SectionA.Section67.2500,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections67.2500and311.094,toreadasfollows:
67.2500.1.Atheater,culturalarts,andentertainmentdistrictmaybeestablishedin
2themannerprovidedinsection67.2505bythegoverningbodyofanycounty,city,town,or
3villagethathasadoptedtransect-basedzoningunderchapter89,anycountydescribedinthis
4subsection,oranycity,town,orvillagethatiswithinsuchcounties:
5 (1)Anycountywithacharterformofgovernmentandwithmorethantwohundred
6fiftythousandbutlessthanthreehundredfiftythousandinhabitants;
7 (2)Anycountyofthefirstclassificationwithmorethanninety-threethousandeight
8hundredbutfewerthanninety-threethousandninehundredinhabitants;
9 (3)Anycountyofthefirstclassificationwithmorethanonehundredeighty-four
10thousandbutfewerthanonehundredeighty-eightthousandinhabitants;

25 3.Asusedinsections67.2500to67.2530,thefollowingtermsmean:
26 (1)"District",atheater,culturalarts,andentertainmentdistrictorganizedunderthis
27section;
28 (2)"Qualifiedelectors","qualifiedvoters",or"voters",registeredvotersresiding
29withinthedistrictorsubdistrict,orproposeddistrictorsubdistrict,whohaveregisteredto
30votepursuanttochapter115or,iftherearenopersonseligibletoberegisteredvotersresiding
31inthedistrictorsubdistrict,proposeddistrictorsubdistrict,propertyowners,including
32corporationsandotherentities,thatareownersofrealproperty;
33 (3)"Registeredvoters",personsqualifiedandregisteredtovotepursuanttochapter
34115;and
35 (4)"Subdistrict",asubdivisionofadistrict,butnotaseparatepoliticalsubdivision,

311.094.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Commonarea",anyareadesignatedasacommonareainadevelopment
3planfortheentertainmentdistrictapprovedbythegoverningbodyofthecounty,city,
4town,orvillage;anyareaofapublicright-of-waythatisadjacenttoorwithinthe
5entertainmentdistrictandhascrossingswellmarked;andanyotherareaidentifiedin
6thedevelopmentplanordistrictplan;
7 (2)"Lakefrontentertainmentdistrict",anyarealocatedinthejurisdictionof
8anylocalgovernmentwhichbordersonorwhichcontainspartofalakewithnotless
9thanonethousandmilesofshorelinethat:
10 (a)Islocatedinanycitywithmorethanonethousandninehundredbutfewer
11thanseventhousandinhabitantsandpartiallylocatedinacountywithmorethan
12twenty-twothousandbutfewerthantwenty-fivethousandinhabitantsandwitha
13countyseatwithmorethanonehundredbutfewerthanfivehundredinhabitants;and
14 (b)Containsacombinationofentertainmentvenues,bars,nightclubs,and
15restaurants;
16 (3)"Portablebar",anybar,table,kiosk,cart,orstandthatisnotapermanent
17fixtureandcanbemovedfromplacetoplace.
HCSHB643 2 18 2.Notwithstandinganyotherprovisionsofthischaptertothecontrary,any
19personwhopossessesthequalificationsrequiredbythischapter,andwhomeetsthe
20requirementsofandcomplieswiththeprovisionsofthischapter,mayapplyfor,andthe
21supervisorofalcoholandtobaccocontrolmayissue,alakefrontentertainmentdistrict
22speciallicensetosellintoxicatingliquorbythedrinkforretailforconsumption
23dispensedfromoneormorelicensedestablishmentsorportablebarswithinthe
24lakefrontentertainmentdistrictfrom6:00a.m.until3:00a.m.onthefollowingday,
25MondaythroughSaturday,andfrom6:00a.m.to1:30a.m.thefollowingdayon
26Sunday.
27 3.Theapplicant(s)grantedalakefrontentertainmentdistrictspeciallicense
28underthissectionshallpayalicensefeeofthreehundreddollarsperyearperdistrictin
29additiontothefeesrequiredforeachindividuallicensee.
30 4.Notwithstandinganyotherprovisionofthischaptertothecontrary,the
31holderoftheentertainmentdistrictspeciallicense,atitssolediscretion,willdetermine
32whenandwherealicenseeisallowedunderthischaptertosellalcoholicbeverages,
33personsmaybeallowedtoleavelicensedestablishments,locatedinportionsofthe
34lakefrontentertainmentdistrictwithanalcoholicbeverageandenteruponandconsume
35thealcoholicbeveragewithinotherlicensedestablishmentsandcommonareaslocated
36inportionsoftheentertainmentdistrict.Nopersonshalltakeanyalcoholicbeverageor
37alcoholicbeveragesoutsidetheboundariesofthelakefrontentertainmentdistrict.
38 5.Everylicenseewithinthelakefrontentertainmentdistrictshallservealcoholic
39beveragesonlyifthecontainersdisplayandcontainthelicensee'stradenameorlogoor
40someothermarkthatisuniquetothatlicenseandlicensee.
41 6.Inadditiontotheindividuallicenseholder’sliability,anyholderofalakefront
42entertainmentdistrictspeciallicenseshallbejointlyresponsiblewiththeindividual
43licenseholderforalcoholviolationsoccurringonthepremises,atanyportablebar,and
44inanycommonarea.
45 7.Thegoverningbodyofthelocalgovernmentinwhichthelakefront
46entertainmentdistrictislocatedshallbeauthorizedtoadoptbyordinanceprocedures
47forapprovalorrejectionofsuchdistrictsaswellasrulesandregulationsforconduct
48andenforcementthereofconsistentwiththissection.
