Torepealsections57.952,57.955,and488.024,RSMo,andtoenactinlieuthereofthreenew
sectionsrelatingtothesheriffs'retirementsystem.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections57.952,57.955,and488.024,RSMo,arerepealedandthreenew
2sectionsenactedinlieuthereof,tobeknownassections57.952,57.955,and488.024,toread
3asfollows:
57.952.1.Thereisherebyauthorizeda"Sheriffs'RetirementFund"whichshallbe
2underthemanagementof[a]theboard[ofdirectors] asdescribedinsection57.958.The
3board[ofdirectors] shallberesponsiblefortheadministrationandtheinvestmentofthefunds
4ofsuchsheriffs'retirementfund.Thegeneralassemblyandthegoverningbodyofacounty
5mayappropriatefundsfordepositinthesheriffs'retirementfund.Ifinsufficientfundsare
6generatedtoprovidethebenefitspayablepursuanttotheprovisionsofsections57.949to
757.997,theboardshallproportionthebenefitsaccordingtothefundsavailable.
8 2.Theboardmayacceptgifts,donations,grants,andbequestsfrompublicorprivate
9sourcestothesheriffs'retirementfund.
10 3.Eachcountyshallmakethepayrolldeductionsformembercontributionsmandated
11undersection57.961,andthecountyshalltransmitsuchmoneystotheboardfordepositinto
12thesheriffs'retirementfund.
57.955.1.Thereshallbeassessedandcollectedasurchargeofthreedollarsinall
2civilactionsfiledinthecourtsofthisstate[andinallcriminalcasesincludingviolationof
3anycountyordinanceoranyviolationofcriminalortrafficlawsofthisstate,including
4infractions,butnosuchsurchargeshallbeassessedwhenthecostsarewaivedoraretobe

7notincludeanyordinanceofthecityofSt.Louis]. Theclerkresponsibleforcollectingcourt
8costsincivil[andcriminal] cases,shallcollectanddisbursesuchamountsasprovidedby
9sections488.010to488.020.Suchfundsshallbepayabletothesheriffs'retirementfund.
10Moneyscreditedtothesheriffs'retirementfundshallbeusedonlyforthepurposesprovided
11forinsections57.949to57.997andfornootherpurpose.
12 2.Theboardmayacceptgifts,donations,grantsandbequestsfrompublicorprivate
13sourcestothesheriffs'retirementfund.
488.024.Asprovidedbysection57.955,thereshallbeassessedandcollecteda
2surchargeofthreedollarsinallcivilactionsfiledinthecourtsofthisstate[andinallcriminal
3casesincludingviolationofanycountyordinanceoranyviolationofcriminalortrafficlaws
4ofthisstate,includinginfractions,butnosuchsurchargeshallbeassessedwhenthecostsare
5waivedoraretobepaidbythestate,countyormunicipalityorwhenacriminalproceedingor
6thedefendanthasbeendismissedbythecourt.Forpurposesofthissection,theterm"county
7ordinance"shallnotincludeanyordinanceoftheCityofSt.Louis]. Theclerkresponsiblefor
8collectingcourtcostsincivil[andcriminal] casesshallcollectanddisbursesuchamountsas
9providedbysections488.010to488.020.Suchfundsshallbepayabletothesheriffs'
10retirementfund.
