172.280.Thecuratorsshallhavetheauthoritytoconfer,bydiploma,undertheir
2commonseal,onanypersonwhomtheymayjudgeworthythereof,suchdegreesasare
3knowntoandusuallygrantedbyanycollegeoruniversity.[TheUniversityofMissouriisthe
4state'sonlypublicresearchuniversityandtheexclusivegrantorofresearchdoctorates.As
5such,exceptasprovidedinsection175.040,theUniversityofMissourishallbetheonlystate
6collegeoruniversitythatmayofferdoctorofphilosophydegreesorfirst-professional
7degrees,includingdentistry,law,medicine,optometry,pharmacy,andveterinarymedicine.]
173.005.1.Thereisherebycreateda"DepartmentofHigherEducationand
2WorkforceDevelopment",andthedivisionofhighereducationofthedepartmentof
3educationisabolishedandallitspowers,duties,functions,personnelandpropertyare
4transferredasprovidedbytheReorganizationActof1974,AppendixB,RSMo.
5 2.Thecommissiononhighereducationisabolishedandallitspowers,duties,
6personnelandpropertyaretransferredbytypeItransfertothe"CoordinatingBoardfor
7HigherEducation",whichisherebycreated,andthecoordinatingboardshallbetheheadof
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8thedepartment.Thecoordinatingboardshallconsistofninemembersappointedbythe
9governorwiththeadviceandconsentofthesenate,andnotmorethanfiveofitsmembers
10shallbeofthesamepoliticalparty.Noneofthemembersshallbeengagedprofessionallyas
11aneducatororeducationaladministratorwithapublicorprivateinstitutionofhigher
12educationatthetimeappointedorduring[his]suchmember'sterm.Moreover,noperson
13shallbeappointedtothecoordinatingboardwhoshallnotbeacitizenoftheUnitedStates,
14andwhoshallnothavebeenaresidentofthestateofMissouritwoyearsnextpriorto
15appointment,andatleastonebutnotmorethantwopersonsshallbeappointedtosaidboard
16fromeachcongressionaldistrict.Thetermofserviceofamemberofthecoordinatingboard
17shallbesixyearsandsaidmembers,whileattendingthemeetingsoftheboard,shallbe
18reimbursedfortheiractualexpenses.Notwithstandinganyprovisionoflawtothecontrary,
19nothinginthissectionrelatingtoachangeinthecompositionandconfigurationof
20congressionaldistrictsinthisstateshallprohibitamemberwhoisservingatermonAugust
2128,2011,fromcompletinghisorherterm.Thecoordinatingboardmay,inordertocarryout
22thedutiesprescribedforitinsubsections1,2,3,7,and8ofthissection,employsuch
23professional,clericalandresearchpersonnelasmaybenecessarytoassistitinperforming
24thoseduties,butthisstaffshallnot,inanyfiscalyear,exceedtwenty-fivefull-timeequivalent
25employeesregardlessofthesourceoffunding.Inadditiontoallotherpowers,dutiesand
26functionstransferredtoit,thecoordinatingboardforhighereducationshallhavethe
27followingdutiesandresponsibilities:
28 (1)Thecoordinatingboardforhighereducationmayapprove,notapprove,or
29provisionallyapproveproposednewdegreeprogramstobeofferedbythestateinstitutionsof
30highereducation.Thecoordinatingboardmayauthorizeadegreeprogramoutsidean
31institution'scoordinatingboard-approvedmissiononlywhenthecoordinatingboardhas
32receivedclearevidencethattheinstitutionproposingtooffertheprogram:
33 (a)Madeagood-faithefforttoexplorethefeasibilityofofferingtheprogramin
34collaborationwithaninstitutionthemissionofwhichincludesofferingtheprogram;
35 (b)Iscontributingsubstantiallytothegoalsinthecoordinatingboard'scoordinated
36planforhighereducation;
37 (c)Hastheexistingcapacitytoensuretheprogramisdeliveredinahigh-quality
38manner;
39 (d)Hasdemonstratedthattheproposedprogramisneeded;
40 (e)Hasaclearplantomeetthearticulatedworkforceneed;and
41 (f)Suchotherfactorsdeemedrelevantbythecoordinatingboard;
42 (2)[Thegoverningboardofeachpublicinstitutionofhighereducationinthestate
43shallhavethepowerandauthoritytoconferdegreesinchiropractic,osteopathicmedicine,
44andpodiatryonlyincollaborationwiththeUniversityofMissouri,providedthatsuch
HB616	2 45collaborativeagreementsareapprovedbythegoverningboardofeachinstitutionandthatin
46theseinstancestheUniversityofMissouriwillbethedegree-grantinginstitution.Shouldthe
47UniversityofMissourideclinetocollaborateintheofferingofsuchprograms,anyofthese
48institutionsmayseekapprovaloftheprogramthroughthecoordinatingboardforhigher
49education'scomprehensivereviewprocesswhendoingsowouldnotunnecessarilyduplicate
50anexistingprogram,collaborationisnotfeasibleoraviablemeansofmeetingtheneedsof
51studentsandemployers,andtheinstitutionhastheacademicandfinancialcapacitytooffer
52theprograminahighqualitymanner;
53 (3)]Thecoordinatingboardforhighereducationmaypromoteandencouragethe
54developmentofcooperativeagreementsbetweenMissouripublicfour-yearinstitutionsof
55highereducationwhichdonotoffergraduatedegreesandMissouripublicfour-year
56institutionsofhighereducationwhichdooffergraduatedegreesforthepurposeofoffering
57graduatedegreeprogramsoncampusesofthosepublicfour-yearinstitutionsofhigher
58educationwhichdonototherwiseoffergraduatedegrees.Suchagreementsshallidentifythe
59obligationsanddutiesoftheparties,includingassignmentofadministrativeresponsibility.
60Anydiplomaawardedforgraduatedegreesundersuchacooperativeagreementshallinclude
61thenamesofbothinstitutionsinscribedthereon.Anycooperativeagreementinplaceasof
62August28,2003,shallrequirenofurtherapprovalfromthecoordinatingboardforhigher
63education.Anycostsincurredwithrespecttotheadministrativeprovisionsofthis
64subdivisionmaybepaidfromstatefundsallocatedtotheinstitutionassignedthe
65administrativeauthorityfortheprogram.Theprovisionsofthissubdivisionshallnotbe
66construedtoinvalidatetheprovisionsofsubdivision(1)ofthissubsection;
67 [(4)](3)Inconsultationwiththeheadsoftheinstitutionsofhighereducationaffected
68andagainstabackgroundofcarefullycollecteddataonenrollment,physicalfacilities,
69manpowerneeds,andinstitutionalmissions,thecoordinatingboardforhighereducationshall
70establishguidelinesforappropriationrequestsbythoseinstitutionsofhighereducation;
71however,otherprovisionsoftheReorganizationActof1974notwithstanding,allfundsshall
72beappropriatedbythegeneralassemblytothegoverningboardofeachpublicfour-year
73institutionofhighereducationwhichshallprepareexpenditurebudgetsfortheinstitution;
74 [(5)](4)Nonewstate-supportedseniorcollegesorresidencecentersshallbe
75establishedexceptasprovidedbylawandwithapprovalofthecoordinatingboardforhigher
76education;
77 [(6)](5)Thecoordinatingboardforhighereducationshallestablishadmission
78guidelinesconsistentwithinstitutionalmissions;
79 [(7)](6)Thecoordinatingboardforhighereducationshallrequireallpublictwo-year
80andfour-yearhighereducationinstitutionstoreplicatebestpracticesinremediationidentified
81bythecoordinatingboardandinstitutionsfromresearchundertakenbyregionaleducational

83inthesubject,andidentifyandreducemethodsthathavebeenfoundtobeineffectivein
84preparingorretainingstudentsorthatdelaystudentsfromenrollmentincollege-level

86 [(8)](7)Thecoordinatingboardshallestablishpoliciesandproceduresfor
87institutionaldecisionsrelatingtotheresidencestatusofstudents;
88 [(9)](8)Thecoordinatingboardshallestablishguidelinestopromoteandfacilitate
89thetransferofstudentsbetweeninstitutionsofhighereducationwithinthestateand,withthe
90assistanceofthecommitteeontransferandarticulation,shallrequireallpublictwo-yearand
91four-yearhighereducationinstitutionstocreatebyJuly1,2014,astatewidecoretransfer
92libraryofatleasttwenty-fivelowerdivisioncoursesacrossallinstitutionsthatare
93transferableamongallpublichighereducationinstitutions.Thecoordinatingboardshall
94establishpoliciesandprocedurestoensuresuchcoursesareacceptedintransferamongpublic
95institutionsandtreatedasequivalenttosimilarcoursesatthereceivinginstitutions.The
96coordinatingboardshalldevelopapolicytofosterreversetransferforanystudentwhohas
97accumulatedenoughhoursincombinationwithatleastonepublichighereducation
98institutioninMissourithatoffersanassociatedegreeandonepublicfour-yearhigher
99educationinstitutionintheprescribedcoursessufficienttomeetthepublichighereducation
100institution'srequirementstobeawardedanassociatedegree.Thedepartmentofelementary
101andsecondaryeducationshallmaintainthealignmentoftheassessmentsfoundinsection
102160.518andsuccessorassessmentswiththecompetenciespreviouslyestablishedunderthis
103subdivisionforentry-levelcollegiatecoursesinEnglish,mathematics,foreignlanguage,
104sciences,andsocialsciencesassociatedwithaninstitution'sgeneraleducationcore;
105 [(10)] (9)Thecoordinatingboardshallcollectthenecessaryinformationanddevelop
106comparabledataforallinstitutionsofhighereducationinthestate.Thecoordinatingboard
107shallusethisinformationtodelineatetheareasofcompetenceofeachoftheseinstitutions
108andforanyotherpurposesdeemedappropriatebythecoordinatingboard;
109 [(11)](10)Compliancewithrequestsfromthecoordinatingboardforinstitutional
110informationandtheotherpowers,dutiesandresponsibilities,hereinassignedtothe
111coordinatingboard,shallbeaprerequisitetothereceiptofanyfundswhichthecoordinating
112boardisresponsibleforadministering;
113 [(12)] (11)Ifanyinstitutionofhighereducationinthisstate,publicorprivate,
114willfullyfailsorrefusestofollowanylawfulguideline,policyorprocedureestablishedor
115prescribedbythecoordinatingboard,orknowinglydeviatesfromanysuchguideline,or
116knowinglyactswithoutcoordinatingboardapprovalwheresuchapprovalisrequired,or
117willfullyfailstocomplywithanyotherlawfulorderofthecoordinatingboard,the
118coordinatingboardmay,afterapublichearing,withholdordirecttobewithheldfromthat

120board,ormayremovetheapprovaloftheinstitutionasanapprovedinstitutionwithinthe
121meaningofsection173.1102.Ifanysuchpublicinstitutionwillfullydisregardsboardpolicy,
122thecommissionerofhighereducationmayordersuchinstitutiontoremitafineinanamount
123nottoexceedonepercentoftheinstitution'scurrentfiscalyearstateoperatingappropriation
124totheboard.Theboardshallholdsuchfundsuntilsuchtimethattheinstitution,as
125determinedbythecommissionerofhighereducation,correctstheviolation,atwhichtimethe
126boardshallrefundsuchamounttotheinstitution.Ifthecommissionerdeterminesthatthe
127institutionhasnotredressedtheviolationwithinoneyear,thefineamountshallbedeposited
128intothegeneralrevenuefund,unlesstheinstitutionappealssuchdecisiontothefull
129coordinatingboard,whichshallhavetheauthoritytomakeabindingandfinaldecision,by
130meansofamajorityvote,regardingthematter.However,nothinginthissectionshallprevent
131anyinstitutionofhighereducationinthisstatefrompresentingadditionalbudgetrequestsor
132fromexplainingorfurtherclarifyingitsbudgetrequeststothegovernororthegeneral
133assembly;
134 [(13)] (12)Inrecognitionofinstitutionsthatmeettherequirementsofsubdivision(2),

155offeringsbyanyout-of-statepublicinstitutionofhighereducationseekingtoofferdegree
156programsorcourseworkwithinthestateofMissouri;and
157 b.Theboard'sapprovalprocessofdegreeprogramsandcoursesofferedbyanyout-
158of-statepublicinstitutionsofhighereducationthat,priortoJuly1,2008,wereapprovedby
159theboardtooperateaschoolincompliancewiththeprovisionsofsections173.600to
160173.618.Therulesshallensurethat,asofJuly1,2008,allout-of-statepublicinstitutions
161seekingtoofferdegreesandcourseswithinthestateofMissouriareevaluatedinamanner
162similartoMissouripublichighereducationinstitutions.Suchout-of-statepublicinstitutions
163shallbeheldtostandardsnolowerthanthestandardsestablishedbythecoordinatingboard
164forprogramapprovalandthepolicyguidelinesofthecoordinatingboardfordatacollection,
165cooperation,andresolutionofdisputesbetweenMissouriinstitutionsofhighereducation
166underthissection.Anysuchout-of-statepublicinstitutionsofhighereducationwishingto
167continueoperatingwithinthisstatemustbeapprovedbytheboardundertherules
168promulgatedunderthissubdivision.Thecoordinatingboardmaychargeandcollectfees
169fromout-of-statepublicinstitutionstocoverthecostsofreviewingandassuringthequalityof
170programsofferedbyout-of-statepublicinstitutions.Anyruleorportionofarule,asthatterm
171isdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
172becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536
173and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany
174ofthepowersvestedwiththegeneralassemblyunderchapter536toreview,todelaythe
175effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then

182 3.Thecoordinatingboardshallmeetatleastfourtimesannuallywithanadvisory
183committeewhoshallbenotifiedinadvanceofsuchmeetings.Thecoordinatingboardshall
184haveexclusivevotingprivileges.Theadvisorycommitteeshallconsistofthirty-two

222stateofMissouriandshallnotbedisposedofwithoutlegislativeapproval.
173.030.Thecoordinatingboard,inaddition,shallhaveresponsibility,withinthe
2provisionsoftheconstitutionandthestatutesofthestateofMissouri,for:
3 (1)Requestingthegoverningboardsofallstate-supportedinstitutionsofhigher
4education,andofmajorprivateinstitutionstosubmittothecoordinatingboardanyproposed
5policychangeswhichwouldcreateadditionalinstitutionsofhighereducation,additional
HB616	7 6residencecenters,ormajoradditionsindegreeandcertificateprograms,andmakepertinent
7recommendationsrelatingthereto;
8 (2)Recommendingtothegoverningboardofanyinstitutionofhighereducationin
9thestatethedevelopment,consolidation,oreliminationofprograms,degreeofferings,
10physicalfacilitiesorpolicychangeswherethatactionisdeemedbythecoordinatingboardas
11inthebestinterestsoftheinstitutionsthemselvesand/orthegeneralrequirementsofthestate.
12Recommendationsshallbesubmittedtogoverningboardsbytwelvemonthsprecedingthe
13terminwhichtheactionmaytakeeffect;
14 (3)Recommendingtothegoverningboardsofstate-supportedinstitutionsofhigher
15education,includingpubliccommunitycollegesreceivingstatesupport,formulastobe
16employedinspecifyingplansforgeneraloperations,fordevelopmentandexpansion,andfor
17requestsforappropriationsfromthegeneralassembly.Suchrecommendationswillbe
18submittedtothegoverningboardsbyAprilfirstofeachyearprecedingaregularsessionof
19thegeneralassemblyofthestateofMissouri;
20 (4)Promulgatingrulestoincludeselectedoff-campusinstructioninpubliccollege
21anduniversityappropriationrecommendationswherepriorneedhasbeenestablishedinareas
22designatedbythecoordinatingboardforhighereducation.Fundingforsuchoff-campus
23instructionshallbeincludedintheappropriationrecommendations,shallbedeterminedby
24thegeneralassemblyandshallcontinue,withintheamountsappropriatedtherefor,unlessthe
25generalassemblydisapprovestheactionbyconcurrentresolution;
26 (5)CoordinatingreciprocalagreementsbetweenoramongMissouristateinstitutions
27ofhighereducationattherequestofoneormoreoftheinstitutionspartytotheagreement,
28andbetweenoramongMissouristateinstitutionsofhighereducationandpubliclysupported
29highereducationinstitutionslocatedoutsidethestateofMissouriattherequestofany
30Missouriinstitutionpartytotheagreement;
31 (6)Enteringintoagreementsforinterstatereciprocityregardingthedeliveryof
32postsecondarydistanceeducation,administeringsuchagreements,andapprovingor
33disapprovingapplicationstoparticipateinsuchagreementsfromapostsecondary
34institutionthathasitsprincipalcampusinthestateofMissouri:
35 (a)Thecoordinatingboardshallestablishstandardsforinstitutionalapproval.Those
36standardsshallinclude,butarenotlimitedtothe:
37 a.Definitionofphysicalpresencefornon-MissouriinstitutionsservingMissouri
38residentsconsistentwithotherstates'definitionsofphysicalpresence;and
39 b.Establishmentofconsumerprotectionpoliciesfordistanceeducationaddressing
40recruitmentandmarketingactivities;disclosureoftuition,fees,andothercharges;disclosure
41ofadmissionprocessesandprocedures;andstudentcomplaints;
HB616	8 42 (b)Thecoordinatingboardshallestablishpoliciesforthereviewandresolutionof
43studentcomplaintsarisingfromdistanceeducationprogramsofferedundertheagreement;
44 (c)Thecoordinatingboardmaychargefeestoanyinstitutionthatappliesto
45participateinaninterstatepostsecondarydistanceeducationreciprocityagreementauthorized
46pursuanttothissection.Suchfeesshallnotexceedthecoordinatingboardforhigher
47education'scostofreviewingandevaluatingtheapplications;and
48 (d)Thecoordinatingboardshallpromulgaterulestoimplementtheprovisionsofthis
49subdivision.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
50createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
51withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
52Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe

7studentsforsuccessfulcollegeanduniversityperformance.Thereportproducedpursuantto
8thissubsectionshallannuallybefurnishedtothestateboardofeducationforreporting
9pursuanttosubsection4ofsection161.610andshallnotbeusedforanyotherpurposeuntil
10suchtimethatastandardprocessandconsistent,specificcriteriafordeterminingastudent's

13 2.Theproceduresshallbedesignedsothatthereportingismadebythenameofeach
14highschoolinthestate,withindividualstudentdatatobegroupedaccordingtothehigh
