ThisbillrequirestheDepartmentofHealthandSeniorServicesto
createaregistrationprocessfororganizationsinterestedin
operatingasyringeaccessprogram,orsimilarprogramintendedto
mitigatehealthrisksassociatedwithinjectabledruguse.The
billrequirestheDepartment,asaconditionforregistration,to
ensurethatanyentityseekingregistrationhasacollaborative
agreementwithanorganizationthatprovidesaccesstomental
healthand/orsubstanceusetreatmentoptions. Anyentity
registeredwiththeDepartmentcannotbelocatedwithin500feetof
anyschoolbuildingiftheschoolbuildingwasestablishedpriorto
theentity'soperation.
Inaddition,thisbillexemptsanyentityregisteredwiththe
Department,aswellasanystaffmember,volunteer,orparticipant
inasyringeaccessprogramthatisoperatedbyanentity
registeredwiththeDepartment,thatpossesses,distributes,
delivers,ormanufactureshypodermicneedlesorsyringesforthe
operationofasyringeexchangeprogramortootherwisemitigate
healthrisksassociatedwithunsterilizedinjectiondrugs,fromthe
lawscontrollingtheunlawfuldistribution,delivery,sale,
possession,andmanufacturingofdrugparaphernalia.
