57.278.1.Thereisherebycreatedinthestatetreasurythe"DeputySheriffSalary
2SupplementationFund",whichshallconsistofmoneycollectedfromchargesforservice
3receivedbycountysheriffsundersubsection4ofsection57.280.Themoneyinthefundshall
4beusedsolelytosupplementthesalaries,andemployeebenefitsresultingfromsuchsalary
5increases,ofcountydeputysheriffs.Thestatetreasurershallbecustodianofthefundand
6mayapprovedisbursementsfromthefundinaccordancewithsections30.170and30.180.
7TheMissourisheriffmethamphetaminerelieftaskforcecreatedundersection650.350shall
8administerthefund.
9 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
10remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral
11revenuefund.Fiftypercentofthemoneysremainingattheendofthebienniumshall
12reverttothecreditofthesheriffs'retirementfundcreatedundersection57.952.The
13statetreasurershallinvesttheremainingmoneysinthefundinthesamemannerasother
14fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
15thefund.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 57.280.1.Sheriffsshallreceiveachargeforserviceofanysummons,writorother
2orderofcourt,inconnectionwithanycivilcase,andmakingonthesameeitherareturn
3indicatingservice,anonestreturnoranullabonareturn,thesumoftwentydollarsforeach
4itemtobeserved,exceptthatasheriffshallreceiveachargeforserviceofanysubpoena,and
5makingareturnonthesame,thesumoftendollars;however,nosuchchargeshallbe
6collectedinanyproceedingwhen[court] costsforservicearetobepaidbythestate,county,
7ormunicipality.Inadditiontosuchcharge,thesheriffshallbeentitledtoreceiveforeach
8mileactuallytraveledinservinganysummons,writ,subpoenaorotherorderofcourttherate
9prescribedbytheInternalRevenueServiceforallallowableexpensesformotorvehicleuse
10expressedasanamountpermile,providedthatsuchmileageshallnotbechargedformore
11thanonesubpoenaorsummonsorotherwritservedinthesamecauseonthesametrip.Allof
12suchchargesshallbereceivedbythesheriffwhoisrequestedtoperformtheservice.Except
13asotherwiseprovidedbylaw,allchargesmadepursuanttothissectionshallbecollectedby
14the[courtclerkascourtcosts] sheriff'sofficeresponsibleforserviceandarepayableprior
15tothetimetheserviceisrendered;providedthatiftheamountofsuchchargecannotbe
16readilydetermined,thenthesheriffshallreceiveadepositbaseduponthelikelyamountof
17suchcharge,andthebalanceofsuchchargeshallbepayableimmediatelyuponascertainment
18oftheproperamountofsaidcharge.Asheriffmayrefusetoperformanyserviceinany
19actionorproceeding,otherthanwhen[court] costsforservicearewaivedasprovidedbylaw,
20untilthechargeprovidedbythissectionispaid.Failuretoreceivethechargeshallnotaffect
21thevalidityoftheservice.
22 2.Thesheriffshallreceiveforreceivingandpayingmoneysonexecutionorother
23process,wherelandsorgoodshavebeenleviedandadvertisedandsold,fivepercentonfive
24hundreddollarsandfourpercentonallsumsabovefivehundreddollars,andhalfofthese
25sums,whenthemoneyispaidtothesheriffwithoutalevy,orwherethelandsorgoodslevied
26onshallnotbesoldandthemoneyispaidtothesherifforpersonentitledthereto,hisagentor
27attorney.Thepartyatwhoseapplicationanywrit,execution,subpoenaorotherprocesshas
28issuedfromthecourtshallpaythesheriff'scostsfortheremoval,transportation,storage,
29safekeepingandsupportofanypropertytobeseizedpursuanttolegalprocessbeforesuch
30seizure.Thesheriffshallbeallowedforeachmile,goingandreturningfromthecourthouse
31ofthecountyinwhichheresidestotheplacewherethecourtisheld,therateprescribedby
32theInternalRevenueServiceforallallowableexpensesformotorvehicleuseexpressedasan
33amountpermile.Theprovisionsofthissubsectionshallnotapplytogarnishmentproceeds.
34 3.Thesheriffuponthereceiptofthechargehereinprovidedforshallpayintothe
35treasuryofthecountyanyandallchargesreceivedpursuanttotheprovisionsofthissection.
36Thefundscollectedpursuanttothissection,nottoexceedfiftythousanddollarsinany
37calendaryear,shallbeheldinafundestablishedbythecountytreasurer,whichmaybe
HCSHB558	2 38expendedatthediscretionofthesheriffforthefurtheranceofthesheriff'ssetduties.Any
39suchfundsinexcessoffiftythousanddollarsinanycalendaryearshallbeplacedtothecredit
40ofthegeneralrevenuefundofthecounty.Moneysinthefundshallbeusedonlyforthe
41procurementofservicesandequipmenttosupporttheoperationofthesheriff'soffice.
42Moneysinthefundestablishedpursuanttothissubsectionshallnotlapsetothecounty
43generalrevenuefundattheendofanycountybudgetorfiscalyear.
44 4.Notwithstandingtheprovisionsofsubsection3ofthissectiontothecontrary,the
45sheriffshallreceive[ten]fifteendollarsforserviceofanysummons,writ,subpoena,orother
46orderofthecourtincludedundersubsection1ofthissection,inadditiontothechargefor
47suchservicethateachsheriffreceivesundersubsection1ofthissection.Themoneyreceived
48bythesheriffunderthissubsectionshallbepaidintothecountytreasuryandthecounty
49treasurershallmakesuchmoneypayabletothestatetreasurer.Thestatetreasurershall
50deposittendollarsofsuchmoneysinthedeputysheriffsalarysupplementationfundcreated
51undersection57.278andfivedollarsofsuchmoneysinthesheriffs'retirementfund
52createdundersection57.952. Anyotherpersonspeciallyappointedtoserveinacounty
53shallexecuteanddelivertothecircuitclerk,alongwiththeconfirmationofservice,asigned
54andnotarizedaffidavitofconfirmation,madeunderpenaltyofperjury,thatincludesthe
55amount,checknumber,anddateofpaymenttoevidencepaymentwasmadetothesherifffor
56thedeputysheriffsalarysupplementationfundandthesheriffs'retirementfundasrequired
57bythissubsection.
58 5.Notwithstandingtheprovisionsofsubsection3ofthissection,thecourtclerkshall
59collecttendollarsasacourtcostforserviceofanysummons,writ,subpoena,orotherorder
60ofthecourtincludedundersubsection1ofthissectionifanypersonotherthanasheriffis
61speciallyappointedtoserveinacountythatreceivesfundsundersection57.278.The
62moneysreceivedbythecourtclerkunderthissubsectionshallbepaidintothecountytreasury
63andthecountytreasurershallmakesuchmoneyspayabletothestatetreasurer.Thestate
64treasurershalldepositsuchmoneysinthedeputysheriffsalarysupplementationfundcreated
65undersection57.278.
66 6.Sheriffsshallreceiveuptofiftydollarsforserviceofanysummons,writ,orother
67orderofthecourtinconnectionwithanyevictionproceeding,inadditiontothechargefor
68suchservicethateachsheriffreceivesunderthissection.Allofsuchchargesshallbe
69receivedbythesheriffwhoisrequestedtoperformtheserviceandshallbepaidtothecounty
70treasurerinafundestablishedbythecountytreasurer,whichmaybeexpendedatthe
71discretionofthesheriffforthefurtheranceofthesheriff'ssetduties.Allchargesshallbe
72payablepriortothetimetheserviceisrendered;providedthatiftheamountofsuchcharge
73cannotbereadilydetermined,thenthesheriffshallreceiveadepositbaseduponthelikely
HCSHB558	3 74amountofsuchcharge,andthebalanceofsuchchargeshallbepayableimmediatelyupon
75ascertainmentoftheproperamountofsaidcharge.
57.952.1.Thereisherebyauthorizeda"Sheriffs'RetirementFund"whichshallbe
2underthemanagementof[a]theboard[ofdirectors] asdescribedinsection57.958.The
3board[ofdirectors] shallberesponsiblefortheadministrationandtheinvestmentofthefunds
4ofsuchsheriffs'retirementfund.Thegeneralassemblyandthegoverningbodyofacounty
5mayappropriatefundsfordepositinthesheriffs'retirementfund.Ifinsufficientfundsare
6generatedtoprovidethebenefitspayablepursuanttotheprovisionsofsections57.949to
757.997,theboardshallproportionthebenefitsaccordingtothefundsavailable.
8 2.Theboardmayacceptgifts,donations,grants,andbequestsfrompublicorprivate
9sourcestothesheriffs'retirementfund.
10 3.Eachcountyshallmakethepayrolldeductionsformembercontributionsmandated
11undersection57.961,andthecountyshalltransmitsuchmoneystotheboardfordepositinto
12thesheriffs'retirementfund.
57.967.1.Thenormalannuityofaretiredmembershallequaltwopercentofthe
2finalaveragecompensationoftheretiredmembermultipliedbythenumberofyearsof
3creditableserviceoftheretiredmember,exceptthatthenormalannuityshallnotexceed
4seventy-fivepercentoftheretiredmember'saveragefinalcompensation.Suchannuityshall
5benotlessthanonethousanddollarspermonth.
6 2.Theboard,atitslastmeetingofeachcalendaryear,shalldeterminethemonthly
7amountformedicalinsurancepremiumstobepaidtoeachretiredmemberduringthenext
8followingcalendaryear.Themonthlyamountshallnotexceedfourhundredfiftydollars.
9Themonthlypaymentsareatthediscretionoftheboardontheadviceoftheactuary.The
10anticipatedsumofallsuchpaymentsduringtheyearplustheannualnormalcostplusthe
11annualamounttoamortizetheunfundedactuarialaccruedliabilityinnomorethanthirty
12yearsshallnotexceedtheanticipatedmoneyscreditedtothesystempursuantto[sections]
13section57.952[and57.955]. Themoneyamountgrantedhereshallnotbecontinuedtoany
14survivor.
15 3.Ifamemberwitheightormoreyearsofservicediesbeforebecomingeligiblefor
16retirement,themember'ssurvivingspouse,ifheorshehasbeenmarriedtothememberforat
17leasttwoyearspriortothemember'sdeath,shallbeentitledtosurvivorbenefitsunderoption
181assetforthinsection57.979asifthememberhadretiredonthedateofthemember'sdeath.
19Themember'smonthlybenefitshallbecalculatedasthemember'saccruedbenefitathisor
20herdeathreducedbyone-fourthofonepercentpermonthforanearlycommencementfrom
21themember'snormalretirementdate:agefifty-fivewithtwelveormoreyearsofcreditable
22serviceoragesixty-twowitheightyearsofcreditableservice,tothemember'sdateofdeath.
HCSHB558	4 23Suchbenefitshallbepayableonthefirstdayofthemonthfollowingthemember'sdeathand
24shallbepayableduringthesurvivingspouse'slifetime.
221.105.1.Thegoverningbodyofanycountyandofanycitynotwithinacounty
2shallfixtheamounttobeexpendedforthecostofincarcerationofprisonersconfinedinjails
3ormediumsecurityinstitutions.Theperdiemcostofincarcerationoftheseprisoners
4chargeablebythelawtothestateshallbedetermined,subjecttothereviewandapprovalof
5thedepartmentofcorrections.
6 2.Whenthefinaldeterminationofanycriminalprosecutionshallbesuchastorender
7thestateliableforcostsunderexistinglaws,itshallbethedutyofthesherifftocertifytothe
8clerkofthecircuitcourtorcourtofcommonpleasinwhichthecasewasdeterminedthetotal
9numberofdaysanyprisonerwhowasapartyinsuchcaseremainedinthecountyjail.Itshall
10bethedutyofthecountycommissiontosupplythecostperdiemforcountyprisonstothe
11clerkofthecircuitcourtonthefirstdayofeachyear,andthereafterwhenevertheamount
12maybechanged.Itshallthenbethedutyoftheclerkofthecourtinwhichthecasewas
13determinedtoincludeinthebillofcostagainstthestateallfeeswhichareproperly
14chargeabletothestate.Inanycitynotwithinacountyitshallbethedutyofthe
15superintendentofanyfacilityboardingprisonerstocertifytothechiefexecutiveofficerof
16suchcitynotwithinacountythetotalnumberofdaysanyprisonerwhowasapartyinsuch
17caseremainedinsuchfacility.Itshallbethedutyofthesuperintendentsofsuchfacilitiesto
18supplythecostperdiemtothechiefexecutiveofficeronthefirstdayofeachyear,and
19thereafterwhenevertheamountmaybechanged.Itshallbethedutyofthechiefexecutive
20officertobillthestateallfeesforboardingsuchprisonerswhichareproperlychargeableto
21thestate.Thechiefexecutivemaybynotificationtothedepartmentofcorrectionsdelegate
22suchresponsibilitytoanotherdulyswornofficialofsuchcitynotwithinacounty.Theclerk
23ofthecourtofanycitynotwithinacountyshallnotincludesuchfeesinthebillofcosts
24chargeabletothestate.Thedepartmentofcorrectionsshallreviseitscriminalcostmanualin
25accordancewiththisprovision.
26 3.Exceptasprovidedundersubsection6ofsection217.718,theactualcosts
27chargeabletothestate,includingthoseincurredforaprisonerwhoisincarceratedinthe
28countyjailbecausetheprisoner'sparoleorprobationhasbeenrevokedorbecausethe
29prisonerhas,orallegedlyhas,violatedanyconditionoftheprisoner'sparoleorprobation,and
30suchparoleorprobationisaconsequenceofaviolationofastatestatute,ortheprisonerisa
31fugitivefromtheMissouridepartmentofcorrectionsorotherwiseheldattherequestofthe
32Missouridepartmentofcorrectionsregardlessofwhetherornotawarranthasbeenissued
33shallbetheactualcostofincarcerationnottoexceed:
34 (1)UntilJuly1,1996,seventeendollarsperdayperprisoner;
35 (2)OnandafterJuly1,1996,twentydollarsperdayperprisoner;

37prisoner,subjecttoappropriations.
38 4.Thepresidingjudgeofajudicialcircuitmayproposeexpensestobereimbursable
39bythestateonbehalfofoneormoreofthecountiesinthatcircuit.Proposedreimbursable
40expensesmayincludepretrialassessmentandsupervisionstrategiesfordefendantswhoare
41ultimatelyeligibleforstateincarceration.Acountymaynotreceivemorethanitsshareofthe
42amountappropriatedinthepreviousfiscalyear,inclusiveofexpensesproposedbythe
43presidingjudge.Anycountyshallconveysuchproposaltothedepartment,andanysuch
44proposalpresentedbyapresidingjudgeshallincludethedocumentedagreementwiththe
45proposalbythecountygoverningbody,prosecutingattorney,atleastoneassociatecircuit
46judge,andtheofficerofthecountyresponsibleforcustodyorincarcerationofprisonersof
47thecountyrepresentedintheproposal.Anycountythatdeclinestoconveyaproposaltothe
48department,pursuanttotheprovisionsofthissubsection,shallreceiveitsperdiemcostof
49incarcerationforallprisonerschargeabletothestateinaccordancewiththeprovisionsof
50subsections1,2,and3ofthissection.
51 5.Notwithstandinganyotherprovisionsoflawtothecontrary,anycounty
52receivingreimbursementunderthissectionshallmakepayabletwodollarsperprisoner
53perdayofsuchreimbursementtothestatetreasurer,whoshalldepositsuchfundsinthe
54sheriffs'retirementfundcreatedundersection57.952.
[57.955.1.Thereshallbeassessedandcollectedasurchargeofthree
2 dollarsinallcivilactionsfiledinthecourtsofthisstateandinallcriminal
3 casesincludingviolationofanycountyordinanceoranyviolationofcriminal
4 ortrafficlawsofthisstate,includinginfractions,butnosuchsurchargeshall
5 beassessedwhenthecostsarewaivedoraretobepaidbythestate,countyor
6 municipalityorwhenacriminalproceedingorthedefendanthasbeen
7 dismissedbythecourt.Forpurposesofthissection,theterm"county
8 ordinance"shallnotincludeanyordinanceofthecityofSt.Louis.Theclerk
9 responsibleforcollectingcourtcostsincivilandcriminalcases,shallcollect
10 anddisbursesuchamountsasprovidedbysections488.010to488.020.Such
11 fundsshallbepayabletothesheriffs'retirementfund.Moneyscreditedtothe
12 sheriffs'retirementfundshallbeusedonlyforthepurposesprovidedforin
13 sections57.949to57.997andfornootherpurpose.
14 2.Theboardmayacceptgifts,donations,grantsandbequestsfrom
15 publicorprivatesourcestothesheriffs'retirementfund.]
[57.962.Otherprovisionsoflawtothecontrarynotwithstanding,any
2 countyorcitynotwithinacountywhohaselectedorelectsinthefutureto
3 comeundertheprovisionsofsections57.949to57.997shall,afterAugust28,
4 2002,oronthedatethatsuchelectionisapprovedbytheboardofdirectorsof
5 theretirementsystem,whicheverlateroccurs,besubjecttotheprovisionsof
6 section57.955.]

3 shallannually,byJulyfirstofthesucceedingyear,sendacopyofsuch

[488.024.Asprovidedbysection57.955,thereshallbeassessedand
2 collectedasurchargeofthreedollarsinallcivilactionsfiledinthecourtsof
3 thisstateandinallcriminalcasesincludingviolationofanycountyordinance
4 oranyviolationofcriminalortrafficlawsofthisstate,includinginfractions,
5 butnosuchsurchargeshallbeassessedwhenthecostsarewaivedoraretobe
6 paidbythestate,countyormunicipalityorwhenacriminalproceedingorthe
7 defendanthasbeendismissedbythecourt.Forpurposesofthissection,the
