208.247.[1.Pursuanttotheoptiongrantedthestateby21U.S.C.Section862a(d),an
2individualwhohaspledguiltyornolocontenderetoorisfoundguiltyunderfederalorstate
3lawofafelonyinvolvingpossessionoruseofacontrolledsubstanceshallbeexemptfromthe
4prohibitioncontainedin21U.S.C.Section862a(a)againsteligibilityforfoodstampprogram
5benefitsforsuchconvictions,ifsuchperson,asdeterminedbythedepartment:
6 (1)Meetsoneofthefollowingcriteria:
7 (a)Iscurrentlysuccessfullyparticipatinginasubstanceabusetreatmentprogram
8approvedbythedivisionofalcoholanddrugabusewithinthedepartmentofmentalhealth;or
9 (b)Iscurrentlyacceptedfortreatmentinandparticipatinginasubstanceabuse
10treatmentprogramapprovedbythedivisionofalcoholanddrugabuse,butissubjecttoa
11waitinglisttoreceiveavailabletreatment,andtheindividualremainsenrolledinthetreatment
12programandentersthetreatmentprogramatthefirstavailableopportunity;or
13 (c)Hassatisfactorilycompletedasubstanceabusetreatmentprogramapprovedby
14thedivisionofalcoholanddrugabuse;or
15 (d)Isdeterminedbyadivisionofalcoholanddrugabusecertifiedtreatmentprovider
16nottoneedsubstanceabusetreatment;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Issuccessfullycomplyingwith,orhasalreadycompliedwith,allobligations
18imposedbythecourt,thedivisionofalcoholanddrugabuse,andthedivisionofprobation
19andparole;and
20 (3)Doesnotpleadguiltyornolocontenderetoorisnotfoundguiltyofanadditional
21controlledsubstancemisdemeanororfelonyoffenseafterreleasefromcustodyor,ifnot
22committedtocustody,suchpersondoesnotpleadguiltyornolocontenderetoorisnotfound
23guiltyofanadditionalcontrolledsubstancemisdemeanororfelonyoffense,withinoneyear
24afterthedateofconviction.Suchapleaorconvictionwithinthefirstyearafterconviction
25shallimmediatelydisqualifythepersonfortheexemption;and
26 (4)Hasdemonstratedsobrietythroughvoluntaryurinalysistestingpaidforbythe
27participant.
28 2.Eligibilitybaseduponthefactorsinsubsection1ofthissectionshallbebasedupon
29documentaryorotherevidencesatisfactorytothedepartmentofsocialservices,andthe
30applicantshallmeetallotherfactorsforprogrameligibility.
31 3.Thedepartmentofsocialservices,inconsultationwiththedivisionofalcoholand
32drugabuse,shallpromulgaterulestocarryouttheprovisionsofthissectionincluding
33specifyingcriteriafordeterminingactiveparticipationinandcompletionofasubstanceabuse
34treatmentprogram.
35 4.Theexemptionunderthissectionshallnotapplytoanindividualwhohaspled
36guiltyornolocontenderetoorisfoundguiltyoftwosubsequentfelonyoffensesinvolving
37possessionoruseofacontrolledsubstanceafterthedateofthefirstcontrolledsubstance
38felonyconviction] Pursuanttotheoptiongrantedtothestateunder21U.S.C.Section
39862a(d)(1),anindividualconvictedunderfederalorstatelawofafelonyoffense
40involvingpossession,distribution,oruseofacontrolledsubstanceshallbeexemptfrom
41theprohibitioncontainedin21U.S.C.Section862a(a)againsteligibilityforthe
42supplementalnutritionassistanceprogramforsuchconvictions.
221.520.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Extraordinarycircumstance",asubstantialflightriskorsomeother
3extraordinarymedicalorsecuritycircumstancethatdictatesrestraintsbeusedto
4ensurethesafetyandsecurityofapregnantoffenderinherthirdtrimesterora
5postpartumoffenderwithinforty-eighthourspostdelivery,thestaffofthecountyorcity
6jailormedicalfacility,otheroffenders,orthepublic;
7 (2)"Labor",theperiodoftimebeforeabirthduringwhichcontractionsare
8present;
9 (3)"Postpartum",theperiodofrecoveryimmediatelyfollowingchildbirth,
10whichissixweeksforavaginalbirthoreightweeksforacesareanbirth,orlongerifso
11determinedbyaphysicianornurse;
HB916	2 12 (4)"Restraints",anyphysicalrestraintorotherdeviceusedtocontrolthe
13movementofaperson'sbodyorlimbs.
14 2.Exceptinextraordinarycircumstances,acountyorcityjailshallnotuse
15restraintsonapregnantoffenderinherthirdtrimester,whetherduringtransportation
16toandfromvisitstohealthcareprovidersandcourtproceedingsorduringmedical
17appointmentsandexaminations,orduringlabor,delivery,orforty-eighthours
18postdelivery.
19 3.Intheeventasherifforjailerdeterminesthatextraordinarycircumstances
20existandrestraintsarenecessary,thesherifforjailershallfullydocumentinwriting
21withinforty-eighthoursoftheincidentthereasonsheorshedeterminedsuch
22extraordinarycircumstancesexisted,thetypeofrestraintsused,andthereasonsthose
23restraintswereconsideredtheleastrestrictiveavailableandthemostreasonableunder
24thecircumstances.Suchdocumentsshallbekeptonfilebythecountyorcityjailforat
25leastfiveyearsfromthedatetherestraintswereused.
26 4.Anytimerestraintsareusedonapregnantoffenderinherthirdtrimesteror
27onapostpartumoffenderwithinforty-eighthourspostdelivery,therestraintsshallbe
28theleastrestrictiveavailableandthemostreasonableunderthecircumstances.Inno
29caseshallleg,ankle,orwaistrestraintsoranymechanicalrestraintsbeusedonany
30suchoffender,andifwristrestraintsareused,suchrestraintsshallbeplacedinthefront
31ofsuchoffender'sbodytoprotecttheoffenderandtheunbornchildinthecaseofa
32forwardfall.
33 5.Ifadoctor,nurse,orotherhealthcareprovidertreatingthepregnantoffender
34inherthirdtrimesterorthepostpartumoffenderwithinforty-eighthourspostdelivery
35requeststhatrestraintsnotbeused,thesherifforjaileraccompanyingsuchoffender
36shallimmediatelyremoveallrestraints.
37 6.Pregnantoffendersshallbetransportedinvehiclesequippedwithseatbelts.
38 7.Thecountyorcityjailshall:
39 (1)Ensurethatemployeesofthejailareprovidedwithtraining,whichmay
40includeonlinetraining,ontheprovisionsofthissection;and
41 (2)Informfemaleoffenders,inwritingandorally,ofanypoliciesandpractices
42developedinaccordancewiththissectionuponadmissiontothejail,andpostthe
43policiesandpracticesinlocationsinthejailwheresuchnoticesarecommonlyposted
44andwillbeseenbyfemaleoffenders.
221.523.1.ByJanuary1,2026,allcountyandcityjailsshalldevelopspecific
2proceduresfortheintakeandcareofoffenderswhoarepregnant,whichshallinclude
3proceduresregarding:
4 (1)Maternalhealthevaluations;
HB916	3 5 (2)Dietarysupplements,includingprenatalvitamins;
6 (3)Timelyandregularnutritiousmeals,whichshallinclude,atminimum,
7thirty-twoouncesofmilkoracalciumsupplementiflactoseintolerant,twocupsoffresh
8fruit,andtwocupsoffreshvegetablesdaily;
9 (4)Substanceabusetreatment;
10 (5)Treatmentforthehumanimmunodeficiencyvirusandwaystoavoidhuman
11immunodeficiencyvirustransmission;
12 (6)HepatitisC;
13 (7)Sleepingarrangementsforsuchoffenders,includingrequiringsuch
14offenderstosleeponthebottombunkbed;
15 (8)Accesstomentalhealthprofessionals;
16 (9)Sanitarymaterials;
17 (10)Postpartumrecovery,includingthatnosuchoffendershallbeplacedin
18isolationduringsuchrecovery;and
19 (11)Arequirementthatafemalemedicalprofessionalbepresentduringany
20examinationofsuchoffender.
21 2.Asusedinthissection"postpartumrecovery"means,asdeterminedbya
22physician,theperiodimmediatelyfollowingdelivery,includingtheentireperiodan
23offenderwhowaspregnantisinthehospitalorinfirmaryafterdelivery.
491.075.1.Astatementmadebyachildundertheageof[fourteen] eighteen, ora
2vulnerableperson,relatingtoanoffenseunderchapter565,566,568or573,performedby
3another,nototherwiseadmissiblebystatuteorcourtrule,isadmissibleinevidencein
4criminalproceedingsinthecourtsofthisstateassubstantiveevidencetoprovethetruthof
5thematterassertedif:
6 (1)Thecourtfinds,inahearingconductedoutsidethepresenceofthejurythatthe
7time,contentandcircumstancesofthestatementprovidesufficientindiciaofreliability;and
8 (2)(a)Thechildorvulnerablepersontestifiesattheproceedings;or
9 (b)Thechildorvulnerablepersonisunavailableasawitness;or
10 (c)Thechildorvulnerablepersonisotherwisephysicallyavailableasawitnessbut
11thecourtfindsthatthesignificantemotionalorpsychologicaltraumawhichwouldresult
12fromtestifyinginthepersonalpresenceofthedefendantmakesthechildorvulnerableperson
13unavailableasawitnessatthetimeofthecriminalproceeding.
14 2.Notwithstandingsubsection1ofthissectionoranyprovisionoflaworruleof
15evidencerequiringcorroborationofstatements,admissionsorconfessionsofthedefendant,
16andnotwithstandinganyprohibitionofhearsayevidence,astatementbyachildwhenunder
17theageof[fourteen] eighteen, oravulnerableperson,whoisallegedtobevictimofan
18offenseunderchapter565,566,568or573issufficientcorroborationofastatement,
HB916	4 19admissionorconfessionregardlessofwhetherornotthechildorvulnerablepersonis
20availabletotestifyregardingtheoffense.
21 3.Astatementmaynotbeadmittedunderthissectionunlesstheprosecutingattorney
22makesknowntotheaccusedortheaccused'scounselhisorherintentiontoofferthe
23statementandtheparticularsofthestatementsufficientlyinadvanceoftheproceedingsto
24providetheaccusedortheaccused'scounselwithafairopportunitytopreparetomeetthe
25statement.
26 4.Nothinginthissectionshallbeconstruedtolimittheadmissibilityofstatements,
27admissionsorconfessionsotherwiseadmissiblebylaw.
28 5.Forthepurposesofthissection,"vulnerableperson"shallmeanapersonwho,asa
29resultofaninadequatelydevelopedorimpairedintelligenceorapsychiatricdisorderthat
30materiallyaffectsabilitytofunction,lacksthementalcapacitytoconsent,orwhose
31developmentalleveldoesnotexceedthatofanordinarychildof[fourteen] seventeenyears
32ofage.
492.304.1.Inadditiontotheadmissibilityofastatementundertheprovisionsof
2section492.303,thevisualandauralrecordingofaverbalornonverbalstatementofachild
3whenundertheageof[fourteenwhoisallegedtobeavictimof]eighteenoravulnerable
4person,relatingtoanoffenseundertheprovisionsofchapter565,566[or],568,or573if
5performedbyanother,isadmissibleintoevidenceif:
6 (1)Noattorneyforeitherpartywaspresentwhenthestatementwasmade;except
7that,foranystatementtakenatastate-fundedchildassessmentcenterasprovidedforin
8subsection2ofsection210.001,anattorneyrepresentingthestateofMissouriinacriminal
9investigationmay,asamemberofamultidisciplinaryinvestigationteam,observethetaking
10ofsuchstatement,butsuchattorneyshallnotbepresentintheroomwheretheinterviewis
11beingconducted;
12 (2)Therecordingisbothvisualandauralandisrecordedonfilmorvideotapeorby
13otherelectronicmeans;
14 (3)Therecordingequipmentwascapableofmakinganaccuraterecording,the
15operatoroftheequipmentwascompetent,andtherecordingisaccurateandhasnotbeen
16altered;
17 (4)Thestatementwasnotmadeinresponsetoquestioningcalculatedtoleadthechild
18orvulnerablepersontomakeaparticularstatementortoactinaparticularway;
19 (5)Everyvoiceontherecordingisidentified;
20 (6)Thepersonconductingtheinterviewofthechildorvulnerablepersoninthe
21recordingispresentattheproceedingandavailabletotestifyorbecross-examinedbyeither
22party;and
HB916	5 23 (7)Thedefendantortheattorneyforthedefendantisaffordedanopportunitytoview
24therecordingbeforeitisofferedintoevidence.
25 2.Ifthechildorvulnerablepersondoesnottestifyattheproceeding,thevisualand
26auralrecordingofaverbalornonverbalstatementofthechildorvulnerablepersonshallnot
27beadmissibleunderthissectionunlesstherecordingqualifiesforadmissionundersection
28491.075.
29 3.Ifthevisualandauralrecordingofaverbalornonverbalstatementofachildor
30vulnerablepersonisadmissibleunderthissectionandthechildorvulnerableperson
31testifiesattheproceeding,itshallbeadmissibleinadditiontothetestimonyofthechildor
32vulnerablepersonattheproceedingwhetherornotitrepeatsorduplicatesthechild'sor
33vulnerableperson'stestimony.
34 4.Asusedinthissection,anonverbalstatementshallbedefinedasany
35demonstrationofthechildorvulnerablepersonbyhisorheractions,facialexpressions,
36demonstrationswithadollorothervisualaidwhetherornotthisdemonstrationis
37accompaniedbywords.
38 5.Forthepurposesofthissection,"vulnerableperson"shallmeanaperson
39who,asaresultofaninadequatelydevelopedorimpairedintelligenceorapsychiatric
40disorderthatmateriallyaffectstheabilitytofunction,lacksthementalcapacityto
41consent,orwhosedevelopmentalleveldoesnotexceedthatofanordinarychildof
42seventeenyearsofage.
