BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections208.247,491.075,492.304,and558.041,RSMo,arerepealed 2andsixnewsectionsenactedinlieuthereof,tobeknownassections208.247,221.520, 3221.523,491.075,492.304,and558.041,toreadasfollows: 208.247.[1.Pursuanttotheoptiongrantedthestateby21U.S.C.Section862a(d),an 2individualwhohaspledguiltyornolocontenderetoorisfoundguiltyunderfederalorstate 3lawofafelonyinvolvingpossessionoruseofacontrolledsubstanceshallbeexemptfromthe 4prohibitioncontainedin21U.S.C.Section862a(a)againsteligibilityforfoodstampprogram 5benefitsforsuchconvictions,ifsuchperson,asdeterminedbythedepartment: 6 (1)Meetsoneofthefollowingcriteria: 7 (a)Iscurrentlysuccessfullyparticipatinginasubstanceabusetreatmentprogram 8approvedbythedivisionofalcoholanddrugabusewithinthedepartmentofmentalhealth;or 9 (b)Iscurrentlyacceptedfortreatmentinandparticipatinginasubstanceabuse 10treatmentprogramapprovedbythedivisionofalcoholanddrugabuse,butissubjecttoa 11waitinglisttoreceiveavailabletreatment,andtheindividualremainsenrolledinthetreatment 12programandentersthetreatmentprogramatthefirstavailableopportunity;or 13 (c)Hassatisfactorilycompletedasubstanceabusetreatmentprogramapprovedby 14thedivisionofalcoholanddrugabuse;or 15 (d)Isdeterminedbyadivisionofalcoholanddrugabusecertifiedtreatmentprovider 16nottoneedsubstanceabusetreatment;and EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Issuccessfullycomplyingwith,orhasalreadycompliedwith,allobligations 18imposedbythecourt,thedivisionofalcoholanddrugabuse,andthedivisionofprobation 19andparole;and 20 (3)Doesnotpleadguiltyornolocontenderetoorisnotfoundguiltyofanadditional 21controlledsubstancemisdemeanororfelonyoffenseafterreleasefromcustodyor,ifnot 22committedtocustody,suchpersondoesnotpleadguiltyornolocontenderetoorisnotfound 23guiltyofanadditionalcontrolledsubstancemisdemeanororfelonyoffense,withinoneyear 24afterthedateofconviction.Suchapleaorconvictionwithinthefirstyearafterconviction 25shallimmediatelydisqualifythepersonfortheexemption;and 26 (4)Hasdemonstratedsobrietythroughvoluntaryurinalysistestingpaidforbythe 27participant. 28 2.Eligibilitybaseduponthefactorsinsubsection1ofthissectionshallbebasedupon 29documentaryorotherevidencesatisfactorytothedepartmentofsocialservices,andthe 30applicantshallmeetallotherfactorsforprogrameligibility. 31 3.Thedepartmentofsocialservices,inconsultationwiththedivisionofalcoholand 32drugabuse,shallpromulgaterulestocarryouttheprovisionsofthissectionincluding 33specifyingcriteriafordeterminingactiveparticipationinandcompletionofasubstanceabuse 34treatmentprogram. 35 4.Theexemptionunderthissectionshallnotapplytoanindividualwhohaspled 36guiltyornolocontenderetoorisfoundguiltyoftwosubsequentfelonyoffensesinvolving 37possessionoruseofacontrolledsubstanceafterthedateofthefirstcontrolledsubstance 38felonyconviction] Pursuanttotheoptiongrantedtothestateunder21U.S.C.Section 39862a(d)(1),anindividualconvictedunderfederalorstatelawofafelonyoffense 40involvingpossession,distribution,oruseofacontrolledsubstanceshallbeexemptfrom 41theprohibitioncontainedin21U.S.C.Section862a(a)againsteligibilityforthe 42supplementalnutritionassistanceprogramforsuchconvictions. 221.520.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Extraordinarycircumstance",asubstantialflightriskorsomeother 3extraordinarymedicalorsecuritycircumstancethatdictatesrestraintsbeusedto 4ensurethesafetyandsecurityofapregnantoffenderinherthirdtrimesterora 5postpartumoffenderwithinforty-eighthourspostdelivery,thestaffofthecountyorcity 6jailormedicalfacility,otheroffenders,orthepublic; 7 (2)"Labor",theperiodoftimebeforeabirthduringwhichcontractionsare 8present; 9 (3)"Postpartum",theperiodofrecoveryimmediatelyfollowingchildbirth, 10whichissixweeksforavaginalbirthoreightweeksforacesareanbirth,orlongerifso 11determinedbyaphysicianornurse; HCSHB916 2 12 (4)"Restraints",anydeviceusedtocontrolthemovementofaperson'sbodyor 13limbs. 14 2.Exceptinextraordinarycircumstances,acountyorcityjailshallnotuse 15restraintsonapregnantoffenderinherthirdtrimester,whetherduringtransportation 16toandfromvisitstohealthcareprovidersandcourtproceedingsorduringmedical 17appointmentsandexaminations,orduringlabor,delivery,orforty-eighthours 18postdelivery. 19 3.Intheeventasherifforjailerdeterminesthatextraordinarycircumstances 20existandrestraintsarenecessary,thesherifforjailershallfullydocumentinwriting 21withinforty-eighthoursoftheincidentthereasonsheorshedeterminedsuch 22extraordinarycircumstancesexisted,thetypeofrestraintsused,andthereasonsthose 23restraintswereconsideredreasonableunderthecircumstances.Suchdocumentsshall 24bekeptonfilebythecountyorcityjailforatleastfiveyearsfromthedatetherestraints 25wereused. 26 4.Anytimerestraintsareusedonapregnantoffenderinherthirdtrimesteror 27onapostpartumoffenderwithinforty-eighthourspostdelivery,therestraintsshallbe 28reasonableunderthecircumstances.Exceptinextraordinarycircumstances,noleg, 29ankle,orwaistrestraints,oranymechanicalrestraints,shallbeusedonanysuch 30offender,andifwristrestraintsareused,suchrestraintsshallbeplacedinthefrontof 31suchoffender'sbodytoprotecttheoffenderandtheunbornchildinthecaseofa 32forwardfall. 33 5.Pregnantoffendersshallbetransportedinvehiclesequippedwithseatbelts. 34 6.Thecountyorcityjailshall: 35 (1)Ensurethatemployeesofthejailareprovidedwithtraining,whichmay 36includeonlinetraining,ontheprovisionsofthissection;and 37 (2)Informfemaleoffenders,inwritingandorally,ofanypoliciesandpractices 38developedinaccordancewiththissectionuponadmissiontothejail,andpostthe 39policiesandpracticesinlocationsinthejailwheresuchnoticesarecommonlyposted 40andwillbeseenbyfemaleoffenders. 221.523.1.ByJanuary1,2026,allcountyandcityjailsshalldevelopspecific 2proceduresfortheintakeandcareofoffenderswhoarepregnant,whichshallinclude 3proceduresregarding: 4 (1)Maternalhealthevaluations; 5 (2)Dietarysupplements,includingprenatalvitamins; 6 (3)TimelyandregularnutritiousmealsconsistentwiththeAmericanCollegeof 7ObstetriciansandGynecologists'NutritionDuringPregnancyguidelines; 8 (4)Substanceabusetreatment; HCSHB916 3 9 (5)Treatmentforthehumanimmunodeficiencyvirusandwaystoavoidhuman 10immunodeficiencyvirustransmission; 11 (6)HepatitisC; 12 (7)Sleepingarrangementsforsuchpregnantoffenderinherthirdtrimester, 13includingrequiringsuchoffenderstosleeponthebottombunkbed; 14 (8)Accesstomentalhealthprofessionals; 15 (9)Sanitarymaterials;and 16 (10)Postpartumrecovery,includingthat,exceptinextraordinary 17circumstances,nosuchoffendershallbeplacedinisolationduringsuchrecovery. 18 2.Asusedinthissection,"postpartumrecovery"means,asdeterminedbya 19physician,theperiodimmediatelyfollowingdelivery,includingtheentireperiodan 20offenderwhowaspregnantisinthehospitalorinfirmaryafterdelivery. 491.075.1.Astatementmadebyachildundertheageof[fourteen] eighteen, ora 2vulnerableperson,relatingtoanoffenseunderchapter565,566,568or573,performedby 3another,nototherwiseadmissiblebystatuteorcourtrule,isadmissibleinevidencein 4criminalproceedingsinthecourtsofthisstateassubstantiveevidencetoprovethetruthof 5thematterassertedif: 6 (1)Thecourtfinds,inahearingconductedoutsidethepresenceofthejurythatthe 7time,contentandcircumstancesofthestatementprovidesufficientindiciaofreliability;and 8 (2)(a)Thechildorvulnerablepersontestifiesattheproceedings;or 9 (b)Thechildorvulnerablepersonisunavailableasawitness;or 10 (c)Thechildorvulnerablepersonisotherwisephysicallyavailableasawitnessbut 11thecourtfindsthatthesignificantemotionalorpsychologicaltraumawhichwouldresult 12fromtestifyinginthepersonalpresenceofthedefendantmakesthechildorvulnerableperson 13unavailableasawitnessatthetimeofthecriminalproceeding. 14 2.Notwithstandingsubsection1ofthissectionoranyprovisionoflaworruleof 15evidencerequiringcorroborationofstatements,admissionsorconfessionsofthedefendant, 16andnotwithstandinganyprohibitionofhearsayevidence,astatementbyachildwhenunder 17theageof[fourteen] eighteen, oravulnerableperson,whoisallegedtobevictimofan 18offenseunderchapter565,566,568or573issufficientcorroborationofastatement, 19admissionorconfessionregardlessofwhetherornotthechildorvulnerablepersonis 20availabletotestifyregardingtheoffense. 21 3.Astatementmaynotbeadmittedunderthissectionunlesstheprosecutingattorney 22makesknowntotheaccusedortheaccused'scounselhisorherintentiontoofferthe 23statementandtheparticularsofthestatementsufficientlyinadvanceoftheproceedingsto 24providetheaccusedortheaccused'scounselwithafairopportunitytopreparetomeetthe 25statement. HCSHB916 4 26 4.Nothinginthissectionshallbeconstruedtolimittheadmissibilityofstatements, 27admissionsorconfessionsotherwiseadmissiblebylaw. 28 5.Forthepurposesofthissection,"vulnerableperson"shallmeanapersonwho,asa 29resultofaninadequatelydevelopedorimpairedintelligenceorapsychiatricdisorderthat 30materiallyaffectsabilitytofunction,lacksthementalcapacitytoconsent,orwhose 31developmentalleveldoesnotexceedthatofanordinarychildof[fourteen] seventeenyears 32ofage. 492.304.1.Inadditiontotheadmissibilityofastatementundertheprovisionsof 2section492.303,thevisualandauralrecordingofaverbalornonverbalstatementofachild 3whenundertheageof[fourteenwhoisallegedtobeavictimof]eighteenoravulnerable 4person,relatingtoanoffenseundertheprovisionsofchapter565,566[or],568,or573if 5performedbyanother,isadmissibleintoevidenceif: 6 (1)Noattorneyforeitherpartywaspresentwhenthestatementwasmade;except 7that,foranystatementtakenatastate-fundedchildassessmentcenterasprovidedforin 8subsection2ofsection210.001,anattorneyrepresentingthestateofMissouriinacriminal 9investigationmay,asamemberofamultidisciplinaryinvestigationteam,observethetaking 10ofsuchstatement,butsuchattorneyshallnotbepresentintheroomwheretheinterviewis 11beingconducted; 12 (2)Therecordingisbothvisualandauralandisrecordedonfilmorvideotapeorby 13otherelectronicmeans; 14 (3)Therecordingequipmentwascapableofmakinganaccuraterecording,the 15operatoroftheequipmentwascompetent,andtherecordingisaccurateandhasnotbeen 16altered; 17 (4)Thestatementwasnotmadeinresponsetoquestioningcalculatedtoleadthechild 18orvulnerablepersontomakeaparticularstatementortoactinaparticularway; 19 (5)Everyvoiceontherecordingisidentified; 20 (6)Thepersonconductingtheinterviewofthechildorvulnerablepersoninthe 21recordingispresentattheproceedingandavailabletotestifyorbecross-examinedbyeither 22party;and 23 (7)Thedefendantortheattorneyforthedefendantisaffordedanopportunitytoview 24therecordingbeforeitisofferedintoevidence. 25 2.Ifthechildorvulnerablepersondoesnottestifyattheproceeding,thevisualand 26auralrecordingofaverbalornonverbalstatementofthechildorvulnerablepersonshallnot 27beadmissibleunderthissectionunlesstherecordingqualifiesforadmissionundersection 28491.075. 29 3.Ifthevisualandauralrecordingofaverbalornonverbalstatementofachildor 30vulnerablepersonisadmissibleunderthissectionandthechildorvulnerableperson HCSHB916 5 31testifiesattheproceeding,itshallbeadmissibleinadditiontothetestimonyofthechildor 32vulnerablepersonattheproceedingwhetherornotitrepeatsorduplicatesthechild'sor 33vulnerableperson'stestimony. 34 4.Asusedinthissection,anonverbalstatementshallbedefinedasany 35demonstrationofthechildorvulnerablepersonbyhisorheractions,facialexpressions, 36demonstrationswithadollorothervisualaidwhetherornotthisdemonstrationis 37accompaniedbywords. 38 5.Forthepurposesofthissection,"vulnerableperson"shallmeanaperson 39who,asaresultofaninadequatelydevelopedorimpairedintelligenceorapsychiatric 40disorderthatmateriallyaffectstheabilitytofunction,lacksthementalcapacityto 41consent,orwhosedevelopmentalleveldoesnotexceedthatofanordinarychildof 42seventeenyearsofage. 558.041.1.Anyoffendercommittedtothedepartmentofcorrections,exceptthose 2personscommittedpursuanttosubsection7ofsection558.016,orsubsection3ofsection 3566.125,[may] shallreceiveadditionalcreditintermsofdaysspentinconfinementupon 4[recommendationforsuchcreditbytheoffender'sinstitutionalsuperintendent] calculationof 5suchcreditwhentheoffendermeetstherequirementsforsuchcreditasprovidedin 6[subsections3and4of]thissection.Goodtimecreditorearnedtimecreditmaybe 7rescindedbythedirectororhisorherdesigneepursuanttothedivisionalpolicyissued 8pursuanttosubdivision(2)ofsubsection[3]2ofthissection. 9 2.(1)Anycreditextendedtoanoffendershallonlyapplytothesentencewhichthe 10offenderiscurrentlyserving. 11 [3.](2)Thedirectorofthedepartmentofcorrectionsshallissueapolicyfor 12awardinggoodtimecreditand,separately,earnedtimecredit. 13 (3)Thepolicy[may] shallrewardan[inmate] offenderwhohasservedhisorher 14sentenceinanorderlyandpeaceablemanner[andhas]throughgoodtimecreditas 15providedinsubsection3ofthissectionandawardanoffenderwhohassuccessfully 16takenadvantageoftherehabilitationprogramsandproductiveactivitiesavailabletohimor 17herthroughearnedtimecreditasprovidedinsubsection4ofthissection. 18 (4)Anymajorconductviolationofinstitutionalrules[or],violationofthelawsof 19thisstate[may], parolerevocation,ortheaccumulationofminorconductviolations 20exceedingsixwithinacalendaryearshallresultinthelossofall[oraportionofany]prior 21creditearnedbythe[inmate] offenderpursuanttothissection. 22 [4.Thedepartmentshallcausethepolicytobepublishedinthecodeofstate 23regulations. HCSHB916 6 24 5.Noruleorportionofarulepromulgatedundertheauthorityofthischaptershall 25becomeeffectiveunlessithasbeenpromulgatedpursuanttotheprovisionsofsection 26536.024.] 27 3.(1)Subjecttosubsections1and2ofthissection,anoffenderwhoisservinga 28termofimprisonmentofmorethanoneyear,otherthanatermofimprisonmentforthe 29durationoftheoffender'slife,mayreceivegoodtimecredittowardtheserviceofthe 30offender'ssentenceofuptofifty-fourdaysforeachyearoftheoffender'ssentence 31imposedbythecourt,subjecttoyearlydeterminationbythedepartmentofcorrections 32thatduringthatyeartheoffenderhasdisplayedexemplarycompliancewith 33institutionaldisciplinaryregulations. 34 (2)Ifthedepartmentofcorrectionsdeterminesthatduringtheyeartheoffender 35hasnotsatisfactorilycompliedwithsuchinstitutionalregulations,theoffendershall 36receivenogoodtimecredittowardserviceofsentenceorshallreceivesuchlessercredit 37asthedepartmentdeterminestobeappropriate.Creditthathasnotbeenearnedshall 38notlaterbegranted.Creditforthelastyearofatermofimprisonmentshallbecredited 39onthefirstdayofthelastyearofthetermofimprisonment. 40 4.(1)Subjecttosubsections1and2ofthissection,anoffenderwhoisservinga 41termofimprisonmentofmorethanoneyear,otherthanatermofimprisonmentforthe 42durationoftheoffender'slife,andwhosuccessfullyparticipatesinrehabilitative 43programmingorproductiveactivitiesshallearntendaysofearnedtimecreditforevery 44thirtydaysofsuccessfulparticipationinrehabilitativeprogrammingorproductive 45activities. 46 (2)Anoffendershallnotreceiveearnedtimecreditsunderthissubsectionfor 47programscompletedpriortothedatethattheoffender'ssentencecommenced. 48 (3)Thedepartmentofcorrectionsshallspecifyinitspoliciesundersubsection2 49ofthissectionthetypesofprogramsoractivitiesforwhichcreditmaybeearnedunder 50thissection;thecriteriafordeterminingproductiveparticipationin,orcompletionof, 51theprogramsoractivities;andthecriteriaforannuallyawardingcredit.Such 52programsandactivitiesshallinclude,butarenotlimitedto,receivingahighschool 53diplomaorequivalent,collegediplomaorprofessionalcertificate,orvocationaltraining 54certificates,andparticipatinginsuccessfulemployment,parenting,andfinancial 55literacycourses,alcoholanddrugabusetreatmentprograms,andrestorativejustice 56andfaith-basedprograms.Thedepartmentofcorrectionsshallincludeprovisionsfor 57educationalprogrammingthroughcorrespondencecourses. 58 (4)BeginningonJanuary1,2026,butnotlaterthanDecember31,2026,eligible 59offendersmaypetitionthedepartmenttoreceiveearnedtimecreditforanyqualifying 60programsoractivitiescompletedafterJanuary1,2010,butbeforeAugust28,2025. HCSHB916 7 61 (5)BeginningonAugust28,2025,earnedtimecreditforprogramscompletedon 62oraftersuchdateshallbeawardedonanannualbasis. 63 (6)Thedepartmentofcorrectionsshallnotifytheincarceratedpopulationofthe 64petitionprocessthroughpostedsignage,electronicnotification,andthroughstaffinall 65facilitiesandshallprovideapetitionformtooffenders. 66 5.(1)Offenderssentencedundersubsections2and3ofsection558.019shallbe 67eligibleforgoodtimecreditandearnedtimecreditandanycreditearnedshallbe 68subtractedfromtheoffender'sentiresentenceofimprisonment. 69 (2)Offenderscommittedtothedepartmentwhoaresentencedtodeathor 70sentencedtolifewithoutprobationorparoleshallnotbeeligibleforgoodtimecreditor 71earnedtimecreditunderthissection;however,thedepartmentshallrecordtheir 72programparticipationinthesamemannerastheeligiblepopulation. 73 (3)Theincentivesdescribedinthissectionshallbeinadditiontoanyother 74rewardsorcreditsforwhichanoffendermaybeeligible. 75 (4)Nothinginthissectionshallbeconstruedtoremovetheparoleboard's 76discretioninawardinggoodtimecreditorearnedtimecredit. 77 6.Thedepartmentofcorrectionsshallprepareandsubmitanannualreportto 78thegeneralassemblyongoodtimecreditandearnedtimecredit,whichshallinclude 79informationonthenumberofoffendersreceivingcreditunderbothprograms. ✔ HCSHB916 8
