HB664--ADMINISTRATIVE RULES SPONSOR: Keathley Thisbillestablishesanewprocessbywhichadministrative rules aretobeenacted. Undertheprovisionsofthisbill,rules enactedbyStateagenciesmustfirstbeapprovedbytheGeneral Assemblybeforebecomingeffective. TheJointCommitteeonAdministrative Rules(JCAR)willhavethe authoritytoexamineandtemporarilyhaltallproposedrulesuntil ratifiedbyboththeSenateandtheHouseofRepresentatives. When aproposedruleisfiledwiththeSecretaryofState,thefiling agencymustalsosubmitittoJCAR.TheCommitteethenhasthe authoritytoholdhearingsonanyproposedruleatanytime. However,thefinalorderofrulemakingcannotbefiledwiththe SecretaryofStateuntil30daysaftertheCommitteehasreceived it,withsomeexceptionsasspecifiedinthebill. Ifafiscalnoteforaproposedruleestimatescostsexceeding $250,000,JCARcansuspendtherulemakingprocessbeforethefinal orderisfiled.IftheGeneralAssemblydisapprovesofaproposed rule,thefilingagencycannotsubmitittotheSecretaryofState forpublicationintheMissouriregister. TheGeneralAssemblycan approveproposedrulesthroughaconcurrentresolution. After approvalbytheGeneralAssembly,theSecretaryofStatecan publishtherule,subjecttotheGovernor'ssignatureorveto.
