21 2.Thestatewideassessmentsystemshallonlypermittheacademicperformanceof

24 3.(1)Thestateboardofeducationshallsuggest,butnotmandate,criteriafora
25schooltodemonstratethatitsstudentslearntheknowledge,skillsandcompetenciesat
26exemplarylevelsworthyofimitationbystudentsinotherschoolsinthestateandnation.
27 (2)Exemplarylevelsshallbemeasuredbythestatewideassessmentsystem
28developedpursuanttosubsection1ofthissection,oruntilsaidstatewideassessmentsystem
29isavailable,byindicatorsapprovedforsuchusebythestateboardofeducation.
30 (3)Theprovisionsofotherlawtothecontrarynotwithstanding,thecommissionerof

160.522.1.Thedepartmentofelementaryandsecondaryeducationshallproduceor
2causetobeproduced,atleastannually,aschoolaccountabilityreportcardforeachpublic
3schooldistrict,eachpublicschoolbuildinginaschooldistrict,andeachcharterschoolinthe
4state.Thereportcardshallbedesignedtosatisfystateandfederalrequirementsforthe
5disclosureofstatisticsaboutstudents,staff,finances,academicachievement,andother
6indicators.Thepurposeofthereportcardshallbetoprovideeducationalstatisticsand
7accountabilityinformationforparents,taxpayers,schoolpersonnel,legislators,andtheprint
8andbroadcastnewsmediainastandardized,easilyaccessibleform.
9 2.(1)Thedepartmentofelementaryandsecondaryeducationshalldevelopa
10standardformfortheschoolaccountabilityreportcard.
11 (2)Theinformationreportedshallinclude,butnotbelimitedto,the[district's]
12followinginformationreportedbyeachschooldistrictorcharterschool:

49identifyattendancecentersthathavebeencategorizedunderfederallawasneeding
50improvementorrequiringspecificschoolimprovementstrategies.
51 5.Thereportcardshallnotlimitordiscourageothermethodsofpublicreportingand
52accountabilitybylocalschooldistricts.Districtsshallprovideinformationincludedinthe
HCSHB607	6 53reportcardtoparents,communitymembers,theprintandbroadcastnewsmedia,and
54legislatorsbyDecemberfirstannuallyorassoonthereafterastheinformationisavailableto
55thedistrict,givingpreferencetomethodsthatincorporatethereportingintosubstantive
56officialcommunicationssuchasstudentreportcards.Theschooldistrictshallprovidea
57printedcopyofthedistrict-levelorschool-levelreportcardtoanypatronuponrequestand
58shallmakereasonableeffortstosupplybusinessessuchas,butnotlimitedto,realestateand
59employmentfirmswithcopiesorotherinformationaboutthereportssothatparentsand
60businessesfromoutsidethedistrictwhomaybecontemplatingrelocationhaveaccess.
61 6.Forpurposesofcompletinganddistributingtheannualreportcardasprescribedin
62thissection,aschooldistrictmayincludethedatafromacharterschoollocatedwithinsuch
63schooldistrict,providedthelocalboardofeducationorspecialadministrativeboardforsuch
64districtandthecharterschoolreachmutualagreementfortheinclusionofthedatafromthe
65charter[schools] schoolandthetermsofsuchagreementareapprovedbythestateboardof
66education.Thecharterschoolshallnotberequiredtobeapartofthelocaleducationalagency
67ofsuchschooldistrictandmaymaintainaseparatelocaleducationalagencystatus.
160.2700.Forpurposesofsections160.2700to160.2725,"adulthighschool"means
2aschoolthat:
3 (1)Isforindividualswhodonothaveahighschooldiplomaandwhoare[twenty-
4one]eighteenyearsofageorolder;
5 (2)Offersanindustrycertificationprogramorprogramsandahighschooldiplomain
6amannerthatallowsstudentstoearnadiplomaatthesametimethattheyearnanindustry
7certification;
8 (3)Offerschildcareforchildrenofenrolledstudentsattendingtheschool;and
9 (4)Isnoteligibletoreceivefundingundersection160.415or163.031.
160.2705.1.ThedepartmentofsocialservicesshallauthorizeMissouri-based
2nonprofitorganizationsmeetingthecriteriaofthissectiontoestablishandoperateuptofive
3adulthighschools,with:
4 (1)Oneadulthighschooltobelocatedinacitynotwithinacounty;
5 (2)Oneadulthighschooltobelocatedinacountyofthethirdclassificationwithouta
6townshipformofgovernmentandwithmorethanforty-onethousandbutfewerthanforty-
7fivethousandinhabitantsoracountycontiguoustothatcounty;
8 (3)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith
9morethantwohundredsixtythousandbutfewerthanthreehundredthousandinhabitantsora
10countycontiguoustothatcounty;
11 (4)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith
12morethanonehundredfiftythousandbutfewerthantwohundredthousandinhabitants;and

14thousandbutfewerthaneighthundredthousandinhabitants,oracontiguouscounty.
15 2.Thedepartmentofsocialservicesshalladministerfundingtoadulthighschools
16subjecttoappropriations.Thedepartmentshallberesponsibleforgrantingandmaintaining
17authorizationforadulthighschools.ForadulthighschoolsinoperationpriortoJanuary1,
182023,thedepartmentshallmaintainauthorizationforthenonprofitorganizationtooperatethe
19schools,subjecttocompliancewiththissection.Nomorethanoneorganizationshallbe
20authorizedtooperateanadulthighschoolateachlocationdescribedinsubsection1ofthis
21section.Anorganizationmayestablishsatellitecampusesforanyadulthighschoolitis
22authorizedtooperate.Thedepartmentshalladministerfundingforsatellitecampusessubject
23toappropriations.
24 3.OnorbeforeJanuary1,2024,thedepartmentofsocialservicesshallselectan
25eligibleMissouri-basednonprofitorganizationtooperateinalocationdescribedin
26subdivision(5)ofsubsection1ofthissection.Aneligibleorganizationshall:
27 (1)Demonstratetheabilitytoestablish,withintwenty-onemonthsofthereceiptof
28theauthorization,anadulthighschoolofferinghighschooldiplomas,anindustrycertification
29programorprograms,andchildcareforchildrenofthestudentsattendingthehighschools;
30 (2)Demonstratetheabilitytocommitatleastfivehundredthousanddollarsforthe
31purposeofestablishingthenecessaryinfrastructureattheadulthighschool;
32 (3)Demonstratesubstantialandpositiveexperienceinprovidingservices,including
33industrycertificationsandjobplacementservices,toadults[twenty-one] eighteenyearsof
34ageorolderwhoseeducationalandtrainingopportunitieshavebeenlimitedbyeducational
35disadvantages,disabilities,homelessness,criminalhistory,orsimilarcircumstances;
36 (4)Establishapartnershipwithastate-supportedpostsecondaryeducationinstitution
37ormorethanonesuchpartnership,ifapartnershiporpartnershipsarenecessaryinorderto
38meettherequirementsforanadulthighschool;
39 (5)Establishacomprehensiveplanthatsetsforthhowtheadulthighschoolswillhelp
40addresstheneedforasufficientlytrainedworkforceinthesurroundingregionforeachadult
41highschool;
42 (6)Establishpartnershipsandstrategiesforengagingthecommunityandbusiness
43leadersincarryingoutthegoalsofeachadulthighschool;
44 (7)Establishtheabilitytomeetqualitystandardsthroughcertifiedteachersand
45programsthatsupporteachstudentinsuchstudent'sgoaltofindamorerewardingjob;
46 (8)Establishaplanforassistingstudentsinovercomingbarrierstoeducational
47successincluding,butnotlimitedto,educationaldisadvantages,homelessness,criminal
48history,disability,includinglearningdisabilitysuchasdyslexia,andsimilarcircumstances;

50outcomesrelatedtoastudent'sabilitytofindamorerewardingjobthroughtheattainmentof
51ahighschooldiplomaandjobtrainingandcertification;and
52 (10)Limittheadministrativefeetonomorethantenpercent.
53 4.(1)Thedepartmentofelementaryandsecondaryeducationshallestablish
54academicrequirementsforstudentstoobtainhighschooldiplomas.
55 (2)Requirementsforahighschooldiplomashallbebasedonanadultstudent'sprior
56highschoolachievementandtheremainingcreditsandcourseworkthatwouldbenecessary
57forthestudenttoreceiveahighschooldiplomaifsuchstudentwereinatraditionalhigh
58schoolsetting.Theadultstudentshallmeettherequirementswiththesamelevelofacademic
59rigoraswouldotherwisebenecessarytoattainsuchcredits.
60 (3)Theadulthighschoolauthorizedunderthissectionshallawardhighschool
61diplomastostudentswhosuccessfullymeettheestablishedacademicrequirements.The
62adulthighschoolauthorizedunderthissectionshallconferthediplomaasthoughthestudent
63earnedthediplomaatatraditionalhighschool.Thediplomashallhavenodifferentiating
64marks,titles,orothersymbols.
65 (4)Studentsatadulthighschoolsmaycompleterequiredcourseworkattheirown
66paceandasavailablethroughtheadulthighschool.Theyshallnotberequiredtosatisfyany
67specificnumberofclassminutes.Theadulthighschoolmayalsomakeclassesavailableto
68studentsonlineasmaybeappropriate.However,studentsshallnotcompletethemajorityof
69instructionoftheschool'scurriculumonlineorthroughremoteinstruction.Forthepurposes
70ofthissubsection,synchronousinstructionconnectingstudentstoaliveclassconductedina
71Missouriadulthighschoolshallbetreatedthesameasin-personinstruction.
72 (5)Thedepartmentofelementaryandsecondaryeducationshallnotcreateadditional
73regulationsorburdensontheadulthighschoolorthestudentsattendingtheadulthigh
74schoolsbeyondcertifyingnecessarycreditsandensuringthatstudentshavesufficiently
75masteredthesubjectmattertomakethemeligibleforcredit.
76 5.Anadulthighschoolshallbedeemedasecondaryschoolsystemforthepurposes
77ofsubdivision[(15)] (16)ofsubsection1ofsection210.211.
160.2710.1.Anypersonwhois[twenty-one] eighteenyearsofageoroldermay
2enrollinanadulthighschoolifheorshehasnotearnedahighschooldiploma.
3 2.Anadulthighschoolshallgiveapreferenceinadmissiontothosestudentswho
4receiveanylocal,state,orfederalassistanceinwhichapersonorfamilyisrequirednotto
5exceedacertainincomelevelinordertoqualifyfortheassistance.
6 3.Forthepurposesofcompilingandtrackingdropoutratesofalocaleducation
7agencybythedepartmentofelementaryandsecondaryeducation,astudent

2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve
3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool
4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology,
5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein
6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe
7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection.
8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students
9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe
10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant
11provisionsofsubsection3ofthissectionforsuchenrollment.Studentattendanceforfull-
12timevirtualprogramstudentsshallonlybeincludedinanydistrictpupilattendance
13calculationunderchapter163usingcurrent-yearpupilattendanceforsuchfull-timevirtual
14programpupils.Forthepurposeofcalculatingaveragedailyattendanceinfull-timevirtual
15programsunderthissection,averagedailyattendanceshallbedefinedasthequotientorthe
16sumofthequotientsobtainedbydividingthetotalnumberofhoursattendedinatermby
17enrolledpupilsbetweentheagesoffiveandtwenty-onebytheactualnumberofhoursthat
18theprogramwasinsessioninthatterm,andtheprovisionsofsection162.1250shallnot
19applytosuchfundingcalculation.Suchcalculationshallbegeneratedbythevirtualprovider
20andprovidedtothehostdistrictforsubmissiontothedepartmentofelementaryand
21secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,asdefinedin
22subsection4ofthissection,duringanyhourofthedayandduringanydayoftheweek.The
23hoursattendedforeachenrolledpupilshallbedocumentedbythepupil'sweeklyprogressin
24theeducationalprogramaccordingtoaprocessdeterminedbythevirtualprogramand
25publishedannuallyinthevirtualprogram'senrollmenthandbookorpolicy.Totheaverage
26dailyattendanceofthefollowingschooltermshallbeaddedthefull-timeequivalentaverage
27dailyattendanceofsummerschoolstudents.Inthecaseofahostschooldistrictenrollingone
28ormorefull-timevirtualschoolstudents,suchenrollingdistrictshall,aspartofitsmonthly
29stateallocation,receivenolessunderthestateaidcalculationforsuchstudentsthanan
30amountequaltothestateadequacytargetmultipliedbytheweightedaveragedailyattendance
31ofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull-timevirtual

5 (b)Uponthebasisofexamination;
6 (2)Bythestateboard,underrulesandregulationsprescribedbythestateboardwith
7advicefromtheadvisorycouncilestablishedbysection168.015toanyindividualwho
8presentstothestateboardavaliddoctoraldegreefromanaccreditedinstitutionofhigher
9educationaccreditedbyaregionalaccreditingassociationsuchasNorthCentralAssociation.
10Suchcertificateshallbelimitedtothemajorareaofpostgraduatestudyoftheholder,shallbe
11issuedonlyaftersuccessfulcompletionoftheexaminationrequiredforgraduationpursuant
12torulesadoptedbythestateboardofeducation,andshallberestrictedtothosecertificates
13establishedpursuanttosubdivision(2)ofsubsection3ofthissection;
14 (3)Bythestateboard,whichshallissuetheprofessionalcertificateclassificationin
15boththegeneralandspecializedareasmostcloselyalignedwiththecurrentareasof
16certificationapprovedbythestateboard,commensuratewiththeyearsofteachingexperience
17oftheapplicant,andbaseduponthefollowingcriteria:
18 (a)a.Recommendationofastate-approvedbaccalaureate-levelteacherpreparation
19program;
20 b.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain
21aneighteen-hour(onethousandeightyminutes)onlineteacherpreparationprogramrelatedto
22subjectsappropriateforelementaryandsecondaryeducationsettings.Anycharitable
23organizationregisteredinMissourithatisexemptfromfederaltaxationundertheInternal
24RevenueCodeof1986,asamended,maysubmitateacherpreparationprogramtothe
25departmentofelementaryandsecondaryeducationforapproval.Onceapproved,the
26charitableorganizationshallbecertifiedtodevelopandmaintainateacherpreparedness
27program.Approvedteacherpreparednessprogramscreatedbyacharitableorganizationshall

29withabachelor'sdegreemaycompleteaneighteen-houronlinetrainingprogram,either
30createdbythedepartmentorbyacharitableorganization,andreceiveateachercertificate.
31SuchcertificateshallnotbeacceptedbyMissouripublicschools,andnonpublicschoolsshall
32notberequiredtoacceptthecertificate,butshallbeacceptedbyprivateschoolsandprivate
33schoolaccreditingagencies;
34 (b)a.SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessment
35forteachersoradministratorsdesignatedbythestateboardofeducation;
36 b.(i)Applicantswhohavenotsuccessfullyachievedaqualifyingscoreonthe
37designatedexaminationswillbeissuedatwo-yearnonrenewableprovisionalcertificate;
38 (ii)Duringthetwo-yearnonrenewableprovisionalcertification,anindividualteacher
39maygainfullprofessionalcertificationby:
40 i.Achievingaqualifyingscoreonthedesignatedexam;or
41 ii.Successfullyachievinganacceptablescoreonthestate-approvedteacher
42evaluationsystemfromsevenwalk-throughevaluations,twoformativeevaluations,andone
43summativeevaluationforeachofthetwoprobationaryyearsandbeingofferedathird

152makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst
153completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess
154ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe
155missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate
156thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional
157developmentwhichmayincludehoursspentintheclassroominanappropriatecollege
158curriculumwithinthesixmonthspriortoorafterreactivatingthepossessor'scertificate.The

161 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe

5 2.Thedepartmentofeconomicdevelopmentandthedepartmentofelementaryand
6secondaryeducationshalldevelopandrecommend:
7 (1)Requirementsforteacherexternshipsthatcanbeconsideredtheequivalentofthe
8completionofcredithoursingraduate-levelcoursesforpurposesofsalaryschedules;and
9 (2)Anequivalencyschedulethatsetsforththenumberofcredithoursingraduate-
10levelcoursesthatshallbeconsideredequivalenttoandawardedforeachtypeofteacher
11externship.Toclassifyteacherexternshipsanddeterminethenumberofcredithoursthat

18scheduleasdescribedinsubsection2ofthissection.Anyteacherexternshipthatmeetsthe
19publishedrequirementsshallbeknownasandconsideredacertifiedteacherexternshipfor
20purposesofthissection.
21 4.Ifaschooldistrictorcharterschoolusesasalaryscheduleinwhichateacher
22receivesahighersalaryifheorshehasearnedcredithoursingraduate-levelcourses,the
23schooldistrictorcharterschoolshallconsideranyteacherwhohascompletedacertified
24teacherexternshiptohavecompletedcredithoursingraduate-levelcoursesonitssalary
25scheduleinthemannerprescribedbytheequivalencyscheduledevelopedunderthissection
26andcompensatetheteacheraccordingly.
27 5.Thedepartmentofelementaryandsecondaryeducationandthedepartmentof
28economicdevelopmentmaypromulgaterulestoimplementtheprovisionsofthissection.

3consecutiveweeks,inanewspaperofgeneralcirculation,qualifiedpursuanttochapter493,
4locatedwithinthecityinwhichtheschooldistrictislocated,oriftherebenosuchnewspaper,
5inaqualifiednewspaperofgeneralcirculationinthecounty,oriftherebenosuchnewspaper,
6inaqualifiednewspaperofgeneralcirculationinanadjoiningcounty,andmayadvertisein
7business,trade,orminoritynewspapers,forbidsonsaidconstruction.
8 2.Nobidsshallbeentertainedbytheschooldistrictwhicharenotmadein
9accordancewiththespecificationsfurnishedbythedistrictandallcontractsshallbelettothe
10lowestresponsiblebiddercomplyingwiththetermsoftheletting,providedthatthedistrict
11shallhavetherighttorejectanyandallbids.
12 3.Allbidsmustbesubmittedsealedandinwriting,tobeopenedpubliclyattimeand
13placeofthedistrict'schoosing.
14 4.Therequirementsofthisstatutearenotapplicableifthedistrictutilizesa
