86 (c)Foremployeeswhoarepaidasalary,thesamehourlyrateshallbedeterminedby 87dividingthewagestheemployeeearnsinthepreviouspayperiodbythetotalnumberof 88hoursworkedduringthepreviouspayperiod.Fordeterminingtotalnumberofhoursworked 89duringthepreviouspayperiod,employeeswhoareexemptfromovertimerequirementsunder 9029U.S.C.§213(a)(1),theFairLaborStandardsAct,shallbeassumedtoworkfortyhoursin 91eachworkweekunlesstheirnormalworkweekislessthanfortyhours,inwhichcaseearned 92paidsicktimeshallaccrueandthesamehourlyrateshallbecalculatedbasedonthe 93employee'snormalworkweek.Regardlessofthebasisused,thesamehourlyrateshallnotbe 94lessthantheeffectiveminimumwagespecifiedinsection290.502; 95 (d)Foremployeespaidonapiecerateorafee-for-servicebasis,thesamehourlyrate 96shallbeareasonablecalculationofthewagesorfeestheemployeewouldhavereceivedfor 97thepiecework,service,orpartthereof,iftheemployeehadworked.Regardlessofthebasis 98used,thesamehourlyrateshallnotbelessthantheeffectiveminimumwagespecifiedin 99section290.502; 100 (e)Foremployeeswhoarepaidonacommissionbasis(whetherbasewageplus 101commissionorcommissiononly),thesamehourlyrateshallbethegreaterofthebasewage 102ortheeffectiveminimumwagespecifiedinsection290.502;
