3schooldistrict,eachpublicschoolbuildinginaschooldistrict,andeachcharterschoolinthe 4state.Thereportcardshallbedesignedtosatisfystateandfederalrequirementsforthe 5disclosureofstatisticsaboutstudents,staff,finances,academicachievement,andother 6indicators.Thepurposeofthereportcardshallbetoprovideeducationalstatisticsand 7accountabilityinformationforparents,taxpayers,schoolpersonnel,legislators,andtheprint 8andbroadcastnewsmediainastandardized,easilyaccessibleform. 9 2.(1)Thedepartmentofelementaryandsecondaryeducationshalldevelopa 10standardformfortheschoolaccountabilityreportcard. 11 (2)Theinformationreportedshallinclude,butnotbelimitedto,the[district's] 48identifiedasapriorityschoolundersections160.720and161.092.Thereportalsoshall 49identifyattendancecentersthathavebeencategorizedunderfederallawasneeding 50improvementorrequiringspecificschoolimprovementstrategies. 51 5.Thereportcardshallnotlimitordiscourageothermethodsofpublicreportingand 52accountabilitybylocalschooldistricts.Districtsshallprovideinformationincludedinthe HCSHB607 6 53reportcardtoparents,communitymembers,theprintandbroadcastnewsmedia,and 54legislatorsbyDecemberfirstannuallyorassoonthereafterastheinformationisavailableto 55thedistrict,givingpreferencetomethodsthatincorporatethereportingintosubstantive 56officialcommunicationssuchasstudentreportcards.Theschooldistrictshallprovidea 57printedcopyofthedistrict-levelorschool-levelreportcardtoanypatronuponrequestand 58shallmakereasonableeffortstosupplybusinessessuchas,butnotlimitedto,realestateand 59employmentfirmswithcopiesorotherinformationaboutthereportssothatparentsand 60businessesfromoutsidethedistrictwhomaybecontemplatingrelocationhaveaccess. 61 6.Forpurposesofcompletinganddistributingtheannualreportcardasprescribedin 62thissection,aschooldistrictmayincludethedatafromacharterschoollocatedwithinsuch 63schooldistrict,providedthelocalboardofeducationorspecialadministrativeboardforsuch 64districtandthecharterschoolreachmutualagreementfortheinclusionofthedatafromthe 65charter[schools] schoolandthetermsofsuchagreementareapprovedbythestateboardof 66education.Thecharterschoolshallnotberequiredtobeapartofthelocaleducationalagency 67ofsuchschooldistrictandmaymaintainaseparatelocaleducationalagencystatus. 160.2700.Forpurposesofsections160.2700to160.2725,"adulthighschool"means 2aschoolthat: 3 (1)Isforindividualswhodonothaveahighschooldiplomaandwhoare[twenty- 4one]eighteenyearsofageorolder; 5 (2)Offersanindustrycertificationprogramorprogramsandahighschooldiplomain 6amannerthatallowsstudentstoearnadiplomaatthesametimethattheyearnanindustry 7certification; 8 (3)Offerschildcareforchildrenofenrolledstudentsattendingtheschool;and 9 (4)Isnoteligibletoreceivefundingundersection160.415or163.031. 160.2705.1.ThedepartmentofsocialservicesshallauthorizeMissouri-based 2nonprofitorganizationsmeetingthecriteriaofthissectiontoestablishandoperateuptofive 3adulthighschools,with: 4 (1)Oneadulthighschooltobelocatedinacitynotwithinacounty; 5 (2)Oneadulthighschooltobelocatedinacountyofthethirdclassificationwithouta 6townshipformofgovernmentandwithmorethanforty-onethousandbutfewerthanforty- 7fivethousandinhabitantsoracountycontiguoustothatcounty; 8 (3)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith 9morethantwohundredsixtythousandbutfewerthanthreehundredthousandinhabitantsora 10countycontiguoustothatcounty; 11 (4)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith 12morethanonehundredfiftythousandbutfewerthantwohundredthousandinhabitants;and HCSHB607 7 13 (5)Oneadulthighschooltobelocatedinacountywithmorethansevenhundred 14thousandbutfewerthaneighthundredthousandinhabitants,oracontiguouscounty. 15 2.Thedepartmentofsocialservicesshalladministerfundingtoadulthighschools 16subjecttoappropriations.Thedepartmentshallberesponsibleforgrantingandmaintaining 17authorizationforadulthighschools.ForadulthighschoolsinoperationpriortoJanuary1, 182023,thedepartmentshallmaintainauthorizationforthenonprofitorganizationtooperatethe 19schools,subjecttocompliancewiththissection.Nomorethanoneorganizationshallbe 20authorizedtooperateanadulthighschoolateachlocationdescribedinsubsection1ofthis 21section.Anorganizationmayestablishsatellitecampusesforanyadulthighschoolitis 22authorizedtooperate.Thedepartmentshalladministerfundingforsatellitecampusessubject 23toappropriations. 24 3.OnorbeforeJanuary1,2024,thedepartmentofsocialservicesshallselectan 25eligibleMissouri-basednonprofitorganizationtooperateinalocationdescribedin 26subdivision(5)ofsubsection1ofthissection.Aneligibleorganizationshall: 27 (1)Demonstratetheabilitytoestablish,withintwenty-onemonthsofthereceiptof 28theauthorization,anadulthighschoolofferinghighschooldiplomas,anindustrycertification 29programorprograms,andchildcareforchildrenofthestudentsattendingthehighschools; 30 (2)Demonstratetheabilitytocommitatleastfivehundredthousanddollarsforthe 31purposeofestablishingthenecessaryinfrastructureattheadulthighschool; 32 (3)Demonstratesubstantialandpositiveexperienceinprovidingservices,including 33industrycertificationsandjobplacementservices,toadults[twenty-one] eighteenyearsof 34ageorolderwhoseeducationalandtrainingopportunitieshavebeenlimitedbyeducational 35disadvantages,disabilities,homelessness,criminalhistory,orsimilarcircumstances; 36 (4)Establishapartnershipwithastate-supportedpostsecondaryeducationinstitution 37ormorethanonesuchpartnership,ifapartnershiporpartnershipsarenecessaryinorderto 38meettherequirementsforanadulthighschool; 39 (5)Establishacomprehensiveplanthatsetsforthhowtheadulthighschoolswillhelp 51ahighschooldiplomaandjobtrainingandcertification;and 52 (10)Limittheadministrativefeetonomorethantenpercent. 53 4.(1)Thedepartmentofelementaryandsecondaryeducationshallestablish 54academicrequirementsforstudentstoobtainhighschooldiplomas. 55 (2)Requirementsforahighschooldiplomashallbebasedonanadultstudent'sprior 56highschoolachievementandtheremainingcreditsandcourseworkthatwouldbenecessary 57forthestudenttoreceiveahighschooldiplomaifsuchstudentwereinatraditionalhigh 58schoolsetting.Theadultstudentshallmeettherequirementswiththesamelevelofacademic 59rigoraswouldotherwisebenecessarytoattainsuchcredits. 60 (3)Theadulthighschoolauthorizedunderthissectionshallawardhighschool 61diplomastostudentswhosuccessfullymeettheestablishedacademicrequirements.The 62adulthighschoolauthorizedunderthissectionshallconferthediplomaasthoughthestudent 63earnedthediplomaatatraditionalhighschool.Thediplomashallhavenodifferentiating 64marks,titles,orothersymbols. 65 (4)Studentsatadulthighschoolsmaycompleterequiredcourseworkattheirown 66paceandasavailablethroughtheadulthighschool.Theyshallnotberequiredtosatisfyany 67specificnumberofclassminutes.Theadulthighschoolmayalsomakeclassesavailableto 68studentsonlineasmaybeappropriate.However,studentsshallnotcompletethemajorityof 69instructionoftheschool'scurriculumonlineorthroughremoteinstruction.Forthepurposes 70ofthissubsection,synchronousinstructionconnectingstudentstoaliveclassconductedina 71Missouriadulthighschoolshallbetreatedthesameasin-personinstruction. 72 (5)Thedepartmentofelementaryandsecondaryeducationshallnotcreateadditional 73regulationsorburdensontheadulthighschoolorthestudentsattendingtheadulthigh 74schoolsbeyondcertifyingnecessarycreditsandensuringthatstudentshavesufficiently 75masteredthesubjectmattertomakethemeligibleforcredit. 76 5.Anadulthighschoolshallbedeemedasecondaryschoolsystemforthepurposes 77ofsubdivision[(15)] (16)ofsubsection1ofsection210.211. 160.2710.1.Anypersonwhois[twenty-one] eighteenyearsofageoroldermay 2enrollinanadulthighschoolifheorshehasnotearnedahighschooldiploma. 3 2.Anadulthighschoolshallgiveapreferenceinadmissiontothosestudentswho 4receiveanylocal,state,orfederalassistanceinwhichapersonorfamilyisrequirednotto 5exceedacertainincomelevelinordertoqualifyfortheassistance. 6 3.Forthepurposesofcompilingandtrackingdropoutratesofalocaleducation 7agencybythedepartmentofelementaryandsecondaryeducation,astudent 8transferringfromalocaleducationagencytoanadulthighschoolshallbe HCSHB607 9 9consideredatransferstudentandnotadropoutstudentfromthelocaleducation 10agency. 161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof 2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve 3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool 4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology, 5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein 6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe 7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection. 8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students 9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe 10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant 11provisionsofsubsection3ofthissectionforsuchenrollment.Studentattendanceforfull- 12timevirtualprogramstudentsshallonlybeincludedinanydistrictpupilattendance 13calculationunderchapter163usingcurrent-yearpupilattendanceforsuchfull-timevirtual 14programpupils.Forthepurposeofcalculatingaveragedailyattendanceinfull-timevirtual 15programsunderthissection,averagedailyattendanceshallbedefinedasthequotientorthe 16sumofthequotientsobtainedbydividingthetotalnumberofhoursattendedinatermby 17enrolledpupilsbetweentheagesoffiveandtwenty-onebytheactualnumberofhoursthat 18theprogramwasinsessioninthatterm,andtheprovisionsofsection162.1250shallnot 19applytosuchfundingcalculation.Suchcalculationshallbegeneratedbythevirtualprovider 20andprovidedtothehostdistrictforsubmissiontothedepartmentofelementaryand 21secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,asdefinedin 22subsection4ofthissection,duringanyhourofthedayandduringanydayoftheweek.The 23hoursattendedforeachenrolledpupilshallbedocumentedbythepupil'sweeklyprogressin 24theeducationalprogramaccordingtoaprocessdeterminedbythevirtualprogramand 25publishedannuallyinthevirtualprogram'senrollmenthandbookorpolicy.Totheaverage 26dailyattendanceofthefollowingschooltermshallbeaddedthefull-timeequivalentaverage 27dailyattendanceofsummerschoolstudents.Inthecaseofahostschooldistrictenrollingone 28ormorefull-timevirtualschoolstudents,suchenrollingdistrictshall,aspartofitsmonthly 29stateallocation,receivenolessunderthestateaidcalculationforsuchstudentsthanan 30amountequaltothestateadequacytargetmultipliedbytheweightedaveragedailyattendance 31ofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull-timevirtual 32schoolprogramoperatedbyapublicinstitutionofhighereducationinthisstateshallbe 33countedforastateaidcalculationbythedepartment,andthedepartmentshallpay,from 34fundsdedicatedtostateschoolaidpaymentsmadeundersection163.031,tosuchinstitution HCSHB607 10 35anamountequaltothestateadequacytargetmultipliedbytheweightedaveragedaily 36attendanceofsuchfull-timestudents. 37 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict 38ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse 39accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch, 40limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin 41whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall 42promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time 43equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits 44perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount 45asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse 46offeredbytheschooldistrictwouldgenerate. 47 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder 48subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical 49locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity, 50andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor 51providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment. 52 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof 53attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit 54completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe 55mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom 56enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying 57tuitionorcoursefees. 58 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe 59consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe 60statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof 61studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated 62attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike 63mannertootherattendancecenters.Theacademicperformanceofanystudentwhodisenrolls 64fromafull-timevirtualschoolprogramandenrollsinapublicschoolorcharterschoolshall 65notbeusedindeterminingtheannualperformancereportscoreoftheattendancecenteror 66schooldistrictinwhichthestudentenrollsfortwelvemonthsfromthedateofenrollment. 67 (6)Forthepurposesofthissection,apublicinstitutionofhighereducationoperating 68afull-timevirtualschoolprogramshallbesubjecttoallrequirementsapplicabletoahost 69schooldistrictwithrespecttoitsfull-timeequivalentstudents. 70 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand 71virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse HCSHB607 11 72loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe 73schooldistrictorcharterschoolif: 74 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool; 75and 76 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram 77course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool 78throughtheproceduredescribedundersubdivision(2)ofthissubsection. 79 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe 80processbywhichastudentmayenrollincoursesprovidedbytheMissouricourseaccessand 81virtualschoolprogramthatissubstantiallysimilartothetypicalprocessbywhichadistrict 82studentwouldenrollincoursesofferedbytheschooldistrictandacharterschoolstudent 83wouldenrollincoursesofferedbythecharterschool.Thepolicymayincludeconsultation 84withtheschool'scounselorandmayincludeparentalnotificationorauthorization.Thepolicy 85shallensurethatavailableopportunitiesforin-personinstructionareconsideredpriorto 86movingastudenttovirtualcourses.Thepolicyshallallowforcontinuousenrollment 87throughouttheschoolyear.Iftheschooldistrictorcharterschooldisapprovesastudent's 88requesttoenrollinacourseorcoursesprovidedbytheMissouricourseaccessandvirtual 89schoolprogram,thereasonshallbeprovidedinwritinganditshallbeforgoodcause.Good 90causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea 91determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe 92consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe 93processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool 94districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter 95school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe 96studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse 97denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto 98thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin 99coursesofferedbytheschooldistrictandacharterschoolstudentseekingtoenrollincourses 100offeredbythecharterschool. 101 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram 102courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor 103charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall 104paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion 105ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter 106schoolmaystopmakingmonthlypaymentstothecontentprovider.Noschooldistrictor 107charterschoolshallpay,foranyonecourseforastudent,morethanthemarketnecessary 108costsbutinnocaseshallpaymorethanfourteenpercentofthestateadequacytarget,as HCSHB607 12 109definedundersection163.011,ascalculatedattheendofthemostrecentschoolyearforany 110single,year-longcourseandnomorethansevenpercentofthestateadequacytargetas 111describedaboveforanysinglesemesterequivalentcourse. 112 (4)(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheir 113choiceasprovidedinthissubdivision,andtheprovisionsofsubdivisions(1)to(3)ofthis 114subsectionshallnotapplytosuchenrollmentinafull-timevirtualprogram.Eachhostschool 115districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand 116implementanenrollmentpolicyasspecifiedbytheprovisionsofthissubdivision.The 117student,thestudent'sparentorguardianifthestudentisnotconsideredhomeless,thevirtual 118program,thehostdistrict,andtheresidentdistrictshallcollaborateingoodfaithtoimplement 119theenrollmentpolicyregardingthestudent'senrollment,andtheresidentschooldistrictand 120thehostschooldistrictmaymutuallyagreethattheresidentdistrictshallofferorcontinueto 121offerservicesforthestudentunderanagreementthatincludesfinancialtermsfor 122reimbursementbythehostschooldistrictforthenecessarycostsoftheresidentschooldistrict 123providingsuchservices.Anenrollmentpolicyspecifiedunderthissubsectionshall: 124 a.Requireastudent'sparentorguardian,ifthestudentisnotconsideredhomeless,to 125applyforenrollmentinafull-timevirtualprogramdirectlywiththevirtualprogram; 126 b.Specifytimelinesfortimelyparticipationbythevirtualprogram,thehostdistrict, 127andresidentdistrict;providedthattheresidentdistrictshallprovideanyrelevantinformation 128andinputontheenrollmentwithintenbusinessdaysofnoticefromthevirtualprogramofthe 129enrollmentapplication; 130 c.Includeasurveyofthereasonsforthestudent'sandparent'sinterestsin 131participatinginthevirtualprogram; 132 d.Includeconsiderationofavailableopportunitiesforin-personinstructionpriorto 133enrollingastudentinavirtualprogram; 134 e.Evaluaterequestsforenrollmentbasedonmeetingtheneedsforastudenttobe 135successfulconsideringallrelevantfactors; 136 143admitted,basedontheenrollmentpolicy,inconsiderationofallrelevantfactorsandprovide 144thebasisforitsdeterminationandanyserviceplanforthestudent,inwriting,tothestudent, 145thestudent'sparentorguardian,thehostdistrict,andtheresidentdistrict;and HCSHB607 13 146 h.Provideaprocessforreviewingappealsofdecisionsmadeunderthissubdivision. 147 (b)Thedepartmentshallpublishanannualreportbasedontheenrollmentsand 148enrollmentsurveysconductedunderthissubdivisionthatprovidesdataatthestatewideand 149districtlevelsofsufficientdetailtoallowanalysisoftrendsregardingthereasonsfor 150participationinthevirtualprogramatthestatewideanddistrictlevels;providedthatnosuch 151surveyresultswillbepublishedinamannerthatrevealsindividualstudentinformation.The 152departmentshallalsoinclude,intheannualreport,dataatthestatewideanddistrictlevelsof 153sufficientdetailtoallowdetectionandanalysisoftheracial,ethnic,andsocio-economic 154balanceofvirtualprogramparticipationamongschoolsanddistrictsatthestatewideand 155districtlevels,providedthatnosuchsurveyresultswillbepublishedinamannerthatreveals 156individualstudentinformation. 157 (5)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand 158takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five 159percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse. 160 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat 161individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped 162forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull- 163timevirtualschool. 164 (7)Virtualschoolprogramsshallmonitorindividualstudentsuccessandengagement 165ofstudentsenrolledintheirprogramand,forstudentsenrolledinvirtualcoursesonapart- 166timebasis,thevirtualschoolprogramshallprovideregularstudentprogressreportsforeach 167studentatleastfourtimesperschoolyeartotheschooldistrictorcharterschool,providethe 168hostschooldistrictandtheresidentschooldistrictongoingaccesstoacademicandother 169relevantinformationonstudentsuccessandengagement,andshallterminateoralterthe 170courseofferingifitisfoundthecourseisnotmeetingtheeducationalneedsofthestudents 171enrolledinthecourse. 172 (8)Thedepartmentofelementaryandsecondaryeducationshallmonitorthe 173aggregateperformanceofprovidersandmakesuchinformationavailabletothepublicunder 174subsection11ofthissection. 175 (9)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 176secondaryeducation,whenastudenttransfersintoaschooldistrictorcharterschool,credits 177previouslygainedthroughsuccessfulpassageofapprovedcoursesundertheMissouricourse 178accessandvirtualschoolprogramshallbeacceptedbytheschooldistrictorcharterschool. 179 (10)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 180secondaryeducation,ifastudenttransfersintoaschooldistrictorcharterschoolwhile 181enrolledinaMissouricourseaccessandvirtualschoolprogramcourseorfull-timevirtual 182school,thestudentshallcontinuetobeenrolledinsuchcourseorschool. HCSHB607 14 183 (11)NothinginthissectionshallprohibithomeschoolorFPEschoolstudents, 184privateschoolstudents,orstudentswishingtotakeadditionalcoursesbeyondtheirregular 185courseloadfromenrollinginMissouricourseaccessandvirtualschoolprogramcourses 186underanagreementthatincludestermsforpayingtuitionorcoursefees. 187 (12)Nothinginthissubsectionshallrequireanyschooldistrict,charterschool,virtual 188program,orthestatetoprovidecomputers,equipment,orinternetaccesstoanystudent 189unlessrequiredundertheeducationservicesplancreatedforaneligiblestudentunder 190subdivision(4)ofthissubsectionorforaneligiblestudentwithadisabilitytocomplywith 191federallaw.Aneducationservicesplanmayrequireaneligiblestudenttohaveaccessto 192schoolfacilitiesoftheresidentschooldistrictduringregularschoolhoursforparticipation 193andinstructionalactivitiesofavirtualprogramunderthissection,andtheeducationservices 194planshallprovideforreimbursementoftheresidentschooldistrictforsuchaccesspursuantto 195rulesadoptedbythedepartmentunderthissection. 196 (13)Theauthorizationprocessshallprovideforcontinuousmonitoringofapproved 197providersandcourses.Thedepartmentshallrevokeorsuspendortakeothercorrectiveaction 198regardingtheauthorizationofanycourseorprovidernolongermeetingtherequirementsof 199theprogram.Unlessimmediateactionisnecessary,priortorevocationorsuspension,the 200departmentshallnotifytheproviderandgivetheproviderareasonabletimeperiodtotake 201correctiveactiontoavoidrevocationorsuspension.Theprocessshallprovideforperiodic 202renewalofauthorizationnolessfrequentlythanonceeverythreeyears. 203 (14)CoursesapprovedasofAugust28,2018,bythedepartmenttoparticipateinthe 204Missourivirtualinstructionprogramshallbeautomaticallyapprovedtoparticipateinthe 205Missouricourseaccessandvirtualschoolprogram,butshallbesubjecttoperiodicrenewal. 206 (15)Anyonlinecourseorvirtualprogramofferedbyaschooldistrictorcharter 207school,includingthoseofferedpriortoAugust28,2018,whichmeetstherequirementsof 208section162.1250shallbeautomaticallyapprovedtoparticipateintheMissouricourseaccess 209andvirtualschoolprogram.Suchcourseorprogramshallbesubjecttoperiodicrenewal.A 210schooldistrictorcharterschoolofferingsuchacourseorvirtualschoolprogramshallbe 211deemedanapprovedprovider. 212 (16)Ahostdistrictmaycontractwithaprovidertoperformanyrequiredservices 213involvedwithdeliveringafull-timevirtualeducation. 214 4.(1)Asusedinthissubsection,theterm"instructionalactivities"meansclassroom- 215basedornonclassroom-basedactivitiesthatastudentshallbeexpectedtocomplete, 216participatein,orattendduringanygivenschoolday,suchas: 217 (a)Onlineloginstocurriculaorprograms; 218 (b)Offlineactivities; 219 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass; HCSHB607 15 220 (d)Testing; 221 (e)Face-to-facecommunicationsormeetingswithschoolstaff; 222 (f)Telephoneorvideoconferenceswithschoolstaff; 223 (g)School-sanctionedfieldtrips;or 224 (h)Orientation. 225 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof 226anystudentwhoisnotconsistentlyengagedininstructionalactivitiesandshallprovide 227regularstudentprogressreportsforeachstudentatleastfourtimesperschoolyear. 228 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite 229apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired 230instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto 231completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis 232subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe 233studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe 234school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto 235presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe 236consideredpriortoanyfinaldecision. 237 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis 238subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent'sschool 239districtofresidence.Thestudent'sschooldistrictofresidenceshallthenprovidetothe 240parentsorguardianofthestudentawrittenlistofavailableeducationaloptionsandpromptly 241enrollthestudentintheselectedoption.Anystudentdisenrolledfromafull-timevirtual 242schoolshallbeprohibitedfromreenrollinginthesamevirtualschoolfortheremainderofthe 243schoolyear. 244 5.Schooldistrictsorcharterschoolsshallinformparentsoftheirchild'srightto 245participateintheprogram.Availabilityoftheprogramshallbemadeclearintheparent 246handbook,registrationdocuments,andfeaturedonthehomepageoftheschooldistrictor 247charterschool'swebsite. 248 6.Thedepartmentshall: 249 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders 250thatincludesmultipleopportunitiesforsubmissioneachyear; 251 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull- 252timevirtualschoolprovidersthat: 253 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and 254 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection; 261 (4)Withinthirtydaysofanydenial,provideawrittenexplanationtoanycourseor 262full-timevirtualschoolprovidersthataredeniedauthorization; 263 (5)Allowacourseorfull-timevirtualschoolproviderdeniedauthorizationtoreapply 264atanypointinthefuture. 265 7.Thedepartmentshallpublishtheprocessestablishedunderthissection,including 266anydeadlinesandanyguidelinesapplicabletothesubmissionandauthorizationprocessfor 267courseorfull-timevirtualschoolprovidersonitswebsite. 268 8.Ifthedepartmentdeterminesthatthereareinsufficientfundsavailablefor 269evaluatingandauthorizingcourseorfull-timevirtualschoolproviders,thedepartmentmay 270chargeapplicantcourseorfull-timevirtualschoolprovidersafeeupto,butnogreaterthan, 271theamountofthecostsinordertoensurethatevaluationoccurs.Thedepartmentshall 272establishandpublishafeescheduleforpurposesofthissubsection. 273 9.Exceptasspecifiedinthissectionandasmaybespecifiedbyruleofthestateboard 274ofeducation,theMissouricourseaccessandvirtualschoolprogramshallcomplywithall 275statelawsandregulationsapplicabletoschooldistricts,includingbutnotlimitedtothe 276Missourischoolimprovementprogram(MSIP),annualperformancereport(APR),teacher 277certification,curriculumstandards,auditrequirementsunderchapter165,accesstopublic 278recordsunderchapter610,andschoolaccountabilityreportcardsundersection160.522. 279Teachersandadministratorsemployedbyavirtualprovidershallbeconsideredtobe 280employedinapublicschoolforallcertificationpurposesunderchapter168. 281 10.Thedepartmentshallsubmitandpubliclypublishanannualreportonthe 282Missouricourseaccessandvirtualschoolprogramandtheparticipationofentitiestothe 283governor,thechairandrankingmemberofthesenateeducationcommittee,andthechairand 284rankingmemberofthehouseofrepresentativeselementaryandsecondaryeducation 285committee.Thereportshallataminimumincludethefollowinginformation: 286 (1)Theannualnumberofuniquestudentsparticipatingincoursesauthorizedunder 287thissectionandthetotalnumberofcoursesinwhichstudentsareenrolledin; 17usedforagriculturalpurposesanduponwhichsuchindividual'sresidenceissituatedmay 18sendsuchindividual'schildrentopublicschoolinanyschooldistrictinwhichapartofsuch (2)ForallschoolyearsbeginningonorafterJuly1,2023,anycurrentownerof 24residentialrealpropertyoragriculturalrealpropertyoranamedbeneficiaryofatrustthat 25currentlyownsresidentialrealpropertyoragriculturalrealpropertyandthatpaysaschooltax 26inadistrictordistrictsotherthanthedistrictinwhichsuchcurrentownerorcurrent 27beneficiaryresidesmaysenduptofourofsuchowner'sorbeneficiary'schildrentoapublic 28school,excludingacharterschool,inanydistrictinwhichsuchownerortrustpayssuch 29schooltax.Forpurposesofthissubdivision,"residentialrealproperty"shallnotincludeany 30multifamilyresidentialpropertywhichexceedsfourunits.Anowneroranamedbeneficiary 31ofatrustthatcurrentlyownsresidentialrealpropertyshallnotbepermittedunderthis 32subdivisiontosendtheirchildtoadistrictoutsideofthecountyinwhichtheycurrently 33reside.Suchownerorbeneficiaryshallsendthirtydays'writtennoticetoallschooldistricts 34involvedspecifyingwhichschooldistricteachchildwillattend.Suchownerorbeneficiary 35shallalsopresentproofoftheowner'sortrust'sannualpaymentofatleasttwothousand 36dollarsofschooltaxesleviedontherealpropertyspecifiedinthissubdivisionwithinsuch 37schooldistrictandownershipofthespecifiedrealpropertyfornotlessthantheimmediately 38precedingfourconsecutiveyears.Neithertheresidentnornonresidentdistrictsshallbe 39responsibleforprovidingtransportationservicesunderthissubdivision.Theschooldistrict 40attendedshallcountachildattendingunderthissubdivisioninitsaveragedailyattendance 41forthepurposeofdistributionofstateaidunderchapter163,exceptthatsuchnonresident 42studentsshallnotbecountedinthedistrict'saveragedailyattendanceforthepurposesof 43determiningeligibilityforaidpaymentsundersection163.044. 44 4.ForanyschoolyearendingonorbeforeJune30,2023,anyownerofagricultural 45landwho,pursuanttosubsection3ofthissection,hastheoptionofsending[his]such 46individual'schildrentothepublicschoolsofmorethanonedistrictshallexercisesuchoption 47asprovidedinthissubsection.Suchpersonshallsendwrittennoticetoallschooldistricts 48involvedspecifyingtowhichschooldistrict[his]suchchildrenwillattendbyJunethirtiethin 49whichsuchaschoolyearbegins.Ifnotificationisnotreceived,suchchildrenshallattendthe 50schoolinwhichthemajorityof[his]suchindividual'spropertylies.Suchpersonshallnot 51sendanyof[his]suchindividual'schildrentothepublicschoolsofanydistrictotherthanthe 52onetowhich[he]suchindividualhassentnoticepursuanttothissubsectioninthatschool 53yearorinwhichthemajorityof[his]suchindividual'spropertylieswithoutpayingtuitionto 54suchschooldistrict. 55 5.Ifapupilisattendingschoolinadistrictotherthanthedistrictofresidenceandthe 56pupil'sparentisteachingintheschooldistrictorisaregularemployeeoftheschooldistrict 57whichthepupilisattending,thenthedistrictinwhichthepupilattendsschoolshallallowthe HCSHB607 24 58pupiltoattendschooluponpaymentoftuitioninthesamemannerinwhichthedistrictallows 59otherpupilsnotentitledtofreeinstructiontoattendschoolinthedistrict.Theprovisionsof 60thissubsectionshallapplyonlytopupilsattendingschoolinadistrictwhichhasan 61enrollmentinexcessofthirteenthousandpupilsandnotinexcessoffifteenthousandpupils (a)Acontractortoprovidedocumentationshowingthatsuchcontractormeets 91therequirementsofthissubsection;and 92 (b)Acontractororregularemployeetohaveworkedaminimumnumberof 93days,nottoexceedsixty,forsuchcontractor'sorregularemployee'schildtobeeligible 94toattendschoolinsuchnonresidentschooldistrictunderthissubsection. 168.021.1.Certificatesoflicensetoteachinthepublicschoolsofthestateshallbe 2grantedasfollows: 3 (1)Bythestateboard,underrulesandregulationsprescribedbyit: 4 (a)Uponthebasisofcollegecredit; 5 (b)Uponthebasisofexamination; 6 (2)Bythestateboard,underrulesandregulationsprescribedbythestateboardwith 7advicefromtheadvisorycouncilestablishedbysection168.015toanyindividualwho 8presentstothestateboardavaliddoctoraldegreefromanaccreditedinstitutionofhigher 9educationaccreditedbyaregionalaccreditingassociationsuchasNorthCentralAssociation. 10Suchcertificateshallbelimitedtothemajorareaofpostgraduatestudyoftheholder,shallbe 11issuedonlyaftersuccessfulcompletionoftheexaminationrequiredforgraduationpursuant 12torulesadoptedbythestateboardofeducation,andshallberestrictedtothosecertificates 13establishedpursuanttosubdivision(2)ofsubsection3ofthissection; 14 (3)Bythestateboard,whichshallissuetheprofessionalcertificateclassificationin 15boththegeneralandspecializedareasmostcloselyalignedwiththecurrentareasof 16certificationapprovedbythestateboard,commensuratewiththeyearsofteachingexperience 17oftheapplicant,andbaseduponthefollowingcriteria: 18 (a)a.Recommendationofastate-approvedbaccalaureate-levelteacherpreparation 19program; 20 b.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain 21aneighteen-hour(onethousandeightyminutes)onlineteacherpreparationprogramrelatedto 22subjectsappropriateforelementaryandsecondaryeducationsettings.Anycharitable 23organizationregisteredinMissourithatisexemptfromfederaltaxationundertheInternal 24RevenueCodeof1986,asamended,maysubmitateacherpreparationprogramtothe 25departmentofelementaryandsecondaryeducationforapproval.Onceapproved,the 26charitableorganizationshallbecertifiedtodevelopandmaintainateacherpreparedness 27program.Approvedteacherpreparednessprogramscreatedbyacharitableorganizationshall HCSHB607 26 28bemadeavailablebythedepartmentofelementaryandsecondaryeducation.Anindividual 29withabachelor'sdegreemaycompleteaneighteen-houronlinetrainingprogram,either 30createdbythedepartmentorbyacharitableorganization,andreceiveateachercertificate. 31SuchcertificateshallnotbeacceptedbyMissouripublicschools,andnonpublicschoolsshall 32notberequiredtoacceptthecertificate,butshallbeacceptedbyprivateschoolsandprivate 33schoolaccreditingagencies; 34 (b)a.SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessment 35forteachersoradministratorsdesignatedbythestateboardofeducation; 36 b.(i)Applicantswhohavenotsuccessfullyachievedaqualifyingscoreonthe 37designatedexaminationswillbeissuedatwo-yearnonrenewableprovisionalcertificate; 38 (ii)Duringthetwo-yearnonrenewableprovisionalcertification,anindividualteacher 39maygainfullprofessionalcertificationby: 40 i.Achievingaqualifyingscoreonthedesignatedexam;or 41 ii.Successfullyachievinganacceptablescoreonthestate-approvedteacher 42evaluationsystemfromsevenwalk-throughevaluations,twoformativeevaluations,andone 43summativeevaluationforeachofthetwoprobationaryyearsandbeingofferedathird 44contractbytheemployingdistrict.Foranyapplicantwhohasachangeinjobstatusbecause 45ofareductionintheworkforceorachangeinlifecircumstances,thescoresrequiredunder 46thisitemmaybescoresachievedinanyschooldistrictduringthetwo-yearnonrenewable 47provisionalcertificationperiod;and 48 (iii)Theemployingschooldistrictshallrecommendtothedepartmentofelementary 49andsecondaryeducationthattheindividualteacherbeawardedafullprofessional 50certificationbythestateboardunderrulesprescribedbythestateboard;and 51 (c)Uponcompletionofabackgroundcheckasprescribedinsection168.133and 52possessionofavalidteachingcertificateinthestatefromwhichtheapplicant'steacher 53preparationprogramwascompleted; 54 (4)Bythestateboard,underrulesprescribedbyit,onthebasisofarelevant 55bachelor'sdegree,orhigherdegree,andapassingscoreforthedesignatedexitexamination, 56forindividualswhoseacademicdegreeandprofessionalexperiencearesuitabletoprovidea 57basisforinstructionsolelyinthesubjectmatterofbankingorfinancialresponsibility,atthe 58discretionofthestateboard.Suchcertificateshallbelimitedtothemajorareaofstudyofthe 59holderandshallberestrictedtothosecertificatesestablishedundersubdivision(2)of 60subsection3ofthissection.Holdersofcertificatesgrantedunderthissubdivisionshallbe 67sixtycontacthoursintheclassroom,ofwhichatleastforty-fivemustbeteaching;sixty 68contacthoursasasubstituteteacher,withatleastthirtyconsecutivehoursinthesame 69classroom;sixtycontacthoursofteachinginaprivateschool;orsixtycontacthoursof 70teachingasaparaprofessional,foraninitialfour-yearABCTEorTeachersofTomorrow 71certificateoflicensetoteach,exceptthatsuchcertificateshallnotbegrantedfortheareasof 72earlychildhoodeducation,orspecialeducation.Forcertificationintheareaofelementary 73education,ninetycontacthoursintheclassroomshallberequired,ofwhichatleastthirty 74shallbeinanelementaryclassroom.Uponthecompletionofthefollowingrequirements,an 75applicantshallbeeligibletoapplyforacareercontinuousprofessionalcertificateunder 76subdivision(3)ofsubsection3ofthissection: 77 (a)Completionofthirtycontacthoursofprofessionaldevelopmentwithinfouryears, 78whichmayincludehoursspentinclassinanappropriatecollegecurriculum; 79 (b)ValidatedcompletionoftwoyearsofthementoringprogramoftheAmerican 80BoardforCertificationofTeacherExcellence, TeachersofTomorrow,oradistrict 81mentoringprogramapprovedbythestateboardofeducation; 82 112underrulesprescribedbythestateboard;and 113 (d)Completesabackgroundcheckasprescribedinsection168.133. 114 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand 115regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment 116requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor 117suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate 118boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly 119equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II, 120orcontinuousprofessionalcertificateshall,uponexpirationofsuchperson'scurrent 121certificate,beissuedtheappropriatelevelofcertificatebasedupontheclassificationsystem 122establishedpursuanttosubsection3ofthissection. 123 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased 124uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude 125completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall 126provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate 127andacareercontinuousprofessionalcertificate. 128 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof 129requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon 130verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof 131education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate 132to: 133 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora 134minimumoftwoyears; 135 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude 136hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder 137subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin HCSHB607 29 138proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis 139employedlessthanfulltime;and 140 (c)Participateinabeginningteacherassistanceprogram. 141 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon 142verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate 143anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)to 144(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)to(d)ofsubdivision(5)of 145subsection1ofthissection. 146 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon 147verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard 148guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear 149whichmayincludehoursspentinclassinanappropriatecollegecurriculum.Shouldthe 150possessorofavalidcareercontinuousprofessionalcertificatefail,inanygivenyear,tomeet 151thefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwoyears, 152makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst 153completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess 154ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe 155missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate 156thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional 157developmentwhichmayincludehoursspentintheclassroominanappropriatecollege 158curriculumwithinthesixmonthspriortoorafterreactivatingthepossessor'scertificate.The 159requirementsofthisparagraphshallbemonitoredandverifiedbythelocalschooldistrict 160whichemploystheholderofthecareercontinuousprofessionalcertificate. 161 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe 162professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif 163suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool 164districtandmeetstwoofthethreefollowingcriteria: 165 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation; 166 b.Possessesamaster'sdegree;or 167 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof 168education. 169 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot 170retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall 171alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin 172aneducationalpositionforthreeyearsormoretoreactivatetheteacher'slastlevelof 173certificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopmentwhich HCSHB607 30 174mayincludehoursspentintheclassroominanappropriatecollegecurriculumwithinthesix 175monthspriortoorafterreactivatingtheteacher'scertificate. 176 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin 177section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely 178alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof 179teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin 180thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification 181undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall 182annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall 183establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed 184afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein 185anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof 186licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional 187certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume 188classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection 189168.133,foranyapplicantwho: 190 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri; 191 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication; 192 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching 193certificateoflicensefromanotherstate;and 194 (4)Otherwisequalifiesunderthissection. 195 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to 196bedepositedintotheexcellenceineducationfundestablishedpursuanttosection160.268,for 197theissuanceofthecareercontinuousprofessionalcertificate.However,suchfeeshallnot 198exceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequiredasa 199conditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsiblefor 200anyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothingin 201thissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfeereimbursement. 202 7.AnymemberofthepublicschoolretirementsystemofMissouriwhoentered 203coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor 204statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool 205districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho 206laterbecamecertificatedinMissourishallhavethatcertificatedatedbacktothemember's 207originaldateofemploymentinaMissouripublicschool. 208 8.Withinthirtydaysofreceivinganapplicationfromaspouseofanactiveduty 209memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto 210betransferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe HCSHB607 31 211transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas 212movedtothestateofMissourionapermanentchange-of-stationbasisandhassuccessfully 213completedthebackgroundcheckdescribedundersubsection5ofthissectionandsection 214168.133,thestateboardshallissuetosuchapplicantafullcertificateoflicensetoteach, 215providedthattheapplicanthaspaidallnecessaryfeesandhasotherwisemetallrequirements 216tobeissuedsuchacertificate. 168.025.1.Forpurposesofthissection,"teacherexternship"meansanexperiencein 2whichateacher,supervisedbyhisorherschoolorschooldistrict,gainspracticalexperience 3atabusinesslocatedinMissourithroughobservationandinteractionwithemployersand 4employees. 5 2.Thedepartmentofeconomicdevelopmentandthedepartmentofelementaryand 6secondaryeducationshalldevelopandrecommend: 7 (1)Requirementsforteacherexternshipsthatcanbeconsideredtheequivalentofthe 8completionofcredithoursingraduate-levelcoursesforpurposesofsalaryschedules;and 9 (2)Anequivalencyschedulethatsetsforththenumberofcredithoursingraduate- 10levelcoursesthatshallbeconsideredequivalenttoandawardedforeachtypeofteacher 11externship.Toclassifyteacherexternshipsanddeterminethenumberofcredithoursthat 12wouldbeappropriateforeachtype,thelengthoftheteacherexternship,thepractical 13experiencegained,oranyotherfactordeemedrelevantmaybeconsidered. 14 3.Thedepartmentofeconomicdevelopmentandthedepartmentofelementaryand 15secondaryeducationshalladoptandpublishontheirwebsites,beforeJuly1,2020, 16requirementsforteacherexternshipsthatcanbeconsideredtheequivalentofthecompletion 17ofcredithoursingraduate-levelcoursesforpurposesofsalaryschedulesandanequivalency 18scheduleasdescribedinsubsection2ofthissection.Anyteacherexternshipthatmeetsthe 19publishedrequirementsshallbeknownasandconsideredacertifiedteacherexternshipfor 20purposesofthissection. 21 4.Ifaschooldistrictorcharterschoolusesasalaryscheduleinwhichateacher 22receivesahighersalaryifheorshehasearnedcredithoursingraduate-levelcourses,the 23schooldistrictorcharterschoolshallconsideranyteacherwhohascompletedacertified 24teacherexternshiptohavecompletedcredithoursingraduate-levelcoursesonitssalary 25scheduleinthemannerprescribedbytheequivalencyscheduledevelopedunderthissection 26andcompensatetheteacheraccordingly. 27 5.Thedepartmentofelementaryandsecondaryeducationandthedepartmentof 28economicdevelopmentmaypromulgaterulestoimplementtheprovisionsofthissection. 29Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunder 30theauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 31subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissection HCSHB607 32 32andchapter536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 33pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannula 34rulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandany 35ruleproposedoradoptedafterAugust28,2019,shallbeinvalidandvoid. 36 [6.Undersection23.253oftheMissourisunsetact: 37 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshall 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthissection 6toanyindividualwhohasnotcompletedabackgroundcheckasrequiredundersection 7168.021. 8 (2)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeanycertificate 9soughtorissuedunderthissectioninthesamemannerandforthesamereasonsasunder 10section168.071. 11 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividualwhohas 12completed: 13 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhighereducation; 14or 15 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho 16possessesahighschooldiplomaortheequivalentthereof. 17 4.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain 18anonlinetrainingprogramforindividuals,whichshallconsistoftwentyhoursoftraining 19relatedtosubjectsappropriateforsubstituteteachersasdeterminedbythedepartment. 20 5.Thestateboardmaygrantacertificateunderthissectiontoanyhighlyqualified 21individualwithexpertiseinatechnicalorbusinessfieldorwithexperienceintheArmed 22ForcesoftheUnitedStateswhohascompletedthebackgroundcheckrequiredinthissection 23butdoesnotmeetanyofthequalificationsundersubdivision(1)or(2)ofsubsection3ofthis 24sectionifthesuperintendentoftheschooldistrictinwhichtheindividualseekstosubstitute HCSHB607 33 25teachsponsorssuchindividualandtheschoolboardoftheschooldistrictinwhichthe 26individualseekstosubstituteteachvotestoapprovesuchindividualtosubstituteteach. 27 6.(1)Notwithstandinganyotherprovisionstocontrary,beginningonJune30,2022, 28andendingonJune30,[2025] 2030, anypersonwhoisretiredandcurrentlyreceivinga 29retirementallowanceundersections169.010to169.141orsections169.600to169.715,other 30thanfordisability,maybeemployedtosubstituteteachonapart-timeortemporarysubstitute 31basisbyanemployerincludedintheretirementsystemwithoutadiscontinuanceofthe 32person'sretirementallowance.Suchapersonshallnotcontributetotheretirementsystem,or 33tothepublicschoolretirementsystemestablishedbysections169.010to169.141ortothe 34publiceducationemployeeretirementsystemestablishedbysections169.600to169.715, 35becauseofearningsduringsuchperiodofemployment. 36 (2)Inadditiontotheconditionssetforthinsubdivision1ofthissubsection,any 37personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to 38169.141,otherthanfordisability,whoisemployedbyathirdpartyorisperformingworkas 39anindependentcontractormaybeemployedtosubstituteteachonapart-timeortemporary 40substitutebasis,ifsuchpersonisperformingworkforanemployerincludedintheretirement 41systemwithoutadiscontinuanceoftheperson'sretirementallowance. 42 (3)Ifapersonisemployedpursuanttothissubsectiononaregular,full-timebasisthe 43personshallnotbeentitledtoreceivetheperson'sretirementallowanceforanymonthduring 7.Acertificategrantedunderthissectionshallbevalidforfouryears.Acertificate 50grantedunderthissectionshallexpireattheendofanycalendaryearinwhichtheindividual 51failstosubstituteteachforatleastfivedaysorfortyhoursofin-seatinstruction. 52 8.(1)Anindividualtowhomthestateboardgrantsacertificateunderthissection 53maybeasubstituteteacherinapublicschoolinthestateiftheschooldistrictagreesto 54employtheindividualasasubstituteteacherandsuchindividualhascompletedabackground 55checkasrequiredinsubsection10ofthissection. 56 (2)Noindividualtowhomthestateboardgrantsacertificateunderthissectionand 57whoisundertwentyyearsofageshallbeasubstituteteacheringradesninetotwelve. 58 9.Eachschooldistrictmaydevelopanorientationforindividualstowhomthestate 59boardgrantsacertificateunderthissectionforsuchindividualsemployedbytheschool 60districtandmayrequiresuchindividualstocompletesuchorientation.Suchorientationshall HCSHB607 34 61containatleasttwohoursofsubjectsappropriateforsubstituteteachersandshallcontain 62instructionontheschooldistrict'sbestpracticesforclassroommanagement. 63 10.BeginningJanuary1,2023,anysubstituteteachermay,atthetimesuchsubstitute 64teachersubmitsthefingerprintsandinformationrequiredforthebackgroundcheckrequired 65undersection168.021,designateuptofiveschooldistrictstowhichsuchsubstituteteacher 66hassubmittedanapplicationforsubstituteteachingtoreceivetheresultsofthesubstitute 67teacher'scriminalhistorybackgroundcheckandfingerprintcollection.Thetotalamountof 68anyfeesfordisseminatingsuchresultstouptofiveschooldistrictsunderthissubsectionshall 69notexceedfiftydollars. 70 11.Thestateboardmayexercisetheboard'sauthorityunderchapter161to 71promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthissection. 170.014.1.Thissectionshallbeknownasthe"ReadingInstructionAct"andis 2enactedtoensurethatallpublicschoolsincludingcharterschoolsestablishreadingprograms 3inkindergartenthroughgradefivebasedinscientificresearch."Evidence-basedreading 4instruction"includespracticesthathavebeenproveneffectivethroughevaluationofthe 5outcomesforlargenumbersofstudentsandarehighlylikelytobeeffectiveinimproving 6readingifimplementedwithfidelity.Suchprogramsshallincludetheessentialcomponents 7ofphonemicawareness,phonics,fluency,vocabulary,andcomprehension,andallnew 8teacherswhoteachreadinginkindergartenthroughgradethreeshallreceiveadequatetraining 9intheseareas. 10 2.(1)Forpurposesofthissubsection,"three-cueingsystem"meansanymodel 11ofteachingstudentstoreadbasedonmeaning,structureandsyntax,andvisualcues, 12whichmayalsobeknownas"MSV". 13 (2)Apublicschooldistrictorcharterschoolshallprovidereadinginstructionin 14accordancewiththefollowingrequirements: 15 (a)Phonicsinstructionfordecodingandencodingshallbetheprimary 16instructionalstrategyforteachingwordreading; 17 (b)Instructioninwordreadingmaynotincludestrategiesbasedonthethree- 18cueingsystemmodelofreadingorvisualmemory;and 19 (c)Readinginstructionmayincludevisualinformationandstrategiesthat 20improvebackgroundandexperientialknowledge,addcontext,andincreaseoral 21languageandvocabularytosupportcomprehension,butsuchvisualinformationand 22strategiesshallnotbeusedtoteachwordreading. 23 3.Everypublicschoolinthestateshallofferareadingprogramasdescribedin 24subsection1ofthissectionforkindergartenthroughgradefive. 173.232.1.Thereisherebyestablishedthe"TeacherRecruitmentandRetention 2StateScholarshipProgram",whichshallbeadministeredbythedepartmentofelementary HCSHB607 35 3andsecondaryeducation.Theprogramshall,uponappropriation,providescholarships, 4subjecttotheeligibilitycriteriaenumeratedinthissection,foreligiblestudentswhoentera 5teachereducationprogramandmakeacommitmenttoteachasaconditionofreceivingsuch 6scholarship. 7 2.(1)Subjecttoappropriation,eachyearthedepartmentofelementaryand 8secondaryeducationshallmakeavailabletoeligiblestudentsscholarshipsforuptotwoyears 9inanamountthatencompassesuptoonehundredpercentofthetotalcostofeligiblestudents' 10tuitioncostsandeducationalcostsrelatedtoteacherpreparationatafour-yearcollegeor 11universitylocatedinMissouri,exceptthatnoamountgrantedfortuitionshallexceedthe 12amountoftuitionchargedaMissouriresidentattheUniversityofMissouri-Columbiafor 13attendance.Suchamountshallbepaidbyfundsappropriatedtothedepartment. 14 (2)Themaximumnumberofscholarshipsmadeavailableorthemaximumamount 15awardedannuallyunderthissectionshallbeasfollows: 16 [(1)](a)ForacademicyearsendingbeforeJuly1,2025,twohundredscholarshipsor 17amaximumawardedamountofonemilliontwohundredthousanddollars; 18 HCSHB607 36 38 (b)Thedepartmentshalldeterminetheamountofeachscholarshipawarded 39underthissubdivisionbasedonanequaldistributionofsuchremainingmoneysamong 40allstudentseligibleunderthissubdivision. 41 (c)Noamountgrantedfortuitionandunderthissubdivisionshallexceedthe 42amountoftuitionchargedaMissouriresidentattheUniversityofMissouri-Columbia 43forattendanceforonesemester. 44 3.Asusedinthissection,thefollowingtermsmean: 45 (1)"Eligiblestudent",anindividualwho: 46 (a)IsaUnitedStatescitizenandaMissouriresident; 47 (b)Entersandmakesacommitmenttopursueateachereducationprogramapproved 48bythedepartmentofelementaryandsecondaryeducationandofferedbyafour-yearcollege 49oruniversitylocatedinMissouri; 50 (c)Signsanagreementwiththedepartmentofelementaryandsecondaryeducationin 51whichtherecipientagreestoteachinaMissouripublicschoolthatisahard-to-staffschoolor 52toteachatleastonehard-to-staffsubjectareainaMissouripublicschoolthatoffersclassesin 53hard-to-staffsubjectareas,orboth,fortwoyearsforeveryoneyeartherecipientreceivedthe 54scholarship; 55 (d)Maintainsacumulativegradepointaverageofatleasttwoandone-halfonafour- 56pointscaleorequivalent;and 57 (e)ForscholarshipsawardedforanyacademicyearbeginningafterJune30,2025, 58hasmadeagoodfaithefforttofirstsecureallavailablefederalsourcesofgrantfundingthat 59couldbeappliedtothetotalcostofsuchstudent'seligibletuitionandfeesasdescribedin 60subsection2ofthissection; 61 (2)"Hard-to-staffschools",attendancecenterswherethepercentageofcertificated 62positionsintheattendancecenterthatwereleftvacantorwerefilledwithateachernotfully 63qualifiedintheprioracademicyearexceedstenpercentasreportedtothedepartmentof 64elementaryandsecondaryeducation; 65 (3)"Hard-to-staffsubjectareas",contentareasforwhichpositionswereleftvacantor 66werefilledwithateachernotfullyqualifiedintheprioracademicyearasreportedtothe 67departmentofelementaryandsecondaryeducation. 68 4.Ifthenumberofapplicantsexceedsthenumberofscholarshipsorrevenues 69available,thedepartmentofelementaryandsecondaryeducationmayconsiderthefinancial 70needsoftheapplicant. 71 5.Thescholarshipsprovidedinthissectionshallbeavailabletoeligiblestudentswho 72meetatleastoneofthefollowing: HCSHB607 37 73 (1)Havesuccessfullycompletedtwoyearsatacommunitycollegewithaminimum 74offorty-eightcredithoursandagradepointaverageofatleasttwoandone-halfonafour- 75pointscaleortheequivalent; 76 (2)Havebeenawardedanassociatedegreeortheequivalent; 77 (3)Havesuccessfullycompletedfivesemestersatafour-yearcollegeoruniversity 78withaminimumofsixtycredithoursandagradepointaverageofatleasttwoandone-half 79onafour-pointscaleortheequivalent;or 80 (4)Havecompletedtheirbaccalaureatedegree. 81 6.(1)Everyeligiblestudentreceivingscholarshipsunderthissectionshallteachin 82anelementaryorsecondarypublicschoolinMissouriasprovidedinparagraph(c)of 83subdivision(1)ofsubsection3ofthissection.Thestudentshallteachforaperiodoftwo 84yearsforeveryoneyearsuchstudentreceivedascholarshipunderthissection;otherwise,the 85scholarshipshallbetreatedasaloantotheeligiblestudent.Interestshallbechargedonthe 86unpaidbalanceoftheamountreceivedfromthedatetheeligiblestudentceasestoteachuntil 87theamountreceivedispaidbacktothestate.Theinterestrateshallbeadjustedannuallyand 88shallbeequaltoonepercentagepointovertheprevailingUnitedStatesprimerateineffecton 89Januaryfirstofsuchyear. 90 (2)Inordertoprovidefortheservicingofsuchloans,thedepartmentofelementary 91andsecondaryeducation[may] shallsellsuchloanstothehighereducationloanauthorityof 92thestateofMissouricreatedpursuanttosections173.350to173.445.Foreachyearthe 93studentteaches,uptoeightyears,one-eighthoftheamountreceivedpursuanttothissection 94shallbeappliedagainstthetotalamountreceivedandshallnotbesubjecttotherepayment 95requirementofthissection[; providedthattwenty-fivepercentofsuchamount,notsubjectto 96repayment,shallberepaidbythelocalschooldistricttothedepartment]. 97 (3)Thedepartmentofelementaryandsecondaryeducationshallhavethepowerto 98andshalldeferinterestandprincipalpaymentsundercertaincircumstances,whichshall 99include,butneednotbelimitedto,theenrollmentinagraduateprogramorserviceinany 100branchoftheArmedForcesoftheUnitedStates. 101 7.Thereisherebyestablishedinthestatetreasuryafundtobeknownasthe"Teacher 102RecruitmentandRetentionStateScholarshipProgramFund",whichshallconsistofall 103moneysthatmaybeappropriatedtoitbythegeneralassembly,andinadditionmayinclude 104anygifts,contributions,grants,orbequestsreceivedfromfederal,state,private,orother 105sources.Thefundshallbeadministeredbythedepartmentofelementaryandsecondary 106education.Notwithstandingtheprovisionsofsection33.080tothecontrary,moneysinthe 107fundshallnotbetransferredtothecreditofthegeneralrevenuefundattheendofthe 108biennium.Interestandmoneysearnedonthefundshallbecreditedtothefund.Moneysin HCSHB607 38 109thefundshallbeusedsolelyforthepurposeofawardingscholarshipsundertheprovisionsof 110thissection. 111 8.Anindividualwhohasqualifiedasaneligiblestudentunderthissectionshall 112continuetoqualifyasaneligiblestudentforpurposesofparagraph(c)ofsubdivision(1)of 113subsection3ofthissectionaslongassuchindividualremainsemployedbytheschooldistrict 114inwhichsuchindividualagreestoteachregardlessofwhethersuchindividual'semploying 115schoolnolongerqualifiesasahard-to-staffschool,suchclasstaughtbysuchindividualno 116longerqualifiesasahard-to-staffsubjectarea,orsuchindividual'spositionwithintheschool 117districtchanges. 177.086.1.Anyschooldistrictauthorizingtheconstructionoffacilitieswhichmay 2exceedanexpenditureoffiftythousanddollarsshallpubliclyadvertise,onceaweekfortwo 3consecutiveweeks,inanewspaperofgeneralcirculation,qualifiedpursuanttochapter493, 4locatedwithinthecityinwhichtheschooldistrictislocated,oriftherebenosuchnewspaper, 5inaqualifiednewspaperofgeneralcirculationinthecounty,oriftherebenosuchnewspaper, 6inaqualifiednewspaperofgeneralcirculationinanadjoiningcounty,andmayadvertisein 7business,trade,orminoritynewspapers,forbidsonsaidconstruction. 8 2.Nobidsshallbeentertainedbytheschooldistrictwhicharenotmadein 9accordancewiththespecificationsfurnishedbythedistrictandallcontractsshallbelettothe 10lowestresponsiblebiddercomplyingwiththetermsoftheletting,providedthatthedistrict 11shallhavetherighttorejectanyandallbids. 12 3.Allbidsmustbesubmittedsealedandinwriting,tobeopenedpubliclyattimeand 13placeofthedistrict'schoosing. 14 4.Therequirementsofthisstatutearenotapplicableifthedistrictutilizesa 15cooperativeprocurementservice,stateprocurementservicesasauthorizedinsections 1634.046and67.360,servicesasauthorizedundersection67.5060,orotherpurchasing 17processesauthorizedbystateorfederallaw. ✔ HCSHB607 39
