19 2.Thechild,thechild'sparents,anyfiduciaryoranyrepresentativepayeeholdingor
20receivingmoneythatarevestedrightssolelyfororonbehalfofachildarejointlyand
21severallyliableforfundsexpendedbythedivisiontooronbehalfofthechild.Theliability
22ofanyperson,exceptaparentofthechild,shallbelimitedtothemoneyreceivedinhisorher
23fiduciaryorrepresentativecapacity.TheMissouristategovernmentshallnotrequireatrustee
24orafinancialinstitutionactingasatrusteetoexerciseanydiscretionarypowersinthe
25operationofatrust.
26 3.(1)Thedivisionmayacceptanappointmenttoserveasrepresentativepayeeor
27fiduciary,orinasimilarcapacityforpaymentstoachildunderanypublicorprivatebenefit
28arrangement.Moneysoreceivedshallbegovernedbythissectiontotheextentthatlawsand
29regulationsgoverningpaymentofsuchbenefitsprovideotherwise.
30 (2)InthecaseofbenefitsadministeredbytheRailroadRetirementBoard,the
31SocialSecurityAdministration,ortheVeteransAdministration,thedivisionshall
32determinewhetherthechildisreceivingorotherwiseeligibletoreceivesuchbenefits
33withinsixtydaysafterthechildisplacedinthedivision'scustody.Ifthedivision
34determinesthatthechildiseligibleormaybeeligibleforthebenefits,thedivisionshall
35applyforthebenefitsonbehalfofthechild.Ifthechildisalreadyreceivingthebenefits
36beforebeingplacedinthedivision'scustodyorifthedivisionappliesforthebenefitson
37behalfofthechild,thedivisionshallidentify,inconsultationwiththechildandthe
38child'slegalrepresentative,arepresentativepayeeinaccordancewith20CFR404.2021
39and20CFR416.621andshallapplytobecometherepresentativepayeeonlyifnoother
40suitablecandidateisavailable.Thedivisionshallannuallyreviewifsomeoneotherthan
41thedivisionisavailable,ifinthebestinterestsofthechild,toapplytoassumetheroleof
42representativepayee.
43 (3)Thedivisionshallannuallyreviewcasesofchildreninthedivision'scustody
44todeterminewhetherachildmayhavebecomeeligibleforbenefitsafterthedivision's
45initialassessment.
46 4.Anymoneyreceivedbythedivisiononbehalfofachildshallbeaccountedforin
47thenameofthechild.Anymoneyintheaccountofachild[may] shallnotbeexpendedby
48thedivisionforcareorservicesforthechildincluding,butnotlimitedto,fostercare
49maintenanceexpenses,asdefinedin42U.S.C.Section675(4)(A),andanyspecial
50allowancesorexpensesestablishedbythedivisionforthecareofchildreninthe
51division'scustody,forachildofasimilarage;provided,however,thatthedivisionmay
HB737	2 52usethebenefitsadministeredbytheRailroadRetirementBoard,theSocialSecurity
53Administration,ortheVeteransAdministrationforthechild'sunmetneedsbeyond
54whatthedivisionisobligated,required,oragreestopay. Thedivisionshallbyrule
55adoptedunderchapter536establishproceduresfortheaccountingofthemoneyandthe
56protectionofthemoneyagainsttheft,lossormisappropriation.
57 5.Thedivisionshalldepositmoneywithafinancialinstitution.Anyearnings
58attributabletothemoneyintheaccountofachildshallbecreditedtothatchild'saccount.
59Thedivisionshallreceivebidsfrombankingcorporations,associationsortrustcompanies
60whichdesiretobeselectedasdepositoriesofchildren'smoneysforthedivision.Thechild's
61accountshallbeestablishedinamannerconsistentwithfederalandstateassetand
62resourcelimitsandmayincludeaspecial-needstrust,apooledspecial-needstrust,an
63ABLEaccountasdefinedinsection209.600,oranyothertrustaccountdeterminednot
64tointerferewithassetlimitationsforanystateorfederalbenefitprogramforwhichthe
65childmaybeeligible.
66 6.Thedivisionmayacceptfundswhichaparent,guardianorotherpersonwishesto
67providefortheuseorbenefitofthechild.Theuseanddepositofsuchfundsshallbe
68governedbythissectionandanyadditionaldirectionsgivenbytheproviderofthefunds.
69 7.Eachchildforwhosebenefitfundshavebeenreceivedbythedivisionandthe
70guardianadlitemofsuchchildshallbefurnishedannuallywithastatementlistingall
71transactionsinvolvingthefundswhichhavebeendepositedonthechild'sbehalf,toinclude
72eachreceiptanddisbursement.
73 8.Thedivisionshalluseallproperdiligencetodisposeofthebalanceofmoney
74accumulatedinthechild'saccountwhenthechildisreleasedfromthecareandcustodyofthe
75divisionorthechilddies.Whenthechildisdeceasedthebalanceshallbedisposedofas
76providedbylawfordescentanddistribution.If,afterthedivisionhasdiligentlyusedsuch
77methodsandmeansasconsideredreasonabletorefundsuchfunds,thereshallremainany
78money,theownerofwhichisunknowntothedivision,orifknown,cannotbelocatedbythe
79division,ineachandeverysuchinstancesuchmoneyshallescheatandvestinthestateof
80Missouri,andthedirectorandofficialsofthedivisionshallpaythesametothestatedirector
81ofthedepartmentofrevenue,takingareceipttherefor,whoshalldepositthemoneyinthe
82statetreasurytobecreditedtoafundtobedesignatedas"escheat".
83 9.Withinfiveyearsaftermoneyhasbeenpaidintothestatetreasury,anypersonwho
84appearsandclaimsthemoneymayfileapetitioninthecircuitcourtofColeCounty,
85Missouri,statingthenatureoftheclaimandprayingthatsuchmoneybepaidtohim.Acopy
86ofthepetitionshallbeserveduponthedirectorofthedepartmentofrevenuewhoshallfilean
87answertothesame.Thecourtshallproceedtoexaminetheclaimandtheallegationsand
88proof,andifitfindsthatsuchpersonisentitledtoanymoneysopaidintothestatetreasury,it
HB737	3 89shallorderthecommissionerofadministrationtoissueawarrantonthestatetreasurerforthe
90amountofsuchclaim,butwithoutinterestorcosts.Acertifiedcopyoftheordershallbe
91sufficientvoucherforissuingawarrant;provided,thateitherpartymayappealfromthe
92decisionofthecourtinthesamemannerasprovidedbylawinothercivilactions.
93 10.Allmoneyspaidintothestatetreasuryundertheprovisionsofthissectionafter
94remainingthereunclaimedforfiveyearsshallescheatandvestabsolutelyinthestateandbe
95creditedtothestatetreasury,andallpersonsshallbeforeverbarredandprecludedfrom
96settinguptitleorclaimtoanysuchfunds.
97 11.Nothinginthissectionshallbedeemedtoapplytofundsregularlyduethestateof
98Missouriforthesupportandmaintenanceofchildreninthecareandcustodyofthedivision
99orcollectedbythestateofMissouriasreimbursementforstatefundsexpendedonbehalfof
100thechild.
211.221.Inplacingachildinorcommittingachildtothecustodyofanindividualor
2ofaprivateagencyorinstitutionthecourt, children'sdivision,oranychild-placingagency
3contractingwiththestatetoprovidefostercareservicesshallwheneverpracticableselect
4eitheraperson,oranagencyorinstitutiongovernedbypersonsofthesamereligiousfaithas
5thatoftheparentsofsuchchild,orincaseofadifferenceinthereligiousfaithoftheparents,
6thenofthereligiousfaithofthechildorifthereligiousfaithofthechildisnotascertainable,
7thenofthefaithofeitheroftheparents.
568.060.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Abuse",theinflictionofphysical,sexual,ormentalinjuryagainstachildbyany
3personeighteenyearsofageorolder.Forpurposesofthissection,abuseshallnotinclude
4injuryinflictedonachildbyaccidentalmeansbyapersonwithcare,custody,orcontrolof
5thechild,ordisciplineofachildbyapersonwithcare,custody,orcontrolofthechild,
6includingspanking,inareasonablemanner;
7 (2)"Abusiveheadtrauma",aseriousphysicalinjurytotheheadorbraincausedby
8anymeans,includingbutnotlimitedtoshaking,jerking,pushing,pulling,slamming,hitting,
9orkicking;
10 (3)"Mentalinjury",aninjurytotheintellectualorpsychologicalcapacityorthe
11emotionalconditionofachildasevidencedbyanobservableandsubstantialimpairmentof
12theabilityofthechildtofunctionwithinhisorhernormalrangeofperformanceorbehavior;
13 (4)"Neglect",thefailuretoprovide,bythoseresponsibleforthecare,custody,and
14controlofachildundertheageofeighteenyears,thecarereasonableandnecessaryto
15maintainthephysicalandmentalhealthofthechild,whensuchfailurepresentsasubstantial
16probabilitythatdeathorphysicalinjuryorsexualinjurywouldresult;

18includingbutnotlimitedtobruising,lacerations,hematomas,welts,orpermanentor
19temporarydisfigurementandimpairmentofanybodilyfunctionororgan;
20 (6)"Seriousemotionalinjury",aninjurythatcreatesasubstantialriskoftemporaryor
21permanentmedicalorpsychologicaldamage,manifestedbyimpairmentofabehavioral,
22cognitive,orphysicalcondition.Seriousemotionalinjuryshallbeestablishedbytestimony
23ofqualifiedexpertsuponthereasonableexpectationofprobableharmtoareasonabledegree
24ofmedicalorpsychologicalcertainty;
25 (7)"Seriousphysicalinjury",aphysicalinjurythatcreatesasubstantialriskofdeath
26orthatcausesseriousdisfigurementorprotractedlossorimpairmentofthefunctionofany

28 2.Apersoncommitstheoffenseofabuseorneglectofachildifsuchperson
29knowinglycausesachildwhoislessthaneighteenyearsofage:
30 (1)Tosufferphysicalormentalinjuryasaresultofabuseorneglect;or
31 (2)Tobeplacedinasituationinwhichthechildmaysufferphysicalormentalinjury
32astheresultofabuseorneglect.
33 3.Apersoncommitstheoffenseofabuseorneglectofachildifsuchperson
34recklesslycausesachildwhoislessthaneighteenyearsofagetosufferfromabusivehead
35trauma.
36 4.Apersondoesnotcommittheoffenseofabuseorneglectofachildbyvirtueofthe
37solefactthatthepersondeliversorallowsthedeliveryofachildtoaproviderofemergency
38services.
39 5.(1)Apersondoesnotcommittheoffenseofabuseorneglectofachildby
40virtueofthesolefactthatthepersonallowsthechildtoengageinindependentactivities
41withoutadultsupervisionandthepersonisaparenttothechildorisresponsibleforthe
