HCSHBs737&486 4 29 3.(1)Thedivisionmayacceptanappointmenttoserveasrepresentativepayeeor 30fiduciary,orinasimilarcapacityforpaymentstoachildoryouthunderanypublicorprivate 31benefitarrangement.Moneysoreceivedshallbegovernedbythissectiontotheextentthat 32lawsandregulationsgoverningpaymentofsuchbenefitsprovideotherwise. 33 (2)InthecaseofbenefitsadministeredbytheRailroadRetirementBoard,the 34SocialSecurityAdministration,ortheVeteransAdministration,thedivisionshall 35determinewhetherthechildoryouthisreceivingorotherwiseeligibletoreceivesuch 36benefitswithinsixtydaysafterthechildoryouthisplacedinthedivision'scustody.If 37thedivisiondeterminesthatthechildoryouthiseligibleormaybeeligibleforthe 38benefits,thedivisionshallapplyforthebenefitsonbehalfofthechildoryouth.Ifthe 39childoryouthisalreadyreceivingthebenefitsbeforebeingplacedinthedivision's 40custodyorifthedivisionappliesforthebenefitsonbehalfofthechildoryouth,the 41divisionshallidentify,inconsultationwiththechildoryouthandthechild'soryouth's 42legalrepresentative,arepresentativepayeeinaccordancewith20CFR404.2021and20 43CFR416.621andshallapplytobecometherepresentativepayeeonlyifnoother 44suitablecandidateisavailable.Thedivisionshallannuallyreviewifsomeoneotherthan 45thedivisionisavailable,ifinthebestinterestsofthechildoryouth,toapplytoassume 46theroleofrepresentativepayee. 47 (3)Thedivisionshallannuallyreviewcasesofchildrenoryouthinthedivision's 48custodytodeterminewhetherachildoryouthmayhavebecomeeligibleforbenefits 49afterthedivision'sinitialassessment. 50 4.Anymoneyreceivedbythedivisiononbehalfofachildoryouthshallbe 51accountedforinthenameofthechildoryouth. Anymoneyintheaccountofachild[may] 52oryouthshallnotbeexpendedbythedivisionforcareorservicesforthechildoryouth 53including,butnotlimitedto,fostercaremaintenanceexpenses,asdefinedin42U.S.C. 54Section675(4)(A),andanyspecialallowancesorexpensesestablishedbythedivisionfor 55thecareofchildrenoryouthinthedivision'scustody,forachildoryouthofasimilar 56age;provided,however,thatthedivisionmayusethebenefitsadministeredbythe 57RailroadRetirementBoard,theSocialSecurityAdministration,ortheVeterans 58Administrationforthechild'soryouth'sunmetneedsbeyondwhatthedivisionis 59obligated,required,oragreestopay.Thedivisionshallbyruleadoptedunderchapter536 60establishproceduresfortheaccountingofthemoneyandtheprotectionofthemoneyagainst 61theft,lossormisappropriation. 62 5.Thedivisionshalldepositmoneywithafinancialinstitution.Anyearnings 63attributabletothemoneyintheaccountofachildoryouthshallbecreditedtothatchild'sor 64youth'saccount.Thedivisionshallreceivebidsfrombankingcorporations,associationsor 65trustcompanieswhichdesiretobeselectedasdepositoriesofchildren'soryouth'smoneys HCSHBs737&486 5 66forthedivision.Thechild'soryouth'saccountshallbeestablishedinamanner 67consistentwithfederalandstateassetandresourcelimitsandmayincludeaspecial 68needstrust,apooledspecialneedstrust,anABLEaccountasdefinedinsection209.600, 69oranyothertrustaccountdeterminednottointerferewithassetlimitationsforany 70stateorfederalbenefitprogramforwhichthechildoryouthmaybeeligible. 71 6.Thedivisionmayacceptfundswhichaparent,guardianorotherpersonwishesto 72providefortheuseorbenefitofthechildoryouth. Theuseanddepositofsuchfundsshall 73begovernedbythissectionandanyadditionaldirectionsgivenbytheproviderofthefunds. 74 7.Eachchildoryouthforwhosebenefitfundshavebeenreceivedbythedivision 75andtheguardianadlitemofsuchchildoryouthshallbefurnishedannuallywithastatement 76listingalltransactionsinvolvingthefundswhichhavebeendepositedonthechild'sor 77youth'sbehalf,toincludeeachreceiptanddisbursement. 78 8.Thedivisionshalluseallproperdiligencetodisposeofthebalanceofmoney 79accumulatedinthechild'soryouth'saccountwhenthechildoryouthisreleasedfromthe 80careandcustodyofthedivisionorthechildoryouthdies.Whenthechildoryouthis 81deceasedthebalanceshallbedisposedofasprovidedbylawfordescentanddistribution.If, 82afterthedivisionhasdiligentlyusedsuchmethodsandmeansasconsideredreasonableto 83refundsuchfunds,thereshallremainanymoney,theownerofwhichisunknowntothe 84division,orifknown,cannotbelocatedbythedivision,ineachandeverysuchinstancesuch 85moneyshallescheatandvestinthestateofMissouri,andthedirectorandofficialsofthe 86divisionshallpaythesametothestatedirectorofthedepartmentofrevenue,takingareceipt 87therefor,whoshalldepositthemoneyinthestatetreasurytobecreditedtoafundtobe 88designatedas"escheat". 89 9.Withinfiveyearsaftermoneyhasbeenpaidintothestatetreasury,anypersonwho 90appearsandclaimsthemoneymayfileapetitioninthecircuitcourtofColeCounty, 91Missouri,statingthenatureoftheclaimandprayingthatsuchmoneybepaidtohim.Acopy 92ofthepetitionshallbeserveduponthedirectorofthedepartmentofrevenuewhoshallfilean 93answertothesame.Thecourtshallproceedtoexaminetheclaimandtheallegationsand 94proof,andifitfindsthatsuchpersonisentitledtoanymoneysopaidintothestatetreasury,it 95shallorderthecommissionerofadministrationtoissueawarrantonthestatetreasurerforthe 96amountofsuchclaim,butwithoutinterestorcosts.Acertifiedcopyoftheordershallbe 97sufficientvoucherforissuingawarrant;provided,thateitherpartymayappealfromthe 98decisionofthecourtinthesamemannerasprovidedbylawinothercivilactions. 99 10.Allmoneyspaidintothestatetreasuryundertheprovisionsofthissectionafter 100remainingthereunclaimedforfiveyearsshallescheatandvestabsolutelyinthestateandbe 101creditedtothestatetreasury,andallpersonsshallbeforeverbarredandprecludedfrom 102settinguptitleorclaimtoanysuchfunds. HCSHBs737&486 6 103 11.Nothinginthissectionshallbedeemedtoapplytofundsregularlyduethestateof 104Missouriforthesupportandmaintenanceofchildrenoryouthinthecareandcustodyofthe 105divisionorcollectedbythestateofMissouriasreimbursementforstatefundsexpendedon 106behalfofthechildoryouth. 107 12.(1)Subjecttoappropriation,thedepartmentofsocialservicesshallhavethe 108authoritytoenterintocontractswithprivateindividuals,lawfirms,not-for-profit 109corporations,orpartnershipstoapplyforbenefitsonbehalfofachildoryouthinits 110custodyorunderitscourt-orderedsupervisionpursuanttochapter211forthebenefits 111administeredbytheRailroadRetirementBoard,theSocialSecurityAdministration,or 112theVeteransAdministration,andtoestablishaccountsassetforthinsubsection5ofthis 113section. 114 (2)Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe 115administrationofthissubsection.Anyruleorportionofarule,asthattermisdefined 116insection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 117becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 118536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 119andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 120review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 121heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 122adoptedafterAugust28,2025,shallbeinvalidandvoid. 211.221.Inplacingachildinorcommittingachildtothecustodyofanindividualor 2ofaprivateagencyorinstitutionthecourt, children'sdivision,oranychild-placingagency 3contractingwiththestatetoprovidefostercareservicesshallwheneverpracticableselect 4eitheraperson,oranagencyorinstitutiongovernedbypersonsofthesamereligiousfaithas 5thatoftheparentsofsuchchild,orincaseofadifferenceinthereligiousfaithoftheparents, 6thenofthereligiousfaithofthechildorifthereligiousfaithofthechildisnotascertainable, 7thenofthefaithofeitheroftheparents.Thedepartmentofsocialservicesmaycontractto 8implementtheprovisionsofthissection. 568.060.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Abuse",theinflictionofphysical,sexual,ormentalinjuryagainstachildbyany 3personeighteenyearsofageorolder.Forpurposesofthissection,abuseshallnotinclude 4injuryinflictedonachildbyaccidentalmeansbyapersonwithcare,custody,orcontrolof 5thechild,ordisciplineofachildbyapersonwithcare,custody,orcontrolofthechild, 6includingspanking,inareasonablemanner;
