SectionA.Sections290.502and290.600,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections290.502and290.600,toreadasfollows:
290.502.1.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to
2290.530,effectiveJanuary1,2007,everyemployershallpaytoeachemployeewagesatthe
3rateof$6.50perhour,orwagesatthesamerateorratessetundertheprovisionsoffederal
4lawastheprevailingfederalminimumwageapplicabletothosecoveredjobsininterstate
5commerce,whicheverrateperhourishigher.
6 2.[TheminimumwageshallbeincreasedordecreasedonJanuary1,2008,andon
7January1ofsuccessiveyears,bytheincreaseordecreaseinthecostofliving.OnSeptember
830,2007,andoneachSeptember30ofeachsuccessiveyear,thedirectorshallmeasurethe
9increaseordecreaseinthecostoflivingbythepercentageincreaseordecreaseasofthe
10precedingJulyoverthelevelasofJulyoftheimmediatelyprecedingyearoftheConsumer
11PriceIndexforUrbanWageEarnersandClericalWorkers(CPI-W)orsuccessorindexas
12publishedbytheU.S.DepartmentofLabororitssuccessoragency,withtheamountofthe
13minimumwageincreaseordecreaseroundedtothenearestfivecents.
14 3.]Exceptasmaybeotherwiseprovidedpursuanttosections290.500to290.530and
15undersubdivision(2)ofthissubsection, andnotwithstandingsubsection1ofthissection,
16effectiveJanuary1,2025,everyemployershallpaytoeachemployeewagesattherateofnot
17lessthan$13.75perhour,orwagesatthesamerateorratessetundertheprovisionsoffederal
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18lawastheprevailingfederalminimumwageapplicabletothosecoveredjobsininterstate
19commerce,whicheverrateperhourishigher.Thereafter,theminimumwageestablishedby
20thissubsectionshallbeincreasedby$1.25perhour,to$15.00perhour,effectiveJanuary1,
212026.[Thereafter,theminimumwageestablishedbythissubsectionshallbeincreasedor
22decreasedonJanuary1,2027,andonJanuary1ofsuccessiveyears,perthemethodsetforth
23insubsection2ofthissection.] Ifatanytimethefederalminimumwagerateisaboveoris
24thereafterincreasedabovetheminimumwagethenineffectunderthissubsection,[the
25minimumwagerequiredbythissubsectionshallcontinuetobeincreasedpursuanttothis
26subsection,but]thehigherfederalrateshallimmediatelybecometheminimumwagerequired
27bythissubsection[andshallbeincreasedordecreasedperthemethodsetforthinsubsection
282]forsolongasitremainshigherthanthestateminimumwagerequired[andincreased]
29pursuanttothissubsection.
30 3.(1)Exceptwhereotherwiserequiredbyfederallaw,beginningonandafter
31theeffectivedateofthissection,thestateminimumwageunderthissectionshallnot
32applytoanyemployeewhoisundertwentyyearsofage,notwithstandinganyother
33exemptions,lowerwagerates,prevailingwagerates,orotherexceptionsorpreemptions
34ofthestateminimumwagelawthatareallowedunderthischapter,generallaw,or
35federallaw.
36 (2)Employersemployingemployeesundertwentyyearsofagewhoareexempt
37underthissubdivisionshallstillbesubjecttotheremainingapplicableprovisionsof
38sections290.500to290.530.
39 (3)Theexemptionprovidedunderthissubdivisionshallapplyonlyto
40employmentcompensationpaidoraccruedonoraftertheeffectivedateofthis
41sectionandshallnotberetroactiveineffect.
42 4.Forpurposesofthissection,theterm"publicemployer"meansanemployerthatis
43thestateorapoliticalsubdivisionofthestate,includingadepartment,agency,officer,bureau,
44division,board,commission,orinstrumentalityofthestate,oracity,county,town,village,
45schooldistrict,orotherpoliticalsubdivisionofthestate.[Subsection3ofthissection]
46Beginningontheeffectivedateofthissection,theprovisionsofthissectionshall[not]
47applytoapublicemployerwithrespecttoitsemployees.[Anypublicemployerthatis
48subjecttosubsections1and2ofthissectionshallcontinuetobesubjecttothosesubsections.]

15 (b)Anyindividualstandinginlocoparentistofosterchildrenintheircare;
16 (c)Anyindividualemployedforlessthanfourmonthsinanyyearinaresidentorday
17campforchildrenoryouth,oranyindividualemployedbyaneducationalconferencecenter
18operatedbyaneducational,charitableornot-for-profitorganization;

78 (b)Foremployeeswhoarepaidmultiplehourlyratesofpayfromthesameemployer,
79thesamehourlyrateshallbeeither:

81earnedpaidsicktimeiftheemployeehadworked;or,
82 b.Theweightedaverageofallhourlyratesofpayduringthepreviouspayperiod.

84Whatevermethodtheemployeruses,theemployermustuseaconsistentmethodforeach
85employeethroughoutayear;
86 (c)Foremployeeswhoarepaidasalary,thesamehourlyrateshallbedeterminedby
87dividingthewagestheemployeeearnsinthepreviouspayperiodbythetotalnumberof
88hoursworkedduringthepreviouspayperiod.Fordeterminingtotalnumberofhoursworked
89duringthepreviouspayperiod,employeeswhoareexemptfromovertimerequirementsunder
9029U.S.C.§213(a)(1),theFairLaborStandardsAct,shallbeassumedtoworkfortyhoursin
91eachworkweekunlesstheirnormalworkweekislessthanfortyhours,inwhichcaseearned
92paidsicktimeshallaccrueandthesamehourlyrateshallbecalculatedbasedonthe
93employee'snormalworkweek.Regardlessofthebasisused,thesamehourlyrateshallnotbe
94lessthantheeffectiveminimumwagespecifiedinsection290.502;
95 (d)Foremployeespaidonapiecerateorafee-for-servicebasis,thesamehourlyrate
96shallbeareasonablecalculationofthewagesorfeestheemployeewouldhavereceivedfor
97thepiecework,service,orpartthereof,iftheemployeehadworked.Regardlessofthebasis
98used,thesamehourlyrateshallnotbelessthantheeffectiveminimumwagespecifiedin
99section290.502;
100 (e)Foremployeeswhoarepaidonacommissionbasis(whetherbasewageplus
