nonnativeinvasiveplantspecies.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section263.070,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection263.070,toreadasfollows:
263.070.1.Ascheduleoffeestodefraythecostofinspectinggreenhouses,
2nurseries,nurserydealers,nurserystock,plants,plantproductsandothermaterialsishereby
3establishedandshallbelistedintherulesmadepursuanttosections263.010to263.180.This
4feeschedulemayberevisedfromtimetotimetomoreaccuratelyreflecttheactualcostof
5theseinspections.
6 2.Greenhouseinspectionshallbeoptionalandanygrowerofgreenhouseplantswho
7maydesireorfindneedforacertificateofgreenhouseinspectionmayobtainsemiannual
8inspectionofhisgreenhouse,premisesandplants,bymakingapplicationtothestate
9entomologist.Thissemiannualinspectionandcertificationofgreenhousesshallbe
10performedunderthesamegeneralprovisionsasapplytotheannualinspectionof
11nurseries.GreenhouseinspectioncertificatesshallexpireonNovemberthirtiethofeachyear.
12 3.Allnurseriesinthisstateshallbeinspectedatleastonceeachyeartoascertain
13whethertheyareinfestedorinfectedwithplantpestsandshallmeettheaffidavit
14requirementsunderparagraph(d)ofsubdivision(1)ofsubsection5ofthissection.
15Uponfullpaymentofthefeeandsubmissionoftheaffidaviteachnurserymanshallreceive
16awrittennoticeofthefindingsofsuchinspectionalongwithanurseryinspectioncertificate;
17exceptthat,thestateentomologistmaywithholdcertificationofanurserypendingeradication
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18ofextremelyseriousorabundantplantpestsorweedsofsuchnaturewhichwouldpreventthe
19adequateinspectionofsuchnursery.Thiscertificateshallbeusedinconnectionwiththe
20shipmentormovementofanynurserystockshowntobeapparentlyfreeofharmfuland
21destructiveplantpestsorothernurserystockfromwhichharmfulanddestructiveplantpests
22havebeeneliminated.AllnurseryinspectioncertificatesshallexpireonSeptemberthirtieth
23ofeachyear.Eachnurseryshallbeallowedoneretailsalesoutletpercertificate.Additional
24outletsshallrequireseparatenurserydealerregistration-inspectioncertificates.Whenthe
25findingsoftheannualinspectionofanurseryshallintheopinionofthestateentomologist
26warrantsuchaction,additionalinspectionsofthenurserymaybemadeandthenurserymay
27bechargedafeesufficienttocoverthecostofsuchreinspection.
28 4.Bynoticeinwritingthestateentomologistmayrequireanurserymantoholdany
29varietyoranyamountofnurserystockforinspectionorreinspectionbyquarantiningsuch
30nurserystockwheneversuchactionisnecessarytodeterminethatitisfreefrompestsorto
31allowtimetoeradicateanysuchpests.Thestateentomologistmayfurtherordertheremoval
32fromsaleandthetreatmentordestructionofanynurserystockinfestedorinfectedwith
33especiallyinjuriouspestsornurserystockwhichisnotviableorisinsuchdamagedor
34desiccatedconditionastobeincapableofreasonablegrowth.Nocompensationshallbepaid
35foranystockordereddestroyed.
36 5.(1)Eachnurserydealer,beforesellingorofferingforsaleorotherwisedistributing
37nurserystockwithinthisstate,shallannuallyobtainanurserydealers'registration-inspection
38certificateforeachindividuallocationfromwhichthedealersellsoroffersforsalenursery
39stock.Eachnurserydealershallmakeapplicationonformstobeprovidedbythestate
40entomologistforeachindividuallocation,whichshallinclude:
41 (a)Thenameandcompleteaddressofthenurserydealer'splaceofbusinessforwhich
42suchcertificateisrequested;
43 (b)Adeclarationthatapplicantwillobtainanddistributeonlyinspectedandcertified
44nurserystock;[and]
45 (c)Anup-to-datelistingofallsourcesfromwhich[he]thenurserydealersecures
46nurserystock; and
47 (d)Anaffidavitthatthenurserydealershallnotknowinglyandintentionally
48import,export,buy,sell,transport,distribute,orpropagateanyviableplantportionor
49seedsof:
50 a.Wintercreeper(Euonymusfortunei,varietyColoratus),allvarietiesof
51Japanesehoneysuckle(Lonicerajaponica),orallvarietiesofsericealespedeza
52(Lespedezacuneata)onorafterJanuary1,2027;or
53 b.Burningbush(Euonymusalatus,varietyCompactus)orallvarietiesof
54Callerypear(Pyruscalleryana)onorafterJanuary1,2029.

56registration-inspectionfeeassetforthintherulesmadepursuanttosections263.010to
57263.180.
58 (3)Allnurserydealerregistration-inspectioncertificatesshallexpireonSeptember
59thirtiethofeachyear.
60 (4)Thestateentomologistmayinspectorcausetobeinspectedthepremisesofany
61nurserydealerincludinganysalesyard,packingshed,nurserystockonhandorequipment,
62forthepresenceofdangerousanddestructiveplantpestswhichmaybedisseminatedon
63nurserystock.
64 6.Bynoticeinwritingthestateentomologistmayrequireanurserydealertoholdany
65varietyoranyamountofnurserystockbyquarantiningsuchnurserystockwheneversuch
66actionisnecessarytodeterminethatitisfreefrompestsortoallowtimetoeradicateanysuch
67pests.Thestateentomologistmayfurtherordertheremovalfromsaleandthetreatmentor
68destructionofanynurserystockinfestedorinfectedwithespeciallyinjuriouspests,ornursery
69stockwhichisnotviableorisinsuchdamagedordesiccatedconditionastobeincapableof
70reasonablegrowth.Nocompensationshallbepaidforanystockordereddestroyed.
71 7.Anypersoninneedofaspecialinspectionandcertificationofnurserystock,other
72plantsorplantproductsmayuponrequesttothestateentomologisthavesameinspectedfor
73plantpests.Afeesufficienttocoverthecostofsuchinspectionorcertificate,orboth,maybe
74charged.Uponcompletionoftheinspectionandpaymentofthefee,acertificateof
75inspectionshallbeissuedprovidedtheplantsorplantproductsarefreeofharmfulplantpests.
76Thestateentomologistmayenterintoagreementswithvariouspersonsorcompanies,tocarry
77outtherequirementsofthisstateandimportingstatesorcountries.
78 8.Allmoneysreceivedforanyinspectionfeeorotherreceiptsunderthislawshallbe
79depositedinthestatetreasuryandshallbesubjecttoappropriationbythegeneralassembly.
