opioidprescriptions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter192,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection192.985,toreadasfollows:
192.985.1.BeforeDecember31,2025,thedepartmentofhealthandsenior
2servicesshallpromulgaterulesandregulationsregardingtaperingapatientoffopioids
3forallhealthcareprofessionalswiththeauthoritytoprescribeopioidsconsistentwith
4themostrecentguidelinesforprescribingopioidsissuedbytheCentersforDisease
5ControlandPrevention(CDC).Thereafter,thedepartmentshallreviewsuchrulesand
6regulationseveryfiveyearsandupdatethemasnecessary.Thedepartment'srulesand
7regulationsshallinclude,butnotbelimitedto:
8 (1)Instructiononwhentodecreaseopioiddosesortaperversuscontinuation;
9 (2)Taperingprotocols;
10 (3)Taperingstrategies;and
11 (4)Anyotherconsiderationfortaperingopioids.
12 2.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
13createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
14complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
15section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
16vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
17effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
1928,2025,shallbeinvalidandvoid.
