwholeorinpartfromrevenuesderivedfromthetax 72leviedpursuanttotheprovisionsofthissection. 73 [8.]9.Thesalestaximposedpursuanttotheprovisionsofthissectionshallexpire 74twenty-fiveyearsfromtheeffectivedatethereofunlessanextensionofthetaxissubmittedto 75andapprovedbythevotersineachcountyinthemannerprovidedinthissection.Each 76extensionofthesalestaxshallbeforaperiodoftenyears. 77 [9.]10.Thegoverningbodyofeachofthecountiesimposingasalestaxunderthe 78provisionsofthissectionmaycooperatewiththegoverningbodyofanycountyorother HB532 20 79politicalsubdivisionofthisstateincarryingouttheprovisionsofthissection,andmay 80establishandconductjointlyasystemofpublicrecreation.Therespectivegoverningbodies 81administeringprogramsjointlymayprovidebyagreementamongthemselvesforallmatters 82connectedwiththeprogramsanddeterminewhatitemsofcostandexpenseshallbepaidby 83each. 84 [10.]11.Theprovisionsofthissectionshallnotinanywayrepeal,affect, orlimitthe 85powersgrantedtoanycountytoestablish,maintain, andconductparksandotherrecreational 86groundsforpublicrecreation. 87 [11.]12.Exceptasmodifiedinthissection,allprovisionsofsections32.085and 8832.087shallapplytothetaximposedunderthissection. 67.783.1.Thereisherebycreatedwithin[anycountyofthethirdclasshavinga 2populationofmorethantenthousandandlessthanfifteenthousandandanycountyofthe 3secondclasshavingapopulationofmorethanfifty-eightthousandandlessthanseventy 4thousandadjacenttosuchthirdclasscounty,bothcountiesmakingupthesamejudicial 5circuit,] thecountiesdescribedundersubsection1ofsection67.782ajointcounty 6recreationallakeauthority,whichshallbeabodycorporateandpoliticandapolitical 7subdivisionofthisstate. 8 2.Subjecttothelimitationsinsection67.788,theauthoritymayexerciseitspowers 9overthereservoirareaencompassinganyrecreationallakeandwithinfivethousandfeetof 10theconservationstoragelevelofanyrecreationallakeconstructedortobeconstructedbythe 11authoritypursuanttosections67.781to67.790. 12 3.Itshallbethepurposeofeachauthoritytopromotethegeneralwelfare,topromote 13recreationandtoencourageprivatecapitalinvestmentthroughtheconstruction,operation, 14andmaintenanceofarecreationallakeandrelatedimprovementstobelocated[jointlyinthe 15secondclasscountyandthethirdclasscounty] inthecountiesdescribedundersubsection 161ofsection67.782. 17 4.Theincomeoftheauthorityandallpropertyatanytimeownedbytheauthority 18shallbeexemptfromalltaxationoranyassessmentswhatsoevertothestateorofany 19politicalsubdivision,municipality, orothergovernmentalagencythereof. 20 5.Nocountyinwhichanauthorityisorganizedshallbeheldliableinconnection 21withtheconstruction,operation, ormaintenanceofanyprojectorprogramundertaken 22pursuanttosections67.781to67.790,includinganyactionstakenbytheauthorityin 23connectionwithanyprojectorprogramundertakenpursuanttosections67.781to67.790. 67.785.1.Theauthorityshallconsistofninemembers,appointedorelectedas 2follows: 3 (1)Withinthirtydaysafterapprovalbythevotersofthesalestaxauthorizedin 4section67.782,thecountycommissionof[thesecondclass] acountydescribedunder HB532 21 5subdivision(2)ofsubsection1ofsection67.782shallinitiallyappointsixmemberstothe 6authority,withthetermsofmembersstaggeredsuchthatthetermsoftwomembers[each 7expiringonDecember31,1992,December31,1994,andDecember31,1996] expireon 8Decemberthirty-firstofeacheven-numberedyear. Thecountycommissionof[thethird 9class] acountydescribedundersubdivision(1)ofsubsection1ofsection67.782shall 10initiallyappointthreememberstotheauthority,withthetermsofmembersstaggeredsuch 11thatthetermofonemember[eachexpiringonDecember31,1992,December31,1994,and 12December31,1996] expiresonDecemberthirty-firstofeacheven-numberedyear; 13 (2)Asthetermofeachinitialmemberexpires,newmembersshallbeelectedfrom 14eachcounty.Eachelectedmembershallserveasix-yeartermanduntil[his]themember's 15successorisdulyelectedandqualified. 16 2.Aperson,tobequalifiedtoserveasamember,shallbeavoterofthestateformore 17thanfiveyearspriorto[his]themember'selectionorappointment,shallbearesidentinthe 18countywhich[he]thememberwillrepresentformorethanfiveyearsandshallbeoverthe 19ageoftwenty-fiveyears.Ifanymembermovesoutsidethecountyfromwhich[he]the 20memberwasappointedorelected,[his]themember'sseatshallbedeemedvacantanda 21newmembershallbeappointedbythecountycommissionofsuchcountytocomplete[his] 22theunexpiredterm. 23 3.Apersondesiringtobecomeacandidatefortheauthorityshallpaythesumoffive 24dollarsasafilingfeetothetreasurerofthecountyinwhich[he]thepersonresides,andshall 25filewiththeelectionauthorityastatementunderoaththat[he]thepersonpossessesallofthe 26qualificationssetoutinsections67.781to67.790foramemberoftheauthority.Thereafter, 27[he]suchpersonshallhave[his]suchperson'snameplacedontheballotasacandidate. 28 4.Ifsixormorepersonsfrom[thesecondclass] acountydescribedunder 29subdivision(2)ofsubsection1ofsection67.782fileascandidates,aprimaryelectionshall 30beheldinAugust,andthefourcandidateswhoreceivethemostvotesshallbecandidatesat 31thegeneralelection.Iftwoormorecandidatesreceiveanequalnumberofvotes,andifthat 32numberofvoteswouldotherwisequalifyeachtiedcandidateforapositiononthegeneral 33electionballot,allsuchtiedcandidatesshallbeincludedonthegeneralelectionballot.The 34twocandidates[fromthesecondclasscounty] receivingthemostvotesinthegeneralelection 35shallbedeclaredthewinners. 36 5.Iffourormorepersonsfrom[thethirdclass] acountydescribedunder 37subdivision(1)ofsubsection1ofsection67.782fileascandidates,aprimaryelectionshall 38beheldinAugust,andthetwocandidateswhoreceivethemostvotesshallbecandidatesat 39thegeneralelection.Iftwoormorecandidatesreceiveanequalnumberofvotes,andifthat 40numberofvoteswouldotherwisequalifyeachtiedcandidateforapositiononthegeneral 41electionballot,allsuchtiedcandidatesshallbeincludedonthegeneralelectionballot.The HB532 22 42candidate[fromthesecondclasscounty] receivingthemostvotesinthegeneralelectionshall 43bedeclaredthewinner. 67.1003.1.Thegoverningbodyofthefollowingcitiesandcountiesmayimposea 2taxasprovidedinthissection: 3 (1)Anycityorcountyhavingmorethanthreehundredfiftyhotelandmotelrooms 4insidesuchcityorcounty; 5 (2)Acountyofthethirdclassificationwithapopulationofmorethanseventhousand 6butlessthanseventhousandfourhundredinhabitants; 7 (3)Athirdclasscitywithapopulationofgreaterthantenthousandbutlessthan 8eleventhousandlocatedinacountyofthethirdclassificationwithatownshipformof 9governmentwithapopulationofmorethanthirtythousand; 10 (4)Acountyofthethirdclassificationwithatownshipformofgovernmentwitha 11populationofmorethantwentythousandbutlessthantwenty-onethousand; 12 (5)Anythirdclasscitywithapopulationofmorethaneleventhousandbutlessthan 13thirteenthousandwhichislocatedinacountyofthethirdclassificationwithapopulationof 14morethantwenty-threethousandbutlessthantwenty-sixthousand; 15 (6)Anycityofthethirdclassificationwithmorethantenthousandfivehundredbut 16fewerthantenthousandsixhundredinhabitants; 17 (7)Anycityofthethirdclassificationwithmorethantwenty-sixthousandthree 18hundredbutfewerthantwenty-sixthousandsevenhundredinhabitants; 19 (8)Anycityofthethirdclassificationwithmorethantenthousandeighthundredbut 20fewerthantenthousandninehundredinhabitantsandlocatedinmorethanonecounty. 21 2.Thegoverningbodyofanycityorcountylistedinsubsection1ofthissectionmay 22imposeataxonthechargesforallsleepingroomspaidbythetransientguestsofhotelsor 23motelssituatedinthecityorcountyoraportionthereof,whichshallbenotmorethanfive 24percentperoccupiedroompernight,exceptthatsuchtaxshallnotbecomeeffectiveunless 25thegoverningbodyofthecityorcountysubmitstothevotersofthecityorcountyatastate 26generalorprimaryelectionaproposaltoauthorizethegoverningbodyofthecityorcountyto 27imposeataxpursuanttothissection.Thetaxauthorizedbythissectionshallbeinadditionto 28thechargeforthesleepingroomandshallbeinadditiontoanyandalltaxesimposedbylaw 29andtheproceedsofsuchtaxshallbeusedbythecityorcountysolelyforthepromotionof 30tourism.Suchtaxshallbestatedseparatelyfromallotherchargesandtaxes. 31 3.Notwithstandinganyotherprovisionoflawtothecontrary,exceptasprovidedin 32[subsection] subsections5and6ofthissection,thetaxauthorizedinsubsection1ofthis 33sectionshallnotbeimposedbythefollowingcitiesorcounties: HB532 23 34 (1)Anycityorcountyalreadyimposingataxsolelyonthechargesforsleeping 35roomspaidbythetransientguestsofhotelsormotelssituatedinanysuchcityorcounty 36underanyotherlawofthisstate; 37 (2)Anycitynotalreadyimposingataxunderthissectionandthatislocatedinwhole 38orpartiallywithinacountythatalreadyimposesataxsolelyonthechargesforsleeping 39roomspaidbythetransientguestsofhotelsormotelssituatedinsuchcountyunderthis 40sectionoranyotherlawofthisstate;or 41 (3)Anycountynotalreadyimposingataxunderthissectionandthathasacity 42locatedinwholeorinpartwithinitsboundariesthatalreadyimposesataxsolelyonthe 43chargesforsleepingroomspaidbythetransientguestsofhotelsormotelssituatedinsuch 44cityunderthissectionoranyotherlawofthisstate. 45 4.Citiesofthethirdclasshavingmorethantwothousandfivehundredhoteland 46motelrooms,andlocatedinacountyofthefirstclassificationinwhichandwhereanothertax 47onthechargesforallsleepingroomspaidbythetransientguestsofhotelsandmotelssituated 48insuchcountyisimposed,mayimposethetaxauthorizedbythissectionofnotmorethan 49one-halfofonepercentperoccupiedroompernight. 50 5.Thegoverningbodyofanycityofthefourthclassificationwithmorethanfifty-one 51thousandinhabitantslocatedinacountywithacharterformofgovernmentandwithmore 52thantwohundredfiftythousandinhabitantswhichadjoinsanothercountywithacharterform 53ofgovernmentandwithmorethanonemillioninhabitantsmayimposeataxonthecharges 54forallsleepingroomspaidbythetransientguestofhotelsormotelssituatedinsuchcityora 55portionthereof,whichtaxshallbenotmorethantwopercentperoccupiedroompernight, 56exceptthatsuchtaxshallnotbecomeeffectiveunlessthegoverningbodyofsuchcity 57submits,afterJanuary1,2012,tothevotersofthatcity,atanelectionpermittedundersection 58115.123,aproposaltoauthorizethegoverningbodyofthecitytoimposeataxunderthis 59section.Thetaxauthorizedbythissectionshallbeinadditiontoanyandallothertaxes 60imposedbylaw,andtheproceedsofsuchtaxshallbeusedbythecitysolelyforthe 61promotionoftourism.Suchtaxshallbestatedseparatelyfromallotherchargesandtaxes. 62 6.(1)Thegoverningbodyofthefollowingcitiesmayimposeataxasprovidedin 63thissubsection: 64 (a)Acitywithmorethanfourthousandninehundredbutfewerthanfive 65thousandsixhundredinhabitantsandlocatedinacountywithmorethanfourhundred 66thousandbutfewerthanfivehundredthousandinhabitants;or 67 (b)Acitywithmorethanfivethousandsixhundredbutfewerthansixthousand 68threehundredinhabitantsandlocatedinacountywithmorethanfourhundred 69thousandbutfewerthanfivehundredthousandinhabitants. HB532 24 70 (2)Thegoverningbodyofanycitylistedinsubdivision(1)ofthissubsectionmay 71imposeataxonthechargesforallsleepingroomspaidbythetransientguestsofhotels 72ormotelssituatedinsuchcityoraportionthereof.Suchtaxshallnotexceedfive 73percentperoccupiedroompernight.Nosuchtaxshallbecomeeffectiveunlessthe 74governingbodyofsuchcitysubmits,afterJanuary1,2026,tothevotersofthatcity,at 75anelectionpermittedundersection115.123,aproposaltoauthorizethegoverningbody 76ofthecitytoimposeataxunderthissection.Thetaxauthorizedbythissectionshallbe 77inadditiontoanyandallothertaxesimposedbylaw.Suchtaxshallbestated 78separatelyfromallotherchargesandtaxes. 79 7.Theballotofsubmissionforanytaxauthorizedinthissectionshallbein 80substantiallythefollowingform: 81 Shall(insertthenameofthecityorcounty)imposeataxonthecharges 82 forallsleepingroomspaidbythetransientguestsofhotelsandmotels 83 situatedin(nameofcityorcounty)atarateof(insertrateofpercent) 84 percentforthesolepurposeofpromotingtourism? 34personappointedasagentofsaidnonresidentthecountyclerkshallbecometheappointeeas 35agentofsaidnonresident. 36 4.Nopersonresidinginanyhomerulecitywithmorethanseventy-onethousandbut 37fewerthanseventy-ninethousandinhabitantsshallbeeligibletooffertopurchaselandsunder 38thissectionunlesssuchpersonhas,nolaterthantendaysbeforethesaledate,demonstrated 39tothesatisfactionoftheofficialchargedbylawwithconductingthesalethatthepersonisnot 40theownerofanyparcelofrealpropertythathastwoormoreviolationsofthemunicipality's 41buildingorhousingcodes.Aprospectivebiddermaymakesuchademonstrationby 42presentingstatementsfromtheappropriatecollectionandcodeenforcementofficialsofthe 43municipality.Thissubsectionshallnotapplytoanytaxingauthorityorlandbankagency,and 44entitiesshallbeeligibletobidatanysaleconductedunderthissectionwithoutmakingsucha 45demonstration. 205.971.1.Theboardofaldermenorothergoverningbodyofacitynotwithina 2countyandthecountycommissionorothergoverningbodyofthecounty,exceptforacounty 3ofthefirstclassificationhavingacharterformofgovernmentcontaininginpartacitywitha 4populationofmorethanthreehundredfiftythousandinhabitants,oracountyofthefirst 5classificationhavingacharterformofgovernmentwithapopulationofatleastninehundred 6thousandinhabitantsmay,uponapprovalofamajorityofthequalifiedvotersofsuchcityor 7countythereon,levyandcollectataxnottoexceedfourmillsperdollarofassessedvaluation 8uponalltaxablepropertywithinthecityorcountyforthepurposeofestablishingand 9maintainingthecountyshelteredworkshop,residence,facilityand/orrelatedservices.The 10countycommissionorothergoverningbodyofacountyofthefirstclassificationhavinga 11charterformofgovernmentcontaininginwholeorpartacitywithapopulationofmorethan 12threehundredfiftythousandinhabitants,oracountyofthefirstclassificationhavingacharter 13formofgovernmentwithapopulationofatleastninehundredthousandinhabitantsmay, 14uponapprovalofamajorityofthequalifiedvotersofsuchcountyorcityvotingthereon,levy 15andcollectataxnottoexceedtwomillsperdollarofassessedvaluationuponalltaxable 16propertywithinsuchcountyorcityforthepurposeofestablishingandmaintainingthecounty HB532 53 20 2.Allfundscollectedfor[this]thepurposeofestablishingandmaintainingthe 21countyorcityshelteredworkshop,residence,facility,relatedservices,orany 22combinationthereofshallbedepositedinaspecialfundandshallbeusedfornoother 23purpose. 24 3.Depositsinthefundshallbeexpendedonlyuponapprovaloftheboardasfollows: 25 (1)Board-approvedexpendituresshallincludefundsfortheoperationsand 26maintenanceofshelteredworkshopsthatarecompliantwithboardfundingrequest 27requirements; 28 (2)Noboardofdirectors,asestablishedundersection205.968,shallrequire 29additionalcertificationsorrequirementsforacompliantandcredentialedapplicant 30thatarecontraryto,ornotcurrentlyrequiredby,rulesandstandardsdevelopedand 31adoptedbythedepartmentofelementaryandsecondaryeducationfortheoperationof 32ashelteredworkshop;and 33 (3)Thissectionshallnotbeconstruedtoprohibitboardexpendituresfrombeing 34usedforthepurposesofresidence,facility,relatedservices,oranycombinationthereof 35inadditiontousingboardexpendituresfortheestablishmentormaintenanceofthe 36countyorcityshelteredworkshop. 221.400.1.Anytwoormorecontiguouscountieswithinthestatemayforman 2agreementtoestablisharegionaljaildistrict.Thedistrictshallhaveaboundarywhich 3includestheareaswithineachmembercounty,anditshallbenamedthe"______Regional 4JailDistrict".Suchregionaljaildistrictsmaycontracttocarryoutthemissionofthe 5commissionandtheregionaljaildistrict. 6 2.Thecountycommissionofeachcountydesiringtojointhedistrictshallapprovean 7ordinanceorresolutiontojointhedistrictandshallapprovetheagreementwhichspecifiesthe 8dutiesofeachcountywithinthedistrict. 9 3.Ifanycountywishestojoinadistrictwhichhasalreadybeenestablishedunderthis 10section,theagreementshallberewrittenandreapprovedbyeachmembercounty.Ifthe 11districtalreadyleviesasalestaxundersection221.407,thejoiningofanycountytosuch 12districtshallnotbeeffectiveuntilthevotersofthecountydesiringtojoinapprovethe 13levyofthedistrictsalestaxinthejoiningcountyundersubsection3ofsection221.407. 14Uponsuchapproval,therewrittenagreementshallindicatetheapprovalofthejoining 15county. 16 4.Theagreementwhichspecifiesthedutiesofeachcountyshallcontainthe 17following: 18 (1)Thenameofthedistrict; 19 (2)Thenamesofthecountieswithinthedistrict; 20 (3)Theformulaforcalculatingeachcounty'scontributiontothecostsofthedistrict; HB532 54 21 (4)Thetypesofprisonerswhichtheregionaljailmayhouse,limitedtoprisoners 22whichmaybetransferredtocountiesunderstatelaw; 23 (5)Themethodsandpowerswhichmaybeusedforconstructing,leasingorfinancing 24aregionaljail; 25 (6)Thedutiesofthedirectoroftheregionaljail; 26 (7)Thetimingandproceduresforapprovaloftheregionaljaildistrict'sannualbudget 27bytheregionaljailcommission;and 28 (8)Thedelegation,ifany,bythemembercountiestotheregionaljaildistrictofthe 29powerofeminentdomain. 30 5.Anycounty,city,townorvillagemaycontractwitharegionaljailcommissionfor 31theholdingofitsprisoners. 221.402.Inadditiontothepowersgrantedtothedistrictbyitsmembercounties 2undertheagreement,thedistricthasallthepowersnecessaryorappropriatetocarryoutits 3purposes,including,butnotlimitedto,thefollowing: 4 (1)Toadoptbylawsandrulesfortheregulationofitsaffairsandtheconductofits 5business; 6 (2)Toadoptanofficialseal; 7 (3)Tomaintainanofficeatsuchplaceorplacesinoneormoreofthemember 8countiesasthecommissionmaydesignate; 9 (4)Tosueandbesued; 10 (5)Tomakeandexecuteleases,contracts,releases,compromisesandother 11instrumentsnecessaryorconvenientfortheexerciseofitspowersortocarryoutitspurposes; 12 (6)Toacquire,construct,reconstruct,repair,alter,improve,[and]equip,extend, and 13maintainjailfacilities; 14 (7)Tosell,assign,lease,mortgage,grantasecurityinterestin,exchange,donateand 15conveyanyorallofitspropertieswheneverthecommissionfindssuchactiontobein 16furtheranceofthedistrict'spurposes; 17 (8)Tocollectrentals,feesandotherchargesinconnectionwithitsservicesorforthe 18useofanyfacilities; 19 (9)Toissueitsbonds,notesorotherobligationsforanyofitscorporatepurposesand 20torefundthesame. 221.405.1.Anyregionaljaildistrictcreatedpursuanttosection221.400shallbe 2governedbyacommission.Thecommissionshallbecomposedofthesheriffandpresiding 3commissionerfromeachcountywithinthedistrict. 4 2.Eachcommissionershallserveduring[his]suchcommissioner'stenureassheriff 5oraspresidingcommissioner. HB532 55 6 3.Commissionersshallserveuntiltheirsuccessorsintheircountyofficeshave[been 7dulyappointed] assumedoffice. Vacanciesonthecommissionshallbefilledbythe 8succeedingsherifforpresidingcommissionerfortheremainderoftheterm. 9 4.Commissionersshallservewithoutcompensation,exceptthattheyshallbe 10reimbursedbythedistrictfortheirreasonableandnecessaryexpensesintheperformanceof 11theirduties. 12 5.Ajailcommissionerfromeachcountyinthedistrictshallpresentaproposed 13budgettothecountycommission. 221.407.1.Thecommissionofanyregionaljaildistrictmayimpose,byorder,a 2salestax[intheamount] of[one-eighthofonepercent,one-fourthofonepercent,three- 3eighthsofonepercent,orone-halfof]uptoonepercentonallretailsalesmadeinsuch 4regionwhicharesubjecttotaxationpursuanttotheprovisionsofsections144.010to144.525 5forthepurposeofprovidingjailservices[andcourt], facilities, andequipmentforsuch 6region.Thetaxauthorizedbythissectionshallbeinadditiontoanyandallothersalestaxes 49castonthequestionbythequalifiedvotersvotingthereonareopposedtothequestion, 50thecountyshallnotjointheregionaljaildistrict,andthetaxshallnotbecomeeffective 51unlessanduntilthequestionisresubmittedunderthissectiontothequalifiedvotersof 52thecountyandsuchquestionisapprovedbyamajorityofthequalifiedvotersofthe 53countyvotingonthequestion. 54 4.Allrevenuereceivedbyadistrictfromthetaxauthorizedpursuanttothissection 55shallbedepositedinaspecialtrustfundandshallbeusedsolelyforprovidingjailservices 56[andcourt],facilities, andequipmentforsuchdistrictforsolongasthetaxshallremainin 57effect. 58 [4.]5.Oncethetaxauthorizedbythissectionisabolishedorterminatedbyany 59means,allfundsremaininginthespecialtrustfundshallbeusedsolelyforprovidingjail 60services[andcourt],facilities, andequipmentforthedistrict.Anyfundsinsuchspecialtrust 61fundwhicharenotneededforcurrentexpendituresmaybeinvestedbythecommissionin 62accordancewithapplicablelawsrelatingtotheinvestmentofothercountyfunds. 63 [5.]6.Allsalestaxescollectedbythedirectorofrevenuepursuanttothissectionon 64behalfofanydistrict,lessonepercentforcostofcollectionwhichshallbedepositedinthe 65state'sgeneralrevenuefundafterpaymentofpremiumsforsuretybondsasprovidedin HB532 57 66section32.087,shallbedepositedinaspecialtrustfund,whichisherebycreated,tobe 67knownasthe"RegionalJailDistrictSalesTaxTrustFund".Themoneysintheregionaljail 68districtsalestaxtrustfundshallnotbedeemedtobestatefundsandshallnotbecommingled 69withanyfundsofthestate.Thedirectorofrevenueshallkeepaccuraterecordsoftheamount 70ofmoneyinthetrustfundwhichwascollectedineachdistrictimposingasalestaxpursuant 71tothissection,andtherecordsshallbeopentotheinspectionofofficersofeachmember 72countyandthepublic.Notlaterthanthetenthdayofeachmonththedirectorofrevenueshall 73distributeallmoneysdepositedinthetrustfundduringtheprecedingmonthtothedistrict 74whichleviedthetax.Suchfundsshallbedepositedwiththetreasurerofeachsuchdistrict, 75andallexpendituresoffundsarisingfromtheregionaljaildistrictsalestaxtrustfundshallbe 76paidpursuanttoanappropriationadoptedbythecommissionandshallbeapprovedbythe 77commission.Expendituresmaybemadefromthefundforany[functionauthorizedinthe 78orderadoptedbythecommissionsubmittingtheregionaljaildistricttaxtothevoters] ofthe 79district'sauthorizedpurposes. 80 [6.]7.Thedirectorofrevenuemaymakerefundsfromtheamountsinthetrustfund 81andcreditedtoanydistrictforerroneouspaymentsandoverpaymentsmade,andmayredeem 82dishonoredchecksanddraftsdepositedtothecreditofsuchdistricts.Ifanydistrictabolishes 83thetax,thecommissionshallnotifythedirectorofrevenueoftheactionatleastninetydays 84priortotheeffectivedateoftherepeal,andthedirectorofrevenuemayorderretentioninthe 85trustfund,foraperiodofoneyear,oftwopercentoftheamountcollectedafterreceiptof 86suchnoticetocoverpossiblerefundsoroverpaymentofthetaxandtoredeemdishonored 87checksanddraftsdepositedtothecreditofsuchaccounts.Afteroneyearhaselapsedafter 88theeffectivedateofabolitionofthetaxinsuchdistrict,thedirectorofrevenueshallremitthe 89balanceintheaccounttothedistrictandclosetheaccountofthatdistrict.Thedirectorof (4)Itshalldeterminetheinitialbudgetfortheregionaljailandshallapprove,aftera 8reviewandamajorityofthecommissionersconcurringtherein,allsubsequentbudgets,for 9whichproposalsmaybesubmittedbythedirector; 10 (5)Itmaydeterminethepoliciesforthehousingofprisonerswithintheregionaljail; 11 (6)Itmaybuy,lease, orsellrealorpersonalpropertyforthepurposeofestablishing 12andmaintainingaregionaljail,anditmaycontractwithpublicorprivateentities[forthe 13planningandacquisitionofajail]toacquire,construct,reconstruct,repair,alter,improve, 14equip,andextendaregionaljail; 15 (7)Itmaycontractwith[thedepartmentofcorrectionsandwithcitiesandother 16countiesinthisstate] governmentalentitiesincluding,butnotlimitedto,departments 17andinstrumentalitiesthereof,orprivateentitiesforthehousingofprisoners; 18 (8)Itshallapproveallpositionstobecreatedforthepurposeofadministeringthe 19regionaljail;and 20 (9)Itshallapprovealocationfortheregionaljail[whichisgenerallycentralto]that 21iswithinthedistrict. 251.034.Paymentsmadeundersections251.032to251.038tothevariousregional 2planningcommissionsshallbedistributedonamatchingbasisofone-halfstatefundsforone- 3halfoflocalfunds.Nolocalunitshallreceiveanypaymentwithoutprovidingthematching 4fundsrequired.Thestatefundssoallocatedshallnotexceedthesumof[sixty-five] one 5hundredthirtythousanddollarsfortheEast-WestGateway[Coordinating] Councilof 21licensetosellintoxicatingliquorbythedrinkforretailforconsumptiondispensedfrom 22oneormoreportablebarswithinthecommonareasoftheentertainmentdistrictuntil 233:00a.m.onMondaysthroughSaturdaysandfrom6:00a.m.onSundaysanduntil1:30 24a.m.onMondays. 25 3.Anapplicantgrantedanentertainmentdistrictspeciallicenseunderthis 26sectionshallpayalicensefeeofthreehundreddollarsperyear. 27 4.Notwithstandinganyotherprovisionofthischaptertothecontrary,onsuch 28daysandatsuchtimesduringthehoursalicenseisallowedunderthischaptertosell 29alcoholicbeverages,personsmaybeallowedtoleavelicensedestablishmentslocatedin 34timeswhenapersonisallowedtoconsumealcoholicbeveragesdispensedfromportable 35barsandincommonareasofalloranyportionoftheentertainmentdistrict,the 36entertainmentdistrictshallensurethatminorscanbeeasilydistinguishedfrompersons 37oflegalagebuyingalcoholicbeverages. 38 5.Everylicenseewithintheentertainmentdistrictshallservealcoholic 39beveragesincontainersthatdisplayandcontainthelicensee'stradenameorlogoor 40someothermarkthatisuniquetothatlicenseandlicensee. 41
