Underthisbill,anypersonwhoacquires,uses,produces,
possesses,transfers,oradministerspsilocybinfortheperson's
owntherapeuticusewillnotbesubjecttostateorlocalcriminal
orcivilpenaltiesiftheperson:
(1)Is21yearsofageorolder;
(2)Suffersfromaconditionlistedinthebill;
(3)InformstheDepartmentofMentalHealththatsuchpersonplans
toacquire,use,produce,possess,transfer,oradminister
psilocybinunderthisbill;
(4)ProvidestheDepartmentwithspecifieddocumentationand
information;
(5)Ensuresthepsilocybinistestedinalicensedlaboratory;and
(6)Limitstheuseofpsilocybintonomorethan150milligramsof
psilocybinanalyteduringany12-monthperiod.
Apersonwhoassistsanotherinanyoftheactspermittedunder
thisbillandanylaboratorytestingpsilocybinunderthisbill
willnotbesubjecttostateorlocalcriminalorcivilpenalties.
Additionally,thisbillmodifiescurrentlawontheuseof
investigational drugsanddevicesforindividualswithterminal
illnessestoincludeindividualswithlife-threateningorseverely
debilitatingconditionsorillnesses. Currently,investigational
drugsmustnotincludeScheduleIcontrolledsubstances. Thisbill
repealsthatprohibition.
