Thisbillprohibitshealthcarriersandpharmacybenefitsmanagers,
ortheiraffiliatesfromdiscriminating againstentitiesthat
dispense340Bdrugs.Thisincludes:
(1)Reimbursingcoveredentitieslessfor340Bdrugs;
(2)Imposingdifferenttermsorconditionsoncoveredentities;
(3)Interferingwithpatients'choicestoreceive340Bdrugs;
(4)Settingreimbursementratesbelowthenationalaveragedrug
acquisitioncostrateorwholesaleacquisitioncost;
(5)Refusingtocover340Bdrugsorcontractwithcoveredentities
whodistribute340Bdrugs;
(6)Denyingtheabilityofcoveredentitiestopayfor340Bdrugs
atdiscountedprices;or
(7)Requiringacoveredentitytoreverse,resubmit,orclarifya
claimfora340Bdrugafterinitialadjudicationunlessthese
actionsare:
(a)Inthenormalcourseofpharmacybusinessandnotrelatedto
42U.S.C.Section256b;or
(b)Requiredbystateorfederallaw.
Anycontractthatisenteredinto,amended,extended,orrenewedon
oraftertheeffectivedateofthissectionthatincludesa
provisionthatviolatestheprovisionsofthebillwillbevoidand
unenforceable.
TheDirectoroftheDepartmentofCommerceandInsurancewill
establishrulestoimplementthissection,subjecttolegislative
reviewandconstitutionality. TheDirectorwillimposecivil
penaltiesupto$5,000perviolationperdayfornon-compliance.
