104.490.1.Shouldanyerrorresultinanymemberorbeneficiaryreceivingmoreor
2lessthanheorshewouldhavebeenentitledtoreceivehadtheerrornotoccurred,theboard
3shallcorrectsucherror,and,asfaraspracticable,torecoveranyoverpayments,mayaccept
4singlesumorinstallmentrepaymentormakefuturepaymentsinsuchamannerthatthe
5actuarialequivalentofthebenefittowhichsuchmemberorbeneficiarywasentitledshallbe
6paid[, andtothisendmayrecoveranyoverpayments]. Inallcasesinwhichsucherrorhas
7beenmade,nosucherrorshallbecorrectedunlessthesystemdiscoversorisnotifiedofsuch

11 2.Apersonwhoknowinglymakesafalsestatement,orfalsifiesorpermitstobe
12falsifiedarecordofthesystem,inanattempttodefraudthesystemissubjecttofineor
13imprisonmentpursuanttotheMissourirevisedstatutes.
14 3.TheboardoftrusteesoftheMissouristateemployees'retirementsystemshall
15ceasepayingbenefitstoanysurvivororbeneficiarywhoischargedwiththeintentional
16killingofamemberwithoutlegalexcuseorjustification.Asurvivororbeneficiarywhois

18beneficiaryisnotconvictedofsuchcharge,theboardshallresumepaymentofbenefitsand
19shallpaythesurvivororbeneficiaryanybenefitsthatweresuspendedpendingresolutionof
20suchcharge.
104.1060.1.Shouldanyerrorresultinanypersonreceivingmoreorlessthanthe
2personwouldhavebeenentitledtoreceivehadtheerrornotoccurred,theboardshallcorrect
3sucherror,and,asfaraspracticable,torecoveranyoverpayments,mayacceptsinglesum
4orinstallmentrepaymentormakefuturepaymentsinsuchamannerthattheactuarial
5equivalentoftheannuitytowhichsuchpersonwasentitledshallbepaid[, andtothisendmay
6recoveranyoverpayments]. Inallcasesinwhichsucherrorhasbeenmade,nosucherror
7shallbecorrectedunlessthesystemdiscoversorisnotifiedofsucherrorwithintenyearsafter
8themember'sannuitystartingdateorthedateoferror,whicheveroccurslater.Incasesof
9fraud,anyerrordiscoveredshallbecorrectedwithoutconcerntotheamountoftimethathas
10passed.
11 2.Apersonwhoknowinglymakesafalsestatement,orfalsifiesorpermitstobe

16survivororbeneficiarywhoisconvictedofsuchchargeshallnolongerbeentitledtoreceive
17anannuity.Ifthesurvivororbeneficiaryisnotconvictedofsuchcharge,theboardshall
18resumeannuitypaymentsandshallpaythesurvivororbeneficiaryanyannuitypaymentsthat
19weresuspendedpendingresolutionofsuchcharge.
104.1092.1.Inlieuofretirementannuitybenefitsotherwisepayableunderthe
2closedplanoryear2000plan,anymemberwhohasterminatedemployment,isentitledtoa
3deferredannuity,andhasnotyetreachednormalretirementageoreligibilitymaymakea
4one-timeelectiontoreceivealumpsumpaymentequaltoapercentageofthepresentvalueof
5suchmember'sdeferredannuityshouldaboardchoosetoestablishsuchaprogrambyboard
6rulepursuanttosection104.1063.
7 2.Anysuchelectionundersubsection1ofthissectionmaybemadebythemember
8beginningon[adateasestablishedbytheboardundersuchprogrambutnot]orafter[May
931,2018.AfterMay31,2018,nosuchelectionshallbemadeandretirementannuitybenefits
10shallonlybepaidasotherwiseprovidedbylawunderthischapter] January1,2026.
11 3.Anysuchmembermakingsuchelectionundersubsection1ofthissectionshall
12forfeitallsuchmember'screditableorcreditedserviceandfuturerightstoreceiveretirement
13annuitybenefitsfromthesystemunderthischapterandshallnotbeeligibletoreceiveany
14long-termdisabilitybenefits.Ifsuchmembersubsequentlybecomesanemployee,such
HB686 2 15membershallbeconsideredanewemployeewithnopriorcreditedserviceandshallbe
16subjecttotheprovisionsofsection104.1091.
105.695.1.Nocontributionorexpenditureofsystemfundsshallbemade
2directlybyanypublicpensionsystemtoadvocate,support,oropposethepassageor
3defeatofanyballotmeasureorthenominationorelectionofanycandidateforpublic
4office.Norshallanysystemfundspayanydebtsorobligationsof,anycommittee
5supportingoropposingsuchballotmeasuresorcandidates.
6 2.Forthepurposesofthissection,theterm"system"shallbedefinedasany
7retirementsystemestablishedbythestateofMissourioranypoliticalsubdivisionor
8instrumentalityofthestateforthepurposeofprovidingplanbenefitsforelectedor
9appointedpublicofficialsoremployeesofthestateofMissourioranypolitical
10subdivisionorinstrumentalityofthestate.
