BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section40.490,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection40.490,toreadasfollows:
40.490.1.Membersofthestatemilitaryforcesofthisstatewhoareorderedtoactive
2statedutybythegovernor,anyMissouriemployeewhoisamemberoftheNationalGuardof
3anotherstateandwhoiscalledintoactivestatedutybythegovernorofthatstate,orany
4memberofanyreservecomponentoftheArmedForcesoftheUnitedStateswhoiscalledto
5activedutyshall,uponbeingrelievedfromsuchduty,beentitledtothesamereemployment
6rightsprovidedbyTitle38oftheUnitedStatesCode,theRevisedStatutesofMissouri,and
7allamendmentsthereto.Theattorneygeneralshallenforcethereemploymentrights
8containedinthissectionformembersofthestatemilitaryforceswhoareorderedtoactive
9statedutybythegovernor.
10 2.MembersoftheMissouriNationalGuardwhoarecalledtoactivestateduty
11bythegovernorandanyMissouriemployeeswhoaremembersoftheNationalGuardof
12anotherstateandarecalledtoactivestatedutybythegovernorofthatstateshall,upon
13beingrelievedfromsuchduty,beentitledtoallrightsandprotectionsprovidedbythe
14ServicemembersCivilReliefAct,50U.S.C.Section3901etseq.,andallamendments
15thereto.
16 3.Thedepartmentoflaborandindustrialrelationsshallmakeavailablethe
17followingnoticethateveryemployershallpostinaconspicuousplaceineach

23Guard,contacttheMissouricommitteeoftheEmployerSupportoftheGuardand
24Reserve(ESGR)at573-638-9625.".
25 4.AnymemberoftheMissouriNationalGuardandanyMissouriemployeewho
26isamemberoftheNationalGuardofanotherstatemaybringsuitinanycourtof
27competentjurisdictionandappropriatevenueifsuchindividualbelievesthathisorher
28rightsunderthissectionhavebeenviolated.Theattorneygeneralmayalsobringsuit
29againstanemployerwhoviolatestheprovisionsofthissection.
