SectionA.Chapter195,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection195.900,toreadasfollows:
195.900.1.Thissectionshallbeknownandmaybecitedasthe"Intoxicating
2CannabinoidControlAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Cannabinoid",anyoftheligandsthatareplant-derived,synthetic,or
5semisyntheticandthathaveanaffinityforandactivityatcannabinoidreceptors;
6 (2)"CBD",cannabidiol,anonintoxicatingcannabinoidfoundincannabisand
7hemp;
8 (3)"Department",thedepartmentofhealthandseniorservices;
9 (4)"Hemp",theplantCannabissativaL.andanypartofthatplant,including
10theseedsthereofandallderivatives,extracts,cannabinoids,isomers,acids,salts,and
11saltsofisomers,whethergrowingornot,withadelta-9tetrahydrocannabinol
12concentrationofnotmorethanthree-tenthsofonepercentonadry-weightbasis;
13 (5)"Intoxicatingcannabinoid":
14 (a)Anycannabinoid,howeverderivedorcreated,thathasanintoxicatingeffect
15whenconsumedorotherwiseingested,regardlessofwhetherthecannabinoidwas
16createdordevelopedthroughnaturalmeansorthroughchemicalconversion,
17isomerization,syntheticderivation,heat,oranyotherprocessbywhichmolecules

21intoxicatingcannabinoidthatmaybecomeintoxicatingwhenheated,decarboxylated,or

24Theterm"intoxicatingcannabinoid"shallbeconstruedtoconformto,andbeincluded
25in,thedefinitionof"marijuana"underArticleXIVoftheConstitutionofMissouribut
26shallnotbeconstruedtoconformtoorbeincludedinthedefinitionof"hemp"inthis
27sectionorinthedefinitionof"industrialhemp"insection195.010;
28 (6)"Intoxicatingcannabinoidproduct",anyproductcontaininganintoxicating
29cannabinoid;
30 (7)"Marijuana",thesamemeaninggiventotheterminArticleXIVofthe
31ConstitutionofMissouri.Theterm"marijuana"shallnotbeconstruedtoconformto
32orbeincludedinthedefinitionof"hemp"inthissection.
33 3.Hemp,industrialhemp,andhemp-derivedproductsthatdonotcontain
34intoxicatingcannabinoidsshallnotbeconsideredmarijuanaandshallnotbesubjectto
35thelegalframeworkcontainedinArticleXIVoftheConstitutionofMissouri.Nothing
36inthissectionshallbeinterpretedtoregulatehemp,industrialhemp,orproductsthat
37donotcontainintoxicatingcannabinoids,andtheprovisionsofthissectionshallnotbe
38interpretedinamannerthatwouldconflictwithorotherwisepreempttheAgriculture
39ImprovementActof2018,Pub.L.115-334.
40 4.Nothinginthissectionprohibitstheinterstatecommerceofhemporthe
41transportationorshipmentofhempthroughthisstate.
42 5.Notwithstandinganyprovisionoflawtothecontrary,allintoxicating
43cannabinoidproductsaremarijuanaandshallberegulatedbythedepartmentinthe
44samemannerasthedepartmentregulatesmarijuanaunderArticleXIVofthe
45ConstitutionofMissouriincluding,butnotlimitedto,requiringintoxicating
46cannabinoidproductstobesubjecttothesamegrowing,manufacturing,dispensing,
47transportation,advertising,marketing,testing,packaging,andlabelingrequirementsas
48marijuanaandrequiringallintoxicatingcannabinoidproductstobecultivated,
49manufactured,andsoldonlyatalicensedcomprehensivefacility,medicalfacility,or
50marijuanamicrobusinessfacility,assuchtermsaredefinedinArticleXIVofthe
51ConstitutionofMissouri.Thedepartmentshallregulateallintoxicatingcannabinoid
52productsconsistentwith,andinadditionto,othernaturalmarijuanaproductsin
53accordancewithitsconstitutionallymandatedrequirementtoregulatemarijuana
54withintheframeworkofArticleXIVoftheConstitutionofMissouri.
HB593	2 55 6.Nopersonorentityotherthanacomprehensivemarijuanadispensaryfacility,
56medicalmarijuanadispensaryfacility,ormicrobusinessdispensaryfacilitylicensed
57underArticleXIVoftheConstitutionofMissourishallcarryon,conduct,ortransacta
58businessunderanamethatcontainsaspartofthenametheword"dispensary"orany
59wordofsimilarorlikeimport.
60 7.Thedepartmentshallcollaboratewiththedepartmentofpublicsafetyandall
61otherpertinentlawenforcementagenciesinthisstatetoensuretheprovisionsofthis
62sectionareenforced.
63 8.Thedepartmentshallpromulgateallrulesandregulationsnecessaryto
64implementtheprovisionsofthissection.Thedepartmentandthedepartmentofpublic
65safetyshallactivelyandaggressivelyenforcetheprovisionsofthissectionandall
66departmentrulesandregulationspromulgatedunderthissection.Anyruleorportion
67ofarule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority
68delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto
69alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand
70chapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
71pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
72arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
73andanyruleproposedoradoptedafterAugust28,2025,shallbeinvalidandvoid.
