4 (2)Submits,inaccordancewithrulesoftheboard,thefollowingitemstothe 5board: 6 (a)Anapplicationforlicensuredesignedandapprovedbytheboardand 7submittedinaccordancewithrulesoftheboard; 8 (b)Anapplicationfeesubmittedinanamountandmannerestablishedbyrules 9oftheboard; 11 (b)Beaccreditedorhaveachievedcandidacystatusforaccreditationbythe 12CouncilonNaturopathicMedicalEducationoranequivalentfederallyrecognized 13accreditingbodyfornaturopathicmedicalprogramsalsorecognizedbytheboard;and 14 (c)Beaninstitutionofhighereducationorpartofaninstitutionofhigher 15educationthatiseitheraccreditedorisacandidateforaccreditationbyaregionalor 16nationalinstitutionalaccreditingagencyrecognizedbytheUnitedStatesSecretaryof 17Education; 6 (2)Prescribeonlywhenthenaturopathicdoctorhasadequateeducation, 7training,andexperiencetosafelymanagethemedicalregimen;and 8 (3)RegisterwiththeUnitedStatesDrugEnforcementAdministration(DEA)in 9ordertoprescribecontrolledsubstancesauthorizedbysections324.1900to324.1970. 324.1950.Alicenseeshallrefertoaphysicianlicensedandauthorizedtoengage 2inthepracticeofmedicineasdescribedinsection334.010anypatientwhosemedical 3conditionshould,atthetimeofevaluationortreatment,bedeterminedtobebeyondthe 4scopeofpracticeofthelicensee. 324.1955.Alicenseeshallnot: 2 (1)Performmajorsurgery; HB91 10 11 (3)Anypersonwhosellsavitaminorherbfromprovidinginformationabout 12thevitaminorherb; 13 (4)Thepracticeofnaturopathicmedicinebypersonswhoarelicensedto 14practiceinanyotherstateordistrictintheUnitedStatesandwhoenterthisstateto 15consultwithanaturopathicdoctorofthisstate,providedthattheconsultationislimited 16toexamination,recommendation,ortestimonyinlitigation;or 17 (5)Anypersonorpractitionerwhoisnotlicensedasanaturopathicdoctorfrom 18recommendingayurvedicmedicine,herbalremedies,nutritionaladvice,homeopathy,or 19othertherapythatiswithinthescopeofpracticeofnaturopathicmedicine,provided 20thatthepersonorpractitionershallnot: 21 (a)Useatitleprotectedundersection324.1965; 22 (b)Representorassumethecharacterorappearanceofalicensee;or 23 (c)Otherwiseuseaname,title,orotherdesignationthatindicatesorimpliesthat 24thepersonisalicensee. 324.1965.1.Alicenseeshallusethetitle"naturopathicphysician"or 2"naturopathicdoctor"andtherecognizedabbreviation"N.D.". 3 2.Alicenseehastheexclusiverighttousethefollowingtermsinreferencetothe 4licensee'sself:"naturopathicphysician","naturopathicdoctor","doctorof 5naturopathicmedicine","N.D.","ND","NMD",and"N.M.D.". 6 3.Anindividualrepresentstheindividual'sselftobeanaturopathicphysicianor 7anaturopathicdoctorwhentheindividualusesoradoptsanyofthefollowingtermsin 8referencetotheindividual'sself:"naturopathicphysician","naturopathicdoctor", 9"doctorofnaturopathicmedicine","N.D.","ND","NMD",and"N.M.D.". 10 4.Anindividualshallnotrepresenttheindividual'sselftothepublicasa 11naturopathicphysician,anaturopathicdoctor,oradoctorofnaturopathicmedicine,or 12asbeingotherwiseauthorizedtopracticenaturopathicmedicineinthisstate,unlessthe 13individualisalicensee. 324.1970.1.Theboardmayrefusetoissue,renew,orreinstateanylicense 2requiredbysections324.1900to324.1970foroneoranycombinationofcausesstatedin 3subsection2ofthissection.Theboardshallnotifytheapplicantinwritingofthe 4reasonsfortherefusalandshalladvisetheapplicantofhisorherrighttofilea 5complaintwiththeadministrativehearingcommissionasprovidedinchapter621. 6 2.Theboardmaycauseacomplainttobefiledwiththeadministrativehearing 7commissionasprovidedbychapter621againstanyholderofalicenseissuedunder 8sections324.1900to324.1970oranypersonwhohasfailedtoreneworhassurrendered 9hisorherlicenseforanyoneoranycombinationofthefollowingcauses: HB91 11 10 (1)Thepersonhasbeenfinallyadjudicatedandfoundguilty,orenteredapleaof 11guiltyornolocontendere,inacriminalprosecutionunderthelawsofanystate,ofthe 12UnitedStates,orofanycountryforanyoffensedirectlyrelatedtothedutiesand 13responsibilitiesoftheoccupation,assetforthinsection324.012,regardlessofwhethera 14sentenceisimposed; 28 (7)Disciplinaryactionagainsttheholderofalicenseorotherrighttopractice 29theprofessionregulatedbysections324.1900to324.1970grantedbyanotherstate, 30territory,federalagency,orcountryupongroundsforwhichrevocationorsuspensionis 31authorizedinthisstate; 32 (8)Apersonisfinallyadjudgedinsaneorincompetentbyacourtofcompetent 33jurisdiction; 34 (9)Issuanceofalicensebaseduponamaterialmistakeoffact;or 35 (10)Useofanyadvertisementorsolicitationthatisfalse,misleading,or 36deceptivetothegeneralpublicorpersonstowhomtheadvertisementorsolicitationis 37primarilydirected. 38 3.Anyperson,organization,association,orcorporationthatreportsorprovides 39informationtotheboardordivisioninaccordancewiththeprovisionsofsections 40324.1900to324.1970andthatdoessoingoodfaithandwithoutnegligenceshallnotbe 41subjecttoanactionforcivildamagesasaresultthereof. 42 4.Afterthefilingofacomplaintundersubsection2ofthissection,the 43proceedingsshallbeconductedinaccordancewiththeprovisionsofchapter621.Upon 44afindingbytheadministrativehearingcommissionthatoneormoreofthegroundsfor 45disciplinaryactionprovidedinsubsection2ofthissectionaremet,theboardmay, 46singlyorincombination,censureorplacethepersonnamedinthecomplainton HB91 12 47probationorsuspensionorrevokethelicenseofthepersononsuchtermsand 48conditionsastheboarddeemsappropriate. ✔ HB91 13
