122 (8)Orderthechildtoatermofcommunityserviceunderthesupervisionofthecourt 123orofanorganizationselectedbythecourt.Everyperson,organization,andagency,andeach 124employeethereof,chargedwiththesupervisionofachildunderthissubdivision,orwho 125benefitsfromanyservicesperformedasaresultofanorderissuedunderthissubdivision, 126shallbeimmunefromanysuitbythechildorderedtoperformservicesunderthis 127subdivision,oranypersonderivingacauseofactionfromsuchchild,ifsuchcauseofaction 128arisesfromthesupervisionofthechild'sperformanceofservicesunderthissubdivisionandif 129suchcauseofactiondoesnotarisefromanintentionaltort.Achildorderedtoperform 130servicesunderthissubdivisionshallnotbedeemedanemployeewithinthemeaningofthe 131provisionsofchapter287,norshalltheservicesofsuchchildbedeemedemploymentwithin 132themeaningoftheprovisionsofchapter288.Executionofanyorderenteredbythecourt, 133includingacommitmenttoanystateagency,maybesuspendedandthechildplacedon 134probationsubjecttosuchconditionsasthecourtdeemsreasonable.Afterahearing, 135probationmayberevokedandthesuspendedorderexecuted; 136 (9)Whenachildhasbeenadjudicatedtohaveviolatedamunicipalordinanceorto 137havecommittedanactthatwouldbeamisdemeanorifcommittedbyanadult,assessan 138amountofuptotwenty-fivedollarstobepaidbythechildtotheclerkofthecourt;whena 139childhasbeenadjudicatedtohavecommittedanactthatwouldbeafelonyifcommittedby 140anadult,assessanamountofuptofiftydollarstobepaidbythechildtotheclerkofthe 141court. 142 4.BeginningJanuary1,1996,thecourtmaysetforthintheorderofcommitmentthe 143minimumperiodduringwhichthechildshallremaininthecustodyofthedivisionofyouth 144services.Nocourtordershallrequireachildtoremaininthecustodyofthedivisionofyouth 145servicesforaperiodwhichexceedsthechild'snineteenth[birthdate]birthdayexceptupon 146petitionfiledbythedivisionofyouthservicespursuanttosubsection1ofsection219.021.In 147anyorderofcommitmentofachildtothecustodyofthedivisionofyouthservices,the 148divisionshalldeterminetheappropriateprogramorplacementpursuanttosubsection3of 149section219.021.BeginningJanuary1,1996,thedepartmentshallnotdischargeachildfrom 150thecustodyofthedivisionofyouthservicesbeforethechildcompletesthelengthofstay 151determinedbythecourtinthecommitmentorderunlessthecommittingcourtorders 152otherwise.Thedirectorofthedivisionofyouthservicesmayatanytimepetitionthecourt 153forareviewofachild'slengthofstaycommitmentorder,andthecourtmay,uponashowing 154ofgoodcause,ordertheearlydischargeofthechildfromthecustodyofthedivisionofyouth HB736 6 155services.Thedivisionmaydischargethechildfromthedivisionofyouthserviceswithouta 156furthercourtorderafterthechildcompletesthelengthofstaydeterminedbythecourtormay 157retainthechildforanyperiodafterthecompletionofthelengthofstayinaccordancewiththe 158law. 159 5.Whenanassessmenthasbeenimposedundertheprovisionsofsubsection2or3of 160thissection,theassessmentshallbepaidtotheclerkofthecourtinthecircuitwherethe 161assessmentisimposedbycourtorder,tobedepositedinafundestablishedforthesole 162purposeofpaymentofjudgmentsenteredagainstchildreninaccordancewithsection 163211.185. 219.021.1.Exceptasprovidedinsubsections2and3ofthissection,anychildmay 2becommittedtothecustodyofthedivisionwhenthejuvenilecourtdeterminesasuitable 3community-basedtreatmentservicedoesnotexist,orhasprovenineffective;andwhenthe 4childisadjudicatedpursuanttotheprovisionsofsubdivision(3)ofsubsection1ofsection 5211.031orwhenthechildisadjudicatedpursuanttosubdivision(2)ofsubsection1ofsection 6211.031andiscurrentlyundercourtsupervisionforadjudicationundersubdivision(2)or(3) 7ofsubsection1ofsection211.031.Thedivisionshallnotkeepanyyouthbeyond[his 8eighteenthbirthdate]theyouth'snineteenthbirthday, exceptuponpetitionandashowing 9ofjustcauseinwhichcasethedivisionmaymaintaincustodyuntiltheyouth'stwenty-first 10[birthdate]birthday. Notwithstandinganyotherprovisionoflawtothecontrary,the 11committingcourtshallreviewthetreatmentplantobeprovidedbythedivision.Thedivision 12shallnotifythecourtoforiginaljurisdictionfromwhichthechildwascommittedatleast 13threeweekspriortothechild'sreleasetoaftercaresupervision.Thenotificationshallinclude 14asummaryofthetreatmentplanandprogressofthechildthathasresultedintheplanned 15release.Thecourtmayformallyobjecttothedirectorofthedivisioninwriting,statingits 16reasonsinoppositiontotherelease.Thedirectorshallreviewthecourt'sobjectionin 17considerationofitsfinalapprovalforrelease.Thecourt'swrittenobjectionshallbemade 18withinaone-weekperiodafteritreceivesnotificationofthedivision'splannedrelease; 19otherwisethedivisionmayassumecourtagreementwiththerelease.Thedivisiondirector's 20writtenresponsetothecourtshalloccurwithinfiveworkingdaysofserviceofthecourt's 21objectionandpreferablypriortothereleaseofthechild.Thedivisionshallnotplaceachild 22directlyintoaprecaresettingimmediatelyuponcommitmentfromthecourtuntilitadvises 23thecourtofsuchplacement. 24 2.Nochildwhohasbeendiagnosedashavingamentaldiseaseoracommunicableor 25contagiousdiseaseshallbecommittedtothedivision;exceptthedivisionmay,byregulation, 26whenservicesforthepropercareandtreatmentofpersonshavingsuchdiseasesareavailable 27atanyofthefacilitiesunderitscontrol,authorizethecommitmentofchildrenhavingsuch 28diseasestoitfortreatmentinsuchinstitution.Noticeofanysuchregulationshallbe HB736 7 29promptlymailedtothejudgesandjuvenileofficersofallcourtshavingjurisdictionofcases 30involvingchildren. 31 3.Whenachildhasbeencommittedtothedivision,thedivisionshallforthwith 32examinetheindividualandinvestigateallpertinentcircumstancesofhisbackgroundforthe 33purposeoffacilitatingtheplacementandtreatmentofthechildinthemostappropriate 34programorresidentialfacilitytoassurethepublicsafetyandtherehabilitationofthechild; 35exceptthat,nochildcommittedundertheprovisionsofsubdivision(2)ofsubsection1of 36section211.031maybeplacedintheresidentialfacilitiesdesignatedbythedivisionasa 37maximumsecurityfacility,unlessthejuvenileissubsequentlyadjudicatedundersubdivision 38(3)ofsubsection1ofsection211.031. 39 4.Thedivisionmaytransferanychildunderitsjurisdictiontoanyotherinstitution 40forchildrenif,aftercarefulstudyofthechild'sneeds,itisthejudgmentofthedivisionthat 41thetransfershouldbeeffected.Ifthedivisiondeterminesthatthechildrequirestreatmentby 42anotherstateagency,itmaytransferthephysicalcustodyofthechildtothatagency,andthat 43agencyshallacceptthechildiftheservicesareavailablebythatagency. 44 5.Thedivisionshallmakeperiodicreexaminationsofallchildrencommittedtoits 45custodyforthepurposeofdeterminingwhetherexistingdispositionsshouldbemodifiedor 46continued.Reexaminationshallincludeastudyofallcurrentcircumstancesofsuchchild's 47personalandfamilysituationandanevaluationoftheprogressmadebysuchchildsincethe 48previousstudy.Reexaminationshallbeconductedasfrequentlyasthedivisiondeems 49necessary,butinanyevent,withrespecttoeachsuchchild,atintervalsnottoexceedsix 50months.Reportsoftheresultsofsuchexaminationsshallbesenttothechild'scommitting 51courtandtohisparentsorguardian. 52 6.Failureofthedivisiontoexamineachildcommittedtoitortoreexaminehim 53withinsixmonthsofapreviousexaminationshallnotofitselfentitlethechildtobe 54dischargedfromthecustodyofthedivisionbutshallentitlethechild,hisparent,guardian,or 55agencytowhichthechildmaybeplacedbythedivisiontopetitionforreviewasprovidedin 56section219.051. 57 7.Thedivisionisherebyauthorizedtoestablish,build,repair,maintain,andoperate, 58fromfundsappropriatedorapprovedbythelegislatureforthesepurposes,facilitiesand 59programsnecessarytoimplementtheprovisionsofthischapter.Suchfacilitiesorprograms 60mayinclude,butnotbelimitedto,theestablishmentandoperationoftrainingschools, 61maximumsecurityfacilities,moderatecarefacilities,grouphomes,daytreatmentprograms, 62familyfosterhomes,aftercare,counselingservices,educationalservices,andsuchother 63servicesasmayberequiredtomeettheneedsofchildrencommittedtoit.Thedivisionmay 64terminateanyfacilityorprogramnolongerneededtomeettheneedsofchildren. HB736 8 65 8.Thedivisionmayinstitutedayreleaseprogramsforchildrencommittedtoit.The 66divisionmayarrangewithlocalschools,publicorprivateagencies,orpersonsapprovedby 67thedivisionforthereleaseofchildrencommittedtothedivisiononadailybasistothe 68custodyofsuchschools,agencies,orpersonsforparticipationinprograms. 69 9.Thedivisionshallmakeallreasonableeffortstoensurethatanyoutstanding 70judgmententeredinaccordancewithsection211.185oranyoutstandingassessmentsordered 71inaccordancewithsection211.181bepaidwhileachildisinthecare,custodyorcontrolof 72thedivision. 455.010.Asusedinthischapter,unlessthecontextclearlyindicatesotherwise,the 2followingtermsshallmean: 3 (1)"Abuse",includesbutisnotlimitedtotheoccurrenceofanyofthefollowingacts, 4attemptsorthreatsagainstapersonwhomaybeprotectedpursuanttothischapter,except 5abuseshallnotincludeabuseinflictedonachildbyaccidentalmeansbyanadulthousehold 6memberordisciplineofachild,includingspanking,inareasonablemanner: 7 (a)"Abusingapet",purposelyorknowinglycausing,attemptingtocause,or 8threateningtocausephysicalinjurytoapetwiththeintenttocontrol,punish,intimidate,or 9distressthepetitioner; 10 (b)"Assault",purposelyorknowinglyplacingorattemptingtoplaceanotherinfear 11ofphysicalharm; 12 (c)"Battery",purposelyorknowinglycausingphysicalharmtoanotherwithor 13withoutadeadlyweapon; 14 (d)"Coercion",compellinganotherbyforceorthreatofforcetoengageinconduct 15fromwhichthelatterhasarighttoabstainortoabstainfromconductinwhichthepersonhas 16arighttoengage;
