191.1011.1.Thedepartmentofhealthandseniorservicesshallestablisha
2registrationprocessforentitiesdesiringtooperateasyringeaccessprogramintendedto
3mitigatethehealthrisksassociatedwithunsterileinjectiondrugusewherebyanyentity
4thatwouldliketooperatesuchaprogramshallbeallowedtodosoifitmeets
5requirementssetbythedepartmentofhealthandseniorservices.
6 2.Thedepartmentofhealthandseniorservicesshallrequire,asaconditionfor
7registrationundersubsection1ofthissection,thattheentityseekingregistrationhasa
8collaborativeagreementwithanorganizationthatprovidesaccesstomentalhealthand
9substanceusetreatmentoptions.
10 3.Noentityregisteredwiththedepartmentofhealthandseniorservicesunder
11subsection1ofthissectionshallbepresentwithinfivehundredfeetofanyschool
12buildingunlesstheschoolbuildingwasconstructedorestablishedasaschoolafterthe
13entitywasinoperation.
14 4.Thedepartmentofhealthandseniorservicesshallpromulgaterulesto
15implementtheprovisionsofthissection.Anyruleorportionofarule,asthattermis
16definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection

579.040.1.(1)Apersoncommitstheoffenseofunlawfuldistribution,delivery,or
2saleofdrugparaphernaliaifheorsheunlawfullydistributes,delivers,orsells,orpossesses
3withintenttodistribute,deliver,orselldrugparaphernaliaknowing,orundercircumstances
4inwhichonereasonablyshouldknow,thatitwillbeusedtoplant,propogate,cultivate,grow,
5harvest,manufacture,compound,convert,produce,process,prepare,test,analyze,pack,
6repack,store,contain,conceal,inject,ingest,inhale,orotherwiseintroduceintothehuman
7bodyacontrolledsubstanceoranimitationcontrolledsubstanceinviolationofthischapter.
8 (2)Thefollowingentitiesandpersonsshallbeexemptfromtheprovisionsofthis
9section:
10 (a)Anyentityregisteredwiththedepartmentofhealthandseniorservices
11undersection191.1011thatpossesses,distributes,ordelivershypodermicneedlesor
12syringesforthepurposeofoperatingasyringeaccessprogramdescribedundersection
13191.1011;and
14 (b)Anystaffmember,volunteer,orparticipantinasyringeaccessprogram
15operatedbyanentitydescribedunderparagraph(a)ofthissubdivisionwhopossesses,
16distributes,ordelivershypodermicneedlesorsyringesinconnectionwithhisorher
17dutiesorparticipationinthesyringeaccessprogram.
18 2.TheoffenseofunlawfuldeliveryofdrugparaphernaliaisaclassAmisdemeanor,
19unlessdoneforcommercialpurposes,inwhichcaseitisaclassEfelony.
