29 (b)Formisdemeanors,ifoneyearhaspassedsincefinaldispositionandthe 30individualhasnotcommittedanyfelonyormisdemeanorcriminaloffenseinMissouri; 31 (c)Forfelonyoffenses,ifthreeyearshavepassedsincefinaldispositionandthe 32individualhasnotcommittedanyfelonyormisdemeanorcriminaloffenseinMissouri; 33 (d)Forallofanindividual'soffenses,iftheindividualhasattainedsixty-five 34yearsofageandhasnotbeenconvictedofanymisdemeanorsorfeloniesinMissouri 35otherthanatechnicalviolationofthetermsofhisorherprobationorparoleintheten 36immediatelyprecedingyears;or 37 (e)AlloffensesforwhichthegovernorofMissourihasgrantedafullpardon. 38 (2)Recordspertainingtojuvenileadjudicationsoroffensesinvolvingthe 39operationofamotorvehiclearenoteligibleforautomatedexpungement. 40 (3)Nooffenseshallbeeligibleforautomatedexpungementifapersonhas 41chargespendingthathavebeenfiledinaMissouristatecourtforwhichanindividual 42hasnotyetbeensentencedduringtheperiodofreviewforcleanslateeligibilityas 43describedinsubsection3ofthissection. 44 (4)(a)Anindividualmaybegrantedmorethanoneexpungementunderthis 45section,exceptthatduringhisorherlifetimethetotalnumberofoffensesforwhich 46expungementcanbegrantedtotheindividualunderthissectionorsection610.140shall 47notexceedthefollowinglimits: 48 a.Nomorethantwofelonyoffenses;and 49 b.Nomorethanfourmisdemeanoroffenses. 50 (b)Ifanindividual'selectronicrecordcontainsmorefeloniesormisdemeanors 51thancanbeexpungedduringtheindividual'slifetimeunderparagraph(a)ofthis 52subdivision,theindividualshallnotbeeligibleforautomatedexpungementunderthis 53section. 54 (c)Forpurposesofdetermininglifetimelimitsonexpungementunderthis 55sectionandsection610.140: 56 a.Iftheoffenseswerechargedascountsinthesamecase,allsuchoffensesand 57violationsshallcountasonlythehighest-leveloffenseinthatcaseforpurposesof 58determininglifetimelimitsonexpungementunderthissectionandsection610.140. 59However,ifoneormorecountsinthesameindictmentorinformationorconduct 60committedwereapartofthesamecourseofcriminalconductasanoffenselistedin 61subsection2ofsection610.140,theentirerecordshallnotbeexpungedunderthis 62section;and HB953 4 63 b.Iftheoffenseswerecommittedbyanindividualwhohasattainedsixty-five 64yearsofageandhasnotbeenconvictedofanymisdemeanorsorfeloniesinthe 65immediatetenprecedingyears,allcleanslateeligibleoffensesshallbeexpunged. 66 (d)Thecourtshallmaintainrecordstoensurethatapersonhasnotexceededthe 67limitationsprovidedunderthissubsection.Nothinginthissectionshallbeconstruedto 68limitorimpairthesubsequentuseofanyrecordmaintainedbythecourtforthe 69purposeofanylawenforcementorprosecutorialinvestigationoractivity,includingany 70arrestorfindingsofguiltexpungedunderthissectionbyalawenforcementagency, 71criminaljusticeagency,prosecutingattorney,circuitattorney,ormunicipalprosecuting 72attorney,includingitsuseasaprioroffenseinasubsequentcriminalorcivil 73investigationorprosecution. 74 3.(1)BeginningAugust28,2028,onamonthlybasis,theofficeofstatecourts 75administratorshallidentifyrecordsthathavebecomeeligibleinthelastmonthand 76transmit,orotherwisemakeaccessiblebyelectronicmeans,tothecentralrepository 77andeveryprosecutingagencyinthestateallcleanslateeligibleoffenserecordswithin 78thirtydaysoftherecordbecomingeligibleforautomatedexpungement. 79 (2)AlldigitalrecordsthatbecomeeligibleforexpungementonorbeforeAugust 8028,2025,shallbeidentifiedandexpungedbeforeAugust28,2030,inacadencetobe 81determinedbytheofficeofstatecourtsadministrator. 82 (3)Delinquentcourtcosts,fines,fees,orothersumsorderedbyacourt,except 83restitutionowedtoavictimofacrime,shallnotbeconsideredbytheofficeofstate 84courtsadministratorwhendeterminingeligibilityofarecordforautomated 85expungementundersubsection2ofthissection.However,theofficeofstatecourts 86administratormayseekasetoffofanyincometaxrefundandlotteryprizepayouts 87undersection488.5028foralldelinquentcourtcosts,fines,fees,orothersumsordered 88byacourtrelatingtoconvictionsexpungedundersubsection2ofthissection. 89 (4)Eachprosecutingagencyinthisstatehasnomorethansixtydaysfromthe 90dayonwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmitted,or 91otherwisemadeaccessiblebyelectronicmeans,toobjecttoanautomatedexpungement 92andtransmitsuchobjectiontotheofficeofstatecourtsadministratorandthecentral 93repository.Theprosecutingagencymayobjecttotheautomatedexpungementforany 94ofthefollowingreasons: 95 (a)Afterreviewingtheprosecutingagency'srecord,theagencybelievesthe 96recorddoesnotmeetthedefinitionofacleanslateeligiblecase; 97 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim;or 98 (c)ThepersonhaschargespendingagainsttheminanothercaseinMissouri. HB953 5 99 (5)Ifaprosecutingagencyobjectsforareasondescribedinsubdivision(4)of 100thissubsection,withinsixtydaysofthedayonwhichthenoticedescribedinsubdivision 101(1)ofthissubsectionistransmitted,orotherwisemadeaccessiblebyelectronicmeans, 102therecordshallnotbeexpunged. 103 (6)Thecentralrepositoryhasnomorethansixtydaysfromthedayonwhichthe 104noticedescribedinsubdivision(1)ofthissubsectionistransmitted,orotherwisemade 105accessiblebyelectronicmeans,toobjecttoanautomatedexpungementandtransmit 106suchobjectiontotheofficeofstatecourtsadministratorandtherelevantprosecutors. 107Thecentralrepositorymayobjecttotheautomaticexpungementiftheagencybelieves 108therecorddoesnotmeetthedefinitionofacleanslateeligiblecasebasedontheir 109availabledata. 110 (7)Ifthecentralrepositoryobjectsforareasondescribedinsubdivision(4)of 111thissubsection,withinsixtydaysofthedayonwhichthenoticedescribedinsubdivision 112(1)ofthissubsectionistransmitted,orotherwisemadeaccessiblebyelectronicmeans, 113therecordshallnotbeexpunged. 114 (8)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor 115thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof 116statecourtsadministratorshalltransmit,orotherwisemakeaccessiblebyelectronic 117means,withinfifteendaysalltherecordstobeexpunged,sortedbycircuit,tothe 118presidingjudgesofeverycircuitcourtinMissouri. 119 (9)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall 120issueordersforexpungementofallrecordsmaintainedinthecircuitunlessthecircuit 121courtdeterminestherecordisnoteligibleforautomatedexpungement.Ifthecircuit 122courtdeterminesarecordisnoteligibleforautomatedexpungement,thecourtshall 123notifytheofficeofstatecourtsadministratorofitsdeterminationwithinthirtydaysand 124shallspecifythereasonsthecourtrelieduponinmakingthedetermination. 125 (10)Onamonthlybasis,eachcircuitcourtshalltransmit,orotherwisemake 126accessiblebyelectronicmeans,copiesofallordersforexpungementthatthecourtissues 127underthissectiontotheofficeofstatecourtsadministrator. 128 (11)Oncethetransmittedrecordsareexpunged,theofficeofstatecourts 129administratorshallprovidenoticetoallstateagenciesmaintainingofficialcopiesofthe 130recordsincluding,butnotlimitedto,theappropriatecircuitcourtclerk,theprosecuting 131attorney,thearrestinglawenforcementagencyoragencies,thedepartmentof 132corrections,thecentralrepository,andthedepartmentofrevenuetoexpungethe 133recordswithinthirtydays.Withrespecttoanypersonincluding,butnotlimitedto,a 134consumerreportingagencyorresearcher,whopurchasesrecordsforinformation 135pertainingtocriminalmattersofpublicrecordfromtheofficeofstatecourts HB953 6 136administrator,suchofficeshallmakeavailabletothepersoninformationconcerningthe 137criminalmattersofpublicrecordthathavebeenerasedunderthissection.Such 138informationshallincludedocketnumbersorotherinformationsufficienttopermitthe 139persontoaccuratelyidentifyanddeleterecordsthathavebeenerasedunderthis 140section. 141 (12)(a)TheMissouristatehighwaypatrolshallretainanonpublicrecordofthe 142orderexpungingaconvictionorothernotificationregardingaconvictionthatwas 143automaticallyexpungedunderthissectionandoftherecordofthearrest,fingerprints, 144conviction,andsentenceofthepersoninthecasetowhichtheorderorother 145notificationapplies.Thenonpublicrecordshallbemadeavailableonlytoacourtof 146competentjurisdiction,anindependentdepartmentofthejudicialbranchofstate 147government,thedepartmentofcorrections,alawenforcementagency,aprosecuting 148attorney,theattorneygeneral,orthegovernoruponrequestandonlyforthefollowing 149purposes: 150 a.Toshowthatapersonwhohasfiledapetitiontoexpungeaconvictionhas 151previouslyhadaconvictionexpungedunderthissection; 152 b.Thecourt'sconsiderationindeterminingthesentencetobeimposedupon 153convictionforasubsequentoffensethatispunishableasafelonyorbyimprisonment 154formorethanoneyear; 155 c.Considerationbythegovernorifapersonwhoseconvictionhasbeen 156expungedappliesforapardonforanotheroffense; 157 d.Considerationbythedepartmentofcorrectionsoralawenforcementagency 158ifapersonwhoseconvictionhasbeenexpungedappliesforemploymentwiththe 159departmentofcorrectionsoralawenforcementagency; 160 e.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 161theattorneygeneralindeterminingwhetherapersonrequiredtoregisterunder 162sections589.400to589.425hascommittedanoffensethatrequiresregistrationunder 163sections589.400to589.425,orinprosecutingapersonforcommittinganoffense 164requiringregistrationundersections589.400to589.425;or 165 f.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 166theattorneygeneralforuseinmakingdeterminationsregardingcharges,pleaoffers, 167andsentencing,asapplicable. 168 (b)Acopyofthenonpublicrecordcreatedunderparagraph(a)ofthis 169subdivisionmaybeprovideduponrequesttothepersonwhoseconvictionisexpunged 170underthissectionuponpaymentofafeedeterminedandchargedbytheMissouristate 171highwaypatrol. HB953 7 172 (c)Thenonpublicrecordmaintainedunderparagraph(a)ofthissubdivisionis 173exemptfromdisclosureunderthischapter. 174 (d)Anentityshallnotbeliablefordamagesorsubjecttocriminalpenaltiesfor 175reportingapublicrecordofconvictionthathasbeenexpungedbycourtorderor 176operationoflawpriortoAugust28,2028,ifthatrecordwasavailableasapublicrecord 177onthedateofthereport. 178 4.Anycourtsentencinganindividualforacleanslateeligibleoffenseshallnotify 179theindividualatthetimeofsentencingofthedatewhentheindividual'sconvictionmay 180becomeeligibleforautomatedexpungementprovidedtheindividualisnotconvictedof 181anymisdemeanororfelonyduringthetimeperiodspecifiedfortheunderlyingoffense 182oroffenses. 183 5.Anyprobationorparoleofficereleasinganindividualfromsupervisionfora 184cleanslateeligibleoffenseshallnotifytheindividualatthetimesupervisionis 185dischargedofthedatewhentheindividual'srecordorrecordsmaybecomeeligiblefor 186automatedexpungementprovidedtheindividualisnotconvictedofanymisdemeanor 187orfelonyduringthetimeperiodspecifiedfortheunderlyingoffenseoroffenses. 188 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge, 189trial,orconvictionforwhichthereisanelectronicrecordregardlessofthedatethatthe 190arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe 191convictionwasentered. 192 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor 193expungementofrecordsundersection610.140ifanindividualiseligibleforautomated 194expungementunderthissectionbutsuchautomatedexpungementhasnotyetoccurred 195orcannotoccur. 196 8.Ifitisdeterminedthataconvictionwasimproperlyorerroneouslyexpunged 197underthissectionbecausetheconvictionwasnoteligibletobeexpungedunderthis 198section,thecourtshall,onitsownmotion,reinstatetheconviction. 199 9.(1)Upontheentryofanorderundersection610.140,orupontheautomated 200expungementofaconvictionunderthissection,thepetitioner,forpurposesofthelaw,is 201considerednottohavebeenpreviouslyconvicted,exceptasprovidedunderthis 202subsectionandsubsection10ofsection610.140. 203 (2)Thepetitionershallnotbeentitledtotheremissionofanyfine,costs,orother 204moneyspaidasaconsequenceofaconvictionthatisexpunged. 205 (3)Thissectionshallnotaffecttherightofthepetitionertorelyuponthe 206convictiontobarsubsequentproceedingsforthesameoffense. 207 (4)Thissectionshallnotaffecttherightofavictimofanoffensetobringor 208defendacivilactionfordamages. HB953 8 209 (5)Thissectionshallnotcreatearighttocommenceanactionfordamagesfor 210incarcerationunderthesentencethatthepetitionerservedbeforetheconvictionis 211expungedunderthissection. 212 (6)Thissectionshallnotrelieveanyobligationtopayrestitutionowedtothe 213victimofanoffensenorshallsuchsectionaffectthejurisdictionoftheconvictingcourt 214ortheauthorityofanycourtorderwithregardtoenforcinganorderforrestitution. 215 (7)Aconviction,includinganyrecordsrelatingtotheconvictionandany 216recordsconcerningacollateralaction,thathasbeenexpungedunderthissectionshall 217notbeusedasevidenceinanactionfornegligenthiring,admission,orlicensureagainst 218anyperson. 219 (8)Aconvictionthatisexpungedunderthissectionorsection610.140maybe 220consideredapriorconvictionbyacourt,lawenforcementagency,prosecutingattorney, 221ortheattorneygeneral,asapplicable,forpurposesofchargingacrimeasasecondor 222subsequentoffenseorforsentencingundersection558.016. 610.142.BeginningAugust28,2028,theofficeofstatecourtsadministratorshall 2reporttothejudiciarycommitteesofthesenateandhouseofrepresentatives,orany 3successorcommittees,thefollowingonayearlybasis: 4 (1)Thenumberofrecordsexpungedundersubsection2ofsection610.141,by 5judicialcircuit,withdataaggregatedbyrace,sex,age,circuit,county,andoffensetype 6andlevel;and 7 (2)ThenumberofrecordstransmittedfromtheMissouristatehighwaypatrol,a 8prosecutingagency,oracircuitcourtbacktotheofficeofstatecourtsadministratoron 9objectionthattherecordisnoteligibleforautomatedexpungementorbyjudicial 10circuit,withdataaggregatedbyrace,sex,age,county,andoffensetypeandlevel. 610.143.1.Acreditbureaumayreportrecordsofarrests,indictmentspending 2trial,andconvictionsofcrimesfornolongerthansevenyearsfromfinaldisposition. 3Recordsofarrests,indictmentspendingtrial,andconvictionsofcrimesshallnolonger 4bereportedifatanytimeafteraconvictionitislearnedthatafullpardonor 5expungementhasbeengrantedforthatconviction,oratanytimeafteranarrestor 6indictmentitislearnedthataconvictiondidnotresult. 7 2.Anycreditbureauoruserofinformationthatwillfullyfailstocomplywith 8anyrequirementofthissectionwithrespecttoanyconsumerisliabletothatconsumer 9inanamountequalto: 10 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure; 11 (2)Punitivedamagesasthecourtmayallow;and 12 (3)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand 13reasonableattorney'sfeesasdeterminedbythecourt. HB953 9 14 3.Anycreditbureauoruserofinformationthatisnegligentinfailingtocomply 15withanyrequirementofthissectionwithrespecttoanyconsumerisliabletothat 16consumerinanamountequalto: 17 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;and 18 (2)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand 19reasonableattorney'sfeesasdeterminedbythecourt. 20 4.Injunctivereliefshallbeavailabletoanyconsumeraggrievedbyaviolationor 21athreatenedviolationofthissectionregardlessofwhethertheconsumerseeksanyother 22remedyunderthissection. 23 5.Anemployerwhoemploysorotherwiseengagesanindividualwhosecriminal 24historyrecordhasbeenexpungedshallbeimmunefromliabilityforanyclaimarising 25outofthemisconductoftheindividualifthemisconductrelatestotheportionofthe 26criminalhistoryrecordthathasbeenexpunged. 610.144.1.(1)Thereisherebycreatedinthestatetreasurythe"Missouri 2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany 3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate 4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180, 5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand, 6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2 7ofthissection. 8 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 9remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 10generalrevenuefund. 11 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 12otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 13creditedtothefund. 14 2.Thedepartmentofpublicsafety,theinformationtechnologyservicesdivision 15withintheofficeofadministration,andtheofficeofstatecourtsadministratorshall 16expendmoneysfromthefund,uponappropriation,onlyforoneormoreofthe 17followingpurposes: 18 (1)Implementationcostsincurredundersections610.141to610.143; 19 (2)Systemupgradesnecessitatedundersections610.141to610.143;or 20 (3)Staffingneedsnecessitatedundersections610.141to610.143. ✔ HB953 10
