BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section160.405,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection160.405,toreadasfollows: 160.405.1.Aperson,groupororganizationseekingtoestablishacharterschool 2shallsubmittheproposedcharter,asprovidedinthissection,toasponsor.Ifthesponsoris 3notaschoolboard,theapplicantshallgiveacopyofitsapplicationtotheschoolboardofthe 4districtinwhichthecharterschoolistobelocatedandtothestateboardofeducation,within 5fivebusinessdaysofthedatetheapplicationisfiledwiththeproposedsponsor.Theschool 6boardmayfileobjectionswiththeproposedsponsor,and,ifacharterisgranted,theschool 7boardmayfileobjectionswiththestateboardofeducation.Thechartershallincludea 8legallybindingperformancecontractthatdescribestheobligationsandresponsibilitiesofthe 9schoolandthesponsorasoutlinedinsections160.400to160.425andsection167.349and 10shalladdressthefollowing: 11 (1)Amissionandvisionstatementforthecharterschool; 74 (2)Achartermaybeapprovedwhenthesponsordeterminesthattherequirementsof 75thissectionaremet,determinesthattheapplicantissufficientlyqualifiedtooperateacharter 76school,andthattheproposedcharterisconsistentwiththesponsor'schartersponsorship 77goalsandcapacity.Thesponsor'sdecisionofapprovalordenialshallbemadewithinninety 78daysofthefilingoftheproposedcharter; 79 (3)Ifthecharterisdenied,theproposedsponsorshallnotifytheapplicantinwriting 80astothereasonsforitsdenialandforwardacopytothestateboardofeducationwithinfive 81businessdaysfollowingthedenial; 82 (4)Ifaproposedcharterisdeniedbyasponsor,theproposedchartermaybe 83submittedtothestateboardofeducation,alongwiththesponsor'swrittenreasonsforits 84denial.Ifthestateboarddeterminesthattheapplicantmeetstherequirementsofthissection, 85thattheapplicantissufficientlyqualifiedtooperatethecharterschool,andthatgrantinga 86chartertotheapplicantwouldbelikelytoprovideeducationalbenefittothechildrenofthe 87district,thestateboardmaygrantacharterandactassponsorofthecharterschool.Thestate 88boardshallreviewtheproposedcharterandmakeadeterminationofwhethertodenyorgrant 89theproposedcharterwithinsixtydaysofreceiptoftheproposedcharter,providedthatany 90chartertobeconsideredbythestateboardofeducationunderthissubdivisionshallbe HB889 3 91submittednolaterthanMarchfirstpriortotheschoolyearinwhichthecharterschoolintends 92tobeginoperations.Thestateboardofeducationshallnotifytheapplicantinwritingasthe 93reasonsforitsdenial,ifapplicable;and 94 (5)Thesponsorofacharterschoolshallgiveprioritytocharterschoolapplicantsthat 95proposeaschoolorientedtohigh-riskstudentsandtothereentryofdropoutsintotheschool 96system.Ifasponsorgrantsthreeormorecharters,atleastone-thirdofthechartersgrantedby 97thesponsorshallbetoschoolsthatactivelyrecruitdropoutsorhigh-riskstudentsastheir 98studentbodyandaddresstheneedsofdropoutsorhigh-riskstudentsthroughtheirproposed 99mission,curriculum,teachingmethods,andservices.Forpurposesofthissubsection,a 100"high-risk"studentisonewhoisatleastoneyearbehindinsatisfactorycompletionofcourse 101workorobtaininghighschoolcreditsforgraduation,hasdroppedoutofschool,isatriskof 102droppingoutofschool,needsdrugandalcoholtreatment,hasseverebehavioralproblems, 103hasbeensuspendedfromschoolthreeormoretimes,hasahistoryofseveretruancy,isa 104pregnantorparentingteen,hasbeenreferredforenrollmentbythejudicialsystem,isexiting 105incarceration,isarefugee,ishomelessorhasbeenhomelesssometimewithinthepreceding 106sixmonths,hasbeenreferredbyanareaschooldistrictforenrollmentinanalternative 107program,orqualifiesashighriskunderdepartmentofelementaryandsecondaryeducation 108guidelines.Dropoutshallbedefinedthroughtheguidelinesoftheschoolcoredatareport. 109Theprovisionsofthissubsectiondonotapplytocharterssponsoredbythestateboardof 110education. 111 3.Ifacharterisapprovedbyasponsor,thecharterapplicationshallbesubmittedto 112thestateboardofeducation,alongwithastatementoffindingbythesponsorthatthe 113applicationmeetstherequirementsofsections160.400to160.425andsection167.349anda 114monitoringplanunderwhichthechartersponsorshallevaluatetheacademicperformance, 115includingannualperformancereports,ofstudentsenrolledinthecharterschool.Thestate 116boardofeducationshallapproveordenyacharterapplicationwithinsixtydaysofreceiptof 117theapplication.Thestateboardofeducationmaydenyacharterongroundsthatthe 118applicationfailstomeettherequirementsofsections160.400to160.425andsection167.349 119orthatachartersponsorpreviouslyfailedtomeetthestatutoryresponsibilitiesofacharter 120sponsor.Anydenialofacharterapplicationmadebythestateboardofeducationshallbein 121writingandshallidentifythespecificfailuresoftheapplicationtomeettherequirementsof 122sections160.400to160.425andsection167.349,andthewrittendenialshallbeprovided 123withintenbusinessdaystothesponsor. 124 4.Acharterschoolshall,asprovidedinitscharter: 125 (1)Benonsectarianinitsprograms,admissionpolicies,employmentpractices,and 126allotheroperations; 203 (8)Providealongwithanyrequestforreviewbythestateboardofeducationthe 204following: 205 (a)Documentationthattheapplicanthasprovidedacopyoftheapplicationtothe 206schoolboardofthedistrictinwhichthecharterschoolistobelocated,exceptinthose 207circumstanceswheretheschooldistrictisthesponsorofthecharterschool;and 208 (b)Astatementoutliningthereasonsforapprovalordenialbythesponsor, 209specificallyaddressingtherequirementsofsections160.400to160.425and167.349. 210 5.(1)Proposedorexistinghigh-riskoralternativecharterschoolsmayinclude 211alternativearrangementsforstudentstoobtaincreditforsatisfyinggraduationrequirementsin 212theschool'scharterapplicationandcharter.Alternativearrangementsmayinclude,butnotbe 213limitedto,creditforoff-campusinstruction,embeddedcredit,workexperiencethroughan 214internshiparrangedthroughtheschool,andindependentstudies.Whenthestateboardof 215educationapprovesthecharter,anysuchalternativearrangementsshallbeapprovedatsuch 216time. 217 (2)Thedepartmentofelementaryandsecondaryeducationshallconductastudyof 218anycharterschoolgrantedalternativearrangementsforstudentstoobtaincreditunderthis 219subsectionafterthreeyearsofoperationtoassessstudentperformance,graduationrates, 220educationaloutcomes,andentryintotheworkforceorhighereducation. 221 6.Thecharterofacharterschoolmaybeamendedattherequestofthegoverning 222bodyofthecharterschoolandontheapprovalofthesponsor.Thesponsorandthegoverning 223boardandstaffofthecharterschoolshalljointlyreviewtheschool'sperformance, 224managementandoperationsduringthefirstyearofoperationandtheneveryotheryearafter 225themostrecentrevieworatanypointwheretheoperationormanagementofthecharter 226schoolischangedortransferredtoanotherentity,eitherpublicorprivate.Thegoverning 227boardofacharterschoolmayamendthecharter,ifthesponsorapprovessuchamendment,or 228thesponsorandthegoverningboardmayreachanagreementinwritingtoreflectthecharter 229school'sdecisiontobecomealocaleducationalagency.Insuchcasethesponsorshallgive 230thedepartmentofelementaryandsecondaryeducationwrittennoticenolaterthanMarchfirst 231ofanyyear,withtheagreementtobecomeeffectiveJulyfirst.Thedepartmentmaywaivethe 232Marchfirstnoticedateinitsdiscretion.Thedepartmentshallidentifyandfurnishalistofits 233regulationsthatpertaintolocaleducationalagenciestosuchschoolswithinthirtydaysof 234receivingsuchnotice. 252 b.Thecharterschool'sannualperformancereportresultsarebelowthedistrict's 253annualperformancereportresultsbasedontheperformancestandardsthatareapplicableto 254thegradelevelconfigurationofboththecharterschoolandthedistrictinwhichthecharter 255schoolislocatedinthreeofthelastfourschoolyears;and 256 c.Thecharterschoolisidentifiedasapersistentlylowestachievingschoolbythe 257departmentofelementaryandsecondaryeducation. 258 (b)Asponsorshallhaveapolicytorevokeacharterduringthechartertermifthere 259is: 260 a.Clearevidenceofunderperformanceasdemonstratedinthecharterschool'sannual 261performancereportinthreeofthelastfourschoolyears;or 262 b.Aviolationofthelaworthepublictrustthatimperilsstudentsorpublicfunds. 263 (c)Asponsorshallrevokeacharterortakeotherappropriateremedialaction,which 264mayincludeplacingthecharterschoolonprobationarystatusfornomorethantwenty-four 265months,providedthatnomorethanonedesignationofprobationarystatusshallbeallowed 266forthedurationofthechartercontract,atanytimeifthecharterschoolcommitsaserious 267breachofoneormoreprovisionsofitscharteroronanyofthefollowinggrounds:failureto 268meettheperformancecontractassetforthinitscharter,failuretomeetgenerallyaccepted 269standardsoffiscalmanagement,failuretoprovideinformationnecessarytoconfirm 270compliancewithallprovisionsofthecharterandsections160.400to160.425and167.349 HB889 8 271withinforty-fivedaysfollowingreceiptofwrittennoticerequestingsuchinformation,or 272violationoflaw. 273 (2)Thesponsormayplacethecharterschoolonprobationarystatustoallowthe 274implementationofaremedialplan,whichmayrequireachangeofmethodology,achangein 275leadership,orboth,afterwhich,ifsuchplanisunsuccessful,thechartermayberevoked. 276 (3)Atleastsixtydaysbeforeactingtorevokeacharter,thesponsorshallnotifythe 277governingboardofthecharterschooloftheproposedactioninwriting.Thenoticeshallstate 278thegroundsfortheproposedaction.Theschool'sgoverningboardmayrequestinwritinga 279hearingbeforethesponsorwithintwoweeksofreceivingthenotice. 280 (4)Thesponsorofacharterschoolshallestablishprocedurestoconduct 281administrativehearingsupondeterminationbythesponsorthatgroundsexisttorevokea 282charter.Finaldecisionsofasponsorfromhearingsconductedpursuanttothissubsectionare 283subjecttoanappealtothestateboardofeducation,whichshalldeterminewhetherthecharter 284shallberevoked. 285 (5)Aterminationshallbeeffectiveonlyattheconclusionoftheschoolyear,unless 286thesponsordeterminesthatcontinuedoperationoftheschoolpresentsaclearandimmediate 287threattothehealthandsafetyofthechildren. 288 (6)Achartersponsorshallmakeavailabletheschoolaccountabilityreportcard 289informationasprovidedundersection160.522andtheresultsoftheacademicmonitoring 290requiredundersubsection3ofthissection. 291 9.(1)Asponsorshalltakeallreasonablestepsnecessarytoconfirmthateachcharter 292schoolsponsoredbysuchsponsorisinmaterialcomplianceandremainsinmaterial 293compliancewithallmaterialprovisionsofthecharterandsections160.400to160.425and 294167.349.Everycharterschoolshallprovideallinformationnecessarytoconfirmongoing 295compliancewithallprovisionsofitscharterandsections160.400to160.425and167.349ina 296timelymannertoitssponsor. 297 (2)Thesponsor'srenewalprocessofthecharterschoolshallbebasedonthethorough 298analysisofacomprehensivebodyofobjectiveevidenceandconsiderif: 299 (a)Thecharterschoolhasmaintainedresultsonitsannualperformancereportthat 300meetorexceedthedistrictinwhichthecharterschoolislocatedbasedontheperformance 301standardsthatareapplicabletothegrade-levelconfigurationofboththecharterschooland 302thedistrictinwhichthecharterschoolislocatedinthreeofthelastfourschoolyears; 309 (c)Thecharterisincompliancewithitslegallybindingperformancecontractand 310sections160.400to160.425andsection167.349;and 311 (d)Thecharterschoolhasanannualperformancereportconsistentwitha 312classificationofaccreditedforthreeofthelastfouryearsandisfiscallyviableasdescribedin 313paragraph(b)ofthissubdivision.Ifsuchisthecase,thecharterschoolmayhavean 314expeditedrenewalprocessasdefinedbyruleofthedepartmentofelementaryandsecondary 315education. 316 (3)(a)BeginningAugustfirstduringtheyearinwhichacharterisconsideredfor 317renewal,acharterschoolsponsorshalldemonstratetothestateboardofeducationthatthe 318charterschoolisincompliancewithfederalandstatelawasprovidedinsections160.400to 319160.425andsection167.349andtheschool'sperformancecontractincludingbutnotlimited 320tothoserequirementsspecifictoacademicperformance. 321 (b)Alongwithdatareflectingtheacademicperformancestandardsindicatedin 322paragraph(a)ofthissubdivision,thesponsorshallsubmitarevisedcharterapplicationtothe 323stateboardofeducationforreview. 324 (c)Usingthedatarequestedandtherevisedcharterapplicationunderparagraphs(a) 325and(b)ofthissubdivision,thestateboardofeducationshalldetermineifcompliancewithall 326standardsenumeratedinthissubdivisionhasbeenachieved.Thestateboardofeducationat 327itsnextregularlyscheduledmeetingshallvoteontherevisedcharterapplication. 328 (d)Ifacharterschoolsponsordemonstratestheobjectivesidentifiedinthis 329subdivision,thestateboardofeducationshallrenewtheschool'scharter. 330 10.Aschooldistrictmayenterintoaleasewithacharterschoolforphysical 331facilities. 332 11.Agoverningboardoraschooldistrictemployeewhohascontroloverpersonnel 333actionsshallnottakeunlawfulreprisalagainstanotheremployeeattheschooldistrictbecause 334theemployeeisdirectlyorindirectlyinvolvedinanapplicationtoestablishacharterschool. 335Agoverningboardoraschooldistrictemployeeshallnottakeunlawfulreprisalagainstan 336educationalprogramoftheschoolortheschooldistrictbecauseanapplicationtoestablisha 337charterschoolproposestheconversionofalloraportionoftheeducationalprogramtoa 338charterschool.Asusedinthissubsection,"unlawfulreprisal"meansanactionthatistaken 339byagoverningboardoraschooldistrictemployeeasadirectresultofalawfulapplicationto 340establishacharterschoolandthatisadversetoanotheremployeeoraneducationalprogram. 341 12.Charterschoolboardmembersshallbesubjecttothesameliabilityforactswhile 342inofficeasiftheywereregularlyanddulyelectedmembersofschoolboardsinanyother 343publicschooldistrictinthisstate.Thegoverningboardofacharterschoolmayparticipate,to HB889 10 344thesameextentasaschoolboard,intheMissouripublicentityriskmanagementfundinthe 345mannerprovidedundersections537.700to537.756. 346 13.Anyentity,eitherpublicorprivate,operating,administering,orotherwise 347managingacharterschoolshallbeconsideredaquasi-publicgovernmentalbodyandsubject 348totheprovisionsofsections610.010to610.035. 349 14.Thechieffinancialofficerofacharterschoolshallmaintain: 350 (1)Asuretybondinanamountdeterminedbythesponsortobeadequatebasedon 351thecashflowoftheschool;or 352 (2)Aninsurancepolicyissuedbyaninsurancecompanylicensedtodobusinessin 353Missourionallemployeesintheamountoffivehundredthousanddollarsormorethat 354providescoverageintheeventofemployeetheft. 355 15.Thedepartmentofelementaryandsecondaryeducationshallcalculateanannual 356performancereportforeachcharterschoolandshallpublishitinthesamemannerasannual 357performancereportsarecalculatedandpublishedfordistrictsandattendancecenters. 358 16.Thejointcommitteeoneducationshallcreateacommitteetoinvestigatefacility 359accessandaffordabilityforcharterschools.Thecommitteeshallbecomprisedofequal 360numbersofthecharterschoolsectorandthepublicschoolsectorandshallreportitsfindings 361tothegeneralassemblybyDecember31,2016. ✔ HB889 11
